Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, July 24, 2012, in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Chiao presiding. The meeting was called to order at 7:05 p.m.1 PLEDGE OF ALLEGIANCE Chairman Chiao led the Pledge of Allegiance. ROLL CALL PRESENT: Commissioners Baerg, Beranek, Parrille and Chiao ABSENT: Commissioner Falzone MOTION Commissioner Parrille made a motion to excuse Commissioner Falzone. Commissioner Beranek seconded the motion and without objection the motion was approved. OTHERS ATTENDING City Councilman John Wuo Community Development Administrator, Jim Kasama Associate Planner, Tom Li Senior Administrative Assistant, Billie Tone SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON - PUBLIC HEARING MATTERS — Five - minute time limit per person There were none. PUBLIC HEARING 1. MODIFICATION APPLICATION NO. MP 12 -04, ARCHITECTURAL DESIGN REVIEW NO. ADR 12 -09, OAK TREE REMOVAL PERMIT APPLICATION NO. TRD 12 -09 501 S. Third Avenue Jonathan De Leon (Property Owner's Representative) The applicant is requesting the following Modifications, Architectural Design Review approval, and a Diseased /Hazardous Oak Tree Removal Permit for a proposed two -unit residential condominium project on an R -2 multiple - family zoned property: A. A 13' -0" to 15' -0" street side yard setback in lieu of the minimum 25' -0" required (AMC Sec 9253.2.5). B. An 11' -0" street side yard setback in lieu of the minimum 25' -0" required for two (2) second floor balconies (AMC Sec. 9253.2.5). C. A 7' -0" southerly side yard setback in lieu of 10' -0" required for two (2) air conditioning units (AMC Sec. 9253.2.5). D. A diseased/hazardous oak tree removal permit for a diseased and hazardous Coast Live Oak tree with a trunk diameter of 60 inches. RECOMMENDATION: Approve Mr. Li presented the staff report. Chairman Chiao asked if anyone would like to speak in favor of this project. Mr. De Leon, the applicant, offered to answer any questions the Commissioners might have on the project. Chairman Chiao asked Mr. De Leon if he was in agreement with all the conditions listed in the staff report including those regarding the placement of the air conditioning equipment and Mr. De Leon said that he was. Chairman Chiao asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Beranek to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Beranek to approve Modification Application No. MP 12 -04, Architectural Design Review No. ADR 12 -09 and Oak Tree Removal Permit Application No. TRD 12 -09, for Items A, B and D and to deny item C, subject to the conditions in the staff report. ROLL CALL AYES: Commissioners Baerg, Beranek, Parrille and Chiao NOES: None ABSENT: Commissioner Falzone There is a five working day appeal period after the approval/denial of the applications. Appeals are to be filed by 5:30 p.m. on Wednesday, August 1, 2012. CONSENT ITEM 2. MINUTES OF JULY 10, 2012 MOTION It was moved by Commissioner Parrille, seconded by Commissioner Beranek, to approve the minutes of July 10, 2012 as presented. PC MINUTES 7 -24-12 Paae 2 ROLL CALL AYES: Commissioners Baerg, Beranek, Parrille and Chiao NOES: None ABSENT: Commissioner Falzone MATTERS FROM CITY COUNCIL & PLANNING COMMISSION Councilman Wuo reported that he recently attended the Independent Cities Association meeting at the Rancho Bernardino Inn where the severe wind storm of last December was discussed. He said that representatives of other cities shared what they leamed in dealing with the disaster and he noted that the City of Pasadena presented a book they developed following the storm and the aftermath. Councilman Wuo said that water entered gas lines and the Gas Co. is working in the area of Santa Anita and Las Tunas on this problem. He also mentioned that there is road construction work going on at Huntington Drive and Santa Clara Street and Santa Anita Avenue and that the area should be avoided if possible. Councilman Wuo said that he attended a Chamber of Commerce meeting last week where awards were presented to the General Manager of the Westfield Mall and the Califomia Pizza Kitchen, among others. He stressed the importance of showing support for local businesses. MODIFICATION COMMITTEE AGENDA Chairman Chiao reported that a Modification application was denied at the Modification Committee meeting because it was basically the same application that was presented and denied at a previous meeting. The applicant failed to make the changes necessary to make the proposed design acceptable to the Committee. MATTERS FROM STAFF & UPCOMING AGENDA ITEMS Mr. Kasama said that at present there are no items scheduled for the August 14 meeting and the Commissioners will be notified if the meeting is cancelled.
