REGULAR MEETING
DECEMBER 15, 1959
The City Council of the City of Arcadia, California, met in regular
session in the Council Chamber of the City Hall at 8:00 o'clock P.M.,
December 15, 1959.
The Invocation was offered by the Rev. Robert Gi+more, Assistant Pastor
of the Arcadia Friends Church.
Mayor Reibold led in the pledge of allegiance to the flag.

Mayor Reibold introduced to the audience the new City Manager,
Mr. Harold K. Schone.
Motion by Councilman Jacobi, seconded by Councilman Phillips and carried
unanimously that the minutes of the Regular Meeting of December 1, 1959,
as submitted in writing be approved.
Motion by Councilman'Phillips, seconded by Councilman Jacobi and carried
unanimously that the City Engineer be ordered to prepare a report pursuant
to Section 17660 of the Streets and Highways Co4e and a map of plat pursuant
to Section 18661 of the Streets and Highways Code concerning the proposed
lNDE~ighting Maintenance District No. 14.

IIEARING Mayor Reibold declared the hearing open on Planning Commission Resolution
(Seidner) No. 349, recommending granting of application of Saul G. Seidner and Nettie
Seidner for the reclassification from Zone R-l to Zone C-2 and Zone D of
certain property located at 2728 South Baldwin Avenue.

There being no written communications received regarding the matter,
Mayor Reibold inquired if anyone desired to address the Council either
in favor of or in opposition to the requested reclassification.

Councilman Phillips commented that he would have approved this particular
parcel had it been included in the application of Bernard Berk and Ralph
D. Stogsdill for a change of zone on property near the southeast corner of
Las Tunas Drive and Baldwin Avenue approved by the Council on September 15,
1959. He thereupon moved that Council accept the recommendation of the
Planning Commission as stated in its Resolution No, 349, and grant
approval to Saul G. Seidner and Nettie Seidner for the reclassification
from Zone R-l to Zone C-2 and D of their property located at 2728 South
Baldwin Avenue. Councilman Jacobi seconded the motion.
A general discussion ensued, and it was Councilman Balser's opinion that
to rezone this particular corner C-2 would not be in the best interests
of the City, inasmuch as it would remove the buffer zone there at this
time; that although the property adjacent on the east and across Workman
Avenue to the south is still zoned R-l, the reclassification of the subject

property would probably result in many similar requests for commercial
zoning there.
Councilman Camphouse stated in part that with reference to Councilman
Phillip's comment, that the development proposed to be constructed in
the area contained in the Berk-Stogsdill application was conceived to
include the lot under consideration at this time, in which event it
would have had the same restrictions imposed upon it; that in this
particular instance he did not feel the requested rezoning would be
compatible to such development. Councilman Phillips commented that there
is no reason to believe that the lot in question might not be developed
with the aforementioned Berk-Stogsdill development.

In answer to Mayor Reibold's comment that Section 4 of Planning Commission
Resolution No. 349 recommended certain architectural restrictions,
Councilman Balser stated that he was referring to restrictions such as
were imposed in the,West Arcadia rezoning matter, which included planting,
walls, certain setbacks, etc.; that under the present restrictions a
service station or something similar might be constructed on the corner in
question. And with reference to Mayor Reibold's statement that there were
no protests either oral or written in this matter, Councilman Camphouse
was of the opinion that regardless of whether or not protests are received,
it is still incumbent upon the Council to determine whether proper
restrictions have been imposed.
Mayor Reibold 'then called for a roll call vote on Councilman Phillip's
motion, which was carried as follows:

Mayor Reibold declared the hearing open on Planning Commission Resolution
No. 354 recommending the reestablishment in Zone R-l and the reclassification
to Zones R-3, PR-3, C-2 and C-3 of certain property in the southerly
portion of' Annexation No. l7-A presently zoned R-l by reason of its
annexation to Arcadia, and 'in compliance with his request the Director of
Public Works displayed a map depicting in different colors the area to be
considered for rezoning.
Mayor Reibold then inquired if anyone in the audience desired to speak in
opposition to the proposed reclassification and the following persons
addressed the Council:
Mr. E. L. Benson stated in substance that the Union Oil Company owned the
northwest corner of Las Tunas Drive and Baldwin Avenue, which included
Lots 11 and 12; that on the southerly part of the lot a service station
has operated for approximately ten years; that the portion being opposed
is the north 60 feet which, Mr. Benson requested be zoned C-2 in
conjunction with the 120 feet adjacent to the service station; that I
immediately to the north there are two individual residences, a multiple
unit and a church; that in his opinion the use of the north 60 feet could
be better utilized by C-2 zoning, which they proposed to use to expand the
present service station to include the sale of tires and the like, and also
for additional parking. He also mentioned that this request was not made
in the hearings before the Planning Commission.
Councilman Balser commented that this again brings up the question of a
business building adjacent to residential property.
Planning Commissioner Stout, who was present at the Council table,
remarked that the matter of zoning commercial on Baldwin Avenue has been
a matter of concern to the Planning Commission; that several hearings had
been held on the matter of parking but that the Planning Commission has
had no opportunity of discussing the matter of additional commercial
zoning on Baldwin Avenue with the property owners and that he suggested

that the matter be referred to the Planning Commission for addit,ional study.
He added, in answer to Mayor Reibold's question, that the two parcels in
question could be handled separately in the event the Council desired to
act that evening upon the reclassification under consideration at this
hearing.
Mrs. Blanche B. Taylor, 9941 Val Avenue, spoke regarding the northwest
corner of Baldwin and Val Avenues, stating in part that she was in'favor
of Baldwin Avenue being zoned R-3 between Garibaldi and Lemon Avenues,
which, in her opinion, would tend to standardize"'the, deve,lopment 01. llaldwin
Avenue.
To Mayor Reibold's inquiry as to whether anyone in the audience desired to
address the Council in favor of the proposed reclassification,
Mr. Thaddeus J. Peters, 6059 South Baldwin Avenue stated in substance that
he was in favor of Baldwin Avenue, between Garibaldi and Las Tunas Drive
being restored to R-3 zoning, as recommended by the Planning Commission;
that he had purchased property in that area because it was zoned R-3
prior to its annexation to Arcadia and that R-l zoning would result in an
economic loss to him. He handed the City Clerk communications from the
following persons favoring the Planning Commission's recommendation
regarding the rezoning of Baldwin Avenue between Garibaldi and Las Tunas
Drive to R-3:

Mrs. H. J. Pratt, 2440 Baldwin Ave.
Mrs. John M. Phillips, Sr., 9977 E. Woodruff Ave.
Mrs. Blanche B. Taylor again addressed the Council, stating in part that
in her opinion those favoring R-I zone on Baldwin Avenue did not live on
Baldwin Avenue but lived on side streets,off of Baldwin Avenue, and that
no one living on Baldwin Avenue desired R-I.
Mr. David B. Voors, 9921 E. Val Avenue stated in substance that he
favored the recommendation of the Planning Commission; that he had
purchased property in an R-I zone and would like it to remain in such
zone as it affects Val Avenue.
No one else desiring to be heard Councilman camphouse moved that the
hearing be closed. Councilman Balser seconded the motion and it was
carried unanimously.
With the exception of Councilman Camphouse, it was the consensus of the
Council that the recommendations of the Planning Commission as contained
in its Resolution No. 354 were well taken. Councilman camphouse, however,
felt that preferential treatment was being accorded the property at the
southwest corner of Baldwin Avenue and Las Tunas Drive in that the zoning
on this property was not the same as it had been prior to its annexation
to Arcadia; that should this property owner desire different zoning he
could through due process request a zone variance.
Councilman Camphouse then moved that Council accept the recommendation of
the Planning Commission as contained in its Resolution No. 354 for the
reestablishment in Zone R-l and the reclassification to Zones R-3, PR-3,
C-2 and C-3 of certain property in the southerly portion of Annexation
No. l7-A, Southwest Arcadia Inhabited presently zoned R-l by reason of
its annexation to Arcadia, with the exception of the southwest corner of
Las Tunas Drive and Baldwin Avenue, of which the southerly 100 feet of the
property facing Baldwin Avenue should remain in a parking zone. Council-
man Jacobi seconded the motion.
A general discussion then ensued wherein the question of C-2 zoning under
the Los Angeles County zoning laws and C-3 zoning under the City of
Arcadia were clarified. Whereupon Councilman camphouse, upon receiving
permission from Councilman Jacobi as to his second, amended his motion to

Upon Council's approval of the report presented and explained by the City
Engineer on the proposed formation of Lighting Maintenance District No. 14

MAINTENANCE DISTRICT, WHICH DISTRICT IS TO PAY THE COST AND EXPENSES FOR
THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF
SOUTHVIEW ROAD, MAGNA VISTA AVENUE, SANTA ANITA TERRACE, LE ROY AVENUE,
LOUISE AVENUE, THIRD AVENUE, ALSTER AVENUE, WISTARIA AVENUE, DANIMERE
AVENUE, LAS FLORES AVENUE, LOGANRITA AVENUE, STANDISH STREET AND ROLYN

The City Attorney presented for the record only Resolution No. 3206,
entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DETERMINING AND ESTABLISHING REGULATIONS TO BE APPLICABLE
TO CERTAIN REAL PROPERTY BOUNDED BY DUARTE ROAD, LOVELL AVENUE, CAMINO
REAL AND BALDWIN AVENUE UNDER ITS CLASSIFICATION IN ZONE D (ARCHITECTURAL
OVERLAY) IN ADDITION TO THE BASIC C-3 ZONING APPLICABLE THERETO."
Councilman Phillips moved that Resolution No. 3206 be held pending
adoption of Ordinance No. 1071. Councilman Camphouse seconded the motion
and it was carried unanimously.
The City Attorney presented, explained the content and read the title of
Resolution No. 3204, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, GRANTING A VARIANCE FOR PUBLIC PARKING AND DRIVEWAY ON
PROPERTY LOCATED AT 639 NAOMI AVENUE IN SAID CITY."

The City Attorney added that this resolution recites the filing of
application by the Professional Square, Inc., the holding of hearings and
adoption of a resolution by the Planning Commission recommending denial of
the requested variance; that although numerous protests were filed by
owners of property in the vicinity against the granting of the requested
variance, proceedings for the reclassification of the subject property
as well as protestants' property to Zone C-3, which would permit the use
requested by this variance on all property in the area, have since been
culminated; that in view of the pending reclassification of the subject
property and other adjacent properties to Zone C-3, the requested variance
will not be detrimental to the other properties in the area, the property
in question being needed as access to the commercial area. That for the
foregoing reasons the 'variance is hereby granted to permit the use of the
above described property for public parking and for access to Naomi Avenue
to and from commercial properties adjacent to the subject property, upon
condition that the southerly twelve feet thereof be offered for dedication
for the widening of Naomi Avenue and that the existing parkway as well as
the southerly twelve feet be planted in accordance with the requirements
of the City Engineer.
Mr. Edward Stout, Planning Commissioner, commented that he did not recall
the Planning Commission approving this procedure and called to the attention
of the City Council the fact that the rezoning of the Naomi Avenue area
is on a two-year basis; that there had been several violations of law in
connection with the requested zone variance and that he would recommend
that Council give the matter further consideration before approving it.
Mayor Reibold explained that this matter was presented to Council, had been
appealed and subsequently placed on the Pending Agenda; that it was an
open matter for Council decision at any time after it had been submitted
to them by Planning Commission.

The City Attorney presented, explained the content and read the title of
Resolution No. 3194, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 3 OF RESOLUTION NO. 3142
OF SAID, CITY."
The City Attorney added that this resolution puts into effect Council's
authorization, given December 1, 1959, to increase by 5%, effective
January'l, 1960, the salaries of the uniformed members of the Police and
Fire Departments.
Councilman camphouse commented that contrary to certain reports, Council
had not reluctantly authorized the above increase. That their hesitancy
had been based on whether to hold this matter as well as the matter of an
increase in salary to other departments of the City pending review by the
new City Manager.. Mayor Reibold and Councilman Phillips agreed with
Councilman Camphouse's statement.

Mr. James L. Horsley, 411 West Norman Avenue addressed the Council,
\ requesting an explanation as to why Council had moved earlier that evening
to hold Resolution No. 3206 pending the adoption of Ordinance No. 1071;
, whether this was done because Council is not fully aware at this time as

covering the design phase plans for the Santa Anita Reservoir. He
added that the contract between the City and said James M. Montgomery
provides 'for payment of 80% of their fee at the time Council accepts the
plans for said reservoir; that the fee is based upon construction costs,
i "which cannot be determined until the bids are received (January 4, 1960),

With reference to police officers who are employed to direct traffic
during the racing season, Councilman Jacobi commented that it would be
his suggestion that the City Manager discuss with the Police Chief the
discontinuance of the habit in the past of some police officers giving
the appearance of a disregard for traffic flow by standing in groups at
intersections.
To Councilman Phillips I inquiry as to when the new "RA" stickers could
be expected, Mayor Reibold replied that he had been assured that they
will be ready very shortly.
Mayor Reibold presented and read in its entirety Resolution No. 3207, I
entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, SUPPORTING THE GREATER LOS ANGELES SAFETY COUNCIL I S PROGRAM."
This resolution stated in substance that the City of Arcadia fully supports
the program of said Safety Council in their request that all organizations
eliminate the serving of alcoholic beverages at traditional office
Christmas parties as a practical attempt to eliminate a definite source
of death and destruction on the highway.
Mayor Reibold then moved that Resolution No. 3207 be adopted. Councilman
Balser seconded the motion and it was carried on roll call vote as
follows:

Councilman Camphouse stated that the City owes a debt of gratitude to
Mr. Charles E. Lortz for the admirable job he has done in taking over
the reins of management of the City during the interim when the City was
seeking the services of a permanent City Manager; and the rest of the
Council joined in this commendation.
Mayor Reibold added that the Council had received that day a letter from
Mr. Harold K. Schone, the new City Manager, informing the Council that he
had that day reappointed Mr. Charles E. Lortz to his former position
of Director of Public Works, effective December 15, 1959.
Mayor Reibold ordered the meeting adjourned at 9:45 P.M.
