I / M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING FEBRUARY 7, 1989 The City Council and the Arcadia Redevelopment Agency met in a regular session at 7:30 p. m., February 7, 1989 in the Arcadia City Hall Council Chamber. It was MOVED by Councilmember Young, seconded by Councilmember Chandler and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. CITY ATTORNEY The City Attorney announced that "pursuant to Government Code Section 54956.9(a) the Arcadia Redevelopment Agency met in a CLOSED SESSION this evening to discuss the existing Federal court case of Arcadia Redevelopment Agency vs. Bong. Additionally, pursuant to the same Government Code Section the Agency d~scussed the existing condemnation case of Arcadia Redevelopment Agency vs. Rentype". AUDIENCE PARTICIPATION Herb Fletcher, 175 West Lemon, stated, in part, that it appeared that one-of the major problems needing to be faced today is the matter of emergency care, since hospitals seem to be running out of funds and many are closing their emergency care facilities or are looking for Government funds to help them. He is concerned about the Arcadia Methodist Hospital which has been attempting to obtain more funds from Medicare. He questions some of the figures they have presented ... if the figures are true, the Hospital is in deep, deep trouble. The City of Arcadia has a special relationship with the Hospital and perhaps it behooves the City to take a look at just what their relation- ship with the Hospital is and what the situation would be if the Hospital had to close or reduce operations. A recent edition of the Tribune stated that the Hospital had lost 18 million dollars on 5,000 Medicare patients; $3,600 for every Medicare patient treated. He questions these figures. In the 1986 statement the Hospital claimed they subsidized Medicare in the amount of 11.5 million dollars; in 1987, 15.8 million; this totals 45 million dollars. He presented the figures which he had taken the time to analyze and suggested the City might take a closer look at the situation. 2/7 /89 -1- 2. 3. i~iL CALL' .y ,- - , 3b. Duarte Road, stated, in part, that the Arcadia School District had recently discontinued bus service for the students who lived within a 1.25 mile radius of their school. His home is out- side a 2 mile radius, but the school refused the bus service for his daughter. He is concerned about the children's safety and was present to ask Council's assistance. Mayor Harbicht replied that the Arcadia Unified School District is a separate entity and that the City Council has no jurisdiction there. The Mayor suggested that Mr. Chen attend the ne~t meeting of the Arcadia School Board and bring this problem to their attention. Mr. Chen was notified of the time and place of the ne~t meeting. I Peter Newman, 1022 Greenfield, stated, in part, that he was present with his wife, Kay, because they had learned that their next door I neighbor was remodeling their home and this included adding a second story to the house. He feels this will change the fabric of the neighborhood since there are no other two-story houses in the vicinity Since he lives next door, his privacy and his view of the mountains will be destroyed. He noted that some sections of the City had Archi- tectural Review Boards to protect the homeowners; his area did not. The neighbors are considering circulating a petition to prevent this second story addition even though they are aware of the fact that, apparently, there is nothing anyone can do if the plans conform to the building codes. He inquired what they could do to maintain the integrity of the neighborhood and if it would be possible to obtain a copy of the City Master Plan. Mayor Harbicht responded that the fact that an area had an Architectural Review Board would not guarantee that this same situation would not occur since homeowners have a right to remodel their homes and add second stories if they conform to the City Code; two story homes have been permitted in Arcadia since the City began; Architectural Review Boards have limited power to control archi- tectural design. As far as the question about the Master Plan, there is a general plan which shows what kind of development, commercial and residential, etc., the City wants to take place; the zoning ordinance is, in effect, the Master Plan. The zoning ordinance restricts what can be done on a certain piece of property in a certain zone; it is also a guarantee of what can be done. A little less than a year ago, the Code was modified to place restrictions on height, setbacks, second-story setbacks and various other things designed to cut down on bulk of homes built in the R-I zone. Councilmember Gilb noted that he had had the same problem with a two-story home next door which affected the privacy of his back yard. Also that recently an Architectural Review Board had rejected a two-story Tudor style home; on appeal, the Council had to approve the construction of the home because it met the Codes. There are some restrictions such as types of windows facing neighboring houses, etc. Mayor Harbicht added that there are few if any juris- dictions in the State of California that do not allow two-story houses. Senior Citizen Center and 3,300 sq. ft., Recreation Department Offices to be located on the City-owned property bounded on the north by Huntington Drive, on the west by Holly Avenue and on the south by Campus Drive. In compliance with the California Environ- mental Quality Act, the Planning Department prepared an initial study (Environmental Checklist Form) for the proposed Senior Citizen Center and Recreation Department offices. On January 4, 1989 the Notice of Negative Declaration was published in the Arcadia Tribune and comments requested by January 16th. One call was received expressing concern regarding traffic. Staff replied that the plans were being refined; they will be presented to Council in two weeks to a month. Mayor Harbicht inquired when bids to contractors would go out. Staff replied the information would be provided in the next newsletter; a rough estimate would be two to six months. Councilmember Gilb noted that the roses had been repotted and moved. Stolteben were DENIED on MOTION by Councilmember Chandler, seconded by Councilmember Young and CARRIED on roll call vote as follows: I AYES: NOES: ABSENT: Councilmembers Chandler, Gilb, Lojeski, Young and Harbicht None None MATTERS FROM STAFF The Police Chief memorandum concerning this non-agenda urgency item was brought to the attention of Council by the City Manager under provisions of the Government Code which states that, "if 2f.3rds of the Council determines that the need to take action arose subsequent to the posting of the agenda, action can be taken on a non-agenda item". The memorandum of February 6, 1989 states, in part, that the County of Los Angeles has proposed the closure of several regional mental health facilities. The Arcadia facility at 330 East Live Oak is one of the offices scheduled for closure. The memorandum sets forth the effect this will have on the Police Department's ability and resources in dealing with mentally disabled individuals without the assistance of the Psychiatric Emergency Team (PET) of the Arcadia Mental Health facility, who will no longer be availabe when thefacilivy is clqsed. In the discussion it was noted that the closure will affect approximately 500 patients. In order to take Council action concerning this emergency situation, it was MOVED by Councilmember Gilb, seconded by Councilmember Young that the need to take action concerning this non-agenda item arose after the required 72-hour agenda posting period. CARRIED on roll call vote as follows: AYES: NOES: ABSENT: Councilmembers Chandler, Gilb, Lojeski, Young and Harbicht None None I It was then MOVED by Councilmember Lojeski, seconded by Councilmember Gilb that a letter over Mayor Harbicht's signature be sent to the Los Angeles County Board of Supervisors stating that; by unanimous action the Arcadia City Council requests that the Board reconsider their decision to close the Arcadia Mental Health facility; the letter to contain specifics as listed by Chief Johnson in his memorandum of February 6, 1989, to the City Manager. Staff was asked if the station is being remodeled or is some other commercial enterprise going in on the site? Staff responded that the station has no plans in Plan Check at the Building Department at this time. Staff directed to look into the matter 'and determine what is happening at the site. The Commission has planned a special evening Thursday, February 16, 1989, featuring teacher Lou Dodd of Arcadia High School who, as part of the Arcadia/Newcastle teacher exchange program, will present a picture program and lecture of his experience. The Commission extends an invitation to Council and their spouses to attend this event. Mayor Harbicht reported that a "standing room only crowd" attended the first informational meeting at the City Library to discuss the new trash system in the City. The Mayor commended Alex McIntyre, Assistant to the City Manager, for an outstanding job as M.C. of the meeting. The results of the meeting appear to indicate that most of those that attended were satisfied that the new system is going to work and seemed reasonably pleased with it. A similar informational meeting is scheduled for Thursday, February 9, 1989, at the City Hall Council Chamber. Mayor Harbicht reported that the Arcadia High School team won 2nd place in the Constitutional Bicentennial Competition in Sacramento against teams from 44 other Congressional Districts in California. The Council had allocated $500 toward team trip expenses January 3, 1989, and "can be very proud of the team and this achievement". ./ Mayor Harbicht attended the ribbon cutting ceremony at the newly re- furbished Par 3 Golf Course and was very impressed with the many fine improvements to the buildings and grounds. Mayor Harbicht announced that Councilmember Gilb will be inducted into the University of Idaho Hall of Fame. Councilmember Gilb will be accepting this honor and involved in commencement activities on May 11 and 13, 1989. The Mayor expressed Council's pride to Mr. Gilb for this accomplishment. / Staff updated Council on the current status of the restaurant at the NE corner of Santa Anita and Huntington Drive formerly Tiny's Restaurant. No structural changes have been made; the booths, kitchen equipment and flooring are being refurbished. It is not known when the restaurant will reopen. The Director of Planning has communicated with the sign company with respect to the date for the removal of the clock/sign atop the building in the shopping center at the SE corner of Huntington and Santa Anita. El Monte Sign Company has scheduled the project for this month. "I'd like to adjourn the meeting in memory of Henrietta Loeffler. She passed away Sunday morning following surgery. Henrietta was a long-time resident of Arcadia and she served as President of the Arcadia Woman's Club and was a member of the San Marino Woman's Club. She was proud of her British heritage and a supporter of the British Home for the Aged in Sierra Madre. I known when Princess Fergie was here and visited the British Home, Henrietta was up there waiting for her. She was a member of the Arcadia Golden Age Club for 25 years and a former member of the Board of Directors. She used her talents for crafts to make and sell items at the club and then gave the money to the Assistance League of Arcadia. For three years she also represented the Golden Age Club on the Arcadia Senior Citizens' Commission, where she always spoke up in her beliefs. I think she was 86 or 87 years old. She has a niece in Skokie, Illinois, where the body will be shipped for burial. I don't believe she has any relatives around here, but she was a very fine woman and a great asset to our Senior Citizens' Commission 2/7/89 -7- 10. She just went right at everything and she was a very feisty gal and I was so surprised when I got this that she passed away Sunday and I'd like to close the meeting in her memory. Thank you."
