Facility for Care of the Elderly) I CLOSED SESSION ADJOURNMENT ATTEST: M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY ADJOURNED REGULAR MEETING FEBRUARY 7, 1989 J The City Council and the Arcadia Redevelopment Agency met in an Adjourned Regular session at 6:30 p. m., February 7, 1989 in the Arcadia City Hall Conference Room of the Council Chamber and CONVENED as the ARCADIA REDEVELOPMENT AGENCY PRESENT: ABSENT: Agency Members Chandler, Gilb, Lojeski, Young and Harbicht None Pursuant to Government Code Section 54956.9(a) the Agency adjourned to a CLOSED SESSION to discuss the existing Federal Court case of the Arcadia Redevelopment Agency vs. Bong. The Agency RECONVENED, ADJOURNED as the Arcadia Redevelopment Agency and - CONVENED as the CITY COUNCIL At 7:00 p. m. Mayor Harbicht called the Adjourned Regular Meeting of the City Council to order, all Councilmembers being present and accounted for. The staff report concerning the proposed closure of the Arcadia Mental Health facility was distributed to Council. This matter arose after the agenda for the Regular Meeting of February 7, 1989 had been posted under the Government Code 72-hour posting requirement. The City Attorney explained the procedure for action to be taken at the Regular Meeting on an emergency situation for a non-agenda item. A flyer in connection with the opening of Mercy's Villa, a residential care facility for the elderly on Santa Anita Avenue, was briefly dis- cussed. The Director of Planning reported that "the facility will house six elderly persons. Mercy's Villa has obtained a State license for this type of facility which was authorized by legislation in 1985. The 1985 legislation expanded upon legislation passed in 1973 where the State closed many State facilities and many mentally ill persons and others were released out into the community. The 1985 legislation goes a step beyond and provides residential opportunities for the elderly. Legislation is clear that cities cannot require a conditional use permit; zone variances; or other local regulations that are not applicable to typical structures in that zone. The City does not have any control in that respect. Further, these type of facilities serv- ing six or fewer persons are not subject to a business license; local registration fees; use permit fees or any other fees. The State has mandated that these type of uses are to be considered as a single family use." The City Manager suggested that the facility should be monitored for property maintenance if it does, in fact, open. The City Manager requested a Closed Session before the Regular City Council meeting this evening.
