On MOTION by Councilmember Chandler, seconded by Councilmember Lojeski and CARRIED, the Minutes of the Adjourned and Regular Meetings of August 16, 1988 were APPROVED. It was MOVED by Councilmember Lojeski, seconded by Councilmember Chandler and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. CITY ATTORNEY The City Attorney announced that "the Arcadia Redevelopment Agency and the City Council met in CLOSED SESSION this evening pursuant to Government Code Section 54956.8 to give instructions to the City's negotiator regarding the potential acquisition of property at l53 Wheeler Avenue in the City of Arcadia and authorize negotiations with the principal on that property, Mr. Cotten and also his attorney, James Helms". PRESENTATIONS j Councilmember Lojeski announced that it is always a great deal of pleasure for the Council to recognize young members of the community. Being recognized tonight are members of the Arcadia Coast Little League Boys' Major League All Star Team who competed in the first level of competition which is District 17 competition. This team got into the final game. They played an outstanding game and were runnersup. This is the farthest any Arcadia Little League Team has gone in quite a few years. All the teams are to be congratulated on their outstanding efforts. Ma. These certificates were presented to the following members of the team: Maeson Amador, Bobby Botana, Jon Ellison, Brandt Larsen, Jeff Lown, Brian Mayclin, Viktor Nemeth, Kristian Reyes, Dan Smith, Josh Smith, Justin Stewart, Zep Stremel, Scotty Sullivan, Mark Vanis, Randy Goodrich, Mark Lechler, Ryan Rossiter and Kurt Chelsuig. Mayor Harbicht also introduced two of the coaches: Doug Ferguson and Blake Larsen. I The Oath of Office was then administered by the City Clerk to K. George Hanks, incoming Member of the Library Board. Mayor Harbicht presented the incoming Member his credentials, a City pin and welcomed him to the City family. ' I ~... ~~ P f'\ e/'p I/J'" 30:0212 On January 5, 1988, the City Council, after petitions from property owners and public hearings on the matter, authorized the Superintendent of Streets to construct lighting improvements (street lights) on Naomi Avenue as shown on map attached to staff report dated September 6, 1988 and in accordance with the provisions of Chapter 27 of the Improvement Act of 1911. Work for this project has been completed in accordance with the plans,and specifications. The report from the Superintendent of Streets, attached to the above mentioned staff report, summarizes the cost of the project, the properties benefited, tmproperty owners' share of the cost and map showing the locations of the new street lights. In accordance with City policy, the City will pay 75% of the installation cost and benefiting property owners will pay 25% of the installation cost plus 100% of future power and maintenance costs through annexation to the Lighting Maintenance District. Funds were advanced from the Capital Outlay Fund to pay the property owners' share of the construction cost. These funds are to be repaid to the City through assessments levied against the benefitted properties. Mayor Harbicht declared the hearing open. The City Attorney presented, explained the content and read the title of Resolution No. 5442, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DETERMINING THAT THE PAYMENT OF CERTAIN ASSESSMENTS UNDER THE IMPROVEMENT ACT OF 1911 MAY BE MADE IN ANNUAL INSTALLMENTS (NAOMI AVENUE)". and Resolution No. 5443, entitled:. AYES: NOES: ABSENT: Councilmembers Chandler, Lojeski and Harbicht None Councilmembers Gilb and Young AUDIENCE PARTICIPATION Phil Lopes, Manager, West Arcadia Business and Professional Association, Temple City resident, stated, in part, that he was present this evening to request the deletion of Condition 6 of the previous Council approval of WABAPA-HUB shopping area carnival. He distributed to the Council copies of a letter addressed to the City Manager which was received too late to be part of the agenda for this, meeting. One of the Council action points (Condition 6) stipulated that there be no dismantling in the evening hours after the close of the carnival Sunday evening. He was unaware that this is normal procedure for a carnival. He has contacted other organizations in the area who have had carnival attractions and who are near residential areas, including Holy Angels Church and this appears t<:> be, standard procedure. His request is to allow the carnival to dismantle after closing hours Sunday evening which will take them to early Monday ,.morning 'between 2:00 - 3:00 a. m. Mayor Harbicht inquired as to the exact location of the carnival. Mr. Lopes replied directly across from the OSCO Drug Building near the Ross Building at the east end of the parking lot and will be 125 - 150 feet away from the nearest residential compound. Councilmember Lojeski inquired if the same language was incorporated, into the Holy Angels agreement. Staff replied they did 9/6/88 -3- 4. 5. 5a. ROLL CALL 5b. / MINUTE APPROVAL (Aug. 16, 1988) (APPROVED) 30:0213 not believe so; this is different in that it is a business promotion therefore it goes through a different process. Councilmember Lojeski said that the lateness of the request in relation to the time of the event does bother him. He feels the dismantling will create a lot of noise at a very late hour. Mr. Lopes replied that it is estimated that the carnival will be off the premises by 12:00 or 1:00 a. m. Mayor Harbicht said that whether it was charitable or business related does not make much difference; the dismantling noise would be the same, and has apparently not been a 'problem previously. This is a major promotion for the business interests in Arcadia. The dismantling is probably a minor thing. He is inclined to grant the request. Councilmember Chandler. said some of the problems mentioned by Councilmember Lojeski also bothere him, but overall it seems it will not be that harmful. It was then MOVED by Councilmember Chandler, seconded by Councilmember Lojeski and CARRIED on roll call vote as follows to amend the previous approval of this Council relative to the one point of take-down hours to allow them to take down at a later time and, if there is a consensus of Council, ask the City Attorney to make the appropriate announcement to make this legal under the provisions of the Brown Act since this is an emergency action for the carnival people but is not on the agenda. The City Attorney announced that, preliminary to the vote on the motion, in order to meet the concerns Councilmember Chandler mention, and since this item is not on the agenda, it cannot be acted upon under the Brown Act unless Council, with at least a two-thirds vote, votes that the need to take action arose after the posting of ' the agenda. Approval requires a two-thirds vote. The Agency granted the Derby a 4 month extension to the DDA performance schedule on AprilS, 1988. The Derby has now requested a 90 day extension to complete this work. (November 25, 1988) Councilmember Lojeski inquired if there were any assurances that if this request were to be granted, it would be the final one. He is not in favor of continuing these 90 day extensions ad infinitum. He requested that this statement be transmitted to Mr. Sturniolo. It was MOVED by Member Lojeski, seconded by Member Chandler and CARRIED on roll call vote as follows that the Arcadia Redevelopment Agency APPROVE Amendment Number 2 to the January 5, 1988 DDA by and between the Arcadia Redevelopment Agency and the Derby Restaurant extending the construction schedule for the above described work until November 25, 1988 with the comment that Council will not look with favor upon another request for extension. All other terms and conditions of the DDA remain in full force and effect. Arcadia has not adjusted its business license fee since 1969. Since then costs (Consumer Price Index) have increased 260%. Arcadia is in the bottom ' lO% of 51 Los Angeles County cities surveyed for business license fees charged. The average license fee is two to three and one-half times higher than Arcadia's (depending on the size of the business). ' AYES: Councilmembers Chandler, Lojeski and Harbicht NOES: None ABSENT: Councilmembers Gilb and Young MATTERS FROM STAFF None MATTERS FROM ELECTED OFFICIALS I Expressed concern about the property maintenance at the Weiner property at Santa Anita and Huntington Drive, which was formerly Tiny's Restaurant, now vacant. The landscaping is in a deplorable state. The City has recently renovated the adjacent Parking District lot and it was a fine job. However, the big chuckholes are actually in the back lot portion of the Weiner prop- erty .,. the citizens probably think that is also Parking District property and wonder why the City did not repair that area. Staff had been requested to check into this situation. It was noted that Property Maintenance staff was checking into the matter. He further inquired if a new restaurant is planned for this location. Staff replied it had been their information that within a week of the closing, plans would be turned in for a new restaurant; however, to date this has not happened. Councilmember Lojeski also noted that at one time there had been a temporary structure located on the SE corner of Wheeler and Santa Anita; this being a portion of the Weiner property. When that structure was removed, there had been some discussion in Council of the City obtaining that corner portion. If a structure were placed on that corner, it would create parking congestion in an already extremely busy lot. He wondered if it had ever been pursued. Staff replied that it had been the majority consensus of Council not to proceed with investigating the purchase of that property because it would remain parking anyway under private ownership, so why spend money if it will be parking in any event. Councilmember Lojeski replied Mr. Weiner could spinoff that one parcel, since he has adequate parking area. It is possible that a two or three story building could be constructed there .,. the temporary building formerly in that space had had adequate parking I area .,. so conceivably another building could go in there. Mayor Harbich . suggested the Economic Development Director take a look at the matter and put together a rough estimate of cost. Noted that he was very pleased with the rehabilitation of the animal hospital on Santa Anita Avenue. He felt they had done an outstanding job ... the design of the building, the plants, the signage are all very well done. Hopes the Arcadia Beautiful Commission will keep it in mind when they consider their awards next year. They took a completely dilapidated building and replaced it with a beautiful, multi-storied structure ... they even managed to stay in operation during the con- struction period. It makes a great difference when driving down the alleyway. 12.
