SUBJECT: RESOLUTION NO. 6849 DESIGNATING SPECIFIED INDIVIDUALS AS
LOCAL AGENCY OFFICIALS FOR THE PURPOSE OF GOVERNMENT
CODE SECTION 53234 (AB 1234 ETHICS TRAINING REQUIREMENTS)
Recommendation: Adopt
SUMMARY
In October 2005, the Governor signed Assembly Bill (AB) 1234 which placed new
reimbursement reporting and ethics training requirements on local agency officials. AB
1234 mandates that elected and appointed officials take two hours of training in general
ethics principles and ethics law if they receive compensation for their services or are
reimbursed for their expenses. The City of Arcadia recognizes the value of public trust
in its decision makers and therefore recommends the City Council adopt the attached
Resolution which will clarify which persons must take the training while complying with
the ethics training requirements of AB 1234.
DISCUSSION
The law mandates that ethics training be provided by local agencies that pay any
compensation, salary, or stipend to, or reimburses the expenses of, members of a
legislative body. The training must be provided to each member of a legislative body,
each elected official and any employees who may be designated by the agency to
receive the training. The training must take two hours and must be provided every two
years and thereafter at least every two years. Ethics training was last conducted in
2010, therefore, this is an ethics training year.
The ethics training must be at least two hours in length and cover, among other things,
such topics as conflicts of interest, gift and travel restrictions, prohibitions against
certain uses of public resources, mass mailing restrictions, financial disclosure, the
Brown Act, bias, competitive bidding and incompatible offices.

Records of the training are maintained by the City Clerk for five years and subject to
disclosure under the Public Records Act. The City Clerk's office tracks compliance.
FISCAL IMPACT
There are sufficient funds in the current budget to accommodate training costs, if any.
RECOMMENDATION
It is recommended the City Council adopt Resolution No. 6849 designating specified
individuals as local agency officials for the purpose of Government Code Section 53234
(AB 1234 Ethics Training Requirements).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DESIGNATING SPECIFIED INDIVIDUALS AS LOCAL
AGENCY OFFICIALS FOR THE PURPOSE OF GOVERNMENT CODE
SECTION 53234 (AB 1234 ETHICS TRAINING REQUIREMENTS)
WHEREAS, AB 1234 was passed by the State Assembly and State Senate in
August of 2005, signed by the Governor on October 7, 2005, and codified, in part, at
Government Code section 53234, et seq.; and
WHEREAS, AB 1234 requires ethics training for, among other individuals, those
designated as Local Agency Official; and
WHEREAS, Government Code section 53234(c) defines a Local Agency Official
as any member of a local agency legislative body or any elected local agency official
who receives any type of compensation, salary, or stipend or reimbursement for actual
and necessary expenses incurred in the performance of official duties or any employee
designated by a local agency legislative body to receive the training.
NOW, THERFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council designates those positions listed in the attached
Exhibit "A" as Local Agency Officials required to participate in ethics training pursuant to
California Government Code Section 53234(c).
SECTION 2. The City Clerk shall certify the adoption of this Resolution.
