Councilmember Lojeski ABSTAINED since he was not present at the September 19, 1989 meeting. " It was MOVED by Councilmember Harbicht, seconded by Councilmember Gilb and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. CITY ATTORNEY The City Attorney announced that, ("the City Council and Redevelopment Agency met in a CLOSED SESSION pursuant to Government Code Section 54956.8 to give instructions to the City negotiator regarding the potential acquisition of property known as the Richter property at 148 E. Huntington Drive. Also the City Council met in CLOSED SESSION pursuant to Government Code Section 54956.9(b)(1) to discuss pending litigation. The pending litigation cannot be named at this time because of possible prejudice to the City". ~v . (APPROVED) ~ ~"1--0~0 (,'fIp.. ~ The Planning Commission at its September 22, 1989 meeting voted 4 to 0 with one member absent to recommend approval of zone change Z-89-003 to add an "H" (high rise) overlay on the CPD-1 (Commercial Planned Development) zoned property at 324 North Second Avenue. The applicants, Robert W. and Donald P. Johnson, are requesting the high rise overlay to permit the construction of a two or three story building to be utilized for offices and/or research and development. They would like the flexibility of the "H" overlay to be able to design a building which is aesthetically pleasing, but which may require a building height which exceeds the maximum height of 40'0". Discussion ensued regarding the allowable heights for buildings constructed in this area, as well as inquiry as to the heights of the nearby water tanks. This was thought to be 25 - 30 feet. No one desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Lojeski, seconded by Councilmember Gilb and CARRIED. Councilmember Lojeski said he thought this would be a terrific improve- ment for this site. He would also like to see staff think about improv- ing the appearance of the bridge trestle and the nearby water tanks -- I perhaps painting or landscaping. . ~t was then MOVED BY Councilmember Lojeski, seconded by Councilmember Gilb and CARRIED on roll call vote as follows that Zone' Change Z-89-003 324 N. Second Avenue be APPROVED; that the Negative Declaration be APPROVED and filed and find that the zone change will not have a significant effect on the environment and DIRECT staff to prepare the appropriate ordinance. AYES, NOES: ABSENT: Councilmembers Gilb, Harbicht, Lojeski, Young and Chandler None None The proposed amendment to Subsection 304(b) of Section 8130.6 of the Arcadia Municipal Code would replace the two level plan review and energy plan review fees and provide for future fees to be adopted by resolution of the City Council. The existing and proposed text is set forth in staff report dated September 26, 1989. A resolution setting forth revised fees will be presented to Council for consideration at the Council's October 17, 1989 meeting. The effective .date .for the revised fees would be the effective date of:Ordinance 1914 -- November 17, 1989. Discussion ensued concerning the fact that Building Inspectors are working overtime to complete plan checks because they are in the field during the day with the exception of two hours. Councilmember Gilb suggested that perhaps additional personnel is needed in that depart- ment to do plan checks. The Planning Director replied that portions of the work load are cyclical, lighter and heavier. In the last couple of years there has been an increase in the number of plan checks. Some of the plan checks are sent out to out~ide firms, especially large industrial and commercial projects, and some of the larger, more complex homes. This year the number of plan checks is down, so it is uncertain what the trend will be; if things slow down, it would not be well to have another full time person. Councilmember Gilb noted that a large number of developments are upcoming in the redevelopment area. He also in- quired how people coming to the Building Department counter are ttelped. The Planning Director replied the Typist-Clerk and the Building Technician can issue building permits and provide basic information in the absence I of the Building Inspectors. Councilmember Gilb requested that the City Manager look into the situation to determine if another employee is needed. Councilmember Harbicht noted that real estate sales are slow- ing; probably indicating a slowdown in demolition and rebuilding. The City has consistently tried to take care of overflow situations by sub- contracting to the private sector, rather than increasing staff. Councilmember Harbicht then inquired what the motivation is for these changes in the way fees are set. Staff replied that the actual fee changes will be coming back to Council for approval. At the present time the Code sets forth how the fee is determined. This amendment will take that procedure out of the Code and allow future fees to be amended year by year by Resolution of the City Council. It will also adjust some percentage figures which are different from those in the Uniform Building Code. They will then be consistent with the Uniform Building Code. r 10/3/89 -2- I ORDINANCE ~ NO. 1914 (INTRODUCED) 3. PUBLIC HEARING (Bingo Games Santa Anita Church - 226 W. Colorado) (APPROVED) . No one desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Lojeski, seconded by Councilmember Harbicht and CARRIED. Councilmember Harbicht inquired if the figures set forth in the Uniform Building Code are higher or lower as a percenage of the permit fee than those in the City's Code. Staff replied that the Building Code will be higher for single family structures; lower forM occupancies. Councilmember Harbicht inquired again as to whether or not the per- centages accurately reflect the time and effort involved in doing them because they are routinely adjusted. Staff replied the energy plan reviews -- the charge for residential construction -- is not sufficient for what is involved. The fees charged for commercial .projects are in excess of the cost to review them. This change will bring both of them more into line with the actual cost for energy plan checking. The Planning Director then presented for introduction and read the title of Ordinance No. 1914, entitled: "AN ORDINANCE OF THE CITY OF ARCADIA AMENDING SUBSECTION 304(b) OF SECTION 8130.6 IN THE BUILDING REGULATIONS ARTICLE OF THE ARCADIA MUNICIPAL CODE REPLACING THE TWO LEVEL PLAN REVIEW AND ENERGY PLAN REVIEW FEES AND PROVIDING FOR FUTURE FEES TO BE ADOPTED BY CITY COUNCIL RESOLUTION". It was then MOVED by Councilmember Young, seconded by Councilmember Harbicht and CARRIED on roll call vote as follows that Ordinance No. 1914 be and it is hereby INTRODUCED. AYES: NOES: ABSENT: Councilmembers Harbicht, Lojeski, Young and Chandler Councilmember Gilb None Consideration of request from the Santa Anita Church, 226 W. Colorado Blvd. for permit for operation of bingo games. They are requesting this permit to hold bingo games for special fund raising events to be scheduled during the year. This request has been reviewed by the Police, Planning and Fire Departments and they have no objections. Councilmember Harbicht inquired if the games could be played weekly even though the request does not so state. The Business License Officer responded that most of the organizations who had permits for bingo games played once a week; that is what the Code allows. This organization could change their times scheduled for the games up to what is allowed in the Code. Mayor Chandler declared the hearing OPEN. No one desiring to be heard, the hearing was CLOSED on MOTION by" Councilmember Young, seconded by Councilmember Gilb and CARRIED. It was then MOVED by Councilmember Gilb, seconded by Councilmember Young and CARRIED on roll call vote as follows that the request of the Santa Anita Church, 226 W.Colorado Blvd. for business license to operate bingo games be APPROVED. Councilmember Harbicht stated, in part, that he would not vote against this permit because this organization should not be discriminated against versus any of the others. He is really not in favor of any of them. It is his opinion that bingo is gambling any way you look at it, and this is not the way money should be raised for things like churches. He does not want to make an issue out of this particular request. Roll call was then taken. GROUNDS FOR The rules currently allow supervisors to discipline employees "for DISCIPLINE cause" yet fail to articulate such causeS. I " AYES: NOES: ABSENT: Councilmembers Gilb, Harbicht, Lojeski, Young and Chandler None None j Various personnel classifications have been selected to consider for modifications in an attempt to'update the current Classification Plan. Several minor changes are proposed. Of significance, the minimum qualifications are proposed to be modified to eliminate the high school graduation requirement. It was the consensus of Council that the high school graduation requirement should not be dropped in view of the current emphasis nationwide on education. It was thought that the City of Arcadia might be sending wrong signals to young people that a high school education is not valuable. The question was raised as to whether or not this constitutes employment discrimination in that the positions under discussion do not require a high school education. This will be checked with the City's Personnel Consultants, Liebert & Cassidy. It was MOVED by Councilmember Gilb, seconded by Councilmember Harbicht and CARRIED on roll call vote as follows that the consideration of the proposed classification changes be withdrawn from the agenda and HELD OVER to the October 17, 1989 meeting. AYES: NOES: ABSENT: Councilmembers Gilb, Harbicht, Lojeski, Young and Chandler None None Review and consideration of the establishment of the Maintenance Worker Trainee classification. Since extensive training of new hires is re- quired for Maintenance Worker, staff proposes to establish a trainee or apprenticeship classification whereby applicants with little Qr no experience can be recruited and trained, and, upon successful comple- tion of the probationay period of one year, promoted to Maintenance I Worker. Such a program allows supervisors to fully and adequately assess and train potentially valuable employees who otherwise would be unable to enter the work force with the City. AYES: NOES: ABSENT: Councilmembers None None Gilb, Harbicht, Lojeski, Young and ,Chandler ,; AUDIENCE PARTICIPATION Karl Wald, 411 Santa Cruz Road, stated, in part, that a City owned tree in front of his neighbor's house at 415 Santa Cruz Road, was up- rooting the owner's pipes and damaging the City street. Mayor Chandler noted that the Public Works Director was present and would look into the matter. Mr. Wald also stated that the race track traffic on Santa Cruz Road travelled sometimes as much as 50 - 60 miles an hour and the residents were greatly concerned for the safety of their children. Mayor Chandler noted that Police Captain Rick Sandona was present and would look into that matter. Robert Scott, 129 Loralyn Drive, stated, in part, that he was pleased about the remarks Councilmember Gilb had made at the previous meeting concerning Herb Fletcher. He thought it might be a good idea to pull some of Herb Fletcher's Letters to the Editor to read again. He also mentioned that Marc Mueller had been an Eagle Scout. The Kiwanis Club to which he belongs buys the Eagle plaques and rings for the boys. ~tephen Lojeski is now involved with this. He knows that Mayor Chandler and Councilmember Gilb are also interested in the Eagle Scouts. AlIi Roysher, 178 South Santa Anita Avenue, stated, in part, that she was addressing Item 4b., tonight's agenda. It is her opinion that a high school diploma is mandatory for a successful program, since there is a possibility of future promotions. President "Bush has ex- pressed concern about the quality of education in the country; Mrs. Bush has appeared on TV to promote her literacy program. There should be some standards of education. Secondly, regarding Item 9i., tonight's agenda, consent item for tree maintenance program, Mrs. Roysher wondered if anyone from the City visited the communities where such contractors have worked or if the contract is merely given to the lowest bidder. She has been appalled at the tree butchery after workers have finished with them. Again, presidett Bush has emphasized the importance of the tree planting program. We in Arcadia need to take care to preserve our trees because of the many large trees that have been lost due to the construction of the monsterous houses. CITY COUNCIL RECESSED IN ORDER TO ACT AS THE ARCADIA REDEVELOPMENT AGENCY PRESENT: ABSENT: Agency Members Gilb, Harbicht, Lojeski, Young and Chandler None ~ On MOTION by Member Gilb, seconded by Member Young and CARRIED, the Minutes of the meeting of September 19, 1989 were APPROVED. Member Lojeski ABSTAINED since he was not present at the Sep- tember 19, 1989 meeting. On September 5, 1989 the Agency adopted the Northwest Corner and Southwest Corner projects. In order to complete these two projects, staff has estimated that the Agency may need to borrow approximately $4,900,000 from the City. Staff estimates that the Agency can repay this by 1995-96 from land sale proceeds, annual tax increment, and interest earnings thereon. However the formal agreement requires that all monies borrowed by the Agency this fiscal year be repaid with interest by June 30, 1990. Staff recommends that the Agency borrow all needed funds from the Facility Construction Fund until such time as the fund is depleted, and then draw any further needed funds from the General Fund - (Unprogrammed), not to exceed a total loan amount of $4,900,000. CITY COUNCL RECONVENED CONSENT ITEMS ./ PUBLIC HEARING SCHEDULED FOR OCTOBER 17, 1989 to consider increasing the Planning Department fees and Building Division fees to reflect overall increase in the 1989-90 City Budget. / PUBLIC HEARING SCHEDULED FOR NOVEMBER 7, 1989 to consider adoption of Building Regulations to mitigate earthquake hazards in existing buildings. APPROVED Final Map No. 47557 for a proposed eight unit residential condominium at 414 South Santa Anita Avenue (Loren C. Councilmember Lojeski questioned the phrase, "in substantial compliance" in the staff report and said he was reluctant to approve the Final Map under these terms and felt perhaps the Final Map should not be approved until all conditions are complied with. The Planning Director responded that it is usually a matter of expediency... a lot of times by the time it gets to the agenda, the matter has been resolved. The map is not signed off until the outstanding conditions are complied with; the ownerl cannot record the map until it has been signed off. The City Attorney noted that the language section, in part, comes out of the State Sub- division Map Act and City law and that is the verbiage used to indicate that that portion of the map is basically ready for approval so that that language is partly because of statue and is used in most of the staff reports to indicate that, as far as staff is concerned, the item is basically ready for approval and there might be some minor things that have to be done administratively. The Director of Public Works reiterated that the language is from the map itself which is the technical or legal portion; the construction portion is of concern and is still ongoing, so if something needs to be complied with, the City has control of that through inspection .., that portion is not released until everything is completed. AWARDED contract to the low bidder, Raymor Electric Company, Inc., in 'the amount of $39,989.00 for street lighting improvements - Fano Street between Santa Anita and First Avenues, Alice Street between First and Third Avenues, and Third Avenue between Bonita Street and Duarte Road. The work consists of constructing 17 new energy-efficient street lights and underground conduit. The project is funded entirely by a Community Development Block Grant. This project is categorically exempt from the requirements of the California Environmental Quality Act. Funds in the amount of $51,000.00 to be appropriated from the CDBG Fund to cover the cost of construction, inspection, and contin- gencies. Any informalities in the bid or bidding process to be waived. The Mayor and City Clerk AUTHORIZED to execute a contract in a form approved by the City Attorney. APPROVED plans and speciications for contracting of tree trimming/ topping of approximately 720 parkway trees at various locations for this fiscal year. The City Clerk is AUTHORIZED to advertise for bids. Councilmember Gilb noted that most of the trees to be trimmed are located in the Village. He requested that the City work crews take a look at the trees on Santa Rosa Street since he has had several calls regarding them. The City Manager took the occasion to answer a question raised during AUDIENCE PARTICIPATION about "butchering" the trees. He explained that the tree crews were experienced in trimming trees and the trees were not harmed; the branches grow back again. Mr. David F'I Sullivan, President of the Santa Anita Oaks Association submitted a letter stating that their Board unanimously supports a change in the current zoning (R-O & D 15,000) to R-O & D 22,000. If Council decides to proceed with consideration of the zone change, public hearings will be required to be held before the Planning Commission and City Council. All property owners within the area of the zone change and within 300 feet will be mailed written notice of the hearings. RESOLUTION NO. 5503 (TABLED) I 12. 13. 31:0214 j The City Attorney presented, explained the content and read the title of Resolution No. 5503, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA APPROVING THE FIGHT GRIDLOCK ORDINANCE AND EXPENDITURE PLAN". Councilmember Harbicht inquired if this Resolution just says that the City Council is in favor of the fight gridlock ordinance and expenditure plan and the plan itself to increase the sales ta~ by ~%. The City Attorney replied that was correct ... that Council would support the placement on the ballot. In reply to a question from Councilmember Young, staff noted that a portion of the monies will come back to the City (55% for transport ion system management and freeway improvements; 30% for local streets) and it is estimated that Arcadia's portion could be as much as $769,000. Councilmember Gilb 'commented that our citizens will be paying this; it's not something the County is giving us. Staff noted that additional funds could be utilized by the City for expansion of computer network for control of the signals as well as street improvement. The Public Works Director added that these monies could be utilized for any street improvement purpose that gas tax monies can be used for. The LACTC report produced a few years ago set the figure of $769,000 as being the amount Arcadia would be in arrears for street improvements by the year 2000. Council- member Gilb inquired how the City would know that Management System will not take more than 55%. Staff replied these percentage figures will be on the ballot itself. Councilmember Harbicht noted that although $769,000 sounds like a lot of money; actually it is about $15.00 per resident; another ~% sales tax will cost more than that. Councilmember Harbicht further said he was not necessarily opposed to this ordinance, but neither was he prepared to vote for it without more thought and consideration of alternatives. He also wondered why it was important that Arcadia become involved in the placement of this matter on the ballot. Staff replied it was a question of gathering support from the cities in the area. Councilmember Gilb stated that instead of voting "yes" or "no", he would prefer no action. He is not going to support it. It was then MOVED by Councilmember Harbicht, seconded by Councilmember Gilb and CARRIED that Resolution No. 5503 be TABLED. In reply to a question from Councilmember Gilb, staff replied this matter would be brought up again only by specific motion of Council. MATTERS FROM STAFF None MATTERS FROM ELECTED OFFICIALS HARBICHT vi' Councilmember Harbicht recounted the on-going difficulties he has (Best Disposal experienced in dealing with Best Disposal staff and their billing Billings) practices. As the owner of several rental properties in the City, the bills for trash services each have an account number but no service address, making it impossible to determine which bill is for what property. Best also has been billing one of his properties as having residential backyard service ... he has told them on several occasions that he does not h&ve this kind of service. After sending payment for the bills, the problem continues. The fact is they do not seem to respond to the calls or are unable to do anything about the problems. Best Disposal should recognize that their billing procedure is in a mess and they should try and straighten it out .., their level of error is incredibly high. vi Councilmember Harbicht noted that in the last few months Council has listened to several citizens who have complained of receiving citations for parking on unpaved surfaces. Some have indicated that they have been doing so for many years. He inquired if it would be possible to place a warning on the windshields of the illegally parked cars for the next month or so and then go back to the citation procedure. Council noted that that old warning system for property maintenance has not been effective. An item in the next City Newsletter warning residents that the City is enforcing the ordinance was suggested. It was noted that complaints have been coming in from neighbors of the parking infractions. The City Attorney reported that he has prosecuted several who were cited for parking on a gravel surface. If a vehicle is parked on gravel it is in violation ....if the surface is gravel, it is unpaved. This is the way the court applies the ordinance also. Councilmember Lojeski suggested it be printed in the Newsletter as a reminder since the City has always enforced the "no parking on an unpaved surface" ordinance. I Councilmember Young reported of the many calls received expressing concern at the possibility that the influx of white flies in the City I may kill the street trees. Councilmember. Harbicht commented that he had seen a display at the County Fair by the Department of Agriculture Indicating that the white flies would not kill the trees. Moreover, there is no known ohemical way to attack the flies. It was also reporte that the Director of Agriculture is alerting the public of a bogus program being promoted door to door at a cost of $500 to the homeowners to rid their trees of the white flies. In response to Councilmember Gilb, the Police Chief explained that the Police have only been enforcing the parked car limit in home driveways on a complaint basis. The information is taken; and at that time the department goes through the City Attorney. They are not issuing cita- tions for having too many cars parked in driveways. In connection with the "For Sale" signs on parked cars, the Police Chief stated that the Police do enforce the ordinance on public property. The cars parked on private streets displaying a "For Sale" sign can not be cited or towed away. The private street at Foothill Blvd. and . Michillinda was mentioned as continually displaying "For Sale" signs on parked cars. The City Attorney suggested asking the property owners on that street to give the City permission to deem those parked vehicles as trespassers. The private street at Baldwin and Foothill has this recurring problem also, it was noted. The Police Chief reported that Pic & Sav and Ralphs Market have letters on file in the Police Depart- ment indicating that they do not want cars parked on their property with "For Sale" signs displayed ... these vehicles are cited by the Police. .; New to the City are the flower sales people who approach cars at the traffic signals. It was noted that these sales people do not have a City license and do not pay tax. The previous weekend calls had been made to the Police Department about this matter .., the sales people left... then returned later that night and the next morning. The Police Chief responded that he would take care of the situation. J In response to the inquiry of Councilmember Lojeski, staff reported V that the building permits have not been issued as yet for the proposed construction behind the Union Oil station at the SW corner of Foothill I and Santa Anita. Some technicalities are still to be worked out between Union Oil and adjacent property owners. Union Oil is requiring a "Meets and Bounds" description of the joint easement area where the driveway off of Santa Anita has existed. Until this issue is resolved the permits cannot be issued. .; Councilmember Lojeski inquired, if 'during the time this area to the west of the Union Oil station is used to sell pumpkins and/or Christmas trees, are the cars parked on the unpaved parking lot parked legally or illegally? Staff indicated they are parked illegally. V "About six weeks ago I adjourned our meeting in honor of Mr. A. L. Farr, former Arcadia Postmaster. This past week his wife of 58 years, Johnie May Farr, passed away after a prolonged illness. Mrs. Farr was born May I, 1911, in Ellis County, Texas, and passed away September 28, 1989. 10/3/89 -10 - 31:0216 "Mrs. Farr lived with her husband on 5th Avenue in Monrovia for 42 years. (Located just across the street from the old City Yard.) Mrs. Farr was a gentle and kind wife, mother and grandmother. ~er whole life was dedicated to her family. Johnie May is survived by three children: Peggy, Don and Art; nine grandchildren and five great-grandchildren: Services were held Saturday, September 30, 1989 at Live Oak Memorial Park.
