and the
ARCADIA REDEVELOPMENT AGENCY
REGULAR MEETING
JANUARY 5, 1982
The City Council of the City of Arcadia, California and the Arcadia
Redevelopment Agency met in a regular session Tuesday, January 5,
1982 at 7:30 p.m. in the City Hall Council Chamber.

ABSENT: Mayor Gilb
On MOTION by Councilman Dring, seconded by Councilman Pellegrino and
carried unanimously Mayor Gilb was excused.
Appeal of Planning Commission denial of request for modifications for
industrial building on Lots 1810 and 1811 of the Chicago Park Tract
CONTINUED TO JANUARY 19, 1982.

Planning Commission Resolution No. 1182 recommending zone change to
add high rise overlay to the existing Planning Commercial Development
for property at 333-421 E. Huntington Drive. The resolution sets
forth that the location abuts'a major arterial which is adequate to
carry the kind of traffic which might be generated by a high rise de-
velopment .. it is adequately buffered from residentially zoned prop-
erty and the size and shape of the property is appropriate for such a
development. This zone change if approved would require development
in substantial compliance with plans submitted in a Conditional Use
Permit 81- 13.

Mayor Protempore Saelid declared the hearinqmoP_eD, and Bruce Low, San Carlos
Road, Arcadia, referred to his communication to the Clty wnlcn basic-
ally sums up their problems and sets forth remedies in order to pro-
ceed. All aspects of the project were addressed and Mr. Low responded
thereto. In one instance Mr. Low stated in part that he could not
guarantee that the Datsun dealership would remain ... the property is
not owned by Datsun and they are on a 30 day lease, however, he will
do everything he can to keep Datsun within the City. Mr. Low stated
further in part that they are not seeking any financial assistance from
the City. '
Bill Connolly, 21 South First Avenue, said in part that as a member of
the downtown Business Association, he is in favor of the project.
Richard Marvin, 28 N. Third Avenue, spoke to publication requirements
and his opposition to the zoning which is being proposed ... that if
it proceeds a pleasant residential street will be surrounded by a mass
of buildings - high rise hotel and now this high rise office buildinq ...
this environment would detract from the quality of life on Third Avenue
residents.

HEARING
Precise
Plan Review of the Precise Plan for the seven story building plus a mezzanine
333-421 E. at 333-421 E. Huntington Drive. It calls for offices, a bank with a
Huntington drive-up teller, restaurant, delicatessen with outdoor seating and an
APPROVED automobile dealership. It will be contemporary in design with earth
^ I tone colors. All aspects of the parking, landscaping and parking struc-
,'I~)J ture were set forth in the report dated January 5.
~ Mayor Protempore Saelid declared the hearinq pp~~ and Richard Marvin, 3rd
Avenue, spoke once again saying in part that there should be an enVlr-
onmental impact report which addresses itself to the precise plans.

Sherry Passmore, 1109 Columbia Road was advised that the zoning on this
property was previously changed to Commercial Planned development desig-
nation in the General Plan and that the "H" overlay is under discussion
at this time ... that the types of uses proposed are consistent with the
uses and intensity of uses which were considered in the Environmental
Impact Report for the area. Mrs. Passmore asked for the same fair con-
sideration for people residing in the west part of the City wnen develop-
ments try to come into that area.
No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Pellegrino, seconded by Councilman Dring and carried unani-
mously.
Councilman Pellegrino MOVED, seconded by Councilman Haltom and carried
on roll call vote as follows that the zone change is appropriate for
the area and that the City Attorney be directed to prepare the ordinance
for introduction.

Staff will prepare the Owner Participation Agreement for Council con-
sideration at the February 2 meeting and that the agreement contain a
clause for Mr. Low's consideration by March 2.

No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Pellegrino, seconded by Councilman Dring and carried unani-
mously.
During the discussion the possibility of including a condition in the
Owner Participation Agreement that the automobile dealership remain in
Arcadia it was suggested that the matter be continued until the entire
Council is present. It was MOVED by Councilman Haltom, seconded by
Councilman Dring and carried on roll call vote as follows that the mat-
ter be resolved at this time - that no condition requiring the continu-
ation of the automobile dealership be included in the Owner Participa-
tion Agreement.

tee's approval of M-81-147 requiring a covenant to insure removal or re-
modeling of kitchen facilities on a nonconforming structure within 20
years at 1032 S. Sixth Avenue.

Prior to considering this appeal it was MOVED by Councilman Dring, sec-
onded by Councilman Pellegrino and carried on roll call vote as follows
that the appeal fee paid by the applicant, Cletus R. Ver1ato, be refund-
ed. (It was noted by the Planning Director that the Commission is check-
ing into these situations.

Staff advised that there are two single family dwelling on this one
property.. both were constructed in 1958 .. and the applicant would
like to build a 75 sq. ft. addition to enlarge a bedroom on the front
buil di ng.
Mayor ProTempore Sae1id declared the hearing open and Mr, Ve~lato ex-
plained what he would like to do and the regulation which orohibits the ndrli-
tion. He felt discretion of the Planning Commission to approve this type
of improvement would be appropriate - and asked Council to remove the
covenant requirement to remove one of the structures - that he could not
improve if he had to remove one of the buildings .. and he would not tear
down a three bedroom two and a half bath house to add 75 sq. ft. .. he
could not then rent it as it would become a guest house. For economic
reasons he could not do that. He has owned the DrODertv since 1965 "
that the regulation was not in effect at that time. .
Diana Curtis, 1020 S. Sixth Avenue, felt this matter should not have to
be heard by both the Planning Commission and the City Council... she
was in favor of the addition as both dwellings are quality. She noted
there are many such additional dwellings on lots in the neighborhood.
Johanna Hofer, 875 Monte Verde Drive, also felt the Planning Commission
should have the authority in matters of this nature. She felt the re-
quest is reasonable. She spoke of legislation being considered to make
it possible to provide second dwellings for senior relatives.
No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Dring, seconded by Councilman Pellegrino and carried unani-
mously.
It was MOVED by Councilman Dring, seconded by Councilman Pellegrino
and carried on roll call vote as follows that Council find in favor of
the appellant and that the subject condition be removed as a requirement.

It was MOVED by Member Dring, seconded by Member Pellegrino and carried
unanimously the Chairman Gilb be excused.
The Agency received the report and recommendation concerning a proposed
hotel and office development at Huntington Drive and Colorado Place
(Ramada Inn site). Staff advised on surrounding improvements. The pro-
posal includes a 149 room hotel with lounge, conference room, three re-
tail stores, restaurant and banquet facilities ... and a parking struc-
ture. It is consistent with the goal standards and requirements set
forth in the redevelopment plan.

It was MOVED by Councilman Dring, seconded by Councilman Haltom and
carried on roll call vote as follows that the Agency receive and file
the application for building permit until such time as an "H" overlay
is approved by ordir.ance and the conditional use permit is approved
for the hotel usage, at which time the application will be reconsider-
ed for code and redevelopment plan compliance. The Agency to aid the
applicant in processing an environmental impact report, the "H" over-
lay and the CUP application now on file.
Council adjourned to a CLOSED SESSION. Reconvened and adjourned to
January 19.
AUDIENCE PARTICIPATION
Johanna Hofer, 875 Monte Verde Drive, expressed appreciation for the I
recent 'drug bust' at the Arcadia High School and for Council giving
the voters the opportunity to vote on the fireworks issue. She sug-
gested that other items be included -- i. e., redevelopment, increas-
ing the admissions tax at the racetrack and perhaps the issuance of
revenue bonds for a Chicago Park development. She also suggested that
the agenda be published in one of the local newspapers.
Herb Fletcher, 175 W. Lemon Avenue, made, suggestions concerning charges
for paramedic services. He also suggested that Council consider asking
the League of California Cities to see if the State will release funds
which are allocated to specific purposes so the cities could use the
money for what they think best for their needs.
CONSENT ITEMS
APPROVED agreement 07-LA-0-ADA M-L365 (7) between the City and the
State. Mayor and City Clerk authorized to execute the agreement in
form approved by the City Attorney.
AWARDED contract to Chuck Hess Construction Company for the resurfac-
ing of five tennis courts at Arcadia High School in the amount of $6500.
Funds in the Parks and Recreation Facilities Fund for 1981-82.
APPROVED plans and specifications and authorized the City Clerk to
advertise for bids for the emergency generator connections at Santa
Anita and Canyon Booster Stations.
Held over to January 19 the item concerning purchase of a perforator
and imprinter for the print shop.
APPROVED the purchase of one 1/2 ton pickup truck from Mark Christopher
Chevrolet in the amount of $8,203.24. This is a replacement vehicle
for the Public Works and Engineering Division. Funds in the Equipment
Replacement Budget for 1981-82.
APPROVED the purchase of a Unitron CP-6 Comparison Projector for
fingerprinting comparison for the Police Department from Revenue
Sharing Funds.

closed session, if any, necessary to discuss personn'el &" litiga-'
tion matters.
