Mayor Phillips welcomed the Arcadia High School students who were elected City Officials and introduced Student "Mayor Italo Gattei, an exchange student from Milan, Italy. Each Councilman thereafter introduced his counterpart Councilman as follows: Judy Marquand, Pat Young, Virginia Jones and Barbara Porteus. Student Mayor Gattei thanked the City for its hospitality to the student government day councilmen and city officials. The Invocation was offered by Rev. H. Warren Anderson, Pastor of the Arcadia Community Church of God. Student Mayor Italo Gattei led in the pledge of allegiance to the flag. PRESENT : ABSENT: Councilmen Balser, Camphouse, Jacobi, Reibold, Phillips None Student City Clerk Sharon Kessinger called the roll of the student Councilmen as follows: PRESENT : ABSENT : Student Counci,lmen Marquand, Young, Jones, porteus, Gattei None Councilman Balser moved that the minutes of the regular meeting of February 3, 1959, the adjourned regular meeting of February 4, 1959, and the regular meeting of February 17, 1959, as submitted in writing, be approved. Motion seconded by Councilman Reibold and carried unanimously. The City Clerk advised that she had been presented with petitions signed by residents of the vicinity of Doshier Avenue requesting the vacation and abandonment of Doshier Avenue for reasons stated In said petitions; in substance being that the area lying easterly of Tract No. 17853 is not suitable for subdivision; that the opening of Doshier Avenue for the purpose of ingress and egress is too far in the future for consideration; that said area is presently being used as a spreading basin and diversion channel by the Los Angeles County Flood Control District and that adequate ingress and egress is provIded in at least two other locations; also that heavy truck traffic would have a detrimental effect on property in the area. Mayor Phillips stated that a communication had been received from the County Flood Control District whIch, in substance, protested the vacation of Doshier Avenue. He added that Mr. H. J. F. Hannemann, Chief Valuation Engineer of said District, was present. Whereupon Mr. Hanneman addressed the Council and to various questions of the Councilmen advised in part, that the estimated time before the District proposes to declare the property between Highland Oaks and Santa Anita Channel as excess to its needs, following the filling of this debris disposal area and the disposal of said property for subdivision or other purposes, will probably be this summer; that the existing subdivision will be filled to the same elevation as the adjacent territory in a short period of time, but that plans for the area east of the channel are in the distant future, anywhere between 50 to 200 years. He added that the construction plans for the Santa Anita Wash project contain provisions for bridge footings in Santa Anita Wash 1. 3-3-59 : 45E2 I" '--,u' at the point where Doshier Avenue would'cross the Wash if Doshier Avenue were opened and extended as a full public street; also that Arcadia would not be required to assume any expense for such footings. He continued that the District's protest and request that Arcadia open said street for public use was only for the purpose of staying the proposed vacation and abandonment of said Doshier Avenue. Mr. A. W. Sommerfield, 1801 Highland Oaks Drive, addressed the Council, stating that he was in favor of said vacation; that an increase in traffic would occur and that he felt the plans for the proposed subdivision were too indefinite to be given serious consideration at this time. The City Attorney thereupon explained the basis of the present proceedings and the alternatives open to the Council as follows: I That at the time the subdivision of the area was presented to the Planning Commission and the City Council, the subdivider offered for dedication the various streets in the area, including the subject portion, known as Doshier Avenue, which is the depth only of one lot. That the City accepted the final map, accepted all of the streets which are now open in the area and rejected the offer' of dedication as to this short extension of Doshier Avenue, shown on the map as a future street. That under the Subdivision Map Act, when such an offer of dedication for a future street is rejected, the offer remains open for all time for future acceptance by the legislative body of the city, so that at any time in the future the rejection of the offer of dedication may be rescinded and the offer accepted, at which time it would become a public street; that only the City Council may rescind that rejection and at a later date accept the offer of dedication. That the Code of Civil Procedure has been amended to provide that after an offer of dedication has remained open unaccepted and unused for 25 years, the owners of the underly- ing fee may quiet title to the land and thereby terminate the offer of dedication; thar the present offer of dedication was made in 1952 and saLd otter specitically reserves unto the subdivider and its assigns the right to use che property ottered tor dedicatLon tor all purposes, except c.he e'rect~on ot scrucr.ures, ana. that r:Lght has passed on tn r:he nTJners o.t tue lors tlankLng the saio extensLon ot DoshLer Avenue. The City Attorney continued that as an alternative the Council could continue the hearing again if it thought additional testimony would thereby be produced, or the hearing could be terminated at this time, which would preclude the introduction of additional testimony. That after terminating the hearing Council has the alternative of abandoning the offer of dedication which then removes the offer as an encumbrance upon the property, or the proceedings may be terminated without Council taking any action, which would leave the offer ,in status quo, thus permitting the City to accept it at any time in the future, with the one exception that after 25 years the abuttIng owners may bring suit to quiet title to the land. Mr. Edward G. Neuhoff, attorney for the Camden-Wilshire Company, addressed the Council, reiterating his client's opposition to the proposed vacation I at this time and again requested that the matter not be resolved at this time but to hold it in abeyance in order to allow his client sufficient time to study the area and come to a decision as to whether or not the building of a subdivision in the area would be feasible; that if the decision was mad that it would not be feasible they would immediately remove objections to said vacation. Mr. Clifford C. Burton, 1830 Highland Oaks Drive, addressed the Council, stating in part that he had been assured by the sales representative of the George Elkins Company, from whom he purchased his property, that under the terms of their dedication of the property to the Los Angeles County Flood Control District, there would be no construction at any time in the future and that that statement had been one of the deciding factors in the purchase of his home four years ago. 2. 3- 3- 59 (Doshier Avenue Continued) rw'I.~ I RECESS HEARING (Weed Abatement - Resolution No. 3102) v..'b~ ~ I HEARING (Avouris) '"' 1 ~4563 The Director of Public Works displayed a map of the area and advised that the record had been reviewed; that approximately 226 acres of the property under option to the Camden-Wilshire Company lies within the confines of Monx'ovia city' limits and approximately 115 acres lies within the city limits of Arcadia; that the City has at Doshier Avenue, extending easterly from Highland Oaks Avenue, a 44 foot storm drain and a 60 foot storm drain easement; that the Santa Anita Wash plan calls for an extension of present storm drains extending out to the proposed location of the constructed channel; that in addition to the offer of dedication for street purposes an easement was offered to and accepted by the City for storm drain purposes arid that the proceedings presently before the Council specifically recite the City's intention to retain that easement; that approximately 200 to 250 feet is the average depth of the land lying between the westerly bank of the extended wash and the easterly property line of the now developed Highland Oaks Avenue property; that while it would be difficult to sub- divide the area in question it could be done; that the construction of a road through the area may be possible but whether or not it is economically feasible can be determined only after an engineering survey; that the disposal oj sewaee would either be by gravity into possibly the City of Arcadia's systems or by pumping it back over the hill into the system owned by the City of Monrovia; that it is possible to subdivide that area on what is the west slope of the range. Councilman Camphouse then moved that the hearing be closed, which motion was seconded by Councilman Jacobi and carried unanimously. Councilman Camphouse further moved that the matter be taken under advise- ment, adding that he felt Council should take the time to consider all phases of the situation; that he felt the statement made by Mr. Burton regarding the use of the land was of material consequence; that he felt the interests of the pe.rsons signing the petition are mandatory to some degree upon Council's action and that whatever Council decides must be right.. Councilman Reibold seconded the motion and it was carried unanimouslY4 Mayor Phillips then called for a five minute recess, at which time the visiting student officials took their leave from the Council Chamber. Mayor Phi 11 ips declared the hearing open on the proposed weed and debris removal for 1959. Upon inquiring if anyone desired to speak regarding said proposal, Mr. A. J, O'Dell, owner of Lot 44 in Tract 23143, stated that he expects to build on said lot; that he has recently cleaned his lot and will continue so to do; that he is notifying the City to that effect, The City Attorney then suggested that if anyone proposes to build or clean his lot in the near future he should so notify the office of the Director of Public 'Works, who supplemented the suggestion with the information that another inspection is made at the time the contract is let for the work and if the lot is clean at that time it is not cleared and accordingly the owner is not billed. No one else desiring to be heard Councilman Reibold moved that the hearing be closed, which motion was seconded by Councilman Balser and carried unanimously. Councilman Reibold further moved that the Superintendent of Streets proceed with the work of weed abatement as outlined in Resolution No. 3102 pursuant to the Weed Abatement Act. Councilman Balser seconded the motion and it was carried unanimously. Mayor Phillips declared the hearing open on the application of Alex Avouris for a business permit to install and operate two skill games at 60 West Las Tunas Drive, known as "Alex's", and inquired if anyone wished to speak on the matter. 3. 3-3- 59 : 45t1. Councilman Jacobi further moved that the Council grant the application of Alex Avouris for a business permit to permit the installation an& operation of two skill games at 60 West Las Tunas Drive. Councilman Reibold seconded the motion, which was carried with an Aye vote of Councilmen Balser, Jacobi, Reibold and Phillips. Councilman Camphouse declined to vote. Mayor Phillips declared the hearing open on the application of Robert E. Dunne for a business permit to install and operate two skill games at l6~ East Huntington Drive, known as "Taku", and inquired if anyone wished to speak on the matter. I No one desiring to speak, Councilman Balser moved that the Hearing be closed, which motion was seconded by Councilman Reibold and carried unanimously. Councilman Balser further moved that the Council grant the application of Robert E. Dunne for a business permit to install and operate two skill games at l6~ East Huntington Drive. He added that this ordinance is for the technical purpose of vacating a portion of an existing street so that it can be realigned and extended into the forthcoming subdivision; that it fixes the time of Hearing as April 7, 1959. Motion by Councilman Jacobi, seconded by Councilman Camphouse and carried unanimously that Council accept the recommendation of the Planning Commission and permit an additional time extension of one year, subject to the conditions of the original approval to tentative map of Tract No. 18568, located north of Longden Avenue, between Santa Anita Avenue and Second Avenue, consisting of 29 lots. Mayor Phillips declared that since no action can be taken until time for I appeal elapses (March 6, 1959) the zone variance request of Fred Kovanen to permit the installation of mechanical equipment at 14l4~South Baldwin Avenue will be held over until the next Council meeting, March 17, 1959. Recommendation of the Planning Commission that MacDonald-Kruse, contractors, be given permission to establish a contractor's construction yard north of the abandoned Pacific Electric Railway right of way and east of the Santa Anita Wash for a period of six to eight months during the construction of a channel. That the entrance to the yard and a portion of the yard area is proposed to be on the right of way, with the balance of the yard area on the rear portion of the lots facing Joyce Avenue, and Zoned R-l; that the location is just across the channel from the City-owned property where the batch plant will be placed; and that the hours of operation will be 8:00 A.M. to 4:30 P.M. A general discussion ensued wherein it was stated, among other matters, that the yard is to be used in part for employee parking, some of the shops for the portable equipment, the office where the plans are kept., etc. That it will be surrounded by a high bamboo fence; that under the wording of the City's ordinance the property was unzoned while used as publiC transportation and until otherwise reclassified reverts to R-I when the transportation facility is abandoned. That the owner of the R-I land is leasing it to the contractor. Councilman Balser moved that the Council accept the recommendation of the Planning Commission and grant the request of MacDonald-Kruse, contractors, to establish a contractor's construction yard at the location stated above. Councilman Reibold seconded the motion and it was carried unanimously. Reibold moved that the Council accept the recommendation oC the I Director of Public Works and authorize the Mayor and City Clerk to execute the' Joint Bridge Improvement and Maintenance Agreement for the construction of'a bridge on Peck Road over Sawpit Wash. Motion seconded by Councilman Balser and carried unanimously. , - AGREEMENT (Joint'Bridge Iinproveinent - Peck Road) 1-<1'17 PROPOSED FOOTHILL FREEWAY ROUTE 1~71 COMMUNICATIONS After due discussion by the Council regarding the advice of the Director of Public Works that a communication had been received from the Division of Highways concerning the status of route adoption for the proposed Foothill Freeway route through the City of Arcadia, Councilman Camphouse stated that since it was the consensus of the Council that the px'eferred route was the least objectionable and that it would be benefi,cial to the persons involved to be in position to make some determination as to their properties, he would move that the City Council instruct the City Attorney to prepare the necessary resolution indicating the City's concurrence with the preferred route as shown at the February 18, 1959 public meeting in Azusa. Councilman Reibold seconded the motion and it was carried unanimously. (a) Camp Fire The City Clerk advised that she had received two communications: one Girls from the Camp Fire Girls thanking the Council for their permission to P:~... celebrate Arbor Day by planting three trees adjacent to the City Hall on (b) Traffic Friday, March 6, 1959; and the other from Mrs. M. F. Chapps, 334 Huntington Markings Drive, thanking the Council for its successful efforts in interceding Huntington with the State Highway Department to change certain traffic markings ~n Drive, Huntington Drive from Second Avenue to Fifth Avenue which were working between a hardship on the merchants in that area, and also commending the Director 2nd & 5th of PubllC Works for his successful efforts. 7'4L/.:< ARCADIA AVE. OPENING 74("!~ ASSEMBLY BILL 919 INDEXED /-i:~~~ RESOLUTION No. 3108 INI:::::XZD The City Attorney advised that a communication had been received from Burke, Williams & Sorensen, special counsel, regarding the basis upon which they would handle proceedings for the opening of Arcadia Avenue if Council desires to proceed in the matter. He suggested that Council study the letter and then discuss it at the next Council meeting. The City Attorney advised that Assembly Bill 919 has been introduced in the Legislature which would authorize the creation of a Metropolitan Fire Protection District. He explained the ramifications of this Bill, the many basic defects and the fact that it might be set for hearing at any time before the City-County Government Committee to which it has now been re fec'red. Planning Commissioner Frank Vachon inquired of the Director of Public Works if he had taken any steps with regard to the preparation of a map showing future streets. Coancilman Camphouse requested a similar to that recencly adopted at a Council meeting. staff report on an insurance program by the School District, to be discussed Councilman Camphouse suggested that the staff check to see if the persons riding horses could not be directed out the rear of the Morlan Place Riding Stables in the direction of the Wash instead of coming out on Santa Anita Avenue; he further expressed concern due to the recent facal accIdent to a rider on the Santa Anita Avenue path. City Manager Pro Tempore Cook stated that regarding the insurance program referred to by Councilman Camphouse, the staff had already conferred with the insurance group and that a report is expected in approximately two weeks. Mayor phillips acknowledged the presence of Mrs. James Johnson for the League of Women Voters. ,../' .-/ Mayor phillips moved that the communication and opinion of the City /' Attorney contained in his letter of/January 30, 1959 be submitted to the Planning Commission for the~r/'consideration.
