The City Council and the Arcadia'Redevelopment Agency met in a
regular session at 7:35 p. m., September 5, 1989 in the Arcadia
City Hall Council Chamber.

On MOTION by Councilmember Gilb, seconded by Councilmember Young
and CARRIED, the Minutes of the Adjourned and Regular Meetings of
August IS, 1989 were APfROVED.
It was MOVED by Councilmember Young, seconded by Councilmember Gilb
and CARRIED that Ordinances and Resolutions be read by title only and
that the reading in full be waived.
CITY ATTORNEY
The City Attorney announced that, "pursuant to the Brown Act
Government Code Section 54956.9(a), the Redevelopment Agency and
City' (Council) met in a CLOSED SESSION to discuss an item of potential
litigation which can not be named at this point in time. Furthermore,
the Agency met in a CLOSED SESSION pursuant to Government Code Section
54956.8 to give instructions to the City~ negotiator regarding po-
tential acquisition of property in the area of Second Avenue and
Huntington Drivetl.
PRESENTAT~ON
.
Jerree Lean, on behalf of the Arcadia Sister City Commission, described
her attendance at the Sister Cities' Conference in Portland, Oregon
and presented a brief report on the proceedings of the Conference. The
Arcadia Sister City Commission received a plaque for outstanding
cultural activities and a plaque for Australia and one for Tripolis,
Greece and a special award. The Mayor of Tripolis, Greece will be
in Arcadia the end of this month and that plaque will be presented at
that time. The Commissioners in attandance then presented to Mayor
Chandler and Councilmember Young from the entire Sister City Commission
the plaque and a citation from the Reader's Digest Foundation and
Town Affiliation Association of the United 'St~tes with the comment
that duplicates would be forwarded to Newcastle; A~stralia and
Tripolis, Greece. Mayor Chandler accepted the plaque and the citation
on behalf of the City of Arcadia.

The City Attorney stated that the purpose of this proceeding is to
determine whether a nuisance exists and whether Resolution No. 5500
should be adopted in order to give:a final order to the property
owner and then take care of the problem there and assess that cost
to the property owneIBif the property owners do not comply. T~e
owners, 'Michael and Barbara Gidden, have both heen served notice
of this proceeding on two different occasions. Previously the owners
have been represented by legal counsel on other matters relating to this
property. Barbara Gidden telephoned this date notifying the City
Attorney that she was hospitalized .., however, in view of prior proceed-
ings in this matter, that should not stop this item from going forward
this evening hecause she has he en represented by legal counsel and alSI
has had ample opportunity through different procedures to put this
property into compliance. The property is characterized by lack of
'conformity to the adjacent area -- it is in need of paint and the land
scaping has deteriorated. He presented recent photographs of the prop
to Councilmembers. These conditions constitute a violation of the
Municipal Code. After the public hearing, if Council concurs with the
staff report,Resolution No. 5500 should be adopted confirming that this
is indeed a public nuisance and should be abated as such.
Mayor Chandler declared the hearing open. No one stepped forward.
The City Attorney further remarked that, seeing none, the staff report
and the material just presented will be deemed as evidence of the City's
position on this matter and if there is no other evidence, Council may
close the hearing at this point.
The hearing was then CLOSED on MOTION by Councilmember Lojeski, seconded
by Councilmemher Gilb and CARRIED on roll call vote as follows:

It was then MOVED by Councilmember Harbicht, seconded by Councilmember
Young and CARRIED on roll call vote as follows that Resolution No. 5500
be ADOPTED.
The City Attorney then read the title of Resolution No. 5500: "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DECLARING A PUBLIC NUISANCE AND ORDERING THE REHABILITATION OF REAL
PROPERTY LOCATED AT 130 BONITA STREET, ARCADIA, CALIFORNIA, OWNED BY
MICHAEL AND BARBARA GIDDEN, AT CITY'S EX~ENSE AND PLACING A LIEN
AGAINST THE PROPERTY PURSUANT TO THE PROVISIONS OF THE ARCADIA MUNICIPAL

Jim~. Lindsay, proprietor, Arcadia Coin Company, 147 N. Santa Anita
Avenue, requested a Building Code Variance to retain the existing
security gates, and a sliding grate across the front display window
of a business in a building which is not equipped with an automatic
sprinklering system (AMC Section 8130.21.5 - Ordinance No. 1885).

The Planning Department has determined that for this particular
business, the high value of the inventory and its vulnerability to
theft crea~e a unique situation. The applicant's reasons and the
review conducted by the various City Departments, indicate that the
granting of this request would not be detrimental to the public welfare
or to the property and improvements in the area. Staff presented photo-
graphs of the security devices to Council. Councilmember Gilb remarked
that the security devices were not visible unless one was inside the
building. Councilmember Lojeski noted that his office is directly
across the street from the building under discussion. One of the
points made when the ordinance was adopted was that of the problem of
trash accumulating beneath the grates. He has never noticed such a
problem at this building.

vehicles at 631 W. Walnut.
Frank Falasco, 631 West Walnut Avenue, appellant, was present and
stated that he had been away on vacation and had not had sufficient
time to prepare his appeal.
Mayor Chandler declared the hearing open, in the event there were
others present who wished to speak. There were none.

AUDIENCE PARTICIPATION
I
~.Johanna Hofer, 875 Monte Verde Drive, stated, in part, that she was
present to speak to Item 8j, tonight's agenda, "Recommendation for
approval of plans and specifications and authorization to call for
bids for the Senior Center and Recreation Department offices". Her
heart goes out to the people and children in the community who are
without a community center. Although she, herself, is a senior citizen
she would not expect the City to spend over four million dollars for
a Senior Center when the community at large is without a community
center. A community center which could be used by the youth of the
community could be instrumental in curbing the use of drugs. Sh~
is aware there have been public meetings on this matter, but why
have there been no public hearings. She wondered if the PTA, the
Superintendent of Schools and the teachers in our local schools had
been consulted. Perhaps it could have been included in the City News-
letter. She feels the majority of the senior citizens are more interest--
ed in lower taxes, lower rents and the future of their grandchildren
and would be more than happy to share in a community center. Please do
not authorize the call for bids at this time. More community input is
needed.
vi AlIi Roysher, 1784 South Santa Anita Avenue, stated, in part, that in
planning the location for the Senior Citizens' Center, Council has gone
against the recommendations of a highly respected consulting firm,
Simon Eisner & Associates, who recommended the City Hall site for the
Center to take care of all segments of the community with special
emphasis on the young people. Special consideration was mentioned for
the 15-19 year age group. Opportunities for constructive activities
are. imperative to help curb drug use. Urban park space is becoming
increasingly scarce, as evidenced by the formation of a new group by
the Sierra Club to protect, improve and expand public parks and open
urban space throughout Los Angeles County. This section of the Sierra

Ciub is called People for Parks. With the increased density of
population in Arcadia, we must cherish what open space we have. No
environmental impact or traffic studies have been made for this Center.
The increased use of the race track facilities and resulting traffic
can be a problem for older drivers. The present City Hall site is
much less stressful for these drivers. She feels changes should
be made in the way Arcadia's finances are handled. When a four
million dollar expenditure comes up, there should be a vote by the
citizens. The School District needs an auditorium and the City is
sitting on the $100,000 donated for this purpose. Councilmember Lojeski
explained that the City does not sit on any funds. Councilmember Gilb
also eXl'lained that these funds were collected by the Walk-A-Thon Group
of private citizens. The trustees for these monies are Gloria Horstman
and Joe Sargis and has nothing to do with the City. Occasionally, thel
interest from these funds is donated to the school district for rental
of an auditorium, etc.

On MOTION by Member Lojeski, seconded by Member Young and CARRIED,
the Minutes of the meeting of August 15, 1989 were APPROVED.
The Arcadia Redevelopment Agency's original Relocation Rules and
Regulations were prepared by the Agency's relocation consultant, Port
& Flor, Inc., and were adopted by the Agency on September 1, 1977,
and updated on March 18, 1986. They serve as guidelines for the
residential and business relocation process. Due to: (a) recent and
pending changes in State relocation law, (b) recent court decisions
in relocation, (c) the experiences of other local redevelopment agencies,
and (d) for the purpose of creating smoother transition periods for
residential and business relocations, Port & Flor recommends that we
supplement and update our rules. The proposed amendments are outlined
in detail in staff report dated September 5, 1989.
The Assistant City Manager for Economic Development then read th~
title of Resolution No. ARA-14l, entitled: "A RESOLUTION OF THE
ARCADIA REDEVELOPMENT AGENCY AMENDING THE AGENCY'S RELOCATION RULES
AND REGULATIONS".

On January 6, 1989, the Arcadia Redevelopment Agency authorized staff
to proceed with the implementation of the Northwest Corner (Second
Avenue & Huntington Drive) Project. Subsequently, appraisals were
obtained for real property furniture fixtures and equipment, and
business goodwill, relocation budgets were prepared, an environmental
assessment of the site was conducted, and demolition estimates were
obtained. The total project costs along with the costs for each of
the component parts of the project are summarzied in the Northwest
Corner Project Budget, Attachment 1 to staff report dated September 5,
1989. Agency staff has prepared an Initial Study (i. e., Environmental

Negative Declaration. Upon selection of a specific development
proposal in the future, the Agency will prepare an Environmental
Assessment and make recommendations consistent with CEQA and AgencYI
Resolution No. ARA~75 which adopts procedures for the implementation
of CEQA. In order to meet CEQA requirements, notice of the Agency's
consideration of the Negative Declaration was published in the Arcadia
Tr~bune and mailed to owners and tenants. Although there is no require-
ment for a public hearing, members of the public were offered the
opportunity to comment on the proposed Negative Declaration.

tion to those qualified developers who have responded to the Agency's
April, 1989 Request for Qualifications. The proposed Request for
Proposals sets forth for the developer a description of the proposed
site as well as an explanation of the Agency's intent in soliciting

On April 4, 1989, the Agency directed staff to solicit developer I
"qualifications and letters of interest from the development community.
Twelve developers responded to the Agency's Request fo~ Qualifications
for the Agency's two new projects. Of these, nine have been selected .
to receive Request for Proposals. Staff report dated September 5,
1989 lists the developers as follows: Southwest/Northwest projects -
WLA Arcon, Blumin Enterprises/Kenneth Ruby Co., Boone Fetter Assoc.,
Chandler Group, Cloverleaf Group and Howard Platz Co.: Southwest
project only - Champion Development. Northwest project only - Larmor
Development and Pankow Development.
After brief discussion, it was MOVED by Member Lojeski, seconded by
Member Gilb and CARRIED on roll call vote as follows that Gribble and
Associates be added to this list of developers to receive Request for
Proposals.

Agency Special Counsel, Steve Deitsch is now a member of the law
firm of Best, Best & Kreiger. Letter Agreement (August IS and
August 19) formalizes the ~retention of Mr. Deitsch as Agency Special
Counsel and the fees and costs of legal services. The provision of
legal services from other members of the firm cannot occur unless
recommended as necessary by Mr. Deitsch and approved by the Agency.
Best, Best & Kreiger has a capable litigation department with experience
in eminent domain. This is the most likely area of their use inI
conjunction with Mr. Deitsch. It was noted that Mr. Deitsch is now I
with this new firm.

Agreement with Stephen P. Deitsch (Best, Best & Kreiger) and AUTHORIZE

Chevrolet in the total amount of $30,146.54. Funds in the amount of
$39,000 are budgeted in the Capital Outlay Fund FY 1989-90.
AWARDED purchase of a sewer jet cleaner from the low bidder, Sreco
Flexible Co. in a total amount of $35,683.10. Funds in the amount
of $45,000 are budgeted in the Capital Outlay Fund FY 1989-90.-
APPROVED purchase of a front bucket for Backhoe #37-2 and a trailer
for transporting the backhoe, hydro hammer and loader for a total
amount of $16,000. In the 1989-90 Capital Improvement Program Water
Budget, funds in the amount of $16,700 were approved to replace'Unit 31,
a 1972 3/4 ton flat bed truck. It is staff's recommendation that Unit
31 not be replaced this fiscal year but be considered for replacement
in the 1990-91 capital budget and that the funds allocated for the
unit be used to purchase the front bucket and trailer.
AUTHORIZED the Mayor to execute response to the Aug.14,1989 supplement to
Irwindale Draft EIR and expressing Arcadia's concerns. Ref. staff

Senior Citizen Center and Recreation Department Offices. Estimated
construction cost for on-site improvmeents of $4,099,000 to be
funded from existing City funds; estimated off-site construction
cost of $97,000 to be funded in part by gas taxes ($55,000 and SB
821 Funds ($27,000). The City Clerk is AUTHORIZED to advertise for
bids.
APPROVED the addition of Deems & Carpenter as the City's defense
counsel along with Clausen & Campbell and Cotkins, Collins &

MATTERS FROM ELECTED OFFICIALS
Commented that he will be absent from the City Council Meetings
of September 19, on vacation, and October 17, in Montana for business
reasons.
Also, that Bruce Low, former owner-operator of the Arcadia Datsun
Agency, is now associated on a part-time basis with the Bowden
Developm~nt Company in Duarte.
Commented that as he understood it, security bars are barred from the
outside of the building only; they can be installed on the inside if
there is a sprinkler system in place. He wondered if that is a
reasonable requirement. Anyone who installs such devices feels he
has a need for them. Are the bars any mor~ of a deterrent to escaping
from a fire, for ~xample, than a door that might be locked or bolted.
Perhaps this is too strict a requirement since most of these people
are in rented buildings; the cost of installing sprinklers might prove
to be prohibitive. Councilmember Gilb said he always thought that
security bars are for keeping people from gettin in ... not from
getting out. He agreed the cost of a sprinkler system might be
prohibitive. Councilmember Harbicht said his feelings about the bars
were of an aesthetic nature because he feels they help speed the
deterioration of a neighborhood. However, if the bars are on the
inside where they are not visible, he wonders if the sprinkler require-
ment is reasonable. Councilmember Young was concerned about fire
fighters falling from the roof into such a building and others being
unable to get in to help. Fire Chief Gerald Gardner was present to
address these questions. He commented that basically, the original
concept goes back to when the building is built, the Building Code
calls for 20 square feet of openings every 50 lineal feet in the
exterior walls of the building, so when these plans are approved under
those conditions in compliance with the Building",C<:lde,. the building
does not need fire sprinkler systems. If that same buildi~g owner came
in at the time the building was originally built and did not have those
openings as required, then the building would have to have fire
sprinklers when it was originally built. What is happening with the
security bars is ... after the building is approved with the 20 square
feet of openings every 50 lineal feet, then either the tenant or build-
ing owner comes in and puts security bars over all of those required
openings which, in essence, results in a 'building with no openings for
emergency access. The Building Code is very clear that 20 sq. ft. is
for the emergency access. That's why the fire sprinkler requirement has
come into play because they've removed those required openings. 'Council-
member Harbicht said he saw the sense in that. Councilmember Gilb
said that in the case of some of the older buildings, the tenant
would not be aware of these Codes and put in bars, but because of
the prohibitive cost, would not put in sprinklers. Fire Chief Gardner,
noted that some businessses have solved the problem by putting grates
or bars over the merchandise counters or racks, when the business is
closed. There are alternative approaches to the requirements. Mayor
Chandler noted that this Building Code does not come into play unless
the building is more than 1500 s'lllare feet so the small jewelry or coin
shop with less than 1500 sq. ft. can have security bars installed as
far as the Fire Department is concerned and still be in compliance
with the Building Code. Councilmember Gilb noted rchat some security
devices can only be unlocked with a'key; perhaps some means of opening
them from the inside could be considered. Councilmember Young said
she was in favor of leaving the ordinance as is, since there are
alternatives. Councilmember Harbicht agreed.
Noted that she had heard that the City Manager was very helpful and
a lot of the local council people east of Arcadia were very compli-
mentary regarding SB I (Reorganization of transportation agencies in
L. A.)

"The Council and the citizens of Arcadia are all still shocked by the
sudden passing of Marc Mueller. Marc was 40 years old and he passed
away Saturday. He was a lifelong resident of Arcadia and Sierra
Madre. He was a Nature Coordinator at Wilderness Park in Arcadia.
He passed away Saturday morning. Marc was born in Pasadena. He
attended Arcadia schools, Citrus College and Cal Poly Pomona. He
was an active member of the Sierra Madre Volunteer Fire Department
and served as chief from 1982 to 1985. Marc was also an appointed
member of the California Board of Fire Services and had served as an
active Board Member since 1985. He was named Chairman of the Committee
for Volunteers for the California State Firemans Association in 1979,
a post he held at the time of his death and he had served as Director
of the National Volunteer Fire Council from 1981 to 1987. Marc was
past President of the Arcadia Kiwanis Club and an active member of the
Pasadnea Tournament of Roses Association. He is survived by his Wife'l
Kathleen; his daughter, Michelle; mother, Janet; grandmother, Mary Len
"and stepdaughters Kari and Kristi Jackson. In lieu of flowers, the
family requests donations be made to the Marc Mueller Memorial Scholar
ship Fund, Ladies' Auxiliary of the California State Firemans Associa-
tion, Sacramento. Funeral services will be held tomorrow, Wednesday,
at the Church of the Good Shepherd at 400 West Duarte Road in Arcadia
with burial in the Sierra Madre Memorial Cemetery. Marc Mueller was
a real fine fellow and was with our City for a long time. He was one
of those people -- if you ever asked him to do a job, he got it done
and got it done well. When I was Mayor two or three times Marc used
to go to Scout Council meetings for me when I was doing something
else or was out of town and present all of the Scout certificates
and did an excellent job and was very involved with the youth of the
community. He really will be sorely missed. It is very difficult to
believe that he has passed away at the age of 40. I don't think any
of us can yet realize that. When we returned from the Labor Day Week-
end, it was the first thing that we heard. I don't know what the
cause of death was, but I know that he was on a diet a long time. Don
Pellegrino said he saw him at the doctor's office Thursday afternoon
and he looked great and was looking forward to the weekend ... had
a big smile on his face. He was a great asset to the Recreation
Division and the 'City of Arcadia. Marc Mueller was somebody that in
later life would have been reckoned with ... he would have gone a
long way, I am sure in his field. He will be sorely missed and
with great sadness I close this meeting in memory of Marc Mueller~'"
The meeting ADJOURNED at 8:30 p. m. to 7:00 p. m., September 19, 1989
in the Chamber Conference Room to conduct the business of the Council
and Agency and CLOSED SESSION, if any, necessary to discuss personnel,
litigation and evaluation of properties.
