OCTOBER 17, 1989
The City Council and the Arcadia Redevelopment Agency met in a
regular session at 7:30 p. m., October 17, 1989 in the Arcadia City
Hall Council Chamber.

and CARRIED, the Minutes of the Adjourned and Regular Meetings of
October 17, 1989 were APPROVED.
It was MOVED by Councilmember Young, seconded by Councilmember Gilb
and CARRIED that Ordinances and Resolutions be read by title only and
that the reading in full be waived. '
CITY ATTORNEY
The City Attorney announced that,"this evening the City Council and
Redevelopment Agency met in a CLOSED SESSION pursuant to Government
Code Section 54956.9(a) to discuss a scheduled hearing before the
Workers' Compensation Appeals Board involving former employee, Jimmy
Montez. Additionally, pursuant to Government Code Section 54956.8,
the Agency met in a CLOSED SESSION to give instructions to the City's
negotiator regarding negotiations as to potential acquisition of the
Cotten property at 153 E. Wheeler in the City of Arcadia".
PRESENTATIONS
Mayor Chandler read a proclamation from the City Council of the City
of Arcadia declaring the week of October 22 - 29, 1989 as National
Red Ribbon Week and encouraging all citizens to participate in drug
prevention education activities making a visible statement that we
are firmly committed to a drug free community. This Proclamation was
then presented to Marilyn Bryant, Chairperson of Parent Alert, 1989
Red Ribbon Campaign. The Proclamation was accepted with thanks by Ms.
Bryant and she and her assistants then distributed red ribbons and red
arm bands to those present. Ms. Bryant noted that the AYSO Youth Soccor
League in Arcadia is declaring war on drugs October 28 and will paint
their faces with red war paint;' Methodist Hospital will have a breakfast
on October 20 to kick off Red Ribbon Week; the young people will be
participating in the health fair ~~ the Mall. A challenge was presented
to the City Council to refrain from using alcohol and tobacco during
Red Ribbon Week as an example for all the citizens of Arcadia.

Mayor Chandler, on behalf of the City Council, then presented to Jack
and Pam Trump, father and daughter team and winners and National Champions
of the 15th Equitable Family Tennis Challenge, a certificate in recogniti-
tion of outstanding achievement in the 15th Equitable Family Tennis
Challenge.

PUBLIC In consideration of increasing the Planning and Building Division fees, the
HEARING Planning Department is recolrnnending that the fees charged for processing the
(Planning & various Planning applications be increased 6%. The Planning Department
Building is recommending that the fees for the Building Division also be in-
Dept. creased 5%. Building permit fees are based on cost per square foot
Fee figures published by ICBO. ICBO's current figures reflect a national
Revisions average increase of approximately 1% over last year. Therefore, an
(APPROVED) ,~ increase in Building fees of 5% actually results in a 6% (5% + 1% ICBO
{~l increase) overall increase, consistent with the City Budget.

Councilmember Harbicht inquired about Section 20 of Resolution No. 5506.
In the event a person appeals a Planning Commission decision to the City
Council and is then referred back to the Planning Commission, he would
have to pay the additional appeal or reprocessing fee. Councilmember
Harbicht did not feel this to be fair. The Planning Director explained
that sometimes when plans come back a second time to the Planning Com-
mission, the plans have been changed so much it is like a new set of
plans. Staff then starts over with a new review and report. Council-
member Gilb remarked that Council could waive the fee at the time of the
hearing. Staff remarked that in the past there have been such situations
where there have been so many substantial changes that Council would
either deny it or offer the developer the opportunity to go back before
the Planning Commission. Every now and then there is something that is
so completely different that it is like a brand new project. Council-
member Harbicht said in that case he could see the need for the additional
fee. Staff replied if the plans were not changed but were being returned
to the Planning Commission, Council could direct that the fee not be im-
posed. The fee would be determined by the Planning Director in the event
of return to the Planning Commission. Councilmember Harbicht also in-
quired about plans turned down by a home owners' association and then
appealed to the Planning Commission -- if such a fee would be applied.
Staff replied that was true. He noted that recently there was a case
where the Planning Commission recommended that the fee be returned.
Councilmember Harbicht noted that in a few cases the homeowners' associa-
tions were overstepping their bounds as to what they could require the
property owner to do. If the Planning Commission agrees that the home
owners' association acted improperly, the property owner had to pay the
filing fee by having to come before the Planning Commission. He feels
that Council and the Planning Commission should be aware that in the event
the case is clear cut and, because of some such circumstance, should not
have had to be appealed, then the option of refunding the fee should at
least be considered. Staff responded that in such an event it would be
appropriate for staff to remind the Commission that they have authority
to refund the fee.
Mayor Chandler then declared the hearing open.

On MOTION by Member Gilb, seconded by Member Young and CARRIED, the
Minutes of the meeting of October 3, 1989 were APPROVED.
On September 5, 1989 the Agency formally adopted a Project Budget,
set Just Compensation and directed staff to begin the acquisition
process for the Southwest Corner Project. Offers were subsequently
sent to property owners on September 11, 1989. Since that time, staff
has talked with all property owners within the project'site. The owners
of the vacant property located at 154 E. Huntington Drive (Amir Zahir and
Yousef Younaei) have asked far in excess of the Agency's offer and far
in excess of comparable properties in the Arcadia area. They have shown
no willingness to negotiate to date. Staff will continue to seek to negotiat,
with Messrs. Zahir and Younaei. In light of this situation, staff feels
that it is appropriate to set a hearing for the property owners in order
to consider use of eminent domain in this acquisition. This hearing
marks the beginning of the condemnation process.
The Assistant City Manager for Economic Development then presented and
read the title of Resolution No. ARA-143 , entitled: "A RESOLUTION OF
THE ARCADIA REDEVELOPMENT AGENCY OF THE CITY OF ARCADIA, CALIFORNIA
SETTING A HEARING CONCERNING THE PROPOSED ADOPTION OF A RESOLUTION OF .
NECESSITY IN CONNECTION WITH THE ACQUISITION OF CERTAIN PROPERTY (ZAHIRI
YOUNAEl)".

CONSENT ITEMS
APPROVED agreement for continued participation in the San Gabriel
Valley Training Consortium with the law firm of Liebert. Cassidy &
Frierson. The proposed cost of this year's agreement is $1.445 (3.6%
higher than the 1988/89 agreement). Sufficient funds have been budget-
ed in the 1989/90 General City budget.
ACCEPTED work and AUTHORIZED final payment pursuant to terms of the
contract with Pavement Coatings Company for 1989-90 annual street
maintenance - slurry seal on selected streets - Job No. 650. The
final contract amount of $115.771.06 was funded from State Gas Tax I
funds in the amount of $110.856.06. Fire Department Operating Budget
in the amount of $267.00 and prepaid developer's fee of $4.648.00. Ten
percent (10%) retention payment becomes due and payable 35 days after
the recordation of Council acceptance and upon completion of all correc-
tions of record.
ACCEPTED work and AUTHORIZED final payment pursuant to terms of the
contract with Industrial Asphalt Contracting Company for the rehabilita-
tion of Campus Drive from Holly Avenue to Santa Anita Avenue - Job No.
652. The final contract amount of $152.276.46 was funded from 86%
(reimbursement) with Federal Aid Urban Funds. and 14% with State Gas
Tax funds. Ten percent (10%) retention payment becomes due and payable
35 days after the recordation of Council acceptance and upon completion
of all corrections of record.

Councilmember Harbicht stated, in part, that he was having second
thoughts about this project to improve the railroad crossing. Originally,
Council was talking about $103,000; now, about twice that amount. He is
not sure this project is worth $230,000. The cost of brick veneer is
high. Perhaps it would be well to reconsider the first ideal. of re-
painting the bridge. He does feel strongly that the bridge should be
beautified; it is consistent with what is being done all along Huntington
Drive. Some of the bridges that he has seen p'aihtelllook great -- Azusa,
Santa Fe Springs. Mayor Chandler agreed that the painted bridge in Azusa
looks very well. He understands there is a problem with the treatment with
bricks in that the bricks tend to falloff. Staff replied in answer to
a question that the bricks 'have not been ordered except for a small
number used for test purposes. Councilmember Harbicht said he would
like to see this move ahead; there is money available if it is to be
painted. Councilmember Young suggested bricks be added in columns as
decoration; which would be cheaper. Councilmember Gilb suggested wait-
ing until the properties on that corner are redeveloped. Staff is direct-
ed to return to Council with a report on the cost of painting the bridge,
and the cost of painting and adding the brick columns.

Counciilmember Harbicht inquired if this is a "housekeeping" matter.
Staff replied that it is more than that ... the City is required to
determine each year where it is with regard to the 'Gann Limitation and
to formally do that, and present the'report to Council. Fortunately,
unlike many cities, Arcadia is not pushed up against the limit.

that 8 phrase requiring the City Clerk to transmit this Resolution, if

to be added to this Resolution.

Noted that he had recently been approached by a resident on Vaquero Drive
who complained that he had very poor water presssure. After some researChl'
he found out that, while most stteets have mains at both ends of the stree
his street only has a main at the south end of the street pushing the wate
up the hill. Is that a common situation, and also is there adequate flow
for fire protection in that area? He requested staff to inform him about
this situation.
CHANDLER Stated that it is a tragic day because ,the San Francisco area had 'a
(Disaster huge earthquake; we don't know as yet how bad it really is. Co-
Preparedness)incidentally, our City, through the leadership of the City Manager
and tbrough the approval of a great deal of expenditure of City funds,
is working to prepare ourselves. He asked the City Manager to elaborate
on this.

, vi "I would like to close the meeting tonight in memory of a long-time
resident of Arcadia, Angelo Mosco. He owned a restaurant for twenty
years in Arcadia; for thirty years in Arcadia and Temple City. He was
71 years old. He passed away at Arcadia Methodist Hospital. Services
were at St. Luke's Church in Temple City; graveside Service at the
Resurrection Cemetery in South San Gabriel. Mr. Mosco lived in Arcadia
and Temple City for three decades. He ran Angelo's Royal Turtle on
Live Oak Avenue from 1971 to 1984 when he sold the business. Prior to
that he ran the Santa Fe Inn in El Monte. He was the patriarch of a
large Italian family that gathered at his home on holidays. He was born
in Cokedale, Colorado, a coal mining town in 1918. His family moved to
California when he was a child. His first job was a bellboy at the
Hilton Hotel in Los Angeles; he worked at the Peppermill and other
restaurants in town before he took over Angelo's Royal Turtle. He is
survived by his son, Michael Mosco of Duarte; a daughter, Tammie 'McKenz;l;e
of Riverside; two sisters, Mary Ringo of Arcadia and Josephine Breckon
of Hobb, N. M., and four grandchildren. I would like to close the meet-
ing tonight in memory of Angelo Mosco."

which started earlier this year when the City sent most of the manage-
ment staff to California Specialized Training Institue, an arm of the
State of California, which provides earthquake preparedness programs
from a management response standpoint; most of the management people
have gone through the program which is a very intensive one-week course.
It opened our eyes with regard to how inadequately prepared we are, as
are most cities, and it was beneficial in that it opened our eyes as to
the things that we can do and should do to prepare to protect the
community as well as humanly possible during an earthquake. Subsequent
to that, it was felt that it was good to test the new plan that was
just finished, as well as the things that were learned at CSTI, so the
CSTI personnel were asked to come down to Arcadia and put on a three
day program which culminated last Friday in an actual hands-on earth-
quake exercise '" of a magnitude of 6.8 ... and the management team
had to respond to that situation. What was particularly good about
this particular exercise was that we had not only approximately 50
of our own people involved in it; but people from various agencies' that
will be dealing directly with the City to help to mitigate any problems
we have with earthquakes. These included Methodist Hospital, Santa
Anita Fashion Park, Santa Anita Race Track, the ham radio amateur
operators; the School District, the local gas, telephone and Edison
utility companies. It was a very enlightening exercise. It was much
better to deal with this in our own City with problems which we know
we will be facing here with the dam and other potential hazards in the
community. We know there is a long way to go with further training
and preparation, but it is a good feeling to know that we are on our
way and are in much better position than most cities to be prepared
to respond to help the citizens should something similar to what
occurred in San Francisco happen here.
The meeting ADJOURNED at 8:15 p. m. to 7:00 p. m., November 7, 1989
in the Chamber Conference Room to conduct the business of the Council
and Agency and CLOSED SESSION, if any, necessary to discuss personnel,
litigation and evaluation of properties.
