HomeMy WebLinkAbout09/18/201254:0108 CITY COUNCIL /SUCCESSOR AGENCY TO THE ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING MINUTES TUESDAY, SEPTEMBER 18, 2012 CALL TO ORDER - Mayor Harbicht called the meeting to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL PRESENT: Council Member Amundson, Kovacic, Segal and Harbicht ABSENT: Council Member Wuo A motion was made by Council Member Kovacic, seconded by Council Member Amundson to excuse Council Member Wuo from this meeting. CLOSED SESSION COMMENTS (5 minutes per person) — No one appeared. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(b)(1) to confer with !".gal counsel regarding the Claim of Patricia Garibay. b. Pursuant to Government Code Section 54956.9(a) to confer with legal counsel regarding the case of Mercedes Chavez v City of Arcadia Community Center, Recreation Department and Does 1 -5 inclusive (Los Angeles County (Pasadena) Superior Court Case No. GC048985. The Closed Session ended at 6:30 p.m. CITY COUNCIL REGULAR MEETING Mayor Harbicht called the regular meeting to order at 7:00 p.m. ROLL CALL OF CITY COUNCIL: PRESENT: Council Member Amundson, Kovacic, Segal and Harbicht ABSENT: Council Member Wuo A motion was made by Council Member Amundson, seconded by Council Member Segal to excuse Council Member Wuo from this meeting. REPORT FROM CITY ATTORNEY ON CLOSED SESSION ITEMS City Attorney Deitsch reported that the City Council met in a Closed Session to consider the two items listed on the posted agenda under closed session; that Item (a) is a tort claim against the City; and Item (b) is pending litigation against the City; and that no reportable action was taken on either item. 09 -18 -12 54:0109 INVOCATION Mayor Robert Harbicht PLEDGE OF ALLEGIANCE Arcadia Boy Scout Troop 111 SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Amundson, seconded by Council Member Segal to read all ordinances and resolutions by title only and waive the reading in full. PUBLIC COMMENTS Bob Machuca, representing the Los Angeles County Economic Development Corporation appeared and commented on guidelines for best practices and film friendly regulations and policies; he commended the City in considering adopting a revised film policy; he offered his services to assist the City do what it can to be more business friendly; and encouraged the City to apply next year for the Most Business Friendly City award. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). City Clerk Glasco announced the Arcadia Woman's Club "Rockin Back to the 50's" fundraiser on September 22 and that tickets can be obtained by calling (626) 355 -8979; that the Friends of the Arcadia Historical Society donated funds to provide a "History Lives Here" marker at the entrance to the Los Angeles County Arboretum and the unveiling is on October 2 at 4:00 p.m.; he provided a brief history of the markers being placed around the City; and noted this makes the 9th historical marker. Council Member Amundson announced that he attended the League of California Cities Annual Conference in San Diego along with Council Member Kovacic and City Manager Lazzaretto; and commented on a couple of workshops he attended regarding pension reform and development in a post redevelopment world, which he felt were very informative. Mayor Pro Tem Segal announced the Arcadia Thrift and Welfare 80th anniversary celebration on October 4 at 5:00 p.m. on First Avenue; the Methodist Hospital Crystal Ball on October 13 and noted that Natalie Cole will be performing; he urged everyone to attend the opening of the Performing Arts Center on October 27; that Paul Anka will be performing; that the event will sponsor an endowment for the Arcadia Performing Arts Foundation; and noted that if it is a sellout, the foundation will raise $1 million; that ticket information can be found on the Arcadia Unified School District website; and stated that some Arcadia High School students will be performing in the orchestra with Mr. Anka. 09 -18 -12 D 54:0110 Council Member Kovacic also announced that he attended the League of California Cities Annual Conference on September 6 and 7 in San Diego; he commented on a couple of workshops he attended concerning regulations on food trucks, options to redevelopment, pension reform, and labor relations, which he noted were all very informative; he also announced and discussed the opening of the Performing Arts Center on October 27; that Paul Anka will be performing; that the Performing Arts Center has 1,200 seats and cost $20 million; that tickets are available for purchase on the Arcadia Unified School District's website at www.ausd.net; and noted that he and Mayor Pro Tern Segal are co- chairs on the Performing Arts Center Foundation which will keep performing arts alive and well in Arcadia and in the region for many years to come. Mayor Harbicht noted that a couple of meetings ago he commented on a number of cities facing bankruptcy and wanted everyone to know that the City of Arcadia is in excellent condition; he announced that later on the agenda, the City will consider refinancing bonds that were issued for the construction of the police station; that the refunding of the bonds will reduce the net interest cost which will directly benefit Arcadia taxpayers by lowering the amount of their assessment on their tax bills; and noted that because of the City's financial status and the refunding of the bonds, the City has received a bond rating of AA +. 1. CONSENT CALENDAR a. Approve the Regular Meeting Minutes of Auaust 7 2012 and Auaust 21, 2012. Recommended Action: Approve b. Adopt Resolution No 6841 approving the City of Arcadia Local Hazard Mitigation Plan. Recommended Action: Adopt C. Authorize and direct the City Manager to execute a Professional Services A_ reement with RBF Consulting to update the Housing Element for the 2014 -2021 cycle in the amount of $19,968 and approve a 10% contingency. Recommended Action: Approve d. Authorize and direct the City Manager to execute a Professional Services Agreement with Trovao and Associates Inc DBA The Christmas Tree Light Guy Company to provide materials installation labor, and removal of holiday decorations on Huntington Drive between Santa Clara Street and Fifth Avenue in the amount of $33,742 for the 2012 holiday season and $28,584 for the 2013 holiday season. Recommended Action: Approve e. Award a purchase order contract to Rotolo Chevrolet for the purchase of three Chevrolet pickup trucks in the amount of $77,883.49. CITY MANAGER ITEM a. Introduce Ordinance No. 2302 amending Section 4610.3 of Part 1 Chapter 6 of Article IV of the Arcadia Municipal Code regarding an exemption from the noise limits. Recommended Action: Introduce Jason Kruckeberg, Assistant City Manager /Development Services Director, and Jim Kasaina, Community Development Administrator, presented the staff report. It was moved by Council Member Segal, seconded by Council Member Amundson, and carried on roll call vote to introduce Ordinance No. 2302 amending Section 4610.3 of Part 1, Chapter 6 of Article IV of the Arcadia Municipal Code regarding an exemption from the noise limits. AYES: Council Member Segal, Amundson, Kovacic, and Harbicht NOES: None ABSENT: Council Member Wuo b. Adopt Resolution No. 6848 providing for the issuance of its General Obligation Refunding Bonds, Series 2012 (Police Station Project) in the principal amount not to exceed Seven Million Dollars ($7,000,000). Recommended Action: Adopt Hue Quach, Administrative Services Director, and Jerry Schwartz, Economic Development Manager, presented the staff report. It was moved by Council Member Segal, seconded by Council Member Amundson, and carried on roll call vote to adopt Resolution No. 6848 providing for the issuance of its General Obligation Refunding Bonds, Series 2012 (Police Station Project) in the principal amount not to exceed Seven Million Dollars ($7,000,000). Recommended Action: Provide direction Jason Kruckeberg, Assistant City Manager /Development Services Director, and Silva Vergel, Business License Officer, presented the staff report. 09 -18 -12 54:0112 It was moved by Council Member Segal, seconded by Council Member Amundson, and carried on roll call vote that filming in residential zones be expanded to include Saturdays from 7:00 a.m. to 10:00 p.m.; that the number of days of filming in residential zones be increased to up to three (3) consecutive days in a quarter; and that policies and fees be established for filming at City facilities.
