The Invocation was offered by Rev. Richard Martin, Associate Pastor of the Arcadia Church of Christ. Mayor Reibold led in the pledge of allegiance to the flag. PRESENT : ABSENT : Councilmen Camphouse, Jacobi, Ph~llips, Reibold Councilman Balser The minutes of the Council meeting of October 6, 1959 were not presented for approval. c / Mayor Reibo1d declared the hearing open on Annexation No. 19, South Arcadia Uninhabited (Revised). The City Clerk advised that one written protest had been received from Wolford, Johnson & Pike, Attorneys at Law, on behalf of Andrew A. and Mary panichas with respect to Lot No. 5 of Tract No. 10898, generally known as 10936 East Live Oak Avenue, Temple City; that the assessed valuation of said property is $3600.00 for the land and $2590.00 for the improvements, a total of $6190.00. Mayor Reibold asked if anyone in the audience owning property in the subject proposed annexation desired to protest or to be heard. No one responding Councilman camphouse moved that the hearing be closed; motion seconded by Councilman Jacobi and carried unanimously. The City Attorney stated that the total assessed valuation of the land and improvements within the territory heretofore designated as Annexation No. 19, South Arcadia Uninhabited (Revised) is $1,057,865.00 according to the last equalized assessment roll of the County of Los Angeles; that written protests by the owners of one half of such amount would be required in order that a majority protest be made to the proceedings. Councilman Camphouse stated that inasmuch as but one protest has been heretofore filed, and the time to file same has expired, that he moved that the following minute order be adopted: "RESOLVED, that the City Council of the City of Arcadia, does hereby find and determine that the total assessed valuation of land and improvements within Annexation No. 19, South Arcadia Uninhabited (Revised) is $1,057,865.00; that but one protest in writing was filed with the City Clerk prior to the time fixed by Resolution No. 3166, to wit: a protest on behalf of Andrew A. and Mary panichas with respect to Lot 5, Tract 10898, generally known as 10936 East Live Oak Avenue, Temple City, California, the assessed valuation of which is 1. 10-22-59 J/77S- (Hear ing Annex. 19 - Continued) ORDINANCE No. 1068 (Introduced) \~ Ii Vj ,\ I \' tV J I) INDEXL;l; ORDINANCE No. 1067 (Introduced) ~ ~ INDEXED $6190.00; that protest has not been made by the owners of one-half of the public property or by owners of one-half of the private property contained within the aforesaid Annexation No. 19, South Arcadia Uninhabited (Revised)." Councilman Phillips seconded the motion and it was carried on roll call vote as follows: AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold NOES: None ABSENT: Councilman Balser The City Attorney stated that if it be the Council's desire to proceed I with the proposed annexation, he recommended the following ordinance be introduced in order that the proceedings might be completed prior to February 1, 1960. Whereupon he presented for the first time, explained the content and read the title of Ordinance No. 1068, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE ANNEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY, DESCRIBED IN RESOLUTION NO. 3166 ADOPTED BY SAID CITY COUNCIL ON SEPTEMBER 1, 1959, AND DESIGNATED THEREIN AS 'ANNEXATION NO. 19, SOUTH ARCADIA UNINHABITED (REVISED)'." Motion by Councilman Phillips, seconded by Councilman Camphouse and carried on roll call vote as follows that the full reading of Ordinance No. 1068 be waived: AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold NOES: None ABSENT: Councilman Balser Motion by Councilman Phillips, seconded by Councilman Camphouse and carried on roll call vote as follows that Ordinance No. 1068 be introduced: AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold NOES: None ABSENT: Councilman Balser The City Attorney also presented for the first time, explained the content and read the title of Ordinance No. 1067, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING CERTAIN REAL PROPERTY WITHIN THE LIMITS OF PROPOSED 'ANNEXATION NO. 19, SOUTH ARCADIA UNINHABITED (REVISED' IN ZONES R-2, R-3, C-2, CM, CM AND D (ARCHITECTURAL OVERLAY) AND M-l." He explained that this ordinance was prepared pursuant to the preliminary determinations made by the City Council after hearings before both the Planning Commission and the City Council, and that when adopted will place on the property in the subject annexation the respective zonings I heretofore determined by the Council as appropriate to be imposed upon the property concurrent with its annexation. Motion by Councilman Jacobi, seconded by Councilman Camphouse and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1067 be waived': AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold NOES: None ABSENT: Councilman Balser Motion by Councilman Jacobi, seconded by Councilman camphouse and carried on roll call vote as follows that Ordinance No. 1067 be introduced: AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold NOES: None ABSENT: Councilman Balser 2. 10- 22- 59 RESOLUTION No. 3180 (Introduced) I ~]:\D~f,D ~I,J, HEARING (Curb Construction - Santa Anita) INDEXEb I /t\ ~] '. . \ Lf77~ The City Attorney then presented, explained the content and read the title of Resolution No. 3180, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DETERMINING AND ESTABLISHING REGULATIONS TO BE APPLICABLE TO CERTAIN REAL PROPERTY ABUTTING LIVE OAK AVENUE AND LYNROSE STREET BETWEEN TYLER AVENUE AND LENORE AVENUE UNDER ITS CLASSIFICATION IN ZONE D (ARCHITECTURAL OVERLAY) IN ADDITION TO THE BASIC CM ZONING APPLICABLE THERETO." He added that the portion of the property placed in Zone CM by Ordinance No. 1067 will be placed also in Zone D, and the adoption of Resolution No. 3180 will place the architectural restrictions to be applicable to the property in Zone D; that the introduction of said resolution at this meeting makes it a matter of record the same as the proposed zoning and he suggested that Resolution No. 3180 be adopted concurrent with the adoption of Ordinance No. 1067. The City Clerk advised that she had in her possession the Affidavit of Posting and that no written protests had been received. No one in the audience the hearing be closed. carried unanimously. desiring to be heard Councilman Jacobi moved that Motion seconded by Councilman Camphouse and The City Attorney advised that under an abbreviated version of the 1911 Act, if more than 50% of an area within a given block on one side of the street has been improved with curbs, gutters and/or sidewalks, the City Engineer may order the owners of property on the remainder of the block to likewise improve their property; that Council at a previous meeting had instructed the City Engineer to so proceed; that proceedings have been conducted up to the point that the property has been posted and notices sent out and this was the time fixed for any person to be heard that might object to the proceedings or the work proposed to be done. Whereupon Councilman Jacobi moved that the Director of Public Works and the City Engineer be instructed to proceed with the curb construction work on the west side of Santa Anita Avenue between Huntington Drive and Morlan Place upon the expiration of time within which the owners may do the work themselves; that if the work be done by the City the cost of same shall be declared a lien upon the property and collected in accordance with the provisions of the Improvement Act of 1911. The number and location of the signs shown on the exhibits introduced by applicant at the hearing before the Council is hereby approved, and no further signs shall be "permitted on subject property or any property used or developed in conjunction with subject property without the further approval of the City Council." Because of the high rate of speed of traffic on Foothill Boulevard, and the fact that previous requests to the State Division of Highways to post lesser speed limits on said boulevard have been ignored and also the fact that previous discussions and contacts with the State Division of Highways have led the Council to believe that signals would be installed at the intersection of Baldwin Avenue and Foothill Boulevard, it was the consensus of the Council that the above resolution should be sent to the State Highway Department both locally and in Sacramento, to each member of the California Highway Commission, to the State Assemblymen from this district and to the State Senator from this district. Councilman Phillips moved that the reading of the full body of Resolution No. 3177 be waived. The City Attorney presented, discussed the content and read the title of Resolution No. 3178, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REQUESTING MODIFICATION OF SOCIAL SECURITY AGREEMENT." The City Attorney added that this will permit those employees of the City of Arcadia who previously elected not to join Social Security to do so at this time. Remove all buildings within the tract. Remove or relocate the garage on Lot 9 to provide required clearance from the lot line. 4. Provide all necessary rear line utility easements. 5. Install all street improvements, including adequate drainage facilities, required by the Subdivision Ordinance. 6. Jllf I TRACT No. 17746 (Final) ~ {~~ J) !.t\DExW . , TRACT No. 25253 ~ f~-J ~~ ~ l.tlDEXED ZONE VARIANCES (Doughman & Adcock) ;) Motion by Councilman Jacobi, seconded by Councilman Phillips and carried unanimously that Council accept the recommendation of the Planning Commission and approve Final Map of Tract No. 17746-, located on Magna Vista Avenue, west of Second Avenue, consisting of 7 lots, subject to conditions as outlined in communication of October 15, 1959 from the Planning Secretary. Upon being advised by the Director of Public Works that all requirements have been complied with, Councilman Camphouse moved that the improvements of Tract No. 17746 be accepted for maintenance by the City and the bond posted by the subdivider be released. Councilman Phillips seconded the motion and it was carried unanimously. I Located on the extension of Fairview Avenue, westerly from Park Avenue, consisting of 8 lots, and recommended by the Planning Commission for denial without prejudice because of the length of the cu1 de sac. In the general discussion that ensued Mr. Fred Erickson, 435 West Walnut Avenue, Arcadia, (the subdivider) addressed the Council, stating in part that he had in various discussions with the Planning Commission adviseQ them that two of the owners of property on the south side of Fairview Avenue protested making the angle in the street at the east line of the tract and also that the City had erred in permitting the construction of a dwelling upon a portion of a lot which had been split off from the remainder and which would have been sufficient to provide a westerly extension of Fairview Avenue to Holly Avenue. It was the feeling of Councilmen Camphouse and Phillips that as the proposed subdivision as presented is incompatible with good planning, that further study should be given the matter in an attempt to work out a solution; that possibly a street opening either to Holly Avenue or Duarte Road should be considered, as the cuI de sac now present in the map being 1135 feet long is not in accordance with the subdivision ordinance which allows only 500 feet. Whereupon Councilman Phillips moved that Council accept the recommendation of the Planning Commission and deny without prejudice the tentative map of Tract No. 25253, and also that Council recommend that the Staff and the City Attorney work with the Subdivision Committee in an attempt to resolve this situation, possibly with an outlet either to Holly Avenue or Duarte Road. Councilman Camphouse seconded the motion and it was carried on roll call vote as follows: AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold NOES: None ABSENT: Councilman Balser The City Attorney commented that the Arcadia Avenue opening, near Baldwin Avenue and Duarte Road, was started by the Council on its own motion; I that an area such as this and others similar to it may be areas where the Council could participate to the extent of conducting related p~oceedings, assessing the cost back against the entire area in accordance with the benefits received, and suggested that this also might be studied by the Staff. Councilman camphouse agreed, adding that street openings would probably alleviate traffic congestion, as this had been done in Pasadena and had greatly helped the traffic problem there. Mayor Reibo1d declared that since no action can be taken until time for appeal elapses (October 23, 1959), the zone variance requests of James L. and Jean P. Doughman to allow the erection of a duplex at 9912-9914 East Camino Real (Planning Commission Resolution No. 347), and of Albert and Jane Adcock to allow the erection of an additional dw~lling on the rear of the lot at 1503 South Fourth Avenue (Planning Commission Resolution No. 348) will be held over until the appeal period has passed and that said matters be placed on the November 3, 1959 agenda. 8. 10-22-59 , " TURF CLUB (Exit Gate) IH::J;:X4D I SANTA ANITA BOWL (Request to Serve Beer) m!X3:mrr '[) o '0 \ :"r ., I BID AWARD (Improvement Colorado Boulevard - Warren Southwestr , ' I~'\ \~~ ~lmEXED . . \ 4L7~.:u Motion by Councilman Camphouse, seconded by Councilman Jacobi .and carried unanimously that Council accept the recommendation of the Staff and approve the request of the Los Angeles Turf Club to relocate exit gate #2 to a point fartheT east of Baldwin Avenue on Huntington Drive upon the conditions as outlined by the City Manager Pro Tempore. The City Clerk read a communication from the law firm of Faith, Weiss and Holland, requesting that their client, the Santa Anita Bowl, be permitted to serve beer on the bowling lanes. Mr. Frank J. Weiss, the attorney representing the bowl, addressed the Council, stating in part that permission to serve beer on the bowling lanes would draw more bowling teams to this alley, as they have been. losing business due to. their inability to so do, and also that thit' is, the only bowling alley in the State of California where a bowler cannot order beer. Mayor Reibo1d felt that Council is out of its element when it attempts to get into the Alcoholic Beverage Control Act as it concerns business, and that so long as it is a law of the land it is not right that Council should disregard it no matter how the individual councilmen feel. Councilman camphouse stated that he agreed with Mayor Reibold in his statement, but that he also felt that it is not Council's prerogative to determine whether the amount of money a business is making is not enough or too much. He added that the request to serve beer only on the bowling alleys was, so to speak, "a foot in the door" proposition and would be letting the residents of the area down for the reason that had this been known at the time the zone variance was originally requested stro~ger protests might have been made by such residents. He stated further that he felt he had expressed the policyc of the City Council in opposing a resolution as tendered by the Resolutions Committee to appoint a joint Federal, State and Local Committee "....to consider and recommend how Federal expenditures can be reduced and the revenue thus derived can be made available to local governments...."; that he had opposed the resolution as drawn because the Arcadia Council had frequently expressed itself as being in opposition to higher levels of government levying taxes for redistribution to lower levels of government for the reasons that it is frequently more expensive, the redistribution is not always fair, and the money frequently comes back with undesirable strings attached. That he was supported by Roger Arnebergh, City Attorney of Los Angeles, whose motion was adopted to amend the resolution to read substantially that ".... consideration be given to the formation of a joint Federal, State and'Loca1 Committee whose duty it shall be to consider and recommend how Federal expenditures can be reduced so that additional revenues will be available to local governments to enable them to more adequately perform their obligations and meet their responsibilities. " Councilman Camphouse tendered for the record a communication written to him, dated October 13, 1959, from Mr. and Mrs. George D. Milligan, 701 Anoakia Lane, calling his attention to a statement purportedly made by him, which appeared in the press, regarding the area around the Anoakia School which had been misconstrued; adding that he desired to clarify his statement, which was that there was fire and police protection all around that particular area and that the chief benefit to be derived by that area in being annexed to Arcadia would be that they too would receive such benefits.
