Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, September 11, 2012, in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Chiao presiding. The meeting was called to order at 7:00 p.m. Chairman Chiao opened the meeting and called for a moment of silence in recognition of Patriot Day. PLEDGE OF ALLEGIANCE Chairman Chiao led the Pledge of Allegiance. ROLL CALL PRESENT: Commissioners Beranek, Falzone, Parrille and Chiao ABSENT: Commissioner Baerg MOTION Commissioner Parrille moved to excuse Commissioner Baerg from the meeting. Commissioner Falzone seconded the motion. Without objection the motion was approved. OTHERS ATTENDING City Councilman, John Wuo Deputy Development Services Director /City Engineer, Phil Wray Community Development Administrator, Jim Kasama Assistant Planner, Tom Li Senior Administrative Assistant, Billie Tone SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS A fax written in opposition to Item 1 was distributed to the Commissioners. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON - PUBLIC HEARING MATTERS — Five - minute time limit per person There were none. PUBLIC HEARING 1. HOMEOWNERS ASSOCIATION DENIAL APPEAL NO. HOA 12 -02 AND MODIFICATION APPLICATION NO. MC 12 -15 1050 Hampton Road Kris and Bic Mohandie An appeal to reconsider the Rancho Santa Anita Property Owner's Association's Architectural Design Review Board decision to deny the architectural design of an existing non - permitted 28 square -foot detached pool bathroom. The proposal also requires a Zoning Modification to allow a 2' -4" to 3' -2W easterly side yard setback in lieu of the 12' -0" requriement (AMC Sec. 9251.2.3). RECOMMENDATION: Denial of Appeal and Modification Mr. Li presented the staff report. Chairman Chiao opened the public hearing. Chairman Chiao asked if anyone would like to speak in favor of this project. Dr. Mohandie, the applicant, spoke in support of the project. Chairman Chiao asked if anyone would like to speak in opposition to this project. Mr. Brad Koehler, Architectural Review Board Chairman of the Rancho Santa Anita Property Owners' Association, spoke in opposition to the project. Chairman Chiao asked if the applicant/appellant wished to rebut any of the comments by Mr. Koehler. Dr. Mohandie declined. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Beranek to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Beranek to deny Homeowners Association Appeal No. HOA 12 -02 and Modification Application No. MC 12- 15. ROLL CALL AYES: Commissioners Beranek, Falzone, Parrille and Chiao NOES: None CONSENT ITEM 2. RESOLUTION NO. 1862 A Resolution of the Planning Commission of the City of Arcadia, Califomia, granting Conditional Use Permit No. CUP 12 -12 for a 2,900 square -foot convenience store at 207 S. First Avenue. RECOMMENDATION: Adopt Resolution No. 1862. There is a five (5) working day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Tuesday, September 18, 2012. PC MINUTES 9 -11 -12 Page 2 3. MINUTES OF AUGUST 28, 2012 MOTION It was moved by Commissioner Parrille, seconded by Commissioner Beranek, to adopt Resolution No. 1862 and to approve the minutes of August 28, 2012 as presented. ROLL CALL AYES: Commissioners Beranek, Falzone, Parrille and Chiao NOES: None MATTERS FROM CITY COUNCIL & PLANNING COMMISSION Commissioner Parrille said that he will not be able to attend the September 25 meeting. Chairman Chiao reported that Councilmen Segal and Kovacic will co -chair the opening event for the new Performing Arts Center at Arcadia High School. MODIFICATION COMMITTEE AGENDA Chairman Chiao reported that there was one item on this morning's Modification Committee agenda and that it was approved by the Modification Committee. MATTERS FROM STAFF & UPCOMING AGENDA ITEMS Mr. Kasama said that the agenda for the City Council meeting on September 18 will include noise limit regulations, the housing element update that is required by State code, and filming regulations. He also said that to date, the September 25 Planning Commission agenda includes three Conditional Use Permit Applications. ADJOURNMENT ATTEST: retary, Planning Commission 7:31 p. m.
