The Invocation was offered by Rev. H. Warren Anderson, Pastor of the Arcadia Community Church of God. Mayor Camphouse led in the pledge of allegiance to the flag. PRESENT: Councilmen Balser, Butterworth, Reibold, Phillips, Camphouse ABSENT: None In answer to Councilman Reibold's request for clarification of the word "we", Council Minutes of March 7, 1961, page 10, first sentence, third paragraph of Mayor Camphouse's statement, Mayor Camphouse advised that it referred to the Council as a whole more than six years ago and prior to the time Councilman Reibold became a member of the Council. Councilman Phillips thereafter moved that the minutes of the Regular Meeting of March 7, 1961 as submitted in writing be approved. Councilman Reibold seconded the motion which was carried unanimously. Hearing continued from March 7, 1961 for the purpose of permitting the Engineering Department to investigate the protest of a representative of the Richfield Oil Station located at 50 Las Tunas Drive of possible excessive cost of construction of curb and gutter and change in elevation at said address. The Director of Public Works reported that the matter had been resolved; that the cost of construction was estimated at approximately $1900.00 and not the several thousand as protested at the March 7th meeting; that with regard to the change in elevation, a survey showed that there will be no drainage problem after completion of construction of curb and gutter. ~NDEAEDMayor Campnouse then inquired if anyone in the audience desired to address the Council at this time with regard to the matter. I No one desiring to speak, Councilman Phillips moved that the hearing be closed. Councilman Balser seconded the motion which was carried unanimously. Councilman Phillips further moved that if any there were or be, be overruled. motion which was carried unanimously. all protests, written or oral, Councilman Reibold seconded the Councilman Phillips then moved that the Superintendent of Streets be instructed to proceed with the work as contemplated in accordance with the provisions of Chapter 27 of the Improvement Act of 1911. INDEXED HEARING (Solicitation Aull) 1'/(( '.; ,tIIlDEXEIl 13: 5294 Mayor Camphouse declared the hearing open on Planning Commission Resolution No. 404, recommending change of zone from R-l, R-2 and R-3 to C-l on certain property located on both sides of Duarte Road between First and Second Avenues, and inquired if anyone desired to be heard regarding the matter. The Director of Public Works displayed a map of the subject area and explained that in 1955 the Council adopted an ordinance placing certain property on the north and south sides of Duarte Road, between First and Second Avenues in Zone C-l; that said ordinance determined that certain other properties would'be rezoned without necessity of further public hearings if certain dedications of land for street and alley purposes were made within two years. That the two year period specified has expired and portions of said property have not been reclassified to Zone C-l, resulting in the above mentioned recommendation of the Planning Commission as contained in its Resolution No. 404. I Planning Commissioner Golisch advised that the action of the Planning Commission in this matter was to confirm the prior determinations but to extend for five more years the time within which to make the required dedications. That the area has been dormant for some time, but of late interest has been shown in developing this area commercially. No one desiring to be heard Councilman Reibold moved that the hearing be closed. Councilman Phillips seconded the motion which was carried unanimously. Councilman Reibold further moved that the Council accept the recommendation of the Planning Commission and approve the zone change on that certain property on Duarte Road between First and Second Avenues as set forth in its Resolution No. 404, subject to the conditions specified therein. Councilman Phillips seconded the motion which was carried unanimously. Mayor Camphouse declared the hearing open on the application of Richard J. Aull, Sales Manager of P. F. Collier, Inc., 51 East Huntington Drive, Arcadia, for a business permit to allow representatives of said corporation to solicit door to door in Arcadia for the sale of Collier's Encyclopedia, Mondays through Saturdays, 9:00 A.M. to 5:00 P.M. and evenings by appoint- ment. In response to Mayor Camphouse's inquiry as to whether anyone desired to speak in regard to the matter, Mr. Aull, the applicant, addressed the Council. In answer to various questions he advised that his company maintains its head office at 219 West 7th Street in Los Angeles with branch offices in Long Beach, Studio City, Anaheim, Whittier and Glendale; that the Long Beach office has been in existence for approximately 15 years and the others approximately two years; that the company contemPlate) opening ten other sales offices, the first one being in Arcadia at 51 East Huntington Drive; that it is proposed to cover Arcadia extensively by five men trained in the Arcadia office; that the cost of the encyclopedia is approximately $300.00 and the salesmen work on a commissio basis; that at the completion of their training they are provided with brief cases and samples to be used in selling the encyclopedia; and that the Arcadia salesmen are directly under his supervision and he in turn is responsible to the Los Angeles office. Councilman Butterworth stated that he felt that inasmuch as there is apparently going to be an extremely intense coverage of Arcadia, in the event a permit is granted some City supervision should be provided over the sales personnel, such as fingerprinting them. In answer to Councilman Phillips' query as to whether the applicant was familiar with the City's ordinance which prohibits solicitation at premises so posted Mr. Aull replied that he was not aware of such ordinance. 2. 3-21-61 :.;..' (H~aring - Aull - Continued) 1 SYCAMORE BRIDGE CONSTRUCTION (Bid Results) CONSTRUCTION WATER MAIN & FURNISHING 1.'- mo, pm BID AWARD (Gasolbl.e) 13:5295 Mayor Camphouse felt that it would be cumbersome for the City to screen everyone hired by an applicant, that fingerprinting the applicant was sufficient, and mentioned the fact that the City does not fingerprint Helm's bakery salesmeh ,or milk delivery men. Both Councilmen Butterworth and Reibold felt the cases differ inasmuch as milkmen and bakery salesmen are known to the area through their daily calls whereas the salesmen in question are temporary. Councilman Balser questioned the applicant with regard to th~ number of calls made by the salesmen in an evening. The applicant replied that ordinances vary in different cities and that as many as 60 calls may be made in an evening put probably not entirely limited to one city. He added the information that the salesmen leave the office at approximately 2:00 P.M. and from 3:00 to 4:30 P.M. make appointments to call in the evening; that from 12 to 15 such appointments are made, after which the salesmen go to dinner and then return for their evening appointments. Also that their entire sales presentation is registered with the Federal Trade Commission. Councilman Butterworth commented that he was sure the applicant was aware of violations of the Federal Trade COmmission Act by encyclopedia salesmen in going to homes ~nd in deceptive selling practices and that said Commission takes an' extremely narrow view of deceptive or high pressure selling, to which Mr. Aull replied that of the major encyclopedia sales companies Collier's is the only one not convicted by the F.T.C. No one else desiring to be heard Councilman Butterworth moved that the matter be continued until the next Council meeting, the applicant in the interim to inform himself as to the provisions of the City's laws with respect to solicitation. That the applicant sub~it the material used by the sales personnel in their door to door solicitation for review by the City Manager, aliil :other' approp~iate,members"of"the..staff; inCluding a copy of the contratt form, and that the City Manager be requested to contact two or three of the cities mentioned by 'the applicant with regard to their experience with the subject company. Councilman Reibold ' seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Balser, Butterworth, Reibold, Phillips, Camphouse NOES: None ABSENT: None The City Manager advised that a staff report on the bids received for'the proposed construction of the Sycamore Avenue Bridge will be made at the next Council meeting. ,The City Manager advised that a problem exists with regard to the bids received on the furnishing of cast iron pipe; that the bids received will be held firm, as provided in the specifications; for recommendation to be made at the next Council meeting. That due to these circumstances recommendation on the bids received for the construction of the water main from the Longden Avenue well site to the Peck Road well site will also be held until the next Council. meeting since it would not be desir- able to award a contract for the construction until it has been definitely ascertained that the parts will be on hand. Also that the Association points out that the City of Inglewood charges one fee which covers the harness racing season. He added that it was his understanding that the City of Inglewood has before its Council a request for a further reduction in the handicap fee schedule. Councilman Reibold moved that inasmuch as the 1961 harness racing season is approximately half over at this time that the matter be held in abeyance and submitted to the Council prior to the next racing season, at which time the City Manager could offer his recommendation as to proper procedure, and that he so notify the Association. Councilman Phillips seconded the motion which was carried unanimously. Motion by Councilman Balser, seconded by Councilman Phillips and carried unanimously that the Council accept the recommendation of the City Manager, the Director of Public Works and the Police Chief and authorize the installation of stop signs on Old Ranch Road at Hugo Reid Drive, signs to be placed on Old Ranch Road stopping both north and south bound traffic, and that the Stop Sign Resolution No. 2795 be amended accordingly. Motion by Councilman Phillips, seconded by Councilman Reibold and carried unanimously that the recommendation of the City Manager, the Director of Public Works and the Water Superintendent be approved and that the City accept the improvements in Tract No. 25368, located at Ninth Avenue south of Magnolia Lane, for maintenance and the surety bond deposited by the subdivider be released. Motion by Councilman Balser, seconded by Councilman Reibold and carried unanimously that the recommendation of the City Manager, the Director of Public Works and the Water Superintendent be approved and that the City accept the improvements in Tract No. 25803, located on Santa Anita Terrace'l east of the Arcadia Wash, for maintenance and the surety bond deposited by the subdivider be released. Due to the necessity of hiring a temporary General Clerk in the Building Department to fill the vacancy resulting from the extended illness of the permanent employee, Councilman Phillips moved that the Council accept the recommendation of the City Manager and authorize the transfer of $600 to supplement the Temporary and Overtime account of the Building Department, from Council Contingency Account No. 409-28 to Account No. 431-3. OF THE CALIFORNIA GOVERNMENT CODE," explaining ~ that under date of November 15, 1960 the Council had approved the [NDEX~Dtentative map of Tract No. 26114, which is located only in part in Arcadia, and had indicated its willingness to deannex that portion of the tract in the City of Arcadia so that the entire tract might be in the County. That the subdivision is now ready to record and that this resolution approves the proposed boundary change and petitions the Board of Supervisors for consent to relocate the boundary line between the City of Arcadia and the County of Los Angeles accordingly. Motion seconded by Councilman Balser and carried on roll call vote as follows: AYES: Councilmen Balser, Butterworth, Reibold, Phillips, Camphouse NOES: None ABSENT: None The City Attorney presented and read the title of Resolution No, 3365 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION TO THE CITY OF ARCADIA OF CERTAIN INHABITED TERRITORY IN THE COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, CONTIGUOUS TO THE CITY OF ARCADIA AND DESIGNATED AS 'ANNEXATION NO. 23, SOUTH ARCADIA INHABITED'." ~?:;..", , aNDEXED 7, 3-21-61 (Resolution No, 3365 - Continued) J1:t-o 'INDEXED 13:5300 The City Attorney commented that said resolution had been submitted to the Councilmen at their request, together with a schedule of the proceed- ings of an inhabited annexation from the time of the Council's consent to commencement of proceedings up to the calling of a special election within the annexation area, Mayor Camphouse advised that each member of the Council had also received a copy of a letter from the Rancho Santa Anita Residents' Association and requested the City Clerk to read the letter submitted by the Santa Anita Village Community Association, Both communications expressed disapproval of the requested annexation, 1 Extensive discussion was then held on various portions of the resolution, It was stated that should the resolution be adopted in its present form a written description of the annexation proposal is filed with the Secretary of the County Boundary Commission and a map of the area is filed with the Registrar of Voters; that within 20 days after receipt of the written proposal the' Boundary Commission must report on the accuracy of the boundary description, the special districts included in the annexation area and like matters; that the Registrar of Voters usually furnishes the estimated number of registered voters in the area within this same period of time, That after the description is approved by the Boundary Commission, the proponents publish notice of intention to circulate the annexation petition, which notice may also contain a state- ment of reasons for annexation, That proofs of such publication, with a copy of the notice and statement, if any, must be filed with the City Clerk within ten days after the publication thereof, That within fifteen days after such filing, the Council should adopt a resolution acknowledg- ing receipt of the proof of publication, copy of notice and statement, if any, and consenting to the circulation of the annexation petition, That such a resolution confers exclusive jurisdiction upon the City over the territory for a period of 50 days and that the propositions to be submitted to the electorate in the annexation area must be included in this resolution, The City Attorney, at the request of Mayor Camphouse, then read Resolution No. 3365 in full, excluding the legal description, Due to the fact that Councilman Butterworth had Laryngitis at the Council meeting of March 7, 1961, he received permission to express his views, as follows, on the requested annexation: "I had occasion to express myself before the Planning Commission last week and I would like to state at this Council meeting essentially what I said to the Planning Commission and I think possibly what I said on two other occasions there. If I may be forgiven while I make one observation which is entirely my own because I see some of the residents in this area, Of course I'm not on the School Board and I cannot speak for the School Board but I have been on the School Board and I can speak 1 with some experience. I think there should be no misunderstanding that should you be annexed to the City of Arcadia this is not ipso facto entrance into the Arcadia School System and again, while this is a matter within the jurisdiction of the Arcadia School System, it is my personal opinion that it would be extremely difficult for the Arcadia School System to take this area in due to the lack of school facilities if the average of children is approximately the same, and I assume that it is. The School District, in my judgment simply does not have the physical facilities to take in the children and I certainly think you should be advised; but again, I make an observation only. I am not on the School Board and in the last analysis that is a decision of the School Board to make. "As I said before the Planning Commission and as I said again at the last Council meeting, I had occasion to agree with the point of view as expressed by the Mayor and Mr. Phillips, I simply cannot accept the 8. 3-21-61 1 1 (Resolution No. 3365 - Continued) J'l~O ~ 13:5301 conclusion that this is a substandard area. I have been through it too many times and I cannot accept that conclusion. I don't think that it is. However, I think that this area should be annexed not for the benefit of the people down there but for the benefit of Arcadia. 1 think it would be good for Arcadia to have this area in and of course I think the people there will benefit and I'm glad they wilf' benefit if they come in. "1 see no reason to give all of my reasons because they have already been stated at the 'last meeting and I don't intend to detail them again at this time, other than to say that in addition to those reasons I have been influenced by the City Manager's report of December 6, 1960, and while the City Manager made no recommendation per se 1 felt that his report was very ably presented and there is material contained in that report that influences my attitude. "The South Arcadia Business Mens' Association has, 1 believe, recommended admittance; on the other hand, the Rancho Santa Anita and the Village have recommended against admittance. 1 am, of course, interested in the recommendations of any group of people and glad that they are interested in civic affairs. To what extent those particular groups on either side have undertaken to advise us of the facts I don't know. 1 agree with the Chamber of Commerce report in part, that the area should come in and of course the Commurity Development Committee recommended the admittance of the area. "There is one part - two parts of the Chamber - I thought the Chamber of Commerce did a very fine job, I know they spent a long time on it and as I say, 1 concur in their conclusion that the area should come in but if the suggestion in there that the - I forget the wording of it, but the inference was that the area to be annexed should buy its way in. I may not be quoting that exactly correctly but I want to say that in addition to that and in fairness to the Chamber, it is not clear exactly what they mean by it, but if it is taken to mean that you take some 17 million dollars net worth of the City and divide it by the number of lots down there or some other formula and come up with a $3000 per lot assessment - that's just something again that is unaccept- able to me. I don't know whether the Chamber of Commerce had that in mind, but in any event I am not agreeable to adopting that kind of an annexation procedure of policy. Indeed if it were adopted Arcadia's boundary would be set right now forever, because no area would ever come in under those conditions. However, I heard some discussion at the last meeting from the residents of the area that distresses me a little. I had at least gained the inference from one or two remarks that some of the residents would not be willing to come in if they were charged a dime. I mean, if it costs $1.00 to come in they simply would not be willing to come into the City of Arcadia. Well, of course, they have to do what they think is right and 1 must do what I think is right and 1 don't agree with that attitude or philosophy any more than 1 agree with the attitude that there should be a very substantial assessment of two or three thousand dollars. "My own thinking on it is not clarified due to my lack of knowledge of annexation costs and procedures. It was brought out at the last meeting that for instance, Arcadia charges $25.00 a lot for - in certain situations, for land in Arcadia and 1 can't imagine why something like that for instance would not be one of the charges that would be assessed against the area. Mr. Phillips, it was reported in the newspapers. to have made a remark pertaining to the water system down there which appealed to me. 1 didn't study it carefully but something along that line makes sense to me too. There may be other out-of-pocket expenses in connection with the annexation, indeed there may be other expenses in connection with this situation, the connecting up of a water system, that 1 think could be very fairly charged against an area to come in. I can't detail these expenses but I personally am in favor of giving at 9. 3-21-61 (Resolution No. 3365 - Continued) J 1J-t) 13:5302 least some consideration to those matters. I have heard it said and talked to one or two relative thereto that have told me that coming into the City would possibly increase the property values anywhere from 5 to 10 to 157.. Somebody at the last meeting said "well I'm not selling my property and I am not going to be able to realize that gain." There is some merit in that argument, but nevertheless there is an increase in valuations and may I say, I am delighted. If coming into Arcadia can increase property valuations that is just fine and something that is a very good fact of this whole annexation proceeding, but bearing that in mind, I think if the City, and I am speaking now for myself, if the City should impose certain charges which I, at this time cannot define in connection with the annexation, I would find it difficult to understand why there would be violent objections to this area undertaking and h01d-t ing harmless the City of Arcadia from certain expenses and costs and fai charges directly connected with the annexation and in addition, such things as our recreation fee and the like. "That fairly well summarizes my attitude and I think Mr. Nicklin, I telephoned you in that connection and asked if you could give me some suggestions or advice on what is customary in some of these proceedings." The City Attorney stated in part that the proceedings have no direct bearing on the boundaries of the respective school districts; that the law permitting a Charter City to automatically transfer property from one school district to another has been repeatedly amended and that the consent of the governing bodies of the school districts is now necessary. Discussion was then held on ways and means of levying an assessment on each parcel annexed and whether or not such a levy should be made. COuncilman Reibo1d stated in part that he had made some calculations, submitting to the Council copies of same, and explained how he had arrived at an approximate figure of $400.00 per unit, adding that such amount was only an estimation and based on the possibility of about 1500 units in the area the figure would probably be between $285 and $400. COuncilman Balser stated in part that he also had made some calculations and that he had arrived at an approximate figure of $406.78; that his calculations were based on the same formula used by Councilman Reibo1d, and that the amount should be prorated on the assessed valuation per parcel as indicated by Councilman Reibo1d. Mayor Camphouse stated in part that in his opinion the calculations would have the effect of a denial to circulate the petition; that the contemplated increase in assessed valuation of the property in the area would serve as an annexation fee. Councilman Reibo1d stated further in part that he would favor the. proponents of the annexation being fully informed in all respects, such as the zoning restrictions, etc. before asking for signatures on 'the petition. 1 Councilman Phillips stated in part that if this Council were to refuse this group of people the right to circulate a petition it would in effect foreclose this Council and future Councils voting for any other area to come into Arcadia; that if a fee is imposed on this area the same procedure would have to be followed in the future. Councilman Butte~orth further stated in part that if the subject area is assessed too highly it would tend to freeze Arcadia at its present boundary and there might be other areas which Arcadia could be desirous of annexing; that $400.00 per parcel appeared high to him and that he would favor further study on the matter of a fair charge. He then suggested the appointment of a committee to consider this aspect. The City Attorney suggested that Section 3 of Resolution No. 3365 could be deleted, thus permitting the time consuming steps to be put into operation. I' Whereupon Councilman Butterworth mOved that the Council appoint an interim committee consisting of Councilmen Phillips and Reibold to study the matter of annexation fees. Councilman Balser seconded the motion which was carried unanimously. Mayor Camphouse ordered filed the notice from the County Boundary Commission that the City of El Monte has filed annexation proposal No. 255 as it has no effect upon Arcadia. No one in the audience desired to address the Council. Mr. Ervin Golisch, Planning Commissioner, advised that at the last Planning Commission meeting steps were taken to set a public hearing on the changing of driveway requirements on Zones R-2, R-3 and R-3-R and also that the Planning Commission is continuing to work on the matter of strengthening the house moving proposal. At the request of the City Manager, Mr. Paul Langly, the District Manager of the Southern California Edison Company, Monrovia office, addressed the Council, stating in part that his company is increasing the capacity of their substation in Arcadia; that they have been working for over a year on the matter and have tried to secure the best routes available in order to cause the least inconvenience to their customers. He suggested that should the Councilmen receive any inquiries or complaints that they be referred to "their customer relations man. 1 The City Manager suggested an adjourned meeting March 23, 1961 at 7:30 P.M. in order that the matter of a City Planner be discussed, touching upon the urgency of the matter, and also suggesting that the Planning Commission be invited to attend. Mayor Camphouse stated that although he would be unable to attend he thought the suggestion a good one. He also excused the City Attorney from attending. After the City Manager's explanation regarding the desirability of establishing a regular meeting date for the purpose of discussing business affairs and being advised of managerial and city activities which time did not permit at 'regular Council meetings, Councilman Reibold read in its entirety Resolution No. 3370, 'entitled: "A 12. 3-21-61 RESOLUTION 'No. 3370 I, 13 : 5305 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FIXING THE LAST THURSDAY OF EACH MONTH AT 7:30 O'CLOCK P.M. Councilman Reibold reported that he had received a letter from the General Manager of the Upper San Gabriel Valley Municipal Water District pointing out that the San Gabriel Valley Municipal Water District itself had engaged the engineering firm of Koebig and Koebig to investigate the water resources available to and required for the District; that representatives of said firm would call on the City in the near future -and suggested that the matter be referred to the City Manager and that everything possible be done to cooperate. Mayor Camphouse so ordered.
