HomeMy WebLinkAboutAUGUST 27,1957 I I ~ , 39~l6 :.: I~ ; l ,r MINUTES CITY COUNCIL OF THE CITY OF ARCADIA ADJOURNED REGULAR MEETING AUGUST 27, 1957 Pursuant to the order of adjournment of the regular meeting of the City Council of August 20, 1957, the City Council of the City of Arcadia met in regular adjourned session in the Council Chamber of the City Hall at 7:30 p.m., August 27, 1957. ROLL CALL PRESENT: Councilmen Jacobi, Phillips, Reibold, and Dennis ABSENT: Councilman Camphouse ORDINANCE No. 992 INDEXED, The City Attorney presented for the second time, dis- cussed, and read the title of Ordinance No. 992, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FIXING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAXATION FOR THE FISCAL YEAR BEGINNING JULY 1, 1957". Motion was made by Councilman Phillips that the reading of the full body of Ordinance No. 992 be waived. Said motion was seconded by Councilman Reibo1d and carried on roll call vote as follows: AYES: Councilmen Jacobi, Phillips, Reibo1d and Dennis NOES: None ABSENT: Councilman Camphouse Motion was made by Councilman Phillips that Ordinance No. 992 be adopted. Said motion was seconded by Councilman Jacobi and carried on roll call vote as follows: AYES: Councilmen Jacobi, Phillips, Reibold and Dennis NOES: None ABSENT: Councilman Camphouse ORDINANCE No. 993 INDEXED The City Attorney presented for the second time, dis- cussed, and read the title of Ordinance No. 993, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FIXING THE RATES OF TAXES AND LEVYING TAXES FOR THE FISCAL YEAR BEGINNING JULY 1, 1957". Motion was made by Councilman Reibo1d that the reading of the full body of Ordinance No. 993 be waived. Said motion was seconded by Councilman Jacobi and carried on roll call vote as follows: AYES: Councilmen Jacobi, Phillips, Reibo1d and Dennis NOES: None ABSENT: Councilman Camphouse 1. 8-':;,~7-57 3"""" t.. ;::]11.: i BAN ON INCINERATOR BURNING INDEXEI5 (VSP BEAUTIFICATION PROGRAM INDEXED' N~P the City Attorney reported that a bulletin had been sent by the Los Angeles County Air Pollution Control District advising that commencing October 1, 1957, the ban on incinerator burning would be enforced in the cities as well as in unincorporated areas; that it was not neces- sary for the cities to pass ordinances creating such a ban; and they requested the cooperation of the cities in enforcing the Air Pollution Control District ban. the City Attorney suggested that the Council might desire to table indefinitely the adoption of the city burning ban contained in Ordinance No. 996 inasmuch as the previous minutes indicated that it was merely to be held indefinitely. He stated that although he personally questioned the validity and enforcibility of the county-wide incinerator ban, adopted by the Air POlluti,on Control Distric,t" particularly as it applied to incorporated territory, he felt that it should be made quite plain to the public that the Air Pollution Control District has announced its intention to enforce it and that the citizens should be prepared to defend themselves if they did not comply with it, as it would not be the function of the City Attorney to defend persons against complaints alleging violation of the . Air Pollution Control District ban, and they should not rely on his personal opinion concerning the enforcibi1ity of the ban within the city. That in any event no appreciable amount of burning can be lawfully done by reason of the basic regulation admittedly applicable throughout the county, which basic regulation prohibits, the emission of air pollutants from any source for a period in excess of three minutes. I Mayor Dennis wondered whether passing a City ordinance banning incinerator burning would not be more effective. The City Manager felt that County enforcement of the ban would be better than City because of the many neighborhood squabbles that would be involved in many of the complaints. , ' Motion was made by Councilman Reibold that proposed Ordinance No. 996 (banning incinerator burning) be tabled indefinitely. Said motion was seconded by Councilman Jacobi and carried unanimously. The City Engineer reported that the Beautification Committee had completed its work and made a report to the Council at a previous meeting. He presented a drawing that the Committee developed with the 1and- 'scape architect for the treatment of the center islands and intersections on Huntington Drive, showing the development of the center lane with grass,arid trees, and of the islands created by the turning lanes at intersections by planter boxes with pebbled surface for walkways. I The City Attorney advised that he would have the landscaping contract ready by Friday so that it could be authorized at the next regular meeting, if the Council so desired. Motion was made by Councilman Phillips that the City Council approve in principle the alignment for the beautification of Huntington Drive as presented by the City Engineer and a~thorize further,development under a contract with the landscaping architect. Said motion was seconded by Councilman Jacobi and carried unanimously. 2. 8-27-57, I I LEAGUE OF CALIFORNIA CITIES INDE.1:ED COMMITTEE OF MAYORS I1lDEXEDJl/SP MINUTES ADJOURNMENT . . ,::;'9 J8 The City Manager reported that the League of California Cities will hold its convention in San Francisco on September 22 to 25, 1957. He recommended that the Council approve attendance at the convention of the Council members, the participating department heads, the Planning Secretary, the City Attorney, the Assistant to the City Attorney, and members of the Boards and Commission to the extent provided in their respective budgets. Motion was made by Councilman Reibo1d that the Council members, the participating department heads, the Planning Secretary, the City Attorney, the assistant to the City Attorney, and members of the Boards and Com- missions be granted permission to attend the League of California Cities Convention in San Francisco on September 22, to 25, 1957, at city expense to the extent provided in their respective budgets; the expenses to be substantiated by itemized expense account upon return and approved by the City Manager and City Controller. Said motion was seconded by Councilman Jacobi and carried on roll call vote as follows: AYES: Councilmen Jacobi, Phillips, Reibold, and Dennis NOES: None ABSENT: Councilman Camphouse Mayo~ Dennis reported that he had received a communica- tion from the Committee of Mayors as to memberShip dues. He passed the communication around to the Council members. Motion was made by Councilman Reibo1d that the minutes of the regular meeting of August 20, 1957, be approved.
