CITY COUNCIL OF THE CITY OF ARCADIA
and the
ARCADIA REDEVELOPMENT AGENCY
ADJOURNED REGULAR MEETING
SEPTEMBER 19, 1989
The City Council and the Arcadia Redevelopment Agency met in an Adjourned
Regular Meeting at 7:00 p. m., September 19, 1989, in the City Hall
Conference Room of the Council Chambers.

MOTION by Councilmember Gilb to EXCUSE the absence of Councilmember
.Lojeski, seconded by Councilmember Young and CARRIED.
Public Hearings set for Consent Items lOa, and lOb. on the Regular Agenda
this date to be set for October 3, 1989.
Requested by the City Manager before the Regular Meeting this evening.
In reference to applications requesting Building Code Variances for
those commercial or industrial buildings having security bars or devices
installed before the June 1988 adoption of Ordinance No. 1885, Council-
member Harbicht stated, in part, that: he is inclined to "grandfather in"
these pre-existing devices. The question of "grandfathering in" the bars
installed on the exterior front of buildings as well as the back was con-
sidered. A lengthy discussion ensued as to the fairness and practicality
of applying the "grandfather" prinicple to the list of 21 known buildings
affected by the ordinance. Many of the buildings have the bars built into
the concrete structures, according to Mayor Chandler. The enforcement of

the Ordinance, it was determined, would create undue hardship, whereas
"grandfathering" them would be the most expedient and fair way to deal
with the issue. Council agreed that the design of the existing bars
could not be changed after the new ordinance is adopted to "grandfather"
them in. It was noted that although there are several variables existing in
the buildings where the bars are inst:alJed,this should be weighed against
the economic burden involved if these were required to be removed ... all
21 buildings should be included in the "grandfather" procedure. The City
Attorney instructed that, "procedurally, if that is what Council is interest-
ed in doing, the 'grandfathering' will have to be accomplished by ordinance.
Also, to be consistent with the Brown Act, when the three hearings come
up tonight on the agenda, before the first hearing, Council could go
over what they have discussed and if it is what they wish to do, the hear-
ings could be 'tabled'''. Council to give staff direction to prepare the
ordinance; and further direction not to enforce Ordinance 1885 against
the 21 buildings which are not in compliance; also, refund the fees to
those who have started the appeal process; the "grandfathering" will run
with the building rather than the existing business. The City Attorney
and Planning Director will then begin to draft the ordinance to present
to Counc il.
The City Manager directed Council's attention to the revised design for the
two proposed office buildings to be constructed at 301 E. Santa Clara. The
Design Review is Item 8c. on the Regular Meeting Agenda this date. The
buildings will be constructed on the former Kiewit West property (Northside
Project), which has been cleared and is ready for construction.
At 7:15 p. m. Council entered a CLOSED SESSION, RECONVENED and ADJOURNED
sine die at 7:30 p. m.
