HomeMy WebLinkAboutFEBRUARY 4,1959 1 1 ROLL CALL WATER BOARD IND;X~D APPOINTMENT OF CITY MANAGER PRO TEMPORE INDEXED 04~47 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA ADJOURNED REGULAR MEETING FEBRUARY 4, 1959 Pursuant to the order of adjournment of the regular meeting of the City Council of February 3, 1959, the City Council of the City of Arcadia met in regular adjourned session in the Council Chamber of the City Hall at 7:30 P.M., February 4, 1959. PRESENT : ABSENT: Councilmen Camphouse, Jacobi, Reibold, Phillips Councilman Balser Councilman Reibold stated that at the regular Council meeting of February 3, 1959, Councilman Camphouse had suggested that in view of the seriousness of the water situation Council consider the formation of a water commission or a citizens' committee to study the matter thoroughly; that he had given it considerable thought and had also that day discussed it with Councilman Balser who had concurred, and that he desired to suggest that Council proceed with the establishment of a Water Board rather than a citizens' committee, because of the short term a citizens' committee serves; that such board consist of seven members representative of the legal, engineering, and financial professions and the like, who would be qualified to gather information and tender advice and recommendations to the Council, and that if Council agreed, to request the City Attorney to draw up an ordinance establishing such a!board. Councilman Camphouse stated that he was agreeable to the City Attorney proceeding in such manner and that in the interim Council could give thought to 'the persons they desired to serve on such a board, suggesting that they consider new residents of Arcadia who have evidenced interest in the community. He added that he did not think this contemplated board should be autonomous, such as the Library Board, but that Council should have jurisdiction over the finances and such since it is responsible for the budget. \ Councilman Jacobi ~oncurred in the above and Mayor Phillips, who also concurred, suggested that the City Attorney present the suggested ordinance at the next Council meeting. At the Council meeting of February 3, 1959 the City Manager requested that effective during his leave of absence, as authorized by Resolution No. 3l04, adopted at said meeting, the Council approve the appointment of'Lawrence E. Cook, Assistant City Attorney, to the office of the City Manager Pro Tempore. At that time the City Attorney questioned whether this would be in conformance with the City Charter and requested the matter be held in abeyance for 24 hours pending his research and recommendation. The meeting was thereafter adjourned to this date. The City Attorneysuggested that a solution to the matter would be for Mr. Cook to resign as Assistant to the City Attorney, which appointment was made by the Council, such resignation to be effective upon Council's acceptance and concurrent with Council's approval of his appointment by the City Manager as City Manager Pro Tempore. He added that this appointment as City Manager Pro Tempore is by the Charter contingent upon his being a department head or officer, and thus dependent upon his being designated as Administrative Assistant. 1. 2-4- 59 04.~4.8 (Appointment City Manager Pro Tempore - Continued) VACATION (City Attorney) ADJOURNMENT Whereupon the Assistant City Attorney submitted his resignation as Assistant to the City Attorney to be effective upon his appointment by the City Manager as Administrative Assistant and Council's approval of his further appointment as City Manager Pro Tempore. Councilman Reibold moved that the Council accept the resignation of Lawrence E. Cook as tendered. Councilman Camphouse seconded the motion and it was carried unanimously. The City Manager then appointed Lawrence.E. Cook as Administrative Assistant to the City Manager at the salary he is presently receiving as Assistant to the City Attorney, to wit: $725.00 per month plus $40.00 per month car allowance, effective as of February l, 1959. 1 The City Manager further appointed the Administrative Assistant as City Manager Pro Tempore. Councilman Camphouse moved that the Council approve the above appointments made by the City Manager at the salary and allowance stated. Councilman Reibold seconded the motion and it was carried unanimously. Councilman Camphouse further moved that the sum of $3625.00 be transferred from Account No. 107.l to Account No. l02.l and the sum of $200.00 be transferred from Account No. l07.9 to Account No. 102.9. He added that he wished to interject with his motion his personal feelings to the effect that what is being done is not an attempt to short-circuit the operation of the Legal Department, but to strengthen the position of the City's staff and key personnel. The City Attorney commented that since the Council had indicated the above to be only a 90-day appointment he did not now contemplate appointing a substitute for Mr. Cook while he was acting in the capacity of City Manager Pro Tempore. Councilman Reibold then seconded the motion and it was carried on roll call vote as follows: AYES; Councilmen Camphouse, Jacobi, Reibold, Phillips NOES: None ABSENT: Councilman Balser The City Attorney advised that he had had no formal vacation since entering the City service about nine years previously, and anticipating a tremendously increased work load in the near future, he asked and received permission to absent himself from duty as he might best arrange.
