HEARING Second Single Family Units ~ ~ M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVLOPMENT AGENCY REGULAR MEETING OCTOBER 18, 1983 The City Council and the Arcadia Redevelopment Agency met in a regular session October 18, 1983 at 7:30 p.m. in the Arcadia City Hall Council Chamber. Haltom PRESENT: Councilmen Haltom, Hannah, Pellegrino, Lojeski ABSENT: Councilman Dring On MOTION by Mayor Lojeski, seconded by Councilman Haltom and carried Councilman Dring was excused. On MOTION by Councilman Haltom, seconded by Councilman Pellegrino and carried on roll call vote as follows the minutes of the adjourned and regular meetings of October 5, 1983 were APPROVED. AYES NOES ABSENT: Councilmen Haltom, Hannah, Pellegrino, Lojeski None Councilman Dring It was MOVED by Councilman Pellegrino, seconded by Councilman Haltom and carried that the ordinances and resolutions be read by title only and the reading in full be WAIVED. CONTINUED - Pursuant to State Legislation the Planning Department initiated a Text Amendment for second unit housing within the R-M, R-O and R-l single family zones upon the granting of a Conditional Use Permit. The Planning Commission felt that the State Law was not appropriate for Arcadia because it would essentially turn the City's single-family zones into R-2 [medium density multiple-family] zones which might create adverse impact on the public welfare of those who own homes in the single-family zone. A sample ordinance was submitted to Council for review. At the September 20 Council meeting the hearing was continued to this date. The Senior Citizen Commission reviewed the Commission's suggested development standards and made recommendations as set forth in its communication dated October 18 and is contained in the material before Council at this time. Mayor Lojeski declared the hearing open and Herb Fletcher, 175 W. Lemon Avenue, stated in part that there is a very definite need to have sufficient legislation to allow second units in certain areas and if it is handled properly it would not destroy R-l neighborhoods but would enhance them. He submitted further in part that economic times have changed and young people find it very difficult to even rent. He brought atten- tion to the downtown area south of Huntington Drive, north of Duarte Road and east of Santa Anita Avenue and noted the lack of high rise development although it has been so zoned. He felt there 'is an oppor- tunity now and urged Council and staff to give this serious considera- tion. -1- 10-18-83 25:0818 Joe Sargis, 1611 Highland Oaks Drive, spoke to the area referred to by Mr. Fletcher in particular and said in part that the reason this property is not selling is because when the H-overlay was placed on the properties everyone thought they could sell for a million dollars.. this never material ized and it never will. He felt. if it were con- stitutional the thing to do would be to isolate an area for senior citizen housing... the units could be small enough to accommodate the senior citizens by setting specific standards. If the developer were sincere enough he could charge reduced rentals and provide a lot of housing for them. And with reference to the State Legislation he felt the State doesn't have the right to legislate what the City can and cannot do withfits property as to zoning matters. He urged Council to adopt the recommended Te~t Amendment and then, if so desired, direct staff or the Commission to iook closely at the subject area (the down- town area) and reduce the lot size standards using the area specifi- cally for senior citizens. No one else de?iring to be heard the hearing was CLOSED on MOTION by Councilman Pellegrino, seconded by Councilman Hannah and carried. I Councilman Haltom said in part that the issue before Council is - does Council want to allow families the latitude of having their parents near them... He noted the size of lots in the southern part of the city -- around 240 feet deep. He felt those property owners who would like to place a second unit on their land for their parents should be permitted to do it legally... util ities are in, the sewer is in, the water is there from the existing house. A covenant could be executed by the owner that only the parents will occupy the unit and the covenant would not go with a new owner. He would be very pleased to get this through for senior citizens and perhaps later legislation could be passed for the young people. Councilman Hannah referred to the County Rental Assistance Program and noted that only 34 persons in the City have taken advantage of this over a period of years, so he questioned whether or not this particular State legislation really appl ies to Arcadia... Arcadia is endeavoring to provide senior citizen housing and it should continue so to do... the elderly should have preferential treatment but he did not see the need for legislating zoning in Arcadia. Councilman Pellegrino had concerns about this legislation.. that there is a definite need but he has problems with the enforcement of the rules... newer communities will probably not have the deep 200 and 300 foot lots... Arcadia is an older community with an excess of property some of which is really a waste. He submitted there is need for housing for the young also and this should be addressed at some time. Mayor Lojeski submitted in part that this type of State Legi'slation is definitely state meddling at its worst... that historically there has been careful zoning which has played a major role in the development of the City.. that the citizens are proud of Arcadia as a city of beautiful homes and he fears this reputation may be tarnished... that if the State mandates something which is definitely a local issue then the state I should provide some sort of appropriate reimbursement Jor all costs bor by the city in its implementation. He was concerned about enforcing th conditions of such second unit housing permits; also what happens if th owner dies or leaves the property... He would like to preserve the char acter of the neighborhoods throughout the city. Mayor Lojeski said further in part that such issues are best addressed by those on the local level who are part of the local environment.. He would support an ordinance setting forth requisite findings to pre- clude such housing within the city and he expressed interest in direct- ing staff to look at the possible rezoning of the H zoned property east of Santa Anita and perhaps reduce the size of the standards of develop- ment. Mayor Lojeski then MOVED to direct staff to draft an ordinance setting forth requisite findings to preclude second units within the City provided for by Section 65852.2(c) of the Cal iforniil'Governmen't;" Co'de: -2- 10-18-83 I ~. HEARING (Church) APPROVED WITH CONDITIONS 0~ l 25:0819 Motion seconded by Councilman Hannah and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Hannah, Pellegrino, Lojeski Councilman Haltom Councilman Dring Appeal filed by Dr. John Gottuso from the decision of the Planning Commission in its denial of his application for a Conditional Use Permit for a church at 141 W. Las Tunas Drive. The Commission had found that there was not adequate parking space and the proposed off- site parking was too far from the proposed church. Mayor Lojeski declared the hearing open and Dr. Guttuso, 370 W. Las Flores Avenue, spoke at' length on what is proposed... there would be two services on Sunday - one in the morning and one at night - there would be Bible study one night a week. He noted that the facility is now being used as a pre-school.. they had invested their total savings to purchase the property in order to have a church ministry. He explained in detail just what they are endeavoring to do... there will not be any social events... they are into personal growth. As to the parking there would be sufficient on the church property and they would not need to use parking across the street as originally planned. There would never be more than 50 persons in attendance.. based on the 4 to 1 ratio there would be about 12 parking spaces and with some redesigning there could be more in the rear of the building. Henr~ Barbosa, 617 S. Olive Street, Los Angeles, attorney for the app11cant, said in part that the City Code does not specifically set a formula for a church .. that Dr. Guttuso would never have more than the 50 persons at anyone time and submitted that the Fire Department had said the building would be suitable for up to 180 persons, however, that would not be in Dr. Guttuso's plans. Mr. Barbosa detailed how the parking could be realigned to meet the need. A plot olan of the park- ing was circulated among the. Council. In response to a question as .to why the new plan was not submitted to the Planning Commission Mr. Barbosa said in part that Dr. Guttuso was not represented by counsel at that time and has since been in a position to determine the way in which the park- ing requirement could be met. A resident of 334 Eldorado was advised on what the Council is facing with this issue -- it is seeing a plan different from that reviewed by the Planning Commission --- and if she had any underlying theories to please put them to rest. An adjacent neighbor said in part that he feels confident Dr. Guttuso would not abuse conditions set forth by the Council; that he under- stands what they are trying to do... the congregation is concerned with personal growth and urged approval. Paul Quakkelstein, 159 W. Sandra Avenue, expressed opposition to the proposal.. he felt the site is not good for a church.. that with the pre-school they are having a lot of on-street parking and probably will have more if the church is approved. He also felt there is a possibility the property in the back of the subject house may in time be purchased to join the church. Dr Guttuso responded in part that they have no interest in the house on Sandra... it has been sold and their facility is fully self-con- tained. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Pellegrino, seconded by Councilman Haltom. Discussion ensued on whether or not to send the matter back to the Planning Commission due to the new parking plan.. Councilman Haltom felt the matter could be expedited .. it is not a structure change or anything as serious.. that if it is approved it should be justified to Planning and show the Commission why and if it- is granted. -3- 10-18-83 25:0820 Councilman Pellegrino submitted in part the conditions on which he would approve the conditional use permit. (See motion) Mayor Lojeski was of the opinion that the new parking plan should go back to the Commission.. there have been substantial changes in what is before Council and that which the Commission acted upon.. He would like to have the Commission's input and urged Council to consider giving this back with the appropriate changes a~ outlined on the new plan. He felt there is ample time to do this and have it back before Council by November 1. Councilman Hannah said he would vote in favor only if the City Attor- ney would have the last word on whether or not the covenant is legal. It was then MOVED by Councilman Pellegrino, seconded by Councilman Haltom and carried on roll call vote as follows that the conditional use permit be granted as follows: 1. That the maximum occupancy at anyone time shall not exceed 50 persons. I 2. That required exits shall be installed and that all Fire Safety requirements shall be complied with to the satisfaction of the Fire Department. 3. A minimum of nine (9) parking spaces shall be provided consistent with the plot plan attached and incorporated as part of this res- olution. The applicant shall maintain a parking-to-occupant ratio of 1 to 4, on-site; however, in no event shall occupancy exceed 50 persons, nor the maximum parking exceed 12 spaces on-site. 4. That the church shall not operate until all conditions of approval have been complied with. 5. That C.U.P. 83-16 'shall not take effect until the owner and appli- cant have executed a form available at the Planning Department in- dicating awareness and acceptance of the conditions of approval. 6. Occupancy in excess of 50 persons shall be deemed an expansion of an existing use pursuant to A.M.C. 9275.2.16, and is therefore not permitted pursuant to this Conditional Use Permit. Applicant shall permit inspection of premises subject to C.U.P. 83-16 by a City inspector at all times while such premises are in use and shall upon request provide the City with any information deemed necessary by City to determine occupancy numbers related to church use and church-related activities. 7. This Conditional Use Permit may be revoked if any of the conditions set forth in this resolution, or any valid regulation of the City is violated. 8. That a covenant (and any other agreement deemed necessary by the City Attorney) in a form and content approved by the City Attorney I shall be recorded noting that the owners of the subject property will not offer or attempt to sell, dispose or otherwise alienate the property as a church use, and further, upon any sale or dis- position of the property, the Conditional Use Permit for a church will lapse and expire of its own terms, and the property will ther~~ fore be sold only as a pre-school. Plus other conditions deemed necessary to assure enforcibi1ity of these conditions. Fairview Avenue. subject to conditions. is for a proposed ~ unit condominium at The Planning Commission recommended approval Mayor Lojeski declared the hearing open and no one desiring to be heard the hearing was CLOSED on MOTION by Councilman Hannah, seconded by Councilman Haltom and carried. Due to a possible conflict of in- terest Councilman Pellegrino did not participate in this matter. During this consideration Mayor Lojeski expressed concern on the 50 foot width of the lot which is very deep and felt the project would be better served if the developer could obtain the adjacent property. Staff submitted in part that the property has been zoned R-3 for at least 15 years and there are many such lots especially in the down- town area. In the future the tentative maps wjll carry sufficient and clear information for Council review. It was MOVED by Councilman Hannah, seconded by Mayor Lojeski and car- ried on roll call vote as follows that the Negative Declaration be approved and filed, find that the project will not have a significant effect on the environment, that the Director of Public Works be AUTHORIZED to approve the subdivision and that the tentative map be APPROVED subject to all conditions set forth in the staff report of October 18, 1983. The Agency adjourned to a CLOSED SESSION on litigation at the con- clusion of the regular meeting - then to 7 p.m. November 1, 1983 in the Conference Room. Council reconvened. AUDIENCE PARTICIPATION Herb Fletcher, 175 W. Lemon Avenue, spoke to the excellent water supply enjoyed by Arcadia and felt a study is in order to estimate average costs and perhaps find a way to reduce consumer costs. He also referred to the so-called Granny Law relating to second unit housing within the R-r~, R-O and R-l single family zones and the Text Amendment prepared and reviewed by the Planning Commission. The Com- mission felt the State Law [SB 1534] is not appropriate for this City and a sample ordinance was prepared and submitted setting forth the requisite findings to preclude second units within the City. Earlier in this meeting the Council had approved the Commission's recommenda- tion. Mr. Fletcher submitted in part that in his opinion the Council did not study the issue sufficiently; that certain areas of the City needed personal review and asked - as a public announcement -'that anyone interested in dividing the City into Districts to contact him. -5- 10-18-83 vi? e C/ 8c. Duarte Road, subject to conditions set forth in Resolution No. 1247. RATIFIED the Conditional Use Permit qranted by the Planning Commis- sion for an automotive garage at 11725 Goldring Road [Chicago Park area] subject to conditions set forth in Resolution No. 1248. 1 ACCEPTED the recommendation of staff and rejected the one bid re- ceived for the relief sewer construction at Huntington Drive and Second Avenue - Job No. 546 - due to the fact that the bid from A & A Pipeline, Inc., was 30% over the estimate and that only one was received. It was staff's observation that at a later date this project might be combined with another relief sewer jOb to make a more attractive bid package. ACCEPTEO the work and AUTHORIZED final payment to Sully-Miller Con- tracting Company in the surface reconstruction of Santa Anita Avenue. Colorado Boulevard to Camino Real - Job No. 522 - pursuant to the terms of the contract. Final contract amount of $296,085 was funded 86.22% with Federal Aid Urban Funds with the balance funded by State Gas Tax Funds. The 350 foot extension increased the project cost of $14,067.25 and was funded entirely by State Gas Tax Funds. $364,810.50 was appro- priated for this project. AUTHORIZED the purchse from Mission Chevrolet for a total cost of ~17,229.23 of one 1/2 ton Pickup Truck and one one-ton Cab and Chassis. The 1/2 Ton Pickup Truck is to be a replacement for the Water Department and the l-Ton Cab and Chassis is to be a replacement truck for the Pub- lic Works Department. The pickup is in the Capital Projects Budget, Water Division, for $10,500. The l-Ton Cab and Chassis is in the Equip- ment Replacement Fund for $14,000 [FY 1983-84J. APPROVED the proposed Coyote Control Agreement with the County Agricul- tural Commissioner for the FY 1983-84 and AUTHORIZED the City Manager to execute the agreement in form approved by the .City Attorney. They were evaluated by the City's telepohone consultant, Don Bushor of COM Systems, Inc. and ECI Communications was judged as meeting the basic bid requirements. The consultant evaluated the system's hardware, software, maintenance and costs as well as the vendor's training programs and ability to meet the City's installation schedule. Total cost of the system is $143,986. The system will require trunk and line installations from Pacific Tele- phone at a cost of approximately $3,705. Total installation and pur- chase price is estimated at $147,691. It was recommended that the system be purchased on a cash basis rather than a lease/purchase option basis. -6- 10-lR"R1 . , I lOa. The additional cost would be $6,000 thus making the total purchase price and installation at $153,691. Due to the complexities involved in installing a phone sys- cem the consultant also recommends that a 10% contingency fee be authorized 'Ihich amounts to $15,309. Staff recommended purchasing the electronic instruments and the addition of the contingency fee. The entire system including the Fire Department, City Yards, City Hall, Police and the li- brary is expected to be operational by January 1, 1984. Whereupon it was MOVED by Councilman Pelleorino, seconded by Councilman Haltom and carried on roll call vote as follows that $169,000 be author- ized from the Capital Outlay Fund for the purchase of a new city tele- phone system from ECI Communications, Inc. AYES: NOES: ABSENT: Councilmen Haltom, Hannah, Pellegrino, Lojeski None Councilman Dring 1 Councilman Hannah brought up the present practice of an applicant, who has had his project disapproved by the Planning Commission, appeals the decision to the City Council. Sometimf's the Council is presented with an entirely new or different plan froll those reviewed by the Com- mission... and the Council at times overru es the Commission. It was felt that this is procedurally incorrect a Id the need for guidelines was submitted... perhaps whereby the appl' :ant would be advised that if the Commission denies his proposal he wJuld have the opportunity of revising his plans and the Commission would then act on the new proposal. Staff will prepare an ordinance for Council consideration to this effect. The meeting adjourned in memory of Dr. Charles Shore who passed away recently in Los Angeles. Dr. Shore was associated with Drs. Ritter and McCauley for over 20 years, and was on the staff at Methodist Hospital. He is survived by his wife Frances, and two daughters. -8- 10-18-83 25:0825 and in memory of 1 ADJOURNMENT November 1 7 p.m. Samuel Alan Muir who passed away October 16, 1983. Mr. Muir was 42 years of age, born in Temple City, California moving to Arcadia at age 5. Attended Arcadia schools and graduated from Arcadia High School in 1959. Continued his education at Citrus Junior College and graduated with a degree in Police Science. Mr. Muir worked for the Temple City Sheriff's Department since 1977 and was very active with the formation and operation of the Arcadia High School Alumni Association. Sam's love was law enforcement and he wore his badge with pride. He is survived by his wife Marilyn, a daughter, Melinda, age 17, a senior at Arcadia High School.
