SUBJECT: ACCEPT ALL WORK PERFORMED BY MNR CONSTRUCTION, INC.
FOR THE BALDWIN AVENUE AND OLD RANCH ROAD SEWER
CAPACITY IMPROVEMENT PROJECT AS COMPLETE AND
AUTHORIZE THE FINAL PAYMENT TO BE MADE IN ACCORDANCE
WITH THE CONTRACT DOCUTMENTS
SUMMARY
On May 15, 2012, the City Council awarded a contract to MNR Construction, Inc. in the
amount of $413,620 for the construction of the Baldwin Avenue and Old Ranch Road
Sewer Capacity Improvement Project. The terms and conditions of this project have
been complied with and the work has been performed satisfactorily according to the
contract documents for a total project cost of $420,770. This amount reflects the
original contract amount of $413,620 plus one contract change order totaling $7,150 or
1.7% above the original contract amount.
It is recommended the City Council accept all work performed by MNR Construction,
Inc. as complete and authorize the final payment to be made in accordance with the
contract documents, subject to retention of $21,038.50.
DISCUSSION
The 2006 Sewer Master Plan evaluated the adequacy of the City's wastewater
collection system and identified sections of the system which were considered deficient.
Baldwin Avenue (between Huntington Drive and Fairview Avenue) and Old Ranch Road
(near the intersection of Victoria Drive) are two sections which were identified as areas
in the City's sewer system that were at capacity and thus, needed to be increased to
accommodate the sewage and eliminate the possibility of a sewer spill.

During the excavation phase of work, sandy soils and sloughing of the trench sidewalls
made it difficult for the contractor to maintain a uniform trench. Project Management
staff worked with the contractor to determine what was reasonable to consider as the
contractor's responsibility and what should be considered extra work due to unexpected
field conditions. The change order described below represents the negotiated
agreement for extra work performed by the contractor:

The terms and conditions of this project have been complied with and the work has
been performed satisfactorily according to the contract documents for a total project
cost of $420,770. This amount reflects the original contract amount of $413,620 plus
one contract change order totaling $7,150 or 1.7% above the original contract amount.
Therefore, it is recommended that the City Council accept all work performed by MNR
Construction, Inc. as complete and authorize the final payment to be made in
accordance with the contract documents, subject to retention of $21,038.50.
ENVIRONMENTAL IMPACT
This project involves the replacement of existing utility systems and is therefore
categorically exempt per Section 15302(c) of the California Environmental Quality Act.
FISCAL IMPACT
The Baldwin Avenue Sewer Main Project was budgeted in the Fiscal Year 2010 -11
Capital Improvement Program (CIP) for construction costs of $435,000. The Old Ranch
Road Sewer Main Project was budgeted in the Fiscal Year 2011 -12 CIP for construction
costs of $104,000. The funding source for these projects is through the Sewer
Enterprise Fund. The total project cost of $420,770 is within the adopted budget for the
Project.
It is recommended that the City Council approve the following:
1. Accept all work performed by IWINR Construction, Inc. for the Baldwin
Avenue and Old Ranch Road Sewer Capacity Improvement project as
