It was MOVED by Councilmember Lojeski, seconded by Councilmember Young and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. CITY ATTORNEY The City Attorney announced ,that, "pursuant to Government Code Section 54956.9(a), the Arcadia Redevelopment Agency met in a CLOSED SESSION to discuss the current case of the Arcadia Redevelopment Agency vs. Kiewit". PRESENTATION Mike Coleman, Auto Club of Southern California, presented a plaque from the American Automobile Association to the City of Arcadia denoting the second successive year of no pedestrian fatalities in the City. This was accepted by Mayor Chandler on behalf of the Council and City with the comment that this excellent record was due in large part to the hard work of the Arcadia Police Department and the Arcadia School District's safety programs. Mayor Chandler declared the hearing open. This area is bordered on the north by Orange Grove Avenue, on the east by Oakmeadow Road, Hacienda Drive and San Carlos Road, on the south by Foothill Boulevard and on the west by Baldwin Avenue. The City Council at its September 26, 1989 meeting directed staff to proceed with a zone change to avoid the possibility of splitting large lots within the area into smaller lots. Mayor Chandler declared the hearing open. No one desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Young, seconded by Councilmember Harbicht and CARRIED. It was then MOVED by Councilmember Harbicht, seconded by Councilmember Gilb and CARRIED on roll call vote as follows that Council MOVE to APPROVE and FILE the Negative Declaration, find that the zone change will not have a significant effect on the environment and DIRECT staff to prepare the appropriate ordinance. At first he thought about deleting the Recreation Office; perhaps adding it later. But, on further thought, the Recreation people will be there which will save money in stationing other people there. The deletions proposed are minor in relation to the total project. Everything has been decided by Committees, group of seniors, by the staff and Council. He does not feel anything is superfluous. He is going to support the proposal as it is bid. It was then MOVED by Councilmember Harbicht, seconded by Councilmember Gilb and CARRIED on roll call vote as follows that any informalities in the bid or bidding process be WAIVED; the Mayor and City Clerk AUTHORIZED to execute a contract in a form approved by the City Attorney with Nationwide Construction in the amount of $4,411,300. It was MOVED by Councilmember Young, seconded by Councilmember Gilb and CARRIED on roll call vote as follows that Resolutions Nos. 5510, 5511, 5512 and 5513 be and they are hereby ADOPTED. Councilmember Harbicht inquired regarding Resolution No. 5512 if deposits were required from candidates and if this should be part I of the Resolution. The City Attorney and City Clerk replied that this has not previously been included in the Resolution; the candidate signs a statement that he will pay the fee and it is pro-rated among the candidates. A bill will be mailed to each candidate. The amount is paid later. AYES: NOES: ABSENT: Councilmembers Gilb, Harbicht, Lojeski, Young and Chandler None None The City Attorney presented, explained the content and read the title of Resolution No. 5514, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, DENYING AN APPEAL OF PLANNING COMMISSION RESOLUTION NO. 1423 WHICH DENIED MC 89-074 FOR 6'0" HIGH MASONRY PILLARS WITH 5'6" HIGH DECORATIVE WROUGHT IRON FENCING, AND TWO DECORATIVE LIGHT FIXTURES ON THE TWO PILLARS AT THE DRIVEWAY ENTRY AT 1150 FALLEN LEAF ROAD". It was MOVED by Councilmember Lojeski, seconded by Councilmember Gilb and CARRIED on roll call vote as follows that Resolution No. 5514 be and it is hereby ADOPTED. Councilmember Harbicht noted that Finding No.2, a. and b. really follow the appropriate improvement part of it and c. speaks to uniformity of development. He inquired if these items could be separated. The City Attorney replied, with Council direction, the Resolution could be revised. Councilmember Harbicht said he would like to make a finding No. 3 that this would not promote uniformity of development and that Item c. would be part of Item No.3; this will make it clearer exactly what Council's findings were. The appropriate improvement should be separate from the uniformity of development; they are two very different things. The Resolution stands as revised. AYES: NOES: ABSENT: Councilmembers Gilb, Harbicht, Lojeski, Young and Chandler None None MATTERS FROM STAFF I Neal Johnson, Arcadia Chief of Police, reported, in part, that the Arcadi Police Department had been involved with the San Gabriel Valley Narcotics Team on December 4, 1989, whereby a traffic stop was made near Bakersfield which netted 99 kilos of cocaine. After further investigation, they obtained three more search warrants netting approximately an additional 330 kilos of cocaine and a kilo of heroin; a total of seven people were arrested and about $100,000 cash taken in. The six men arrested were booked at Central Jail; the one woman booked at Sybil Brand. It was another successful operation; another point being made about the need for narcotics investigations and, again, just showing the tip of the iceberg on this problem. Councilmember Lojeski inquired about the six men being held, who are all non-citizens, after being booked. Chief Johnson replied they are being held on two million dollars bail each; if bail is provided by one of the drug lords, they will probably be gone. 12/5/89 -6- 5c. ARA FY 1988-89 RPT TO STATE DEPT. HEARING SCHEDULED (Dec. 19, 1989) 31:0253 California Redevelopment Law (Health and Safety Code Section 33080) requires that all redevelopment agencies file an annual fiscal and activity report with the California Department of Housing and Community Development (HCD) within six months of the end of the fiscal year. California Redevelopment law requires that this report be approved by City Council prior to transmittal to the State HCD. It was MOVED by Member Lojeski, seconded by Member Gilb and CARRIED on roll call vote as follows that the Agency DIRECT staff to present the Arcadia Redevelopment Agency FY 1988-89 Report to the State Depart- ment of Housing and Community Development to the City Council for approval, and authorization to transmit the report to HCD. (APPROVED) 1':\ 'l1 yP 31:0254 CITY MANAGER In September 1989, the Council approved the plans, and specifications for the proposed Senior Citizens' Center. The project was advertised :for bid and a total of 29 contractors picked up one or more sets of plans (some were general contractors and some were potential subcontractors). Bids were received and opened by the City Clerk on November 3, 1989. A list of the bids received is attached to staff report dated December 5, 1989. The lowest bid (TOTAL) was that submitted by Nationwide Construction in the amount of $4,411,300. The ALT (alternate) dollar amount (shown in attach- ment to staff report of December 5, 1989) represents the amount the total could be reduced if the partitions in the main assembly room were to be manually operated rather than mechanically operated as called for in the specifications. The arch.Ltect's August 1989 Statement of Probable Construction Cost was $3,357,000. The low bid was $1,054,300 (31.4%) over the architect's estimate. I Several alternatives were available to Council: (1) Award the contract at the amount specified to the lowest bidder for the project as set forth in the plans and specifications; (2) reject all bids and rebid the project; (3) reject all bids, modify the plans and specifications and rebid the project. Councilmember Lojeski questioned if the City goes back out to bid, modifying the plans and specifications, etc., would there be additional charges from the architect. Staff replied there would be a charge for reproducing documents; nothing other than that. Mayor Chandler stated that, basically, more than s year ago Council made a commitment to build a Senior Center. A start was made to develop what was wsnted; Council snd staff went out and looked at other Senior Centers; found a design for an upscale Senior Center with a lot of nice, lasting features; low maintenance. Additional space was needed at'City Hall so this provided an opportunity to incorporate the Recreation Offices in the new Senior Center. At this point the absolute bill is before Counci~, in the amount of $4,411,300. The options have been listed ... the option he is going to vote for is to stay the course and go with the building as initially planned without compromising any of the features. Accept the fact that that is the low bid and it will not get cheaper as time goes on. He would like it to be the best that it can be; the City can afford it. City funds are for the purpose of providing amenities for the public. His vote is to go ahead as originally planned, with the bill as presented to Council. Councilmember Harbicht noted that he is basically in agreement with the Mayor. He has looked at this very carefully; also has looked at the alternatives. A great deal of thought has gone into these plans; this is what we want. He feels Council should award the contract to the low bidder and get on with getting it built. Councilmember Young agreed that the Center should be built. However, if there is a question of money, the only change she would like to see is the deletion of the Recreation Department Offices and the covered walk- way adjoining the two buildings. Those items could be added later. I Councilmember Lojeski noted that this type of facility is long overdue. However, the City does not have to build a Taj Mahal; some items could be deleted; the money saved could be put into other programs to benefit the citizens. We have no Senior Center now; so anything is going to be 100% better, than nothing. He feels there are things listed here that are not needed, e. g., a $10,000 chandelier in the entryway. Council- member Young replied that was not an exhorbitant amount for such a chandelier. Councilmember Lojeski said he realized this was a Center that was needed in the City. If something hsd to be deleted, he could not agree that it should be the Recreation Offices. It is his feeling that it is a definite advantage to have the Recreation Offices on the premises. However, perhaps some of the frosting could be done away with. " ! 12/5/89 -4- 11. Councilmember Gilb inquired about the money supposed to be returned to the City after the last large drug bust. Chief Johnson replied the matter has been referred to the U. S. Attorney in Washington, D. C.; it will probably be another six to eight months. Mayor Chandler noted that was very good work: the task force is really paying off: Councilmember Harbicht added his congratulations. MATTERS FROM ELECTED OFFICIALS He was contacted by a representative of the Arcadia Educational Foundation with.. request for the Mayor to make a proclamation that the week of December 11, 1989 be Arcadia Educational Week. The Mayor agreed. Had been contacted by citizens concerning the fact that during heavy traffic hours of 7 - 9 a. m., Arcadia Public Works crews had one lane blocked on the westbound Foothill Blvd. This morning he had been going eastbound on Foothill Blvd. about 5:45 a.m. and a crew was trimming trees with a lane blocked: this morning was not a problem and it was not even certain that the 7 - 9 a. m. crew was an Arcadia crew. How- ever, as a City, it is important to recognize the traffic problems that exist and be sure to schedule lane closures for times when it will have the least impact. Councilmember Harbicht requested a brief CLOSED SESSION at the close of this meeting. Noted that oak trees on lots on Rancho Road south of Foothill Blvd. had been cut down when the lots were cleared of the houses for new construction. Wondered if Council is interested in taking up the tree problem again ... insofar as the old native oaks are concerned. Re. City Newsletter -- there is a letter from the Mayor to the Los Angeles Sanitation District regarding the landfill crisis. Have carbon copies been sent to Supervisor Schabarum and the Mayor of Los Angeles? Staff replied a copy had been sent to Supervisor Schabarum. "r'd like to adjourn tonight's meeting -- it was just brought to our attention that a very fine architect with a very fine firm who was hired by the City of Arcadia to do some architectural work, and basically a site plan for the potential civic center site, of which the Council Chambers and City Hall would be a part of '" the gentleman's name was Wendell Mounce. Wendell, in his dealings with the Council and the staff was always very professional and just a real pro as far as his approach and his demeanor and his work with staff and Council. I understand that he passed away this past weekend at home and it is with regrets that we hear this and I think it would be appropriate to adjourn tonight's meeting in his memory." "I would like to adjourn the meeting in memory of Mary D'Zurko, Mrs. John D'Zurko. Some of you may know John he owned the Formal Knight Tuxedo Shop on Baldwin Avenue for a number of years. Mary passed away on Thanksgiving Day. They have been residents of Arcadia for well Over twenty years. She grew up in the Fresno area and was a past president of the Arcadia Auxiliary of the Methodist Hospital; a life member of the Assistance League of Arcadia; and a former member of the Arcadianns. She and her husband have two children; Marlow, a daughter and a son, Michael; Memorial services were held on November 26 and internment was in Fresno." 12/5/89 -7- 12.
