It wai MOVED by Councilmember Young, seconded by Councilmember Chandler and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. CITY ATTORNEY The City Attorney announced that "the City Council and Agency met in a CLOSED SESSION pursuant to Government Code Section 54956.9(b) to discuss two issues where, based upon legal advice and based on existing facts and circumstances, there is a significant exposure to litigation against the City". ' Councilmember Gilb MOVED that procedural ordinance be waived in order to move Item lla. MATTERS FROM ELECTED OFFICIALS forward to be the first item discussed this evening. This was seconded by Councilmember Chandler and CARRIED. Mayor Hsrbicht noted that the Arcadia High School team had entered the Constitutional Bicentennial Competition and won that competition for the 22nd Congressional District. This group of young people is now going to Sacramento to compete with teams from the other 44 Congressional Districts in California. It was then MOVED by Mayor Harbicht, seconded by Councilmember Gilb and CARRIED on roll call vote as follows that the City Council ALLOCATE $500. toward team expenses for this trip. AYES: NOES: ABSENT: Councilmembers Chandler, Gilb, Young and Harbicht None Councilmember Lojeski 1/3/89 -1- l. PUBLIC HEARING (Best Disposal Agreement - Rates Bstab.) (APPROVED) llo.b Y - 31:0003 This public hearing is for consideration of establishing service rates for the collection and disposal of residential refuse within the City of Arcadia by agreement with Best Disposal. Dale Newton, 943 Balboa Drive, President of Best Disposal, was presen~ answer questions as was staff member Alex McIntyre. Councilmember Gilb expressed his concerns with regard to the charges of Best Disposal for backyard pickup, which had been more expensive for Arcadia residents than for those of some of the surrounding cities serviced by Best Disposal. Councilmember Gilb noted that when the last rate change was discussed, the rate for backyard pickup went to $57. Council was told at that time that Best Disposal had a certain amount of expenses in regard tOI tlilsactivity and that these expenses would be spread over the cities 'they operated in -- Monrovia, Duarte and'whatever else and that the upcoming contract with Monrovia would be similar. However, the Monro rate came to $40. Best had told Council that Monrovia would be in Ii with Arcadia; but they were $17. a month less. Councilmember Gilb thought that this was very unfair to Arcadia; he would like to see a moratorium on the backyard pickup for one year so Arcadia residents could catch up and get some of the money back from the last two or three years. Councilmember Gilb was concerned about this and wanted to be sure that in this contract, Arcadia was not subsidizing other communities. Mr. McIntyre replied that if the driver had to leave the truck and pullout the container, the rate would be raised a little over 2%; if the container is positioned in a manner that it can be picked'up by the truck, possibly the rate would be lowered as much as 14%. Councilmember Gilb remarked that after the last rate change, the only complaints he had had were in regard to the backyard pickup and that he did realize that Arcadia has longer driveways, etc. He wants them to know how he felt about the difference in charges. Mr. Newton indicated that Best Disposal would be providing 60 gallon and 90 gallon bins in the near future which will be necessary for the automated pick- up as planned. One bin per residence will be provided; there will be a $2 charge for each additional bin. Yard waste will not be considered extra trash; that can be placed in trecustomer's own bins or in plastic bags; tree parts can be bundled. Trash that has been compacted in trash compactors may be placed in the regular trash bins. Councilmember Chandler questioned the $l/month surcharge for recyclable material. Staff replied the surcharge would be applied whether or not residents wished to participate in the recycling. There are several reasons for this: recycling is not cost effective for the contractor and would not be for the City if the City were to establish such a program. However, this is a saving in the amount of material going into the landfills, which are filling up rapidly. Also this is an environmental concern -- to recycle materials that can be reused. Staff noted that it had been reported that recycling programs have been successful with 40% to 50% of the residents separating recyclables in the neighboring cities of Duarte and Walnut. Mayor Harbicht declared the hearing open I Roger Schwind, 2335 South Third Avenue, ~tated' in part, that he thought there had been a lack of publicity on this issue and that ' perhaps the City should have brought this contract before the resident so that they could have read the contract for themselves. He under- stood that there was to be an increase in rates and also that the residents would have to pay for the recycling, to which he objects. To his comment that the City should consider bids from other companies, the Mayor responded that the City had received proposals from five companies before deciding to sign the contract with Best Disposal. All proposals were looked at very carefully and extensively reviewed and Council determined that Best Disposal submitted the best proposal. Also he noted that the recycling effort will be voluntary -- no one will be forced to pick through trash. However, landfills are being rapidly filled and within 4 or 5 years this area will be facing a crisis; we are trying to do what we can to head off the problem. 1/3/89 -2- .. ~~ ___.. _.~_____. ...................,...__--...-.........~w~,..-.- I I 31:0004 Council is addressing this by recycling; containers will be provided for aluminum cans, bottles and plastic containers so that these things can be recycled and not go into the landfills; this is an ecologically desirable approach. Another item is the yard waste; Council is hoping people will put that in separate containers so it can be composted and also recycled and n9t go into the landfill. The family c~~,rate is going to be approximately 7% higher than last year; that is n~t an outrageous increase; $1 of that is to help pay for the recycling. A program has been planne~ to inform the residents of just what the new service entails. A mailer is going out from Best Disposal soon, and another in mid-February explaining the program and giving more informa- tion. There will also be meetings scheduled in February so that ' I ' residents may receive information and answers to their questions. I The next issue of the Arcadia Newsletter will also contain this informa- tion. Later in the hearing, Councilmember Gilb commented, in part and in reply to Mr. Schwind, that the biggest problem Council has is informing the community of what is going on. Arcadia does not have a television station or radio; there is a newspaper, but the circulation is perhaps not has high as it could be. Council spent a great deal of time con- sidering the trash pickup proposals and contract. Best Disposal has . I serviced this community for a long time and has done a good job. Council has done its best to get rates that would be fair to everyone. He realizes a lot of people are not going to like the recycling, but this is a problem that has happened and we are all going to have to live with trying to find solutions. This is not just something th~t has come out of the air; Council and staff have spent a great ,deal of time and con- cern on this; we are trying to get this going so that it is something the citizens can live with and we do have to move in the community to help the refuse stituation. Herb Fletcher, 175 West Lemon, asked about the rate to be charged ior single family can service. Staff replied it would be $8.45/month (90 gallon container), which includes the $1 surcharge for recycling. Yard waste will be picked up the same day as the trash. ALIi Roysher, 1784 S. Mayor Harbicht responded that senior rates would be offered; 'also that there is a provision in the contract that upon payment in advance for 11 months, the 12th month would be free. Councilmember Chandler noted that the senior citizen rate would be $6.40/m( for a 60 gallon bin. Mrs. Helfer also said she had a complaint about the amount of junk mail she received in her mail box which just added to .the trash. Bill Weiss, 417 Harvard Drive, had questions as to the rates and the ~n~trash that could be put out for pickup. Mayor Harbicht re- iterated that fue rate would be $8.45 for a 90-gallon can; $7.00 for a 60- gallon can and as much yard waste could be put out as the resident wished. He also noted that the bins would be supplied by Best Disposal; not the City, at no cost to the residents. , - , . AYES: NOES: ABSENT: Councilmembers Chandler, Gilb, Young and Harbicht None Councilmember Lojeski The Planning Commission at its December 13, 1988 meeting voted to I recommend approval of application Z 88-005; a zone change from C-l (Limited Commercial) to C-3 (General Commercial) at 141-149 West Live Oak Avenue and 148-158 Las Tunas Drive. Staff reported the subject property is commonly known as the "Marketowne" shopping center and the C-2 ' zoning designation will allow for a greater variety of uses within this existing center. Pursuant to the provisions of the California Environ- mental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said study did not disclose any sub- stantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project. A Negative Declara- tion has been prepared for this project. In response to a question from Councilmember Young, staff replied that the code violations on the site, as outlined in the staff report to the Planning Commission, are in the process of being resolved. AYES: NOES: ABSENT: Councilmembers Chandler, Gilb, Young and Harbicht None Councilmember Lojeski Earlier this year, the City Council after petitions from property owners and public hearings on the matter, authorized the Superintendent of Streets to construct lighting improvements on Le Roy Avenue and Sewanee Lane as shown on maps attached to staff report dated January 3, 1989. ,Work has been completed in accordance with the plans and specifica- tions. It is recommended that Council approve provision for payment to the City in annual installments not to exceed ten years with a maximum interest of .7%, per annum. After confirmation, an owner has ,fifteen dayl in which to pay the total assessment, after which a lien is filed and entered on the County Assessment Book and collected by the City Treasu (per Section 5895 of the Streets and Highways Code). All notices re- quired have been posted. Le Roy stated, in part, that he wanted more information regarding the costs involved and inquired why he was being assessed for these lighting improvements when the poles are on City property and they service all who use the street. Staff replied that most cities assessed 100% of the cost of installation; whereas Arcadia only assesses 25% to the taxpayer. The cost will amount to $120.42 to each property owner; 100% of the future maintenance and power will amount to approximately $l.OO/month. No one else desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Gilb, seconded by Councilmember Young and CARRIED. It was then MOVED by Councilmember Young, seconded by Councilmember Chandler and CARRIED on roll call vote as follows that the Report of the Superintendent of Streets be ACCEPTED; and that Resolution No. 5457 and Resolution No. 5458 be and they are hereby ADOPTED. AYES: NOES: ABSENT: Councilmembers Chandler, Gilb, Young and Harbicht None Councilmember Lojeski AUDIENCE PARTICIPATION Herb Fletcher, 175 W. Lemon, stated, in part, that he had some concerns about the water supply, especially with reference to the proposed land- fill in Arcadia. He sees this as a potential hazard to the water supply in Arcadia. He wondered just what the water table is worth? If water from the water table was polluted and unavailable, the City would have to pay approximately four million dollars to purchase water from the Water District. Also, it is important that Arcadia not be liable in any way for contributing to the pollution of the underground water table. In trying to think of other uses for this area, he thought perhaps it could be turned into a water conservation park. In the event of an earthquake, a water conservation park would be most valuable. Mayor Harbicht noted that the pit in the proposed landfill area would not hold water due to seepage. Paul Herr, 515 E. Wistaria, stated, in part, that he was ,present to address the matter of non-smoking ordinances. He presented to Council copies of a model smoking pollution control ordinance developed by American Non-smokers Rights. He noted that Councilmember Lojeski had indicated he was in favor of such an ordinance. He had also talked to the City Attorney about this ordinance. This is an ordinance to protect the public health and welfare by prohibiting smoking in public places except in designated areas and regulating smoking in places of employment and to strike a reasonable balance between the needs ,~f those who smoke and the need of non-smokers for smoke-free air. Where conflicts exist, the need for smoke-free air should take priority. He noted the reports which he had presented to Council indicated that second-hand smoke is the cause of disease in healthy non-smokers. He also suggested that public opinion polls indicate the public wants limits on where smoking is allowed and feels that smoke is hazardous to non-smokers. He called attention to several other publications with headline stories about smoking concerns. He indicated a list of 321 cities in the United States which have smoking control legislation with 150 cities in California included. Arcadia Methodist Hospital is a non-smoking facility. He feels the City of Arcadia should follow this lead and pass a smoking pollution control ordinance. He re- quested that Council make the model ordinance an agenda item for a public hearing. Councilmember Gilb noted problems with, for instance, small restaurants which would not have room for two separate areas and also the Santa Anita Race Track. In response, Mr. Herr stated, in part, that since most of Santa Anita Race Track is outdoors, there would be no problem. The inside areas, such as the restaurant sections,could be 50% non-smoking and 50% smoking. Mayor Harbicht advised that Council will take this information under advisement. 1/3/89 -5- 5. 6. 6a. ROLL CALL 31:0007 Dr. George Gamboa, 1102 Loganrita, stated, in part, that he is President Elect of the Northeast L. A. County Unit of the American Cancer Society and is an oral maxillo-facial surgeon. He noted that 25 years ago probably 20% of those who smoked were addicted; now because of the many people that have stopped smoking, there are probably 80-90% of people smoking who are addicted. The addiction can be broken. He has been involved in a "Stop-Smoking" program at Arcadia Methodist Hospital. He agreed that secondary smoke was more dangerous. A person who starts smoking at 15 years of age has 2~ greater potential of lung cancer than a person who starts smoking at age 25; therefore those infants and young people who inhale the secondary smoke will have increased risk of lung cancer as they age. Annually there are about 5,000 cases of lung cancer from secondary smoke. Also, he feels I those people who have stopped smoking have the right to a smoke-free atmosphere. There is also concern for people with heart problems which are exacerbated by inhaling smoke. He hopes Council will make a wise decision when this matter comes before them for the health of our community. At that meeting, Agency requested a number of changes be made in the Design Review. Kam Sang Company has revised and submitted new site plans for the Arcadia Landmark Development. New plans were delivered on December 28, 1988 to all Agency members for their review. A summary of the major changes is set forth in staff report dated January 3, 1989. Huntington Drive be APPROVED subject to the.conditions that the project comply with all Zoning and Building Codes as established by the City; that the property owner comply with the departmental requirements set forth in staff report dated Decembel' 1988 and that the Design Review be in effect for one year, as per Res ic ARA-126. Emkay has requested a formal clarification of their Schedule of Performance under the Disposition and Development Agreement, since the original property transfers were delayed by Edison underground schedul- ing and soils problems. Huntington Drive, the Sus and Pelletiers. The purchase price of $105,000 includes the reimbursement to the owners of some of their costs to re1esign the buildings due to earth- quake damage. The Agreement to Acq~ire Real Property was approved by the Agency General Counsel and forwarded to the owners for execution. AYES: NOES: ABSENT: Members Chandler', None Member Lojeski Gilb, Young and Harbicht The City's Designat~d Towing Contractor (G&S Towing) has been leasing the Redevelopment Agency owned property at 135-141 E. Wheeler Avenue for use as an impound lot since December 1976. The current lease runs until January 10, 1989. Agency staff has negotiated a new lease with G&S Towing for the continued use of the property as an impound lot. Changes in the lease are set forth in staff report dated January 3, 1989. The new lease will increase the current rent of $550 per month to $800 and substantially modify the length of the lease term. AWARDED purchase of breathing apparatus from the low bidder, Santa Rosa Fire Equipment Co. for a total cost of $41,705.93. Funds for this purchase are budgeted in the Capital Outlay Fund, FY 1988-89 in the amount of $40,170. APPROVED the appropriation of additional furtds in the amount of $1,535.93 needed for this purchase. AWARDED purchase of 53 Alert Monitors for the Fire Department. There was one response to bid notice from Motorola, El Segundo, for $23,876.24. Funds for this purchase are budgeted in the Capital Outlay Fund, FY 1988- 89 in the amount of $24,000. AWARDED contract for traffic striping and pavement markings to the low bidder, Traffic Operations, Inc., in the amount of $24,030.93 for Schedule A which indicates the contractor will provide all labor and equipment with the City providing all materials. Funds in the amount of $41,800 have been budgeted in the FY 1988/89 operating budget. Hoard who was a long time resident of the community. He passed away Christmas eve. He and his wife, Jean, have supported almost everything that has happened here. He had a debilitating disease for the last four or five years. He is survived by one son and two daughters. The funeral was held the 29~h of December in Arcadia with Rev. Paul Johenk officiating. Mr. Hoard was a long time supporter and at one time was involved with the Arcadia Beautiful Commission until he became ill. The community will greatly miss him. He was out of the scene for the last three or four years because of this disease. In fact, he was one of those used as an example to go to the U. S. Senate and House of Representatives to try to get some relief from the U. S. government for people who have catastrophic diseases and can not handle the bills,and some relief was given to him and other people like him because his bill was tremendous and no insurance company would cover him. He will leave a legacy in this town because a lot of people knew him. He was very well known and very well respected." At 8:50 p. m.
