MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING DECEMBER 20, 1988 The City Council and the Arcadia Redevelopment Agency met in a regular session at 7:30 p.m., December 20, 1988 in the Arcadia City Hall Council Chamber. Lojeski PRESENT: ABSENT: Councilmembers Chandler, Gilb, Lojeski, Young and Harbicht None On MOTION by Councilmember Gilb, seconded by Councilmember Chandler and CARRIED, the Minutes' of the Adjourned and Regular Meetings of December 6, 1988 were APPROVED. It was MOVED by Councilmember Young, seconded by Councilmember Lojeski and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. CITY ATTORNEY The City Attorney announced that "the City Council and the Arcadia Redevelopment Agency met in a CLOSED SESSION this evening pursuant to Government Code Section 54956.8 to give instructions and direction to the City's negotiator regarding the potential lease of so-called Avis property at 112 North First Avenue". PRESENTATION Mr. Howard Walker, representing the Automobile Club of Southern California and the American Automobile Association, presented to Council s Pedestrian Safety Citation. This Citation is made to cities and states that have made outstanding pedestrian safety achievements. Arcadia is one of 63 southland communities to merit this honor with a record of no pedestrian fatalities reported in the AAA Pedestrian Protection Program while meeting the AAA standards of program performance for 1987. Mayor Harbicht accepted the Citation on behalf of the City Council with thanks to the AAA and also with appreciation to the Police Department and for all of the planning for pedestrian safety that has gone into Arcadia's streets. AYES: NOES: ABSENT: Councilmembers Rone None Chandler, Gilb, Lojeski, Young and Harbicht I AUDIENCE PARTICIPATION Marjorie Elliott, 535 West Duarte Road, 03, Community Representative for the Arcadia Branch of the American Association of Qniversity Women, read a communication from that group to the Council, as follows: "At our regularly scheduled monthly meeting on Monday, December 12, 1988, the following statement was made: The AAUW California State Division 87- 89 Program for Community Policy lists Action Priorities and advocates: A healthy environment including long range comprehensive planning, wise use, preservation and enhancement.of 'natural and energy resources. In accord with the AAUW policy the following motion was made and passed: The Arcadia Branch AAUW recommends that the expenditure by the Arcadia City Council of several million dollars of public moneys for any capital improvement be discussed at a well publicized hearing and that a legally required environmental impact study be made. A summary of the key points includes: 1) A case in point is the Senior Citizen Center, together with the Parks and Recreation offices and storage building, proposed at $3,500,000 to be built in the Rose Garden. 2) The Quit Claim deed transferring this property from the United States Army to Los Angeles County and then to the City of Arcadia specifies that the property be used for park and recreation purposes only. Activities proposed for the Senior Citizen Center may violate this convenant. 3) Arcadia is unique in having extensive open space inviting one into and through the City. A large building would block this view and would require destruc- tion of the Rose Garden for a parking lot. 4) The effect of Race Track traffic for seven months of the year on the access by Senior Citizens to this location has been ignored. 5) Potential sites for the Senior Citizen Center. should be identified arid discussed in well publicized hearings." Richard Proctor. 327 Fairview. which is near the location of the proposed Senior Center. does not feel this is a wise location for this Center. Will Conrad. 9359 Shrike; Fountain Valley. stated. in part. that he OWDS property at 37 and 41 Bonita Street. His family has been in Arcadia since 1934. He wished to address Item 7 on the Agenda - the residential refuse agreement. He had requested and received a copy of the proposed contract with Best Disposal. He has gone over the propose contract line by line and then had spent some time with Mr. McIntyre. Most of his questions had been answered. He feels Best has been doing a tremendous job in the City. However. he felt there were some specifics that were not addressed in the contract. It sounds to him ,somewhat like a "handshake"-type contract. Knowing the people and the backgrourid of Best. any disagreements or differences of opinion can be resolved on a one-on-one basis. However. if there are problems and the ownership changes. the "handshake" contract may not be sufficient. Perhaps the contract should be reviewed and be more specific. He gave as an example. the item of reports requested by the City from the company and that it was not indicated that such reports should be free to the 12/20/88 -2- -.' 30:0298 City. Also, it does not address multi-family dwellings. He is not against the contract, he merely thinks it'might be written more finitely to protect the City. Mr. Conrad gave his annotated copy of the proposed contract to the City Clerk to be forwarded to Mr. Mclntyrei I Harold Ellis, 1604 South Eighth Avenue, stated, in part, that their horse issue was now before the U. S. Court of Appeal. He has made some public document requests from the City. He has requested defini- tions of terms used in the Code, specifically, what is a "variance"; what is a "modification". Variances and modifications are mentioned in the Code; "administrative" modifications are mentioned. The Code gives examples of types of items that can be handled as such. The term, "appropriate improvement" is used quite frequently and often used when variances or modifications are granted. He feels his re- quest for definitions of these terms was a perfectly legitimate and reasonable request. He was denied this on some flimsy excuse, he believes, that they are not public records. He wonders if they are not in the public records, 'how the City conducts its businss. Since the City Attorney and Planning Director are present, he would like to get some definitions for these terms and how these terms are applied' to issuance of exceptions from Code. Mayor Harbicht replied that this is time set aside for the citizens to address the Countil; he suggested Mr. Ellis see the Director of Planning for this information. The City Attorney noted that the request was denied because Mr. Ellis was not asking for public records; he was asking for information best given in an interview in a meeting with the City Attorney and Director of Planning. Mayor Harbicht noted that there was no specific definition for the word "modification" in the City Code; there is a list of things that qualify for modification; that will have to suffice as a definition. Three modifications have been issued for property across from Mr. Ellis' lot on Pamela Circle; as modifications these changes require 100 foot notification; he was not notified of these hearings; it is his contention that those'modifications are not modifica- tions, but variances and, as such, he was not properly notified and he feels the City should overturn those modifications; that they should be handled as variances. He gave his notes on this subject to the City Clerk for transmission to the City Attorney. Mr. Ellis suggested that the definitions should be codified in an appropriate manner. 3. MINUTE APPROVAL (Dec 6, 1988) On MOTION by Member Gilb, seconded by Member Chandler and CARRIED the Minutes of the meeting of December 6, 1988 were APPROVED. 4c. DESIGN REVIEW (112 N. First Av. - Avis) Avis' former office building was severely damaged in the October 1987 earthquake and was removed by Avis; Avis has been operating out of a temporary trailer since. This Design Review is for construction of a one-story 642.38 sq. ft. office building. Site Plans are attached to staff report dated December 20, 1988. Staff recommends approval. ~qLeland J. First Avenue be APPROVED subject to the conditions that the project comply with all Zoning and Building Codes, as established or modified by the City; that the property owner comply with the departmental requirements outlined in staff report dated December 20, 1988 and that the Design Review be in effect for one year as per ARA Resolution No. 126. This Design Review is for I construction of an 88,000 square foot commercial mixed-use project consisting of 12,000 square feet of restaurant, 36,000 square feet of retail, and 40,000 square feet of office space. Site Plan is attached to staff report dated December 20, 1988. The applicant is Kem Sang Company, Inc. Staff recommends approval. , .' Kirk Downing, representative of the developer and one of the partners in the development, 615 N. Alhambra Road, San Gabriel, ' replied to a question from Chairman Harbicht about the large grassy'area, that that was to be the site of one of the restaurants. Two sites for restaurants are planned. Member Lojeski noted that he had three major concerns: 1) that this is the entrance to Arcadia and he would like everything aesthetically pleasing. ~o make this the nicest project in the City; 2) the concept of commercial above, retail is a new concept in the City and he is concerned about it; 3) howmuch landscaping will be available once two restaurants are built in that area? He is also concerned about the quality of landscape. He would like to see as much land.. scaping as possible. There will eventually be a landacape design for approval before the Planning Commission. Member Lojeski also had some concerns about the copper roof. Mr. Downing said they hoped to have a higher level of development here than is presently in the area. Member Gilb noted that he was concerned about securing high-quality restaurants for this site, Member Gilb also noted there were only 6 handicapped parking spaces in the project. Mr. Downing replied they were going by Code requirement. Chairman Harbicht noted there was a new development across the street which has quite a different, more traditional, look; this seems to follow through with color and sty,le from the Souplantation which he does not particularly like. He would not like it to set the tone for this project. He would like something more traditional, Mr. Downing said this building would be of high quality design and not of the "trendy" look. Chairman Harbicht also expressed concern about the plastic awning. He would also like to see the use of brick or some sort of masonry on the front. Councilmember Young agreed. but thought the building had a bulky look; it needs to be softened. Mr. Downing replied the copper was going to be the high- light of the building; which would soften the look. Chairman Rarbicht inquired about the facing of the balconies. Ronnie Lam, 9725 Callita I Street, Architect, replied it would be a glass material. Member Lojesk noted that the plans said acrylic -- plastic. Copper will be on each level. Member Young inquired if they will let the copper naturally tur green? Reply, no. However, it may take a light green tint. Member Young also had questions about the ingress and egress and parking. It was noted that a meeting was planned with the traffic engineers to resolve those questions. Member Lojeski inquired if there will be access way behind the retail area for deliveries, etc. Answer, no; however, they anticipate a store there such as MUSIC PLUS which will have small amounts of deliveries; also deliveries will be limited,to specific hours. Chairman Harbicht inquired about the south facade; plans noted "metal tube grills painted white". Wen Sung, Architect, 1023 Loma Lisa Lane, responded they felt this would give a lighter look, instead of heavy 'block on top of the arches. Also he inquired about 15" round columns along the front of the building as to what color and material they wili be. Reply was plaster finish. Member Young also did not like the acrylic domes; also she cannot visualize the white metal tubes; perhaps more detailed drawings are needed. Mr. Downing said they c~old eliminate the acrylic portion and conform that to the rest of the railing instead of having black acrylic on the front, Chairman Harbicht commented that Council needs to take a position on this architecture and many details need to be worked out; they need larger more detailed drawings. He suggested that this be held over and that the developers come back with some sort of rendering of some of the details. Mr. Downing said perhaps they could work with staff on the details that Council does not like. Chairman Harbicht reiterated he did not like the metal grill, the glass block, the acrylic domes; he would feel morecoufortable if columns along the front of the retail were something other than plaster columns painted white. Chairman Harbicht suggested setting up a meeting with staff and a couple members of Council to talk out some of these details and he volunteered to sit in on such a meeting. Member Chandler also noted that he did not like the acrylic domes; perhaps they could continue the con~inuity of the copper where the acrylic domes were and maintain the copper look all the way around. Mr. Downing did not think that was a practical alternative. He thought Kember Young's suggestion of continuing the treatment of the railing all around would be the best way to do it. Member Chandler also noted that the proposed stucco columns would eventually be full of holes and will look dirty; they should be of some other material. Member Lojeski noted that he had a hard time visualizing this from the drawings presented and suggested Council be provided a 'model of the proposed project. He also noted that speed was not the point here; they wanted the right project in that area; wanted it to look right. Member Gilb said he would like to know about new materials being developed especially for the smog conditions in this area to preserve the appearance of buildings. It was then MOVED by Member Young, seconded by Member Chandler and CARRIED on roll call vote as follows that consideration of Design Review for proposed project at 333 Huntington Drive be CONTINUED to January 3, 1989. REFUSE AGREEMENT (Best Disposal Co,) (APPROVED) ~ y \\9 30:0301 AUTHORIZED a three year contract, in form approved by the City Attorney, with Gannon Landscape Management for the landscaping maintenance of 'Parking Districts One and Two in the amount of $15,492. The City Manager is AUTHORIZED to execute the contract and any related documents. ALL OF THE A1iOVE CONSENT ITEMS WERE APPROVED ON MOTION BY COUNCILMEMBER LOJESKI, SECONDED BY COUNCILMEMBER YOUNG AND CARRIED ON ROLL CALL VOTE AS FOLLOWS: AYES: NOES: ABSENT: Councilmembers Chandler, Gilb, Lojeski, Young and Harb.icht None None CITY MANAGER I At the October 20, 1988 meeting Council directed staff to negotiate an agreement for a five year residential refuse collection contract with Best Disposal Company. Council received and reviewed the agree- ment which will become effective March 1, 1989, terminating March 1. 1994. Major points in the agreement were listed in staff's report dated December 15, 1988. In response to Mayor Harbicht's .question concerning the $1.00 surcharge for the recycling program, staff responded that this charge only applies to the single family curbside collection at this time. Those who require back yard collection for bins are not, as yet, included in this program which is designed to be a curbside collection process. If those with back yard bin or can service would like to be included they would have to put the recyclables at curbside and be charged the $1,00 per month surcharge, This option can be made a part of the agreement. In reference to Council's original discussion of the disposal of yard waste, the Mayor noted that the agreement specified plastic bags be used rather than the homeowner's own trash cans as originally agreed upon. Mr. Newton of Best Disposal commented that plastic bags are re- commended over cans for speed of pickup; aesthetics (cans blow down the street); and the problems encountered by using cans for the re- cycling of the yard material, such as removing the yard waste from the can to the truck. The Mayor commented that he would like more discussion on this subject with Mr. Newton. Staff also explained, in response to Council's comments, that the back yard residential customers who use their own trash cans will still be permitted to do so up to a limit of four containers and a rate increase of 7% for the first 150 feet distance from the street. Councilmember Gilb questioned the charge to the customer for the re- cycling program as opposed to a rebate. Mr. Newton explained the automated service and went on to say the recycling program in itself is not profitable for the refuse company even though the material is saleable. The savings are in the landfill space. Best Disposal I anticipates that the multi recyclable material taken from Arcadia could be as much as 45% of all the refuse removed and save that much space in landfill area. Returning to the subject of yard waste, Mayor Harbicht pointed out that if the customers with the larger lots can not use their own cans or plastic sacks their increased cost could possibly be up as much as 25% to 30% over the current cost. These people would need three or four of the 90 gallon automated cans. He feels, to keep cost down and to be socially responsible, in reference to yard waste re- cycled to compost, the customer should be allowed to put yard waste out in plastic bags or their own containers. Mr. Newton replied that Best can put this option back in the agreement ... they are doing so at this time and perhaps this can be phased out at a later time. -6- 12/20/88 ( I I 30:0302 Mr. Newton also verified. in response to Counc11member Chandler's query. that if a family required three 90 gallon cans. the extra two would be at tha additionsl c:oat of $4.00 per _nth. Bast has given outstanding service in the past ... and has indicated their willingness to continue to do an outstanding job for Arcadia. I YOUNG ..I Inquired of staff as to who is responsible to pay for repairs of the (St. repairs - streets dug up and pitted by heavy trucks going in and out of large const.sites) construction projects, Staff replied, if there.}s extensive damage the contractor is expe~ted to repair the street and keep it clean while the construction is in progress. It was also mentioned that this is an ongoing problem. With respect to the condominium project on Camino Real at the ,west end of the City, staff will look into the matter. (Commuter I Councilmember Young reported also that she understands that the City of rail system)V Pasadena is trying to institute a commuter train service using the Santa Fe R9ilway tracks. Parking at the Arboretum or race track was mentioned as a consideration also ... this system, it was noted, would cost far less than any other rail system. CHANDLER ./ Commented that he believes real progress has been accomplished this past year in the area of redevelopment and noted the cooperation that exists between Council and staff. Appreciation was expressed to the staff for a job well done. HARIlICHT (Const. chemical toilets) v In reference to the placement of chemical toilet facilities on construc- tion sites, the Mayor asked staff if the City has any regulations as to where these portable outhouses can be placed on the site. In practice they are placed near the driveway o,r the curb and sometimea left there for several months. He feels this is not a desirable location ... a possible solution might be to require that they not be positioned in the front yard setback. A brief discussion ensued and staff was directed to look into the matter and come back to Council with a report and recommendation.
