ment Agency met in a regular session Tuesday, September 18, 1984

Arcadia High School Student Body President, Chris Konzelman
presented members of the City Council credentials for the forth-
coming football games and invited each to attend the games. He
introduced members of the Student Body, Chris Murphy, Patty
Sma1dino, Stacey Caputo, Jeff Clark, Anne Sciarra, Sharon Green
and members of .the Pep Squad.
The City Attorney presented, explained the content and read in
full Resolution No. 5195, commending the Arcadia Olympic Commission
and recognizing the dissolution of said Commission. Title of
Resolution No, 5195: "A RESOLUTION OF THE CITY COUNCIL OF THE.
CITY OF ARCADIA, CALIFORNIA, COMMENDING THE ARCADIA OLYMPIC
COMMISSION AND RECOGNIZING THE DISSOLUTION OF SAID COMMISSION",

Counci1member Lojeski then made, on'beha1f of the City Council,
presentations to the members of the Olympic Commission who were
present, i. e., Dennis Alfieri, James Considine, Robert Hillman,
Chris McGuire, Gordon Penhar10w, Steve Worsley, and Craig, Lucas.

Appeal filed by Luis Buonsanti from the Planning Commission's
decision which granted a six month time extension for the
completion of concrete sidewalks and driveways at 132 W. Las
Tunas Drive, and the submittal of a grading and drainage plan.
These same conditions were required in 1983 when the Commission
approved Conditional Use Permit to allow the operation of an
automofive garage at the same address. The applicant would like
to delete these conditions. The applicant also submitted that
he has four years left on his lease which has little chance of
being renewed because the landlord is contemplating other possi-
bilities for the property. Compliance with this requirement
would create a financial hardship. The Planning Director said,
in part, that although there are three businesses located at
the subject location, it is considered a single lot so the
conditional use permit refers to the entire lot.

Mayor Hannah declared the hearing open and Sandra Rentschler,
123 S. Magnolia, Monrovia, daughter of the applicant, Luis Buonsanti,
dba C & L Auto Body, noted that they have worked hard to bring the
business to where it is; they have complied with all the various
requirements of the Fire, Planning and Building Departments, ex-
cept the one pertaining to the construction of a sidewalk ...
they have run out of funds at this point. Also, the landlord
is planning to ,develop the property.., their lease has about
four years to go. She noted that there is a sidewalk, but it
is asphalt .,. it is not a very heavily travelled section of the
City. This requirement would place an extra financial burden on
them and asked Co~nci1 to take all this into account and not make
this a requirement.
In response to questions, Mrs. Rentschler stated, in part, that
there are two other businesses in the subject 1ocation: a 1itt1e
kitchen shop to the west and next to that, a 1itt1e Ita1ian pizza
place. She also said the lowest estimate for the construction
of a sidewalk is $7500. It was submitted that the Director of
Public Works gave a figure of $5000.
No one else desiring to be heard, the hearing was CLOSED on

Counci1member Young submitted, in part, that it would appear to
be more fair to pro rate the sidewalk cost among the people using
it, or fronting on it. The applicant would be paying for side-
walks for the other businesses,

Councilmember Gilb said, in part, that the only way sidewalks are
going to be constructed in the area is to put them in when they are
required, The applicant has gotten the conditional use permit know-
ing that was one of the conditions a year ago. Council has no way
of knowing if the property actually will be developed in four years,
but he felt the people who go into business in the area deserve side-
walks in front of their establishments just like anyone else '" and
if Council does not enforce the conditional use permit requirements,
then we are going to have a substandard area from our own doing ...
it may be hard-hearted, but business is business and that area is
entitled to sidewalks as much as other sections of the City,
Mayor Hannah agreed and stated, in part, that this particular require-
ment has never been waived and Council would be remiss in not support-
ing the six month time extension that the Planning Commission granted
to deny the appeal.
Councilmember Pellegrino made a personal observation, in part, that
he did not think it fair for one business to have the burden of con-
structing sidewalks for three businesses .,. he did not like to see
someone on only a three year lease pay so much to help update the
area .,. after all the improvement will actually benefit the landlord,
He would really like to see the time extended until the end of the
lease, but recognized the requirement of the conditional use permit,

Appeal filed by Marie M. Hart from the decision of the Planning
Commission in upholding the denial of the Architectural Review
Board of the Santa Anita Village Community Association for the use
of GAF Timberline Class-A Fiberglass roofing material (three dimen-
sional) at 805 Coronado Drive. The staff report indicated that it
has received 344 resident signatures within the Village boundaries
on a petition which states that they have no objection to the installa-
tion of the requested roofing material -- that this roofing is compat-
ible with the aesthetic standards of the area. The Association's
Architectural Review Board felt that composition roofing does not
meet those standards and denied the request which decision the City
Planning Commission upheld. Staff circulated samples of the type
of material contemplated,

M~yo~~~nnah declared the hearing open and the applicant,
Mrs. Marie Hart, 805 Coronado Drive, submitted photographs of some
of the homes which had fiberglass roofing, three of which were in
the Santa Anita Village area and one of a home in Lower Hastings
Ranch which is the exact type she desires. Mrs, Hart noted that
there are homes in the Village with composition roofs which are
much less attractive than the one she selected. In response to a
, i~ question as to how these roofs were approved, she said she did not

Mrs, Hart stated further, in part, that she has lived at her present
address since 1947 and has always felt there was a need for protection
to the property owners from construction materials or methods which
would lower the standards and adversely affect property values, but

in this instance, she felt the Board is not reflecting the true
wishes and needs of the residents. She felt approval by the Council
of her application would send a message to the Architectural Review
Board to be more flexible in its considerations on an individual
basis. She noted the 344 signatures collected from residents in
the area in favor of the roofing material which she said the Highland
Oaks Architectural Review Board has approved... it is being used
in Pasadena and San Marino and is a fairly new type of roofing, It
carries a 30 year warranty and is rated by the Fire Department as
Class-A.
Herb Fletcher, 175 W. Lemon Avenue, stated that, although he does
not know Mrs. Hart or live in the subject area, he felt that the I
individual homeowner should be given freedom to do with his property
what he judges best as long as he stays within the code of the City
of Arcadia and does not attempt to do something just to spite the
neighbors '" that perhaps if the Homeowner's Association really
does feel so strongly about this, they might levy a fee against
its members to help pay for the shake roof.
Dorothy Somers, 949 Victoria Drive, spoke in hopes that the
signatures of the majority of the residents would indicate the
need to update the roofing guidelines of the Review Board. In
talking with the homeowners, it was evident to her that the present
roofing restrictions are not meeting the needs of the majority.
Because of the current ruling for fire retardant roofs, the excessive
pricing of roofing and the variety of choices, the majority of home-
owners there want the roofing requirements of the Village reviewed
and updated. Their concerns are genuine and need serious considera-
tion.
Howard Brosius, 950 Victoria Drive, said, in part, that he and Mrs,
Brosius assisted in obtaining the signatures on the petition and
found that most everyone seemed very interested in being able to
have a less expensive roofing material when the differential in
the price was made evident -- about $10,000 for a wood shake roof
against $6,000 for fiberglass,
James Lyons, 317 S. Old Ranch Road, spoke in support of the request
and expressed concern about the fire protection involved. He referred
to a fire at the Arboretum a few years ago and how the sparks landed
on roofs in the subject area ... everyone was hosing down the roofs.
He helped on taking the survey and found very little opposition to
signing '" on Drake Road, for instance, out of 24 he received 2
objections ... Fiberglass is a new innovation and questions why the
residents in the Village are not allowed to use it. He had spoken
with the Battalion Chief of Arcadia who was very enthusiastic about
fiberglass.
Len McKiddy, Stevens Roofi ng Co, in Pasadena, 62 N., Lotus, spoke on
behalf of the fiberglass composition shingles ... stating, in part,
that it is fireproof whereas fire treated shake will burn.,. there I
are many different names for fiberglass, but they are all Class A.
Steve Walsh, Royal Roofing Company, 130 El Dorado, Arcadia, said it
is not standard procedure to reroof without a permit ,.. and explored
how this occurred in this instance. He had contacted the Architectural
Review Board about a week before he started, left a sample of the
material and then waited for their response. However he had not
heard and because the old roof had to be torn off, he went ahead
and did this and resheeted, which had to be done. He was advised
by the City that he had to get approval of the Board first..,
before a permit could be issued. He explored the difference in
wood and fiberglass.

Ed McGuinness, 819 Coronado, spoke in support of the request and felt
the proposed material would be attractive.
Robert Munro, 408 Cabrillo, Chairman of the Architectural Review
Board, spoke at length concerning what had transpired -- that Mr.
Walsh had brought over tne samples and the Board did meet about a
week later, He also had spoken with Mrs. Hart on several different
occasions, also her son. His records indicate that between 1976 and
1984, 209 sets of plans had been reviewed by the Board. A survey
had been taken of the roofs in the area and it indicated 8 with
Cal-shake, 22 with rock roofs, 14 with composition shingles with
the balance wood shingle or wood shake. He felt to lower the
standards would be displaying bad faith -- that he has a letter
from a realtor active in the subject area stating that asphalt
shingle roofs belong on lower priced homes ... that to permit them
would cheapen the house and the neighborhood ... to put an asphalt
shingle roof on homes in the price range of about $175,000 would be
a poor investment on the part of the homeowner, He submitted that
the Review Board review what is submitted and render its opinion on
that. The Board also takes the position that what is submitted will
comply with the fire code because a permit must be issued.
Wes Slider, 921 Balboa Drive, told of his visit with Mrs. Hart when
ne-was approached with the petition and from what she said he signed
the petition, but subsequently he discussed the matter with a member
of the Review Board and was advised that the type of roofing material
proposed was not permitted. He said Mrs. Hart had not said the City
had denied her request and because of the ci.rcumstances, he would
like his name stricken from the petition. During this consideration,
it was brought out that there were different petitions circulated --
that is -- the heading on each.
Steven Philipi, 804 Balboa Drive, spoke in oPPosition to the appeal,
stating, in part, that Mrs. Hart was able to collect a lot of
signatures which he could understand giving the nature of the
people who live in the Village area. When he was approached, he
was told that Mrs, Hart needed the signatures in order to put on
a new roof ... at no time was it stated that the roof was considered
non-conforming. He did not believe the 343 persons who signed under-
stood they were giving up some sort of right. He stated further, in
part, that one of the reasons for living in the Village is because
of the protection which exists as a result of the restrictive
covenants .., it is a very serious issue which must be considered
and he did not think there is any question but that the wood shingle
roof is a more aesthetically pleasing roof, a better roof for holding
property value.
George Campbell, 842 Balboa Drive, said, in part, that the fire which
was refe,rred to earlier had nothing to do with the roof -- it was'
an electrical fire -- that if allowed to continue, probably would
have gutted the house. Regarding Cal-Shake, it can be used on any
roof that is acceptable pitch-wise for shake or shingle .., if one
gets into clay type roofs, the roof has to be braced to accept the
weight. In response to a question, Mr. Walsh, the roofer in this
case, said he has been a licensed contractor for eight years.
Ron Van Orden, 928 Palo Alto Drive, said after he signed the petition
he-realized he had been in error and he wasn't interested in what
was being talked about ... that the community as it stands today
reflects the work, the standards established by the Review Board ..,
he would like those standards maintained.

Jim Blackburn, 1031 Coronado Drive, said he si9ned the petition,
not being fully aware that the material did not meet the standards
of the Review Board, and after looking around the area, he adamantly
opposes that type of roof, He would, like to maintain the neighbor-
hood a s it is,
Theresa Sinclair, 927 Palo Alto Drive, asked where does one draw
the line between aesthetics ,.. what is acceptable or what is not,
She felt most of the people who were contacted felt they were talk-
ing about something that had three dimensions -- like a Ca1-Shake,
She sa id she has 1 i ved in the subject area three months and they
purchased in the Village because of the school system and the
aesthetic feeling.
Jack Sae1id, 821 Balboa Drive, Past President of the Santa Anita
V1TTage Homeowners' Association and has served as Chairman of the
Architectural Review Board, said, in part, that he feels the associa-
tions of homeowners are one of the main factors in maintaining the
City as a kind of place one likes to live in ." He feels the Review
Boards have a responsibility to look far and deep to find materials
which are aesthetically suitable and compatible to use in place of
cedar, There will always be forces that downgrade the requirements
based on economics. He referred to a survey taken some years ago --
out of 612, they received about 400 responses which indicated they
wanted to "rigorously enforce the roofing material requirement as
set forth in the City Resolution". Because it was an unsigned poll,
a postcard poll, he was inc1 ined to think that it did at that time
represent the feeling of the people in the Village. From then on,
the Review Board briskly enforced that standard. He said all one
has to do is to look at the roof on Cabrillo and it can be clearly
seen that it is not compatible with the neighborhood. He felt that
they might come up with other materials but not the one presented
tonight, He asked Council to maintain the standards which have
made the City so great ". and asked for denial of the appeal.
Wes Slider spoke once again, saying, in part, that he did not read
the. heading of the petition he signed .,. which he felt supports
his contention that there was misrepresentation,

Vern Leeper, 518 N. A1tura Road, Chairman of the Architectural Review
Board of the Santa Anita Rancho Homeowners' Association, said, in
part, they use the same guidelines in considering roofing materials
... they have looked at literally dozens of samples of roofing
materials, talked with contractors, looked at many homes where the
roofing is in place and it is still their opinion that no composition
material meets the level of quality and appearance that they think
the area deserves. On behalf of his Association, he spoke in support
of the position of the Village Association in this particular appeal.
In response to a question, Mr. Leeper said further, in part, that the
subject material looks better in a piece than when i.t is in place on
a home.

Jim Considine, 1027 Encanto Road, Past President of the Santa Anita
Rancho Homeowners' Association, said, in part, that he was President
at the time the fire ordinance was enacted ,.. they conducted an
extensive survey of roofing materials available at that time .,. the
results were overwhelming in favor of maintaining the Review Board's
standards,.. the rules and regulations were put in "place for a
reason; people moved into the area as a result of what the rules and
regulations did and"people are counting on these rules and regulations
being enfOrced and not overturned. If the authority of the Archi-
tectural Review Boards is lost, it could have a disastrous effect.
He asked that the appeal be denied.

Mrs. Hart spoke once again questioning the effort to discredit the
petitions .,. and explained the reasons for the changes in the head-
ings of the petitions. She felt the material in question would be
compatible with others in the Village -- that other residents feel
the same way, She said she did not misrepresent anything at the
time the signatures were being obtained. She felt the standards
of the Village should indeed be maintained and suggested the homes
in the Highlands which have fiberglass roofs be reviewed .,. the
homeowners' association has approved the brown or rust brown color,
Ed McGinnis, spoke once more, stating, in part, that he was surprised
that Mr. Philipi felt he was misleading when his signature was being
solicited '" it was not his intention to do so and wanted to assure
Council and his neighbors that in no way did he want to deceive any-
one.
No one else desiring to be heard, the hearing was CLOSED on MOTION

Councilmember Pellegrino said, in part, that he would like to see
the Architectural Review Board assess the fires that have hit
California in the last five years -- to ascertain the difference of
opinions of roofing materials, For the protection of the community,
he would like to know the fire ratings of Class A,~B and C. Aesthet-
ically, the guidelines have been set by prior Councilmembers and that
should be maintained, but at the same time, the economics of putting
on a roof today should be considered.
Mayor Hannah commented, in part, that Mrs. Hart's residence is with-
out a roof and she has an immediate problem.
Councilmember Young said, in part, that she agreed with the Archi-
tectural Review Board. She appreciates the problem of the price of
a roof today and wondered if it were possible to send this back for
further study and get an answer back fast enough to put a' roof 'on
Mrs. Hart's house. The City Manager said, in part, that he doubts
the Association could come up with the miracle product that the Rancho
Association has not been able to come up with in the last 20 years
in time to put a roof on her house before it rains again.
Councilmember Lojeski said, in part, that the Associations do a
very credible jOb and as time goes on, there will be some items
and some things that time will negate. He felt the contractor who
attempted to do this without going through the proper procedure is
wrong .., the fact that Mrs. Hart's roof has no covering is his
problem. He did something illegal and he should have been aware of
that as a roofing contractor. He felt that as time goes on, there~
will be different materials .., the ordinance was changed for the
safety of the residents and in the future there will probably be
different types of materials, but in this case, he did not feel
this will happen. Much of this could have been rectified if the
proper permitting channels would have been taken in the first place.

Councilmember Gilb said, in part, that the Architectural Review
Board is actually the voice of the people of that Association .,.
that it has worked well and the properties in that area are quite
valuable through the enforcement of those standards '.' that there
are materials around which perhaps the Board has not seen, He did
not feel the Council should approve a roofing material that has not
been approved by the Homeowners' Association. As far as Mrs. Hart's
problem is concerned, that has to be solved ... if she is allowed
to install this material in question then there will be other
residents wanting this. He felt the Board's decision should be
upheld, but if there are other materials that the area wishes to
accept as the norm, then that area should get together and advise the
officers of the Association that they want the change... that to Changel
to this kind of roofing, the values will be changed considerably.
Councilmember Young agreed with Councilmembers Lojeski and Gilb ...
the standards should be upheld ... but she felt research needs to
be done.
It was then MOVED by Councilmember Lojeski to DENY the appeal
(M-84-94) upholding the Architectural Review Board of the Santa
Anita Village Homeowners' Association; find that the approval would
not secure an appropriate improvement; prevent unreasonable hard-
ship or promote uniformity of development and find that the proposed
roof would not comply with Subsections 10 and 11 of Section 2 of
Resolution No. 4019. Motion seconded by Councilmember Young and
CARRIED on roll call vote as follows:

It was MOVED by Councilmember Gilb, seconded by Councilmember
Pellegrino and CARRIED on roll call vote as follows that it be
the recommendation of the City Council that the Santa Anita Village
Association meet with its officers and the Architectural Review
Board as soon as possible to determine if they would like to change
the roofing standards in its area '.. and make proper recommendations
to the Architectural Review Board to pass on to the City Council.

Planning Commission recommendation concerning regulations relating
to the construction, installation and maintenance of antennas. The
Planning Director presented the staff report and noted that the
antenna height limits remain unchanged in the proposed regulations.
There were some questions regarding the impact of the proposed
regulations on various types of antennas.

Councilmember Lojeski noted that he had received calls relating to
the aesthetic problems with dish type antennas. He also noted that
problems with the Cable TV franchise have probably lead to the in-
creased prevalence of dish antennas.
Mayor Hannah asked if the regulations could be revised to apply just
to the dish antennas. The Planning Director responded that the
regulations could be split.

The City Attorney commented that conceivably an argument could
be made that the City would be treating antennas differently,
which may weaken the application of the ordinance, however, he
said that 'he was not aware of any court tests and that there may
be rationale which will come out at the hearing which will justify
tlifferential treatment and support findings for such treatment.
There was additional discussion regarding the idea of regulations
addressing only dish antennas.
Councilmember Gilb MOVED to direct staff to disregard the Text
Amendment before Council and come back with an ordinance specifically
geared toward the satellite dishes. Councilmember Lojeski seconded
the motion. However, both motions were withdrawn in order to open
the public hearing.
Mayor Hannah declared the hearing open and James Helms, 2220 Sewanee,
an amateur radio operator, noted that the Council had received
corespondence from himself and many other amateur radio operators
and many were in the audience who were in opposition to the amend-
ment. However, if he understood Councilmember Gilb's motion, he
would close any opposition to the text amendment,

The Agency had previously approved a 2 month extension to the Exclusive
Right to Negotiate (ERN) with the Falzone Development Company. The ERN
expires September 21,1984. Mr. Falzone has requested an additional
30 day extension because of his recent illness and hospitalization. It'
was MOVED by Member Lojeski, seconded by Member Young and carried on
roll call vote as follows that the Agency authorize an extension of the,
Exclusive Right to Negotiate dated December 21,1983 for one additional
mOnth or until October 22, 1984.

The Agency authorized the use of Miller-Schroeder Municipals for one
year on September 6, 1983. The Company has throughout the year pro-
vided general financial advisory services to the Agency and city staff,
particularly in the area of bond financing and on possible Civic Center
financing. Pursuant to the contract they have also prepared an anal-
ysis of the Agency's financing. There is no cost to the Agency, ex-
cept in the event the Agency or City issues tax exempt bonds, we would
then be required to utilize their services and pay their fee. It was
MOVED by Member Lojeski, seconded by Member Gilb and carried on roll
call vote as follows that the Executive Director be authorized to
execute a one year extension (through September 7, 1985) of the exist-
ing contract.

Pursuant to Agency direction of July 10, 1984 staff prepared a Request
for Proposals (RFP) for development of the city lying south of East I
Huntington Drive between the Larmor-Cameron V office building and the .
AT&SF Railroad to the west. The RFP will be circulated to those devel-
Opers and realtors on the Developer's list as well as to the owners
and tenants of the site pursuant to the Agency's adopted Owner/Tenant
Participation Regulations. It will also be advertised in both the
L.A. Times, Pasadena Star News and Arcadia Tribune. It was MOVED by
Member Gilb, seconded by Member Lojeski and carried on roll call vote
as follows that the RFP be approved and that $1500 be authorized for
advertising this development opportunity.

A factor which needs to be addressed is "Relocation Goodwill" in
connection with the proposed Beck development site on East Hunting-
ton Drive. It was noted that the Agency is required to consider
the financial impact on a business in the event the Agency requires
its relocation. A technically experienced appraiser will estimate
the dollar loss a company would suffer if it goes out of business
or moves to a different location due to Agency action, Such an
appraiser was recommended by staff. It was MOVED by Member Gilb,
seconded by Member Pellegrino and carried on roll call vote as
follows that the Executive Director be directed to enter into an
agreement for appraisal services (Goodwill) with Desmond and Marcello,
the fee for the appraisals to be paid by Beck and Associates.

Staff has been working for some time under an Exclusive Right to
Negotiate (ERN) with Dean A. Beck and Associates toward the develop-
ment of the northeast corner of East Huntington Drive and Third Avenue.
As part of the preparation for and negotiation of the DDA the Agency
needs to have certain information.., i.e., (appraisal, EIR, financial
analysis) which is of benefit to both the Developer and the Agency.
A Reuse Appraisal will estimate the entire site's future value. Bids
were required for such an appraisal. An experienced appraiser has
agreed to provide the Reuse Appraisal for $8000. Staff recommends a
contingency of $1200 be added in the event additional work is needed,

to execute the contract with Taylor Dark in the amount of $8000 at a
cost not to exceed $9200.

ACCEPTED and AUTHORIZED final payment for the work performed by
Pavement Coatings Company for the annual street maintenance -- Slurry
Seal - Job No. 558. It was noted in the staff report that the final
contract amount, $21,988.96, is funded from State Gas Tax Funds. An
amount of $26,000 was appropriated for this project,
APPROVED the request of the Arcadia Youth Soccer Organization Region 2
to close Campus Drive between E1 Monte and Santa Anita Avenues on

RECEIVED the results of bids received and AWARDED contract for the
construction of ramps for the handicapped - Job No. 554 - to the low
bidder, EGN Construction, Inc., in the amount of $6,956. APPROPRIATED
$9,882 from deposited SB 821 Funds to cover cost of construction in-
cluding design, inspection and contingencies. All other bids rejected;
all informalities or irregularities in the bids or bidding process were
waived. Mayor and City Clerk AUTHORIZED to execute the contract in
form approved by the City Attorney.

Referred to the Olympic Commission minutes of September 12 .. that he
had been asked by the Chairman of the Commission if there were any
problems with the wording of the proposed plaque for the Olympic Rose
Garden or if they could proceed with it. He will contact the Chairman
as they are anxious to get on with the project,
Advised that the Crocker Bank Building on East Huntington Drive was
available for lease and/or sale and suggested staff look into this
as a possible use for senior citizens.
Said she had urged the Senior Citizen Commission to have fund raising
projects in an endeavor to help themselves. She also mentioned that
she had presented the idea of using the schools, since closed and
leased out, for such activities -- also the Maranatha School when it
was ava il ab 1 e.
LOJESKI vi Agreed that the Crocker Bank Building should be investigated
~ he, too, had thought about the Maranatha school site.
