M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY I REGULAR MEETING I JULY 5, 1988 The City Council and the Arcadia Redevelopment Agency met in a regular session at 7:30 p. m., July 5, 1988 in the Arcadia City Hall Council Chamber. Rev. Alfred Carter, Christian Center of Arcadia City Manager George Watts PRESENT: ABSENT: Councilmembers Chandler, Gilb, Young and Harbicht Councilmember Lojeski On MOTION by Councilmember Young, seconded by Councilmember Gilb and CARRIED, Councilmember Lojeski was EXCUSED. On MOTION by Councilmember Chandler, seconded by Councilmember Young and CARRIED, the Minutes of the Meeting of June 14, 1988 and the Adjourned and Regular Meetings of June 21, 1988 were APPROVED with correction on Page 11 of June 21, 1988 Minutes as noted. Council- member Gilb abstained since he was not present at the June 21, 1988 meeting. It was MOVED by Councilmember Gilb, seconded by Councilmember Young and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. CITY ATTORNEY The City Attorney announced that, "the City Council met in a CLOSED SESSION this evening pursuant to Government Code Section 54957.6 to discuss employee compensation. Also the City Council held a CLOSED SESSION to discuss the existing litigation involving the claim of Ying Chen, Winnie Chen and Wilson Chen, pursuant to Government Code Section 54956.9(a)". PRESENTATIONS On behalf of the City Council, Mayor Harbicht and Councilmember Chandler presented a plaque of appreciation for the distinguished service, efforts and accomplishments of outgoing member of the Personnel Board, Bob Hillman. The Oath of Office was then administered by the City Clerk to Patrick Gibson, incoming member of the Recreation Commission. Mayor Harbicht presented the incoming Commissioner his credentials, a City pin and welcomed him to the City family. 7/5/88 -1- l. PUBLIC HEARING (ARCADIA GATEWAY CENTRE) (Parking Modifica- tions) (APPROVED) 1-3 "'1'1' y \d- 2. 30:0161 Consideration of MM-88-005 for parking modifications for the Arcadia Gateway Centre, 821 parking spaces in lieu of 908 parking spaces re- quired (4.61 parking spaces per thousand in lieu of 5.09 required) and an increase in the number of allowable compact spaces (24.1% in lieu of 20% allowed by Code) at th south side of Huntington Drive between Second and Fifth Avenues (Arcadia Gateway Centre Associates, Ltd., applicant). (Continued from June 21, 1988.) Mayor Harbicht declared the hearing open. George Grosso, Arcadia Gateway Associates, Irvine, CA stated that he believed the staff report to be complete and that he was present together with his Traffic Engineer to answer any questions presented. Councilmember Gilb inquired if there were to be any car bumpers in- stalled? Mr. Grosso replied there would be car bumpers around the front and sides of the office buildings; in front of the retail shop- ping area; and parking spaces that face the streets. 1 Councilmember Young inquired what kind of control there would be to insure that employees parked in designated spaces. The reply was that best control as far as the spec office building and 'also speaking for the Auto Club, is that license plate numbers for employees are on hand and available to the security people. Security will be full time on the site. The license plate numbers wi+l ~e perio?ically checked to make sure employees are parking in designated areas. Councilmember Young noted that she was concerned that improper employee parking could cause traffic problems. Reply was they were cognizant of that fact, especially in the Ire tail business. Councilmember Gilb inquired if they enforced this at the Monrovia Huntington Oaks because he had seen in- fractions of this IpOliCY, Reply was that this was the policy at that location also and cited examples of enforcement policies. Mayor Harbicht remarked that it would be good business to enforce that parking policy. No one else desirJng to be heard, the hearing was CLOSED on MOTION by I Councilmember Chandler, seconded by Councilmember Young and CARRIED. It was then MOVED !bY Councilmember Gilb, seconded by Councilmember Chandler and CARR]ED on roll call vote as follows that Council APPROVE , the requested mod~fications subject to condition that there shall not be an increase in Ithe amount of compact parking spaces in the open surface parking area. I Mayor Harbicht stated that he thought this was a reasonable request and I that the ordinance set up relating parking to the gross floor area should be used. I AYES: Councilmembers Chandler, Gilb, Young and Harbicht NOES: None , ABSENT: Councilmember Lojeski I AUDIENCE PARTICIPATION I Herb Fletcher, 175 W. Lemon, stated, in part, that with regard to the proposed homeowneis' association, he is concerned about what the legal I status of a homeowners' association is ... if a person feels that he I has been harmed, can he sue the associstion and, if so, are all the members, willing And/or unwilling in that association, liable if a I judgment is obtained against it or would that person have to sue the I City? The City Attorney stated that that general issue would be , addressed in the informational items included to perspective homeowner I associations. Basically, it is a non-profit corporation. Mr. Fletcher I then noted that there had recently been a two-hour public hearing on I a proposed home to be constructed in the Lower Rancho area. The homeowner associations have a great deal of latitude in determining what will or will not be built ... when the property owner and his architect together with the architectural review board agree on a project, that should be the way it will be; but it has not worked out this way; as an example, the before mentioned public hearing when a large number of people object- ed to the design of the proposed house. The Council had recently passed a revised building code which was, at best, a compromise, but he felt the homeowner associations should put in writing what they agreed or disagreed with so property owners and their architects would know how to make their plans. Pat Leone, 5650 El Monte Avenue, Temple City, stated, in part, that her residence was at Live Oak and El Monte Avenues and she was present to complain about the disturbance created in the area by the presence of the Arcadia Dial-A-Ride office and parking lot. She said there is a great deal of honking of horns; buses and cars coming and going; the tower interferes with TV reception; noise from the dispatcher is audible; on Saturdays the noise level increases when the vehicles are washed; fumes from the cars and vans are unhealthful to the residents. She inquired if the City had noise ordinances. Mayor Harbicht replied that it did. She further stated there were not enough parking spaces for the employees; therefore they were parking on the surrounding streets and in front of the residences. She noted that a doctor in the area has a problem with lack of parking spaces for her patients. There is not even enough parking for the cars and vans; the overflow goes to the park- ing lots of the Santa Anita Lanes; this done without the approval of the manager of the bowling alley. The Dial-A-Ride has become increasingly larger and the parking area is not large enough. Trash is being tossed on the lawns; the property values in the area are going down. There also seems to be a taxi station there; their cars also park on the streets. She and some of the neighbors have complained to City Hall but have received no satisfaction. She felt the DiaI-A-Ride should ~e moved to another site. The City Manager said that he had been made aware of this problem by the Planning Director and that he had driven to the Dial-A-Ride site, spoken to the manager there regarding the employees parking in front of the nearby residences. He informed the manager that he would like it if this were discontinued at once; this was followed up by a letter to the owner of the operation. With regard to the other problems, that is a commercially zoned area and this is a proper use for that zone. It is unfortunate that a single family home is abutting a commercial area. Mrs. Leone noted that there are noise ordinances for commercial areas and referred this to her husband. She also noted that "there are a lot of places where Dial-A-Ride could go". Paul Leone, 5650 El Monte Avenue, inquired whether or not there was any restriction on the number of Dial-A-Ride vehicles which could be operated from the site. The City Manager replied there was no restriction. Mr. Leone inquired why this was different from business parking restrictions. The City Manager replied this was not customer parking. Mr. Leone said he had once applied to the City of Arcadia for a permit to increase his business by adding four tables in a delicatessen and was refused because ".S'J the.lack..Qf parking,..while. the, Dial-A-Ride has no parking for em- ^~ployees', Dial-A-'.Ride vehfde'sl'are".rp~rk'~n\(:~h th""ll~~h;,ng alley parking area. He felt there should be some restric~ion on ,t~f0number of vehicles parked there. The City Manager replied, in part., t9-S!;I,in the Code the parking spaces are per sq. footage of the use -~'4 per 1,000 -- has nothing to do with the number of vehicles they use in the business or number of employees; in this situation there are no customers; but a large number of employees. Dial-A-Ride has no customers at the facility. CounciI- member Gilb said he would like to see a report on this -- if Dial-A-Ride has 17 or 18 vehicles without adequate place to park them -- and he will go down and take a look at the site. Mayor Harbicht asked that staff be informed what the specific problems are and the matter looked into, a report prepared and appropriate action taken. Councilmember Young said there should also be some information given about employee parking. 7/5/88 -3- Design Review for proposed construction of a four-story, 67,000 square foot office building and a three-story parking structure as I part of Arcadia Gateway Centre (Stanley W. Gribble and Associates, Developer). This Iproject is being developed in conjunction with Arcadia Redevelopment Agency. I ' It was MOVED by Member Gilb, seconded by Member Young and CARRIED on rO]l call vote as follows that the Arcadia Redevelopment I Agency APPROVE the Design Review for proposed project located at 440 E. Huntington Drive; Ithat the project comply with all Zoning and Building Codes as established or modified by the City; that final approval is subject to compli~nce with requirements of the City Departments listed I in staff report dated July 5, 1988; and that the Design Review be in I effect for one year, as per Resolution No. ARA-126. I The Assistant Cit~ Manager for Economic Development noted that the Planning Department had called their attention to the fact that they I would like to see Ithe back of the parking structure painted with anti- grafitti paint. There is concern that the back of the structure which , is next to the rai'lroad tracks may be covered with grafitti and they would like to havel it painted so that it could be taken care of quickly and easily. El Monte Avenue, stated, in part, that taxi cabs - I are parked in front of his residence .., they are there all the time. At 7:00 a. m. one I of the taxi cabs parked in front of the house and it is still there now. There is a private alley and they have to go through , the alley to get to their garage. Councilmember Gilb said staff would check this. Mr. Fortier remarked that there' is a building which is vacant across the! street where Marketown is located; there is ample parking in that lit and it is not near any residences. AYES: NOES: ABSENT: Members Chandler, Gilb, Young and Harbicht None Member Lojeski In order to properly pursue the existing case in Federal Court entitled ARA vs. Bong, it is necessary to retain an outside expert for expert testimony purposes. Additionally, outside expert analysis is necessary concerning current negotiations with Kiewit and that potential lawsuit. McLaren Environmental Engineering and specifically Fred McLaren have worked with our Special Counsel on other cases, and are qualified to participate as experts in courtroom proceedings. The staff has made some recommendations concerning general formation criteria for homeowners' I associations as well as formation procedures. Staff would also develop I a summary... on the last page is a sample homeowner's association I petition for support. Reference is made in the text of that petition form concerning City information regarding homeowners' association ... I . that would be ap..fttachmeJ1.t; ,w.q~~h would. be. a very shor~ but concise 1 summary of how such an association could affect the individual home- owner. That is if process of preparation. As the MkY~r had earlier mentioned, that WrUld be a critical part of the package. . Mayor Harbicht directed discussion to page 1 of July 5 memorandum. The Director of Planning has made certain recommendations for guide- lines for COUnCil['S consideration in the formation of homeowners' associations. He felt Council should either agree or disagree with each of the guidelines, as a matter of general policy. He noted that Council is not talking about a group of people who just decide to get together and have \ an association, which any group can do and there are no rules involved. But going a step further is having the design I , ' overlay in a homeowners association area which the Council has to I approve and make part of the approval process and the obtaining of building permits. Discussion is needed regarding requirements to 7/5/88 -6- 30:0166 1 have the design overlay. He would start by saying that he agrees with items 1 - 2 - 3 - 5 ... they set up some good criteria for establishing an area. Item 4 -- at least 60% of the property owners in the area should be in support of the formation of the association. He would like to inquire if Council feels that is an adequate number -- should it be 51% or two-thirds? Councilmember Gilb referred back to Item 1. Are there areas in town that would be contiguous for a home- owners' association, but by natural boundaries -- thinking, for instance, of the wash which divides an area. so it is not 150 gross acres. The City Manager replied they had tried to pick a reasonable number which is comparable to existing property owners' associations. Councilmember Gilb inquired why it would not be 51% of property owners to set up associations. Mayor Harbicht said it was his feeling that it should be at least 60% because, by putting a design overlay on, fairly significant rights that people now enjoy are being taken away; at this time if a person is not in a homeowners' association with a design overlay, he can come in and get a building permit and build as long as City requirements are met, but now there will be an extra layer of government. He would be concerned about 49% of the residents saying they don't want this group of people telling them what they can do on their property. 51% could say to the 49% -- you'll do it by our rules. So maybe there should be more than 51%. Councilmember Gilb noted that these properties could change with respect to ownerships in the next six months or so ... does the association stay in place. Mayor Harbicht replied that when new owners take over they are on notice that this is in existence and they will have to go by those rules. He is concerned only about the people who are living there right now. Councilmembers Gilb and Young said they weren't sure about the 60% figure, but perhaps they should wait and see how the people in the area felt about it. The City Manager added that the 60% figure was used because that figure is used, for example, in instances where people are requesting street lights, so that when it comes to Council, there is some assurance that more than just half are interested. Also 51% in favor today might change to 51% against in a short period of time. Councilmembers Gilb and Young said they felt the 60% figure should be tried. Council- member Chandler said he felt it should be a higher figure. He would like to see a very high vote of the people saying that is what they want. Mayor Harbicht and Councilmember Chandler said they were comfort- able with the 60% figure. No discussion was initiated on the other general formation criteria. 1 Mayor Harbicht referred to the next item of discussion which is the proposed document entitled, "City information regarding homeowner associations". The Planning Director is looking for guidance on what should be included in such a document. Mayor Harbicht's feeling is that what is wanted is a simple document, perhaps one page, with bullet format saying: these are the things that happen when you have a design overlay and these are the things that don't happen. There is a lot of misinformation on these subjects. People need to know what restrictions are going to be placed on their own properties as well as other properties in the association and what restrictions are not going to be in place. Councilmember Young said she thought it might be a good idea to include the general criteria. The City Attorney responded that this information will be included in the ordinances and resolutions adopted to implement the decision, but it can be provided in the informational sheet also. . Councilmember Gilb referred to the provision to provide to the City names and addresses of the association officers -- there should be something to note that these should be updated when necessary. The Planning Director replied that the associations do provide information about changes as they occur. Councilmember Chandler said the talk had been that the principal interest of the residents at this time is to stop construction of very large houses; that they are not part- icularly interested in roofs, patios, etc., but it will probably come to that. I Mayor Harbicht said he would like to see a draft of the proposed City information rega~ding homeowner associations. The City Manager said that would be bro~ght back to Council at the next meeting along with a proposed ordinande which would implement the criteria. I Councilmember Gi~b said Councilmember Lojeski should be informed I and have an opportunity to see the information before the next meeting. 1 Councilmember Chandler inquired if there would be a public hearing on this matter. MATTERS FROM ELECTED OFFICIALS Councilmember Gilb adjourned the meeting in memory of Dr. John Kendall "Ted" McBane who died Sunday at home in Arcadia. The former President of the Arcadia Chamber of Commerce, founder of the Arcadia Medical Clinic and Past President of the Arcadia Rotary Club succumbed to cancer at age 72. The memorial services were held July 3rd. He was a lifelong member of the Society of Friends. A resident of Arcadia since the mid-1940s, he was one of four founders of the Arcadia Medical Clinic and practiced family medicine here for 42 years. Dr. McBane I was the organizational Chief of Staff at Methodist Hospital of Southern California in its early years in Arcadia and was instrumental in organizing the staffs at Santa Teresita Hospital in Duarte and Heartland Hospital in La Puente. He was an active member of the Rotary Club and served as the local chapter's President in 1957. He had 40 years of perfect attendance at Rotary meetings. Dr. McBane was a leader of the local Chamber of Commerce and a Director for five years, during which time the Chamber building was constructed and the plans for Methodist Hospital's move to Arcadia were first developed. He was Vice President of the Santa Anita Family YMCA and on its board for several years. He served on the Board of treCommunity Chest (now United Way) and was Chairman for the Building and Lands Committee that waged a successful drive to unify Arcadia schools. Over the years, Dr. McBane and his wife Peg provided a home for visiting foreign students. He and his wife traveled around the world in 1965 and, in later years, to South America, Africa, China, Russia and the Far East. Dr. McBane was born in Indiana in 1915 and attended Earlham College, where he met his wife. He received his medical degree from Indiana University Medical School in 1941. He is survived by his wife and four children, Baxter, Barbara, Kip and Margo; also, five grandchildren, Windy, Nathan, Matthew, Allegra and Bard. He was a fine citizen of Arcadia and he will be sorely missed.
