CALL TO ORDER - Mayor Harbicht called the meeting to order at 6:00 p.m.
PRESENT: Council Member Kovacic, Segal, Wuo and Harbicht
ABSENT: Council Member Amundson
A motion was made by Council Member Wuo, seconded by Council Member Segal to excuse
Council Member Amundson from this meeting.

STUDY SESSION
a. Report, discussion and direction concerning a potential specific plan application for a
medical office building on Santa Anita Racetrack property — 285 West Huntington
Drive.
Jason Kruckeberg, Assistant City Manager /Development Services Director, presented the staff
report.
Dick Hale from The Hale Builders & Developers, presented conceptual drawings of a new medical
office building; and provided an overview of the proposed project.
The City Council directed staff to proceed through the required Specific Plan process for a medical
office building on Santa Anita Racetrack property at 285 West Huntington Drive.
The Study Session ended at 6:28 p.m.

REPORT FROM CITY ATTORNEY ON CLOSED SESSION /STUDY SESSION ITEMS
City Attorney Deitsch reported that the City Council met in a Study Session to hear a report from
staff concerning a potential specific plan application for a medical office building on Santa Anita
Race Track property located at 285 West Huntington Drive; and that staff was directed to proceed
through the required Specific Plan process, work with the developer and bring back the proposed
project for Planning Commission and City Council review and possible approval.

City Manager Lazzaretto announced there was no supplemental agenda information.
MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE

A motion was made by Council Member Segal, seconded by Council Member Wuo to read all
ordinances and resolutions by title only and waive the reading in full.
PRESENTATION
a. Proclaiming the week of October 7 -13 as Fire Prevention Week.
1. PUBLIC HEARINGS
a. Adopt Resolution No. 6847 adding Waterless Car Washing /Auto Detailing Chair
Massages, Vehicle Displays, Lead Generation and Dance Studios to the list of
permitted uses for the Westfield Santa Anita Mall at 400 S. Baldwin Avenue.
Recommended Action: Adopt

Mayor Harbicht opened the public hearing.
Larry Green, representing Westfield, LLC, appeared and expressed his appreciation to the staff for
their hard work; he noted there was a lot of discussion with staff on how to implement and add the
uses to the list of permitted uses for Westfield Santa Anita Mall; and he thanked the City Council for
considering their proposal.
Scott Hettrick, Executive Director of the Chamber of Commerce appeared and spoke in support of
the proposed resolution; he stated that proposed permitted uses are minor changes that will bring a
positive upside to the Chamber and the Community, and benefit the vibrancy of the mall.
A motion to close the public hearing was made by Council Member Segal, seconded by Council
Member Wuo, and seeing no further objection, Mayor Harbicht declared the public hearing closed.
Council Member Kovacic requested parking space restrictions be added to the Waterless Car
Washing /Auto Detailing section of the proposed Resolution.
At the request of the City Council, City Attorney Deitsch suggested adding language to Section 2 of
the proposed resolution to read "each such operation shall not occupy more than six (6) parking
spaces and shall be in a covered parking area ".

call vote to approve the environmental determination; and adopt Resolution No. 6847 adding

b. Consideration of a Special Use Permit to allow the "626 Night Market" an Asian -
themed food and retail night market within the infield area at Santa Anita Park at 285
W. Huntington Drive on October 20 -21 2012 and December 15 -16 2012

Jason Kruckeberg, Assistant City Manager /Development Services Director, and Lisa Flores, Senior
Planner, Community Development Administrator, presented the staff report.
In response to a question raised by Council Member Kovacic, City Manager Lazzaretto confirmed
that the DJ music will be in a small area during the event; that it is not intended to provide music
throughout the entire event and it is not a concert level sound system.
Mayor Harbicht opened the public hearing.
Jonny Hwang, the organizer of the event, presented an overview of the "626 Night Market "; he
reported that night -time markets are common in many Asian countries and communities; that it
provides Asian businesses an opportunity to showcase their products; that alcoholic beverages will
not be served; he commented on monitoring the noise levels and operating hours; and noted that
he is working with the Police and Fire Departments in order to minimize traffic and safety issues
during the event.
Stephen Reed, an Arcadia resident appeared and spoke in opposition of the proposed Special Use
Permit; he stated that he did not want to reiterate the statements he made earlier in an e -mail to the
City Council (attached to the staff report); he expressed his appreciation to staff for volunteering to
monitor the sound levels; and urged the City Council to enforce previously adopted City laws.
Vince Foley, an Arcadia resident and neighbor of the race track appeared and spoke in favor of the
"626 Night Market "; he urged the City Council to approve the requested dates, and to modify the
conditions if the event has an adverse impact on the Community.
Scott Hettrick, Executive Director of the Chamber of Commerce appeared and spoke in favor of the
"626 Night Market" and the Special Use Permit request; he stated that this event is another
example of the City and Chamber partnering on the ongoing marketing campaign for "Shop
Arcadia "; he noted that the event will attract Arcadians who attended the Night Market in Pasadena
and Arcadia's young adults.
A motion to close the public hearing was made by Council Member Kovacic, seconded by Council
Member Segal, and seeing no further objection, Mayor Harbicht declared the public hearing closed.

In response to Council Member Kovacic's request to add language regarding noise readings,
Assistant City Manager /Development Services Director Kruckeberg suggested that a sentence be
added to No. 10 of the Conditions of Approval to read "noise readings will be conducted during the
event to ensure the sound levels are within the Municipal Code levels;" and indicated that City staff
will monitor the late night readings during the event.
City Manager Lazzaretto indicated that the City would absorb the cost of the sound metering and
not pass the cost to the applicant because the baseline data would be used for determining
appropriate sound levels at other special events at the facility.
City Attorney Deitsch recommended amending Condition of Approval No. 11 to read
"Noncompliance by the applicant with Arcadia Municipal Code or the provisions and Conditions of
Approval for SUP 12 -19 shall be grounds for immediate suspension or revocation of any approvals,
which could result in the closing and /or cancellation of the events."
It was moved by Council Member Wuo, seconded by Council Member Kovacic, and carried on roll
call vote to approve Special Use Permit No. SUP 12 -19 to allow the "626 Night Market ", an Asian -
themed food and retail night market within the infield area at Santa Anita Park at 285 W. Huntington
Drive on October 20 -21, 2012, and December 15 -16, 2012; as amended by Assistant City
Manager /Development Services Director Kruckeberg (Condition of Approval No. 10) and City
Attorney Deitsch (Condition of Approval No. 11).

C. Adopt Resolution No. 6846 authorizing the Arcadia Police Department to use funds
allocated from the Citizens' Option for Public Safety- Supplemental Law Enforcement

It was moved by Council Member Segal, seconded by Council Member Wuo, and carried on roll call
vote to adopt Resolution No. 6846 authorizing the Arcadia Police Department to use funds allocated
from the Citizens' Option for Public Safety - Supplemental Law Enforcement Services Fund (COPS -
SLESF) for the purchase of front line police services.

John Letts, owner of I- Tennis Company, 405 South Santa Anita Avenue, Los Angeles County Park,
appeared and provided information on his tennis concession program at the County Park and
discussed a fundraising campaign which will be held in December to raise money to update the
park's tennis facility.
REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City
Council related to meetings attended at City expense [AB 1234]).
City Clerk Glasco thanked everyone who attended the unveiling ceremony of the City's 9th
Historical Marker dedicated by the Arcadia Historical Society, at the entrance to the Los Angeles
County Arboretum; he provided a brief history of the markers being placed around the City; and
urged everyone to visit the Historical Markers.
Council Member Kovacic announced the Arcadia High School football Homecoming game on
October 5; the Methodist Hospital Crystal Ball on October 13, and the opening of Performing Arts
Center where Paul Anka will be performing on October 27; and noted that the tickets are available
for purchase on the Arcadia Unified School District's website at www.ausd.net and encouraged
everyone to attend and support this event.
Council Member Wuo announced that he attended the Arcadia Travelers Club 30th Anniversary
Celebration along with City Manager Lazzaretto; he thanked the Travelers Club for their successful
travel programs for seniors; he reported that he attended the Moon Festival on September 30 and
the opening day at Santa Anita Race Track on September 28; and that he and Mrs. Kovacic
presented a certificate to retired jockey, Eddie Delahoussaye; he announced a National Holiday for
the People's Republic of China on October 1 and the Taiwan Republic of China on October 10; he
urged everyone to attend the Methodist Hospital Crystal Ball; and he thanked Council Members
Segal and Kovacic for their fundraising efforts.
Mayor Pro Tern Segal congratulated the Chamber of Commerce on a successful Taste of Arcadia
event; he noted that Council Member Wuo is the co -chair of the Methodist Hospital Crystal Ball
which will benefit the stroke program, and encouraged everyone to attend; he announced the
Arcadia Thrift and Welfare 80th anniversary celebration on October 4, and the opening of the
Performing Arts Center on October 27; he noted that the School District has done an incredible job
building the Performing Arts Center; and announced that some of the Arcadia High School students
will be performing with Mr. Anka.
Mayor Harbicht announced that residents who were affected by the 2011 windstorm may be eligible
for State tax relief and suggested they visit the City's website for information on how the program
works and how to apply; he commented on a letter received from a resident complaining about the
Santa Anita Oaks Homeowners Association, and Architectural Review Board, and felt that the
Architectural Review Board is taking advantage of the power given to them by the City.
Mayor Pro Tern Segal advised that a Study Session is in the process of being scheduled regarding
the responsibilities and duties of Homeowner Associations and Architectural Review Boards in the
City.
City Manager Lazzaretto confirmed that a Study Session will be scheduled before the end of the
year.

a. Approve the Regular_Meetinq Minutes of September 4, 2012, and September 18

b. Adopt Ordinance No. 2302 amending Section 4610.3 of Part 1 Chapter 6 of Article
IV of the Arcadia Municipal Code regarding an exemption from the noise limits.

d. Authorize and direct the City Manager to execute a Professional Services Agreement
with HF &H Consultants, LLC for the financial audit of commercial trash service

e. Authorize and direct the City Manager to execute a Professional Services Agreement
with IDModelinq for the 2013 update of the City's Hydraulic Model in the amount of
$96,075.

f. Authorize and direct the City Manager to execute a contract with Target Mailing
Company for mailing services, in an amount not to exceed $88,000 for the period of
November 2012, through June 2013, with the option of three (3) one -year extensions
in an amount not to exceed $132,000 annually.

g. Award a one year purchase order contract extension to Ernie's Auto Parts for the
purchase of automobile repair parts for City vehicles in the amount of $31,877.

h. Award a one year purchase order contract extension to HD Supply Waterworks for
the purchase of water pipeline fittings, brass valves and other related accessories
for the City's water distribution system in the amount of $113,252.

Lieutenant and a new classification specification and salary level for Records /Legal

call vote to adopt Resolution No. 6851 changing the name of the Ruth and Charles Gilb Arcadia
Historical Museum to the Gilb Museum of Arcadia Heritage; and approve a supplemental
appropriation of $3,400 to remove and replace the current outdoor signage with new signage.

Jerry Schwartz, Economic Development Manager, presented the staff report.
City Manager Lazaretto reported that the County of Los Angeles has not officially taken the assets
of the former Redevelopment Agency, and have not taken action to formally act as the Successor
Agency for the Housing Authority; however, Arcadia has done all necessary steps to transfer the
assets.
It was moved by Council Member Segal, seconded by Council Member Kovacic, and carried on roll
call vote to receive and file the report regarding audit of Redevelopment Low and Moderate Income
Housing Funds per AB 1484 and take no action.

Pursuant to the adjournment of the October 2, 2012 Regular Meeting of the City Council /Successor
Agency to the Arcadia Redevelopment Agency, the City Clerk appeared at the time and place of
adjournment at 6:00 p.m. and announced that no quorum was present until 7:00 p.m.

Mayor Harbicht reported that he, City Manager Lazzaretto, and Assistant City
Manager /Development Services Director Kruckeberg met with California Philharmonic and
Pasadena Symphony and Pops representatives to express the City's concern regarding the
conflicting dates for the 2013 summer series; he indicated the dates have already been publicized
and cannot be changed; that California Philharmonic agreed to change the dates next year and

inform the City and Pasadena POPS of the new dates in advance; he stated that both organizations
agreed to make every effort to publicize the best route for attendees to get to their event on the
nights there are conflicts.
It was moved by Council Member Segal, seconded by Council Member Amundson, and carried on
roll call vote to approve Special Use Permit No. SUP 12 -18 for the California Philharmonic to

Introduce Ordinance No. 2303 amending various Sections of Article III (Public
Safety), Chapter 2 (Traffic Regulations) of the Arcadia Municipal Code regarding
Mobile Food Vending in the Public Right- of -WaV.

City Manager Lazzaretto reported that the City has evaluated its ordinance on mobile food vending
and prior to bringing forward a proposed ordinance to permit mobile food vendors to operate in the
public right -of -way, the City was served with a Complaint for Declaratory Relief filed on behalf of the
Southern California Mobile Food Vendors Association alleging that the City's prohibition is contrary
to State Law.
Jason Kruckeberg, Assistant City Manager /Development Services Director, presented the staff
report and noted that upon discussion with the City Attorney and opposing counsel, staff felt that
Condition C of Section 3234.2 is unnecessary and is already part of the law which is regulated by
the Los Angeles County Department of Health; and recommended that Condition C be deleted.

Mayor Harbicht opened the public hearing.
Scott Hettrick, Executive Director of the Chamber of Commerce, appeared and discussed concerns
expressed by some of the members of the Chamber of Commerce in hope that City staff will
mitigate some of the concerns and potential issues; he commented on the downside of allowing
food trucks to park in the public right -of -way, including traffic issues, littering and creating a
nuisance to the local businesses
A motion to close the public hearing was made by Council Member Kovacic, seconded by Council
Member Segal, and seeing no further objection, Mayor Harbicht declared the public hearing closed.
It was moved by Council Member Kovacic, seconded by Council Member Segal, and carried on roll
call vote to introduce Ordinance No. 2303 amending various Sections of Article III (Public Safety),
Chapter 2 (Traffic Regulations) of the Arcadia Municipal Code regarding Mobile Food Vending in
the Public Right -of -Way; that Condition C of Section 3234.2 be deleted; and that Condition be
amended to include "A vending vehicle may not stand or park in the public right -of -way between the
hours of 12:00 a.m. and 6:00 a.m. in commercial and industrial zones, and between 10:00 p.m. and
6:00 a.m. in residential zones."

Jennifer Jackson, PTA President of Hugo Reid Elementary School, appeared and reported on
various programs and activities currently happening at Hugo Reid; she provided information on
upgrades to the school as a result of Measure I; and announced that on Saturday, October 20, a
group of 4th and 5th grade students will perform at the opening of the Performing Arts Center at
Arcadia High School.
REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City
Council related to meetings attended at City expense [AB 1234]).
City Clerk Glasco, announced the "Duffy Hudson as Edgar Allan Poe, 50 Minutes Show ",
sponsored by the Friends of Public Library on October 17; Senior Day Camp at Wilderness Park on
October 18; and Haunted Halloween Happening at the Community Center on October 31; he invited
everyone to attend.
Council Member Amundson, noted how appreciative he was to be on native soil and what we have
as a Country after returning from a trip overseas; and he encouraged everyone to register to vote
and vote in the upcoming Presidential Election on November 6.
Mayor Pro Tern Segal congratulated Council Member Wuo on co- chairing the Methodist Hospital
Crystal Ball; and reported that more than $500,000 was raised.
Council Member Kovacic expressed his appreciation to Hugo Reid PTA President, Ms. Jackson for
her report; he commended Council Member Wuo and Mayor Pro Tern Segal for a job well done as
co -chair and auctioneer at the Methodist Hospital Crystal Ball; he reminded everyone of the
Breeders' Cup on November 2 and 3; and encouraged everyone to attend; he reiterated Ms.

Jackson's comment and invited everyone to attend the Arcadia High School Student Showcase on
October 18, the Hugo Reid Student Showcase on October 20, the ribbon cutting on October 18,
and the Grand Opening Gala Concert on October 27; and provided information to purchase tickets.
Council Member Wuo thanked the community and Mayor Pro Tern Segal for their generous
donations at the Crystal Ball; he commented on Methodist Hospital's brand new Emergency Center,
North Tower, and new Stroke Center; and he encouraged everyone to attend the "626 Night
Market" at the Santa Anita Park.
Mayor Harbicht announced that he also attended the Methodist Hospital Crystal Ball; and also
congratulated Council Member Wuo and Mayor Pro Tern Segal on a successful event.
a. Accept the donation of $2,000 to the Arcadia Public Library for the Jackie Faust -
Moreno Trust Fund.

b. Accept the donation of $5,000 to the Arcadia Public Library from the Hakka
Foundation.

Accept all work performed by E &R Construction, Inc. for the Water Valve
Replacement Project; and authorize the final payment to be made in accordance with
the contract documents, subiect to a retention of $3,029.69.

Jason Kruckeberg, Assistant City Manager /Development Services Director, Philip Wray, Deputy
Director of Development Services /City Engineer and Linda Hui, Transportation Services Manager,
presented the staff report, and a Powerpoint presentation of the Transit Plaza preliminary design
drawings featuring landscape plans, trees, vendor area, water feature and benches.
It was moved by Council Member Segal, seconded by Council Member Amundson, and carried on
roll call vote to approve the preliminary design of the Gold Line Transit Plaza at a project cost of
$747,000, authorize an additional funding appropriation of $138,000, and authorize the City
Manager to enter into a project funding agreement with the Gold Line Foothill Extension
Construction Authority for the approved project design and amount.
