November 19, 1957. INVOCATION AND The invocation was offered by Mayor Dennis, who also led in PLEDGE the pledge of allegiance to the flag. ROLL CALL MINUTES HEARING (Sheahan) g~J~ PRESENT: Councilmen Camphouse, Jacobi, Phillips, Reibold and Dennis Motion was made by Councilman Reibold that the minutes of the regular meeting of November 5, 1957 be approved as submitted in \.riting. Said motion was seconded by Councilman Jacobi and carried unanimously. Appeal from Planning Commission recommendation for denial of request of Robert B. and Mary V. Sheahan for a yard modification to permit the erection of a second dwelling at 1200 South Santa Anita Avenue. Mayor Dennis declared the hearing open. Mr. Robert B. Sheahan, the applicant, protested the recom- mendation for denial and exhibited a diagram of the proposed development and read from a prepared statement which was filed with the City Clerk. Mr. Sheahan appealed to Council to allow the 10 foot setback from the 260.92 line in keeping with the requirement at the time the Planning Commission's decision was made and to conform with the pattern established by his neighbors to the south. Reference was made to Ordinance No. 990 which requires a 25 foot setback; however, Mr. Sheahan felt that his application should be approved inasmuch as this Ordinance was not effective at the time he made his request. Mr. Alfred Allen, subdivider, representing property owners to the south of 1200 South Santa Anita Avenue, addressed Council stating in substance that it would be beneficial to all con- cerned if a policy were established as to whether or not Council would grant any lot splits prior to the time Louise Avenue was actually cut through and if 130 foot depth would be acceptable as a uniform measure. Mayor Dennis advised Mr. Allen that certain requirements are set up by the Planning Commission with which Council concurs. Councilman Phillips moved that the Hearing be closed. Upon questioning by Mayor Dennis, the City Attorney stated that where a person has undergone expense to undertake a development which is legal at the time, then the amendment of the ordinance does not preclude him from finishing that which he has planned and incurred expense so to do; however, 1. 11-19-57 4.026 if he merely has ideas which do not become accomplished before the ordinance is amended, the fact that he merely filed an application for a permit just before the deadline does not of itself give him the right to proceed. Mr. Sheahan expressed willingness to make application for a lot split, which in the opinion of the City Attorney, would determine proximity to a future homesite. Councilman Phillips moved that the recommendation of the Planning Commission be accepted and that Council deny the request of Robert B. and Mary V. Sheahan to build a new house, the rear line of the house to be 250.92 feet east of Santa Anita Avenue, but that the request be modified and granted on the condition that the back line of the rear house be located 243.97 feet east of Santa Anita Avenue consistent with the property at 1212 South Santa Anita Avenue. I Motion was seconded by Councilman Jacobi and carried on roll call vote as follows: AYES: Councilmen Jacobi, Phillips, Reibo1d and Dennis NOES: Councilman Camphouse ABSENT: None HEARING (Seimer) fU'N Appeal from Planning Commission recommendation for denial of the request of Mr. and Mrs. William H. Seimer for permission to erect two new dwellings on the front of their property at 1208 South Sixth Avenue. Mayor Dennis declared the hearing open. The City Clerk read a petition signed by 17 property owners protesting the erection of the dwellings and a communication received from the applicants. The following persons addressed Council: Mr. Harry Baylis, 1200 South Sixth Avenue, W. H. McCauley, 1136 South Sixth Avenue, Mrs. Genevieve Dexter, 1205 South Sixth Avenue, Mr. Jack Samson, Jr., 1127 South Sixth Avenue, Mr. Ralph W. Mildrum, 1212 South Sixth Avenue; all protested proposed development of additional rental property in the neighborhood. Mr. Seimer, the applicant, stated that they had decided to build additional rental property due to the fact that they must relinquish their poultry business by the end of 1960 and that it was their feeling that this would help defray financial losses; that the protestants knew existing conditions when they moved in next to a poultry ranch. Mrs. Seimer stated that she was sorry she had brought up the matter of having the garages detached as she was under the impression that a permit would have been issued at that time. I The City Attorney explained that the erection of two additional dwellings had to be approved by the Modification Committee in any case, and that when that approval was appealed by the Planning Commission, it stayed the issuance of the permit and the matter then had been finally decided. Councilman Camphouse then moved that the hearing be closed and Councilman Jacobi seconded the motion which was carried unanimously. 2. 11-19-57 I I 4027 Councilman Camphouse further stated that when Council adopted Ordinance No. 990 it had in mind clarification of just such cases as this - that of additional houses being built on R-l lots. Councilman Phillips stated that to build three houses on a lot this size might be all right if they were equally spaced the length of the lot but to cram two houses at the front building line on a 90-foot lot in effect made two 45-foot lots which certainly was neither desirable nor compatible with the rest of the neighborhood. 'Councilman Camphouse moved that the appeal from the decision of the Planning Commission be sustained; that the recom- mendation of the, Planning Commission for approval of this request to build two additional dwellings at 1208 South Sixth Avenue be disapproved and that permission to build two additional dwellings at said address as proposed was denied. Councilman Reibold seconded the motion and it was carried on roll call vote as follows: AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold and Dennis NOES: None ABSENT: None HEARING (Senior) ~~bi Planning Commission recommendation, as contained in their Reso- lution No. 267, that the applicant, Reuben V. Senior, be granted a zone variance to allow the property at 108 West Las Tunas Drive to be used for the construction and maintenance of a pet hospital. Mayor Dennis declared the hearing open. The City Clerk read communications from the following persons: Two letters of protest signed by Mr. and Mrs. Frank L. Dolan, 8556 Skyway, Paradise, California and Douglas C. Huntington, 1814 Watson Drive, Arcadia. The following letters in favor of the zone variance: L. A. Zima, 132 West Las Tunas Drive, Mrs. Marian Spaulding, 175 West Live Oak, Fred E. Woolf, 103 West Las Tunas Drive, John Godfrey, 111 West Las Tunas Drive, George J. Sullivan, 119 Las Tunas Drive, F. M. Strose, 127 West Las Tunas Drive, Mr. and Mrs. Howard W. Reese, 114 West Las Tunas Drive, Alton W. Hall, 102 West Las Tunas Drive, Mr. and Mrs. Emanuel H. Malter, 117 Woodruff Ave., B. F. Brabee, 14922 East Ramona, Baldwin Park, Joe Bustelloc, 729 East Grand Avenue and Mr. and Mrs. Joseph Kaufman, 50 West Woodruff Avenue. Mr. John E. Orsi, 240 Woodruff Avenue, stated that he represented homeowners in the area and that he was not speaking in opposition to the pet hospital as such, or its construction or the business methods; but that he was opposed to spot zoning and would favor an ordinance which would clearly define zones per se. He was appearing in the interest of good zoning. Attorney J. Patrick Conroy, representing the applicant, advised Council that the property in question was in escrow subject to the requested variance being granted; that the builders and operators of the proposed pet hospital intended to build a dual purpose professional building, air condition- ed and sound proof. He then introduced Mr. Minsky, one of the owners to be, who exhibited a colored drawing of the proposed building, explaining its function. Mr. David Keast, 3. 11-19-57 4028 acoustical engineer, spoke at length on the sound control advantages of the proposed building. Mr. Keast made refer- ence to 'sound control' in place of 'sound proof'. Council- man Reibold questioned Mr. Keast at length in an effort to determine the effectiveness of the sound control operation. Councilman Reibold moved that the hearing be closed. Councilman Phillips seconded the motion and it was unanimously carried. Councilman Reibold then stated that he feels very deeply on the subject of zone variances; that he believes the value of property in Arcadia is determined by what someone is willing to pay for it and that the amount a person is willing to pay for a piece of property to a large extent is determined by the sacredness and integrity of our zoning ordinance; that he believes if Council continues to grant variances as it has in the past few months it will material- ly affect all the values in the city; that t~e zoning ordinance is very specific: It states that in the case of a variance certain conditions must be met, namely, that there is exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use that do not, generally apply; that there will be no material detrimental affect upon the public health or welfare; that such variance is necessary for the preservation and enjoyment of a substantial property right of an applicant possessed by other property in the same zone or vicinity and that it will not affect the comprehensive plan. He contended that the findings of the Planning Commission did not sustain those conditions. In section 3 it contends that this variance should be granted because of the essential deterioration of the property brought about by the granting of variances to other property and indicates that it is a significant quality, that actually the amount of the Triangle that is now under variance is in round figures one tenth of the total area. In section 4, where you have to sustain the point that there will be no injury to property improvements, it maintains that the granting of this variance would not affect the other property in the area, Councilman Reibold further stated that he is personally against the granting of a variance and that he would recommend that this be referred back to the Planning Commission and they be asked to consider that the use of a small pet hospital, which should include the clinic, as a special use and be handled as individual items. He also stated that personally he did not believe the proposed structure would be detrimental to the area but that in all sincerity he believes that to continue to grant variances will go beyond the Triangle and that he is opposed to the variance. General discussion then ensued between the Councilmen. Mayor Dennis asked Councilman Reibold if he would vote in favor of granting the variance if it was in another classification and Councilman Reibold stated that he would if it was in accordance with the specifications contained in the ordinance under a special use permit, and if there was a relatively rigid application of the sound part. Mayor Dennis stated that this would result in quite a delay. 4. 11-19-57 I I ':(4.& f I I 4029 Councilman Phillips stated that he agreed in part with Mr. Orsi and in part with Councilman Reibold. That from time to time they try to weigh ordinances and the building code on something written as recently as 1949-1952. Many operations that are in C-2 are repugnant to us now in C-2; that there should be a down-grading of some operations that are contemplated for the future; that this was done very recently by providing a special zone for professional buildings, architects, offices, doctors offices, doctors clinics, etc. called C-O. Councilman Phillips further stated that he felt the proposal approved by the Planning Commission was sound; that he felt, after listening to the scientific discus- sions and the applicant's presentation, that he felt the applicant was sincere in his endeavor not to harm anyone close by. He further stated that he would hesitate to hold up the approval of this application for approximately six months or longer in order to reclassify the property into a special use zone. Upon questioning as to the length of time it would take to amend the ordinance to make pet hospitals a special use and then to obtain a special use, City Attorney Nicklin advised that if every step were taken at the earliest pos- sible date, it would require approximately 28 weeks to complete the two proceedings. He outlined the respective steps that had to be taken and stated that experience indicated that two such proceedings would take nearer a year than half a year. Mayor Dennis stated that the purpose of a variance was well stated this evening; that in his opinion the applicant was conscientiously attempting to construct a good type of development for the area; that it was unreasonable to expect people not to make such an endeavor for improvement of their property. He further stated that it was his hope that the other members of the Council would give serious consideration to their vote as he felt that this development would in no way depreciate property values and that he felt it would be an attractive addition to the Triangle. Councilman Phillips stated that he felt the Planning Commis- sion's resolution had fulfilled all the requirements; that he would support a motion to change the zoning ordinance but as to this particular application he would now move that the Council accept the recommendation of the Planning Com- mission and approve Resolution No. 267 and approve the variance request of Reuben C. Senior. Councilman Camphouse stated that he would second the motion in order to bring it to a vote, although he would vote against it. AYES: Councilmen Phillips and Dennis NOES: Councilmen Camphouse, Jacobi and Reibold ABSENT: None Councilman Reibold asked how to initia~e an amendment to the zoning ordinance. The City Attorney advised that the Coun- cil could request the Planning Commission to do so by simple motion, in which event the Planning Commission could insti- tute the proceedings by adoption of a resolution; or the Council could institute such proceedings itself by adopting a resolution; that the first procedure would be the quicker. 5. 11-19- 57 4030 LOT SPLIT No. 175 'I." Planning Commission recommendation that approval be given Lot Split No. 175, Walter J. Thomson, co-executor of the Oberly Estate, 167 E. Sycamore Avenue, subject to the following conditions: 1. Furnish a final map prepared by a registered engineer or land surveyor, 2. Provide a sewer lateral by extending the main line north from Sycamore Avenue, 3. Dedicate the extension of Second Avenue; five feet for widening Sycamore Avenue along lots 11, 12 and 13, and for widening Oakhaven Lane, 4. Pay $25.00 recreation fee, I 5. Improve the north side of Sycamore Avenue and the extension of Second Avenue with curbs, gutters, sewer, pavement, water and gas to subdivision standards, 6. Pay all fees and deposits required by the subdivision ordinance, including street lights, street trees, and street name signs, 7. Realign the north extension of Second Avenue to conform with Tract No. 19836. Motion was made by Councilman Phillips that the recommendation of the Planning Commission be accepted and that Council indicate its intention to approve Lot Split No. 175 as requested upon compliance with the conditions specified by the Planning Commission. Said motion was seconded by Councilman Camphouse and carried unanimously. LOT SPLIT No. 180 Planning Commission recommendation that approval be given Lot Split No. 180, Ross Himes, northwest corner of Santa Anita Avenue and Live Oak Avenue. The request is recommended for approval, subject to the following conditions: 1/70 1. File a final map with the City Engineer 2. Provide a sewer lateral for the new parcel, 3. Pay $25.00 recreation fee. Motion was made by Councilman Phillips that the recommendation of the Planning Commission be accepted and that Council indicate its intention to approve Lot Split No. 180 as requested upon compliance with the conditions specified by the Planning Commission. Said motion was seconded by Councilman Camphouse and carried unanimously. LOT SPLIT No. 181 1~11 Planning Commission recommendation that approval be given Lot Split No. 181, Clara Baldwin Stocker Home for Women, northwest corner of Foothill Boulevard and Santa Anita Avenue. The request is recommended for approval subject to the follow- ing conditions: 1. File a final map with the City Manager, 2. Provide a sewer lateral to parcel No.2, 3. Pay $50.00 recreation fee. I Motion was made by Councilman Phillips that the recommendation of the Planning Commission be accepted and that Council' i~dicate its intention to approve Lot Split No. 181 as requested upon compliance with the conditions specified by the Planning Commission. Anderson, 511-515 South Baldwin Avenue. The request is recommended for approval subject to the following conditions: 1. File a final map with the City Engineer, 2. Record the necessary covenant. Hotion was made by Councilman Phillips that the recommendation of the Planning Commission be accepted and that Council indicate its intention to approve Lot Split No. 182 as requested upon compliance with the conditions specified by the Planning Commission. Said motion was seconded by Council- man Camphouse and carried unanimously. Tentative map of Tract No. 19823, located on Third Avenue south of Duarte Road, containing 12 lots. Recommendation of the Planning Commission that it be approved subject to the following conditions: 1. The subdivider should make every effort to secure more land east of lot 11 to make three lots where lots 11 and 12 are now shown. 2. Install all street improvements as required by the subdivision ordinance. 3. Pay all fees and deposits required by the subdivision ordinance, including street lights, street trees, street name signs and recreation fees. 4. Provide all necessary rear line easements for utilities. 5. Dedicate 12 feet for the widening of Second Avenue. 6. Make cash deposit with the City to cover the pro rata share of providing access to the area from Duarte Road or Second Avenue. 7. The City should accept the offer of dedication of portions of lots 6 and 7, Tract No. 18784, shown as "future streetll on said map. Motion was made by Councilman Reibold, seconded by Councilman Jacobi and carried unanimously that the City Council accept the recommendation of the Planning Commission and approve the tentative map of Tract No. 19823, subject to the conditions specified by the Planning Commission. Tentative map of Tract No. 19836, located north of Sycamore Avenue at the north extension of Second Avenue, containing 54 lots. Recommendation of the Planning Commission that it be approved subject to the following conditions: 1. All the streets within the subdivision, including the north side of Sycamore Avenue and the east side of Oakhaven Lane, shall be fully improved as required by the subdivision ordinance. 2. Pay all fees and deposits required by the subdivision ordinance, including street lights, street trees, street name signs and recreation fees. 3. Dedicate the necessary land for the widening of Sycamore Avenue and Oakhaven Lane. 4. Install all necessary drainage structures as required by the City Engineer. 5. Provide necessary rear line easements for utilities. 6. Make necessary arrangements with the City for furnishing water to the area. 7. TRACT No. 15033 (Construction Completed) 7/").,,: A general discussion ensued as to the availability and cost of water to this proposed subdivision. Mr. Egi1 Hopen, of the firm of Barnett, Hopen & Smith, Civil Engineers and Land Surveyors, of Pasadena, (the engineers on this project) addressed Council, explaining the topography of the land in question. It was thereafter the consensus of Council that the water phase should be given more study. Upon Mr. Egi1 Hopen, as agent for the subdivider, wa~v~ng the 40 day approval time in deference to the request of Council, Councilman Camphouse moved that the matter be referred back to staff for further recommendation as it relates to the water situation. Councilman Reibo1d seconded the motion and it was carried unanimously. Revised tentative map of Tract No. 23948, located north of Colorado Boulevard and east of Lorena Street, containing 12 lots. This tract was denied without prejudice on May 21, 1957, with the suggestion that the triangle of land between the tract and the wash channel be included in the subdivision. Recommendation by the Planning Commission that it be approved subject to the following conditions: 1. Extend Newman Avenue to the east line of the tract with a one foot wide lot at the end to be deeded to the City. 2. Install all street improvements, including drainage structures, as required by the subdivision ordinance. 3. Pay all fees and deposits required by the subdivision ordinance, including street lights, street trees, street name signs and recreation fees. 4. Provide all necessary rear line easements for utilities. 5. Provide five foot planting and sidewalk easements along each street. Motion was made by Councilman Jacobi, seconded by Councilman Camphouse and carried unanimously that the recommendation of the Planning Commission be accepted and the revised tentative map of Tract No. 23948 be approved, subject to the conditions specified by the Planning Commission. , Recommendation of the City Engineer that the improvements in Tract No. 19107, Oakg1en Avenue and Sycamore, be accepted as constructed for maintenance by the City and the bonds released. Motion was made by Councilman Phillips that the City Council accept the recommendation of the City Engineer and accept the improvements of Tract No. 19107 for maintenance by the City and the bonds released. Said motion was seconded by Councilman Jacobi and carried unanimously. Recommendation of the City Engineer that the improvements as constructed in Tract No. 15033, Sharon Road, be accepted for maintenance by the City and the bond released. Motion was made by Councilman Reibo1d that the City Council accept the recommendation of the City Engineer and accept the improvements as constructed of Tract No. 15033 for maintenance by the City and the bond released. Said motion was seconded by Councilman Jacobi and carried unanimously. DABA Mr. Roy Long, President of the Downtown Arcadia Business (Christmas Association, addressed Council, requesting permission to hold Events) various events to open the new Parking Districts and the l;:::;::;;~::;D holiday season for shoppers. Helicopter rides for interested persons The City Manager recommended approval of Requests No's 1 and 2; No. 3 provided prior arrangements are made with the Police Department; No.4; and recommended disapproval of No. 5. The City Manager felt that the matter of permitting persons to be taken for helicopter rides would present a hazard to the safety of people in the area, and the problem of setting up a new business for which a business license would be required; also that setting aside the parking area necessary for such take-off and landing purposes would not be consistent with the basic purpose of parking districts, i.e. to provide space for shoppers' automobiles. The City Attorney reminded Council that a District Parking Board should be appointed for Parking District No.2, and the approval of the Boards of Parking Place Commissioners obtained be~ore Parking District Lots could be used. Councilman Reibold moved that the recommendation of the City Manager be approved subject to securing permission to use the property from the Boards of Parking Place Commissioners of Parking Districts No. 1 and No.2, and that Section 18 of Ordinance 737, as amended by Ordinance 823, be waived; and that permission be granted the Downtown Arcadia Business Association to hold its Christmas night opening;and announcement party of the new off-street parking lots to the shopping public on December 13 and 14, 1957, subject to the above stated conditions. Councilman Jacobi seconded said motion and it was carried unanimously. Recommendation of the City Manager that approval be given the request of the First Baptist Church to conduct a baby sitting nursery in its church kindergarten room a few days each week beginning the first week of December in order to help mothers of pre-school children with their Christmas shopping and to advertise this in the neighborhood newspaper without the need of license and trained nurses; also for its youth groups to solicit door to door the sale of candy, mistletoe, fruit cakes, etc. Councilman Camphouse moved that section 18 of Ordinance 737 as amended by Ordinance 823 be waived; and that permission be granted the First Baptist Church to conduct a baby sitting nursery in its church kindergarten room a few days each week beginning the first week of December without the neces- sity of securing a license or trained nurses, and to advertise same in the neighborhood newspaper and also for its youth groups to solicit door to door the sale of candy, mistletoe, fruit cakes, etc.; said activities to terminate by the 24th of December, 1957; said motion was seconded by Councilman Reibold and carried unanimously. Jensen $10,440.00 12,683.00 10,832.00 Motion was made by Councilman Camphouse, seconded by Councilman Jacobi and unanimously carried that all bids received for the construction of automatic sprinkler system on the north side of Colorado Street between Old Ranch Road and Princeton Drive be rejected and all bid deposits, if any, be returned. The City Engineer thereupon stated that the plans had been slightly revised to achieve further savings, recommended that the revised plans and specifications providing for a reduction in the number of controllers required to supply the system be approved and new bids called for. I Councilman Camphouse moved that the City Council approve the revised plans and specifications for the construction of automatic sprinkler system on the north side of Colorado Street between Old Ranch Road and Princeton Drive as submitted by the City Engineer, and that the City Clerk be and she hereby is authorized to readvertise for bids on this project covering the revised plans and specifications; said bids to be receive and opened December 2, 1957 at 11:00 A.M. with recommendation to Council at the next regular meeting of December 3, 1957. Councilman Reibold seconded the motion and it was carried unanimously. Recommendation of the City Manager and the City Engineer that the working plans and specifications for the landscap- ing and sprinkler system installation on Santa Anita Avenue from Foothill Boulevard to Orange Grove Avenue be approved and that authorization be given to advertise for bids. Councilman Reibold moved that the working plans and specifications for the landscaping and sprinkler system installation on Santa Anita Avenue from Foothill Boulevard to Orange Grove Avenue be approved and that the City Clerk be authorized to call for bids to be returned December 2, 1957 at 11:00 A.M. with recommendation to Council at the next regular meeting December 3, 1957. Said motion was seconded by Councilman Phillips and carried on roll call vote as follows: AYES: Councilmen Camphouse, Jacobi, Phillips, Reibold and Dennis NOES: None ABSENT: None I Notice of proposed annexation of certain property in the City of Duarte. This property lies northerly of Arrow Highway easterly'of California Street, bounded on the north by the City of Monrovia and on the east by Mountain Avenue.
