REGULAR MEETING
JANUARY 6, 1959
The City Council of the City of Arcadia, CalifQrnia, met in regular
session in the Council Chamber of the City Hall at 8:00 o'clock P.M.
January 6, 1959.
The Invocation was offered by the Rev. Bennie C. Flint, Pastor of the
First Baptist Church of Arcadia.
Mayor Phillips led in the pledge of allegiance to the flag.

Councilman Camphouse moved that the minutes of the regular meeting
of December 16, 1958 be approved as submitted in writing. Councilman
Reibold seconded the motion and it was carried unanimously.
Mayor Phillips stated that regarding the proposed rezoning of Duarte
Road, between Holly Avenue and the present commercial zone near
Baldwin Avenue, that this matter would remain on the pending agenda
until a report is received from staff as to the sentiment of the area
residents on the costs involved for the cutting through of Arcadia
Avenue.
Continued matter regarding the application of Oscar Robins (dba
Bard Distributing Company) for a business permit to allow the
installation and operation of four skill game machines in'the Santa
Anita Bowling Courts.
The City Attorney stated that with reference to such skill game
machines, the City has in the past attempted to control their
location and manner of operation under Ordinance No. 823 which
amended Ordinance No. 737; that under said ordinance, in order to
sustain a denial of an application there must be evidence in the
record of the hearing on an application for a given location for a
given device; that although certain conduct might be suspicioned it
did not always come forth into the record; and that in an attempt to
close at least one of the avenues of abuse, namely, the use of
amusement and game devices as a means for petty and sometimes more
serious gambling, he wished to present for Council's consideration
Ordinance No. 1044, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA, AMENDING ORDINANCE NO. 737 OF SAID
CITY BY ADDING THERETO A NEW SECTION NO. 23- A."
He added that the effect of this ordinance and its purpose will be:
(1) to provide a license fee of $25.00 per year for all items that
were previously referred to in subsection 19 of section 23 of
Ordinance No. 737, covering all types of amusement, skill games and
juke boxes where they are operated by or for money; (2) to permit
the substitution of like or similar machines or devices upon the
payment of $1.00 transfer fee to absorb the cost of the clerical
work in bringing 'the records up to date and to obviate the necessity
of coming before the Council for such purpose; and (3) to make it a
misdemeanor, punishable upon conviction by a maximum fine of $500.00
or six months imprisonment, for any person utilizing any such amuse-
ment machine for gambling, betting, wagering or pledging anything of
value, or permitting the use thereof for such purpose.

He continued that Ordinance No. 823 already grants Council authority
to revoke or modify any license or permit issued thereunder for the
violation of any applicable city ordinance; that the penalty clause
in Ordinance No. 1044 implements other sections of the ordinances
already in existence.
Whereupon Cou~~llman Reibold moved that the reading of the full body

Councilman Reibold then moved that the hearing be continued to the
next regular Council meeting of January 20, 1959, which motion was
seconded by Councilman Camphouse and carried unanimously.
Mayor Phillips instructed the Staff to advise Marvin Jones, 12235
Ventura Blvd., Studio City, California, whose application in August,
1958 for a business permit to install skill game machines had been
denied by the Council, of the proposed changes incorporated in
Ordinance No. 1044 which, if adopted at the meeting of January 20,
1959, will enable the Council to reconsider his application as well
as that of Oscar Robins (dba Bard Distributing Co.).
Mr. S. R. Levine, the attorney for the applicant Oscar Robins,
addressed the Council, stating that his client Bard Distributing Co.
is proposing to apply in the name of Jones as the Jones group is no
longer interested and that his client has assumed all of the Jones'
interest, to which Mayor Phillips replied that nevertheless he still
desired the staff to contact Mr. Jones directly.
Mayor Phillips declared that this is the time and. place fixed by
Resolution No. 3083 to hear, consider, pass upon and determine the
weight and effect of all written protests to the annexation known as
l7-A Southwest Arcadia Inhabited that may have been filed with the
City Clerk prior to this time. That it is likewise the time fixed
for the hearing of any person interested in the annexation who may
wish to be heard and to show cause why the said annexation should
not proceed further. He inquired of the City Clerk as to whether
anyone had filed any document with her prior to this time purporting
to be a protest to Annexation No. l7-A, to which the City Clerk
replied that none had been received.

The City Attorney described generally the properties included in
said proposed annexation, and added that notice had been published in
both the Temple City paper and the local paper as required by
statute; that this is actually a hearing wherein the property
owners themselves have a voice; that after this hearing is completed,
if a majority protest is not made then notices are mailed to all of
the registered voters living in the area and a statement of the
ballot proposition included; that a vote is then held by the people
in the area under consideration; that if the majority of those voting
vote against the annexation, the proceedings are terminated; that if
the majority of those voting vote in favor of the annexation, the
matter comes back to the City Council who then continue from there;
that this hearing deals with property owners, although any person
interested may speak orally on the subject.

Mayor Phillips then inquired if anyone in the audience desired to
speak and no one desiring to so do Councilman Jacobi moved that the
hearing be closed, which motion was seconded by Councilman Camphouse
and carried unanimously.
Councilman Reibold then moved that the Council does hereby find and
determine that no protests, written or oral, were filed in the matter
of Annexation l7-A. Said motion seconded by Councilman Balser and
carried unanimously.
The City Attorney commented that under the 1913 Act, even though no
protests are filed, the opponents of the annexation, if any there be,
have ten more days in which to file protests, so that the matter can-
not proceed further at this point but will be able to proceed at the
next meeting,
The City Attorney presented for the second time, discussed and read
the title of Ordinance No. 1042, entitled: "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING ORDINANCE NO. 1003
OF SAID CITY. BY ADDING THERETO SECTION 4-A."
He explained that this ordinance amends a recent ordinance requlrlng
the construction of driveways, curbs, gutters, sidewalks, etc. in
commercial areas concurrent with the erection of buildings on the
property, and will permit the Council to modify the basic require-
ments for good cause.
Councilman Reibold moved that the reading of the full body of
Ordinance No. 1042 be waived. Councilman Jacobi seconded the motion

The City Attorney presented for the first time, discussed and read
the title of Ordinance No, 1043, entitled: "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION
TO VACATE AND ABANDON THAT PORTION OF DOSHIER AVENUE OFFERED FOR
DEDICATION AS A PUBLIC STREET IN SAID CITY, RESERVING THEREIN AN
EASEMENT FOR STORM DRAIN PURPOSES, AND FIXING A TIME AND PLACE FOR
THE HEARING OF OBJECTIONS TO SUCH PROPOSED VACATION AND ABANDONMENT."
He added that this ordinance institutes proceedings, pursuant to the
Streets and Highways Code, to consider and enable the taking of
action if desired, to vacate the portion of Doshier Avenue described
therein, and with respect to which an offer of dedication for street
purposes was made at the time of the filing of the subdivision map,
which offer was then rejected; also that this ordinance includes
the determination to reserve the storm drain easement and that a
hearing will be set for February 17, 1959.

The City Attorney presented, discussed and read the title of
Resolution No. 3091, entitled: "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA, DETERMINING, CREATING AND ESTABLISH-
ING TAX DISTRICTS WITHIN SAID CITY."
He added that this resolution is for the purpose of the maintaining
of a permanent record for the various portions of the city to be
included within the various tax districts, which districts must be
established and recorded with the Board of Equalization and the
Assessor's and Tax Collector's offices prior to February 1, 1959;
that there are some minor readjustments of existing boundaries due
partly to annexations and to the fact that some bond issues have now
run their course and the City will not have to have separate code
areas in as many numbers as in the past. That it likewise sets in
motion the creation of separate code areas for the Vehicle Parking
Districts that have been ordered created, so that should it become
desirable or necessary, at the discretion of the Board of Parking
Place Commissioners of either District to levy a maintenance tax,
then the Code Area will have already been created.

The City Attorney presented, discussed and read the title of
Resolution No. 3093, entitled: "A RESOLUTION OF THE CITY COUN.CIL
OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING A PORTION OF LOS
ANGELES COUNTY FIRE PROTECTION DISTRICT INCLUDED WITHIN THE CITY OF
ARCADIA BY REASON OF ANNEXATION NO, 18 WITHDRAWN FROM SUCH DISTRICT."
He added that this resolution withdraws the property in Southeast
Arcadia Annexation No. 18 from the County Fire Protection District;
that since Arcadia city taxes include fire protection, this
eliminates duplicate assessment for the property included in that
annexation.

The City Attorney presented, discussed and read the title of
Resolution No. 3096, entitled: "RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA, ORDERING TIlE CITY ENGINEER TO MAKE
AND DELIVER A DIAGRAM OF ACQUISITION FOR AND OF PROPERTY WITHIN
VEHICLE PARKING DISTRICT NO.2 OF SAID CITY."
The City Attorney added that this resolution is the first step in
the procedure of spreading the assessment for Vehicle Parking
District No.2, and orders the City Engineer to make and deliver
a diagram of the property acquired for that District. That said
diagram will be filed with the City Clerk prior to the next Council
meeting, at which time the City Clerk will set a hearing date.
That notices will then be sent to all owners of property within the
District, giving property owners notice of the filing of the diagram,
the cost to each individual parcel as set forth therein as to each
respective owner, the date, hour and place of the hearing on the
confirmation of the assessment. That at the time of that hearing
all persons owning property within the District and to be assessed
may be heard in connection with the proposed. assessment. Council may

The City Attorney then stated that in connection with Vehicle
Parking District No.1, those proceedings are completed and all the
money has been received; that the statement of O'Melveny & Myers,
Special Counsel, who supervised the conduct of the entire proceedings,
including their opinion as to the validity and merchantability of the
bonds that were sold in the District, has been received in the amount
of $1,064.71 and that said statement has been computed in accordance
with their contract executed at the inception of the proceedings on
said Vehicle Parking District No. 1 and is correct and in order.
That it is his recommendation that the Council approve and authorize
payment of said statement in the amount of $1,064.71, said payment
to be made from the balance of funds on hand in the Vehicle Parking
District No. 1 Account.
Councilman Balser moved that the Council accept the recommendation
of the City Attorney and approve and authorize payment of the state-
ment of O'Melveny & Myers in the amount of $1,064.71, covering
their services rendered as Special Counsel in the matter of the
proceedings of Vehicle Parking District No.1; said payment to be
made from the balance of funds on hand in the Vehicle Parking
District No. 1 Account. Motion seconded by Councilman Camphouse

Councilman Camphouse read the following recommendation from the
Library Board of Trustees dated December 24, 1958:
"Honorable Mayor and City Councilmen
Arcadia City Hall
Arcadia, California
Gentlemen:
The Library Board of Trustees, after considerable study and'with the
aid of library consultants, has now reached agreement on a proposed
location for the proposed Arcadia Public Library.
While the site finally selected was not the most favored by the
Library consultants, it does offer some strong advantages. Among
them are geographical location, easy accessibility by automobile,
attractive and open elevation with adequate space for building and
parking. In addition, it is City owned property.
With this information as a background the following resolution has
been adopted:
"Resolved that the proposed new Arcadia Public Library
building be situated on City owned property located at
Duarte and Santa Anita Avenues. The building should be
located on the eastern portion of the plot, as placed by
the architect, with easy access from Duarte and Santa Anita
Avenues. After a study of available sites by the Board and
Library consultants, City owned property is being recommended
in the interest of economy and location."
The Board is most anxious to proceed in other matters leading to a
new library building and will welcome Council action towards making
the recommended site official.

Councilman Camphouse stated that in order that the Board might be
in position to proceed with the next stage, that of recommending to
the Council their choice of an architectural firm, he moved that
the Council accept the recommendation of the Library Board of
Trustees as contained in the above letter and approve the site
recommended. Councilman Reibold seconded the motion.
A general discussion ensued, and it was the consensus of the Council
that the said Board should be commended on its diligent effort
involved in locating a site for the proposed new Arcadia Public
Library that is in the best interests of the City, both as to
locale and economy-wise. Also the following comments were made
by the following Councilmen:
Councilman Reibold: "The building itself is still several years
removed since there are the plans to be drawn and the money
accumulated for the construction of said library."
Counc ilman Camp house : "Counc il is res tric ted from approving any
project for construction unless the funds for same are already on
hand, this being the reverse of the usual procedure for the people
in this Country, who first buy and then save to pay for the purchase."

Mayor Phillips: "The City has enough funds on hand for the retaining
of an architectural firm in order that the first stage of the project
may be started; the site is very important as the architect must know
where the building is to be located."
Councilman Camphouse: It should be noted that since the site is
already city-owned all funds available can be expended for the
building rather than for some of it going into land."
Mayor Phillips: "A site might have cost the City as much as
$300,000 to $350,000."
Councilman Reibold: "The location of the library on the east side I
is not just happenstance; this leaves that part of the City's
property on the west available for future use without being completely
boxed in; also the cost of the building is to be financed out of '
capital projects funds which are not derived from bonds or ad valorem
taxes."
Mayor Phillips: The usage of the remaining rectangle of land could be
used as a parking lot serving a dual purpose."
Mayor Phillips then asked for a vote on the motion made by Councilman
Camphouse and seconded by Councilman Reibold and received the
unanimous aye vote of all the Councilmen.

Planning Commission recommendation for approval subject to the following
specified conditions:
I. File a final map with the City Engineer.
2. Provide a sewer lateral for Parcell. A cash deposit of
$200.00 may be posted to guarantee the installation of the
sewer lateral'at the time of the construction of the building.
3. Pay $25.00 recreation fee.
4. The alley north of this property should be paved to City of
Arcadia standards, from Second Avenue to the west line of the
requested split.
Councilman Balser moved that the Council accept the recommendation
of the Planning Commission and that Lot Split No. 227 be given
tentative approval subject to the above specified conditions. Motion
seconded by Councilman Camphouse and carried unanimously.
The Planning Commission Secretary advised that on November 5, 1958
map of Tract No. 21228 was given final approval by the Council.
(Tract located on Louise Avenue and LeRoy Avenue, south of Christina
Street). That a change of ownership of a portion of the tract
occurred, the new owners having signed the title sheet of the map
after the date of approval, and reapproval by the Council is
therefore necessary; that all conditions imposed have been
complied with.

Motion was made by Councilman Jacobi that the City Council reapprove
final map of Tract No. 21228 in accordance with letter presented by
the Planning Commission dated December 31, 1958, and that the City
Clerk be authorized and directed to endorse in due form such seal
of the City of Arcadia thereon. Councilman Camphouse seconded the
motion and it was carried unanimously.
Tract No. 24181 - located south of Colorado Boulevard and west of
Santa Anita Avenue.
(a) Recommendation of the Planning Commission that final map of
Tract No. 24181 be approved without the signature of the Southern
California Edison Company. The City Manager explained that under
the provisions of Section 11587(a) of the Business and Professions
Code (Subdivision Map Act) it is not necessary to have Edison

Councilman Jacobi moved that Council approve the recording of the
final map of Tract No. 2418l without the signature of the Southern

necessary gates; that the estimated expense of performing such work is
$2,000.00; and that Council authorize the appropriation of the sum of
$2,000.00 from Council Contingency Fund to cover such estimated expense.

that the recommendation be approved and that between the hours of
11:00 A.M. and 6:00 P.M, on all days, including holidays and excepting
only Sundays, and excepting those spaces clearly designated and
restricted to the use by city employees and for service vehicles,
that no person shall park any vehicle upon the Civic Center Parking
Lots for a period in excess of two hours during anyone day.

The City Manager advised that the Chief of Police had consulted with him
regarding the matter of furnishing police officers to organizations
and individuals who are conducting activities requiring police services
over and above normal, routine services. That in the past it has been
the policy for the Chief of Police to approve the request and assign
off-duty police on a rotation basis, for which compensation was paid
by the individual or organization directly to the policeman performing
the. service.
Thgt this procedure is undesirable in that the officer is not on
official duty and consequently not entitled td workmen's compensation
or other employee benefits provided by the City, but that since he
works in uniform, the City is invariably considered responsible for
his acts without in fact being able to control his activities, and
thgt this imposes an insurance cost and overhead chgrges for which
the City is not reimbursed.
That it is the recommendation of the City Manager and the Chief of
police that since these activities, such as high school athletic
events, commercial organization special events and private events
requiring traffic control, create a need for police service, that it
is felt that the services should be provided as a routine police
function subject to the following conditions:
I. The Chief of Police shall determine which events require police
service and the number of policemen necessary to effectively control
the situation.
2. Compensation shall be paid directly to the City on the basis of
the highest pay step in the patrolman pay scale with an additional
percentage charge for overhead and insurance with a minimum service
of four hours.

3. The City shall pay the officer through regular payroll procedure.
4. Policing of private parties on private property shall be
restricted to control of traffic in the public streets. Safeguarding
of property at these affairs is a proper function of private patrol
or detective services which are available.
5. The service shall be performed under the superv~s~on of the
Chief of Police and shall be performed by officers off-duty.
A general discussion ensued and it was the consensus of the Councilmen

Chief of Police were well taken, except that Councilman Camphouse
felt the only area wherein there may not be unanimous agreement was
the matter of school athletic events; that he did not think'schools
should be charged for policing such events, with which Councilman
Reibold agreed. Mayor Phillips then suggested that a cost accounting
system be kept and characterized in the budget so that the Council
would be kept aware of the amount spent by the City for services to
others.
Thereafter Councilman Jacobi moved that the matter be referred to
the City Manager, the Police Chief and the City Attorney for further
study and recommendation. Councilman Reibold seconded the motion and
it was carried unanimously.

Councilman Camphouse stated in part that he has given a great deal of
thought to the fact that he felt the City is facing a serious problem
in its lack of an overall zoning plan and that it was the responsibility
of the Planning Commission and the Council to give this matter more
concentrated thought. He suggested that it should be determined what
kind of community is desired in this City and then a resolute planning
program, holding to that type of community, be put into effect; that
in order to accomplish such a program he suggested that the Mayor
appoint a committee to devote more time in thinking and planning an
overall zoning plan and also that an outside consultant be appointed
to aid in setting forth such a total plan to the Council.
Mayor Phillips concurred and appointed a committee consisting of
Councilman Camphouse as Chairman, Councilmen Balser and Jacobi, and
the Director of Public Works, Mr. Lortz, to make recommendations to
the Council on the planning problem.
Councilman Camphouse further spoke on the subject of economics, both
federal and municipal, pointing to the alarming ever-increasing
national budget and the fact that economy in government, if it is to
be attained,must begin "at home". He stressed the need for the
Council to study carefully the revenue and spending picture of
Arcadia and that such study should begin immediately and not be
postponed until a month or so before the annual budget is due to begin,
and suggested that the Mayor appoint a committee for this purpose.
Councilmen Balser and Reibold stated that they concurred in
Councilman Camphouse's statements. Councilman Reibold added that he
felt in order to keep the tax rate in Arcadia from rising that the
rule of thumb in working on the budget should be "Is it nice or is it
necessary". Councilman Bnlser then suggested that the Council meet
as a whole to discuss this problem and Mayor Phillips stated that he
also concurred in this matter and that he would arrange for a meeting
of the Councilmen the early part of the following week.
Councilman Jacobi questioned the excessive speed of the trains
traveling through Arcadia and suggested that the speed be checked.
Police Chief Seares stated that it was checked occasionally and
that frequently a meeting is held with the railroad officials, at
which time they are notified of any complaints received regarding
excessive speed.
Councilman Jacobi also inquired into the procedure followed by the
City when a juvenile is cited for excessive speed and also the age
as to when a juvenile is permitted a driver's license. Chief Seares
answered that a juvenile appears before the juvenile Referee in
El Monte; that in some rural areas a person of the age of 14 can
get a license but that he did not know of any issued in the City of
Arcadia under the age of 15~.
Councilman Camphouse inquired as to the status of the protested
traffic lines on Huntington Drive in the area east of Second
Avenue to Fifth Avenue and was informed by the Director of Public
Works that he had had several meetings with representatives of the
State Division of Highways but to date they had made no commitments
as to whether any change would be made. He promised to pursue the
matter further in an effort to secure some cooperation from said
Division; also that he would recommend additional action by the
