Watts, City Manager PRESENT: ABSENT : Councilmen/Members Haltom, Hannah, Lojeski, Pellegrino Councilman Dring On MOTION by Councilman Haltom, seconded by Councilman Lojeski and carried unanimously, Councilman Dring was excused. PLAQUES TO RETIRING MEMBERS OF BOARDS AND COMMISSIONS " . Councilman Lojeski, Liaison to the Library Board, presented Mrs. Jeanne Saunders with a plaque in appreciation of her efforts and accomplish- ments during her eight-year tenure on the Library Board. Mayor Pellegrino presented plaques of appreciation for efforts and accompiishments to the following retiring Senior Citizens' Commission members: John Gaffey John Joseph Anita Santo Mary Young Councilman, Harinah presented plaques of appreciation for efforts and accomplishments to retiring Harl D. Crockett and Patricia Wallace from the Sister City Commission. The City Clerk administered the Oath of Office to Craig D. Lucas, newly appointed to the Library Board for a term of four years. Councilman Lojeski then presented official credentials to Mr. Lucas and welcomed him to the City Family. The City Clerk then administered the Oath of Office to Ruth V. Gilb, newly appointed to the Sister City Commission for a term of four years. Councilman Hannah presented official credentials to Mrs. Gilb and welcomed her to the City Family. Sister City Commissioner Edith Casey presented Harl Crockett and Patricia Wallace Certificates of Appreciation on behalf of the entire Commission. . Mayor Pellegrino presented plaques of appreciation to retiring City employees Edward A. Bozek, Public Works Department, after 29~ years of service. and to J. Robert Sullivan, Business License Officer, after 7~ years of service. Arcadia Beautiful Commissioner Milton Inbody presented Mayor Pellegrino with a box of cookies from Japan with the label "Arcadia". Appe~l of Planning Commission's denial of Conditional Use Permit 82-8 (Resolution No. 1198) for a video game entertainment center at 9954 Las Tunas. The Commission made its findings of fact on the following: 1. The site is not adequate in size and shape to accommodate the park- ing which is required to adjust the use with the land and uses in the neighborhood. 2. The proposed use would increase vehicular traffic on a street in a residentially zoned district. 3. The granting of this conditional use permit would be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. I Mayor Pellegrino declared the hearing open and the applicant, Yun Sam Chung, stated in part that there is adequate parking and noted the parking for Wendy's and the health club adjacent to the subject site. He referred to the above first two findings on which the Commission based its denial. i In response to a question about striping the parking lot for the smaller vehicles, Bob Evans, representing Coldwell Banker, said in part that they have not evaluated the necessity of special parking for compact cars as yet ... that they will meet with the Planning Director to dis- cuss this; and he also made reference to the parking for the adjacent businesses. They now have 168 spaces. The applicant and Mr. Evans, were advised of a regulatory report on arcades and machines on the agenda for this meeting, and in response to his inquiry as to how long such a change would take, it was said it would be about four months to follow procedure. o Speaking in opposition - John Hance of the Continental Bank located at 9934 Las Tunas, spoke of the parking problems being encountered now, and said in part, this project would only add to those ... that the facility would be attended by the youth and felt it too hazardous with the ongoing traffic on Las Tunas Drive ... that Rowland Place is a residential street and that at present they endeavor to control the parking there. Bruce Anderson, 307B E. Foothill Blvd., said he resides close to a facility such as being contemplated and that there is a lot of traffic connected with it ... he felt there is a tendency to be too lenient with parking. Bob Kladifco, 348 W. Las Florea Ave., asked the Council to uphold the decision of the Planning Commission ... that there just isn't sufficient parking space. He questioned the hours of operation ... and where the bike racks would be located. In response to a question, he said in part that he owns rental property on Rowland Ave. on which there are two buildings, and he has four parking spaces for them. Norlyn Brough,,;~presenting the Church of the Nazarene, located across the street from the proposed game center, said in part that the site just is not compatible for the facility; the traffic would increase; there could be a drug distribution problem; and the noise could become excessive during their evening worship hours. I No one else desiring to be heard, the hearing was CLOSED on MOTION by Councilman Haltom, seconded by Councilman Lojeski and carried. -2- 7-6-82 I " -;)" ~I'!J";' f 1,:::0 PUBLIC HEARING Planning & Building Fees I RESOLlITION NO. 5052 ADO;" 25:0526 Councilman Haltom stated in part that he is not opposed to video games ... that they will peak and eventually reach their maximum potential; that he has visited the other game centers and has never observed that they are that busy... it seems to him that those in opposition are contributing to what they are opposing ... he did not see where it could be detrimental to children ... they are mostly on bicycles anyway, and could not contribute that much to the traffic situation. He would be in favor of granting the conditional use permit. I . Councilman Hannah submitted that the applicant is in a diff1cult position and expressed concern with the incompatibility between the business backing up to residential. He would like additional input before granting any additional permits. Councilman Lojeski said in part that he has received numerous calls on this subject ... also a memorandum from Temple City. He also has visited the area on a number of occasions '" and shares the concern of the Planning Commission as to parking, impact of the congestion, inadequate bicycle parking, and inadequate restrooms. He would support the decision of the Commission to deny this conditional use permit. Mayor Pellegrino was opposed to the location for this particular facility as it would generate more traffic on residential streets. He was not against the game center as he enjoys video games himself - just the location. It was MOVED by Councilman Hannah to deny the appeal and sustain the Planning Commission's denial of the conditional use permit. MOTION seconded by Councilman Lojeski and carried on roll call vote as fol- lows: AYES NOES ABS &NT : Councilmen Hannah, Lojeski, Pellegrino Councilman Haltom Councilman Dring Council received the report on fees which are charged by the Planning and Building Divisions. To arrive at fee schedules the actual time spent on processing the permits was looked at - in an endeavor to arrive at the recommended fees. It was noted that the overhead costs have never before been included with the normal analysis of the fee schedule; however, it is a permitted cost as State Law allows the Department to include charges for processing various applications and permits. It was recommended that the fees be approved in order to have each application pay its own way. It was noted that in the past the processing costs of modification applications have never paid their own way. The applications which go directly to the Modification Committee or an appeal to the Planning Commission, involve considerably more staff time and effort than is covered by existing fees. The Building Division fees were reviewed about a year ago. These have been increased this year in order to have permits cover the actual cost to the City, including the overhead costs which were not heretofore considered. Mayor Pellegrino declared the hearing open and no one desiring to be heard, the hearing was CLOSED on MOTION by Councilman Lojeski, seconded by Councilman Hannah and carried. Whereupon the Planning Director presented and read the title of Resolution No. 5052, entitled: "A RESOLlITION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING FEES FOR BUILDING PERMITS, GRADING- PLAN CHECKING, GRADING PERMITS, PLUMBING PERMITS, ELECTRICAL PERMITS, MECHANICAL PERMITS, MOVE EXAMINATION, RELOCATION PERMIT, REMOVAL PER- MIT, DEMOLITION PERMIT, SIGN PERMIT AND SWIMMING POOL PERMIT. APPROVED 25:0527 It was MOVED by Councilman Haltom, seconded by Councilman Lojeski and carried on roll call vote as follows, that the further reading of the full text of Resolution No. 5052 be waived sod that same be ADOPTED. AYES NOES ABSENT : Councilman Haltom, Hannah, Lojeski, Pellegrino None Councilman Dring, Councilman Hannah then presented and read the title of Resolution No. 5053, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA REPEALING RESOLUTIONS 4318, 4777, 4778, 4781, 4811, 4878, 4896 AND 4995 BY CHANGING THE FILING FEES, EXTENSION FEES AND APPEAL FEES FOR GENERAL PLAN AMENDMENTS, TEXT AMENDMENTS, ZONE CHANGES, VARIANCES/CONDITIONAL USE PERMITS, TENTATIVE MAPS, TENTATIVE PARCEL MAPS, PARCEL MAP WAIVERS, CERTIFICATE OF COMPLIANCES, PRECISE PLAN REVIEWS, ADMINISTRATIVE MODIFICATIONS, MODIFICATION FEES AND R-2 AND R-3 MODIFICATIONS." I It was MOVED by Councilman Hannah, seconded by Councilman Haltom and carried on roll all vote as follows, that the further reading of the full text of Resolution No. 5053 be waived and that same be ADOPTED. AYES NOES ABSENT : Councilmen Haltom, Hannah, Lojeski, Pellegrino None Councilman Dring Both resolutions state that the fees specified in the resolutions will not produce an amount in excess of that estimated to fund the opera- tion of the City Planning and Building Divisions. Based on this, the resolutions are exempt from the requirements of the California Environmental Quality Act as specified in Title 14, Section 15079.1 of the California Administrative Code. The Urban Mass Transportation Administration requires recipients of Federal Transit Operating Grants to hold a public hearing prior to making any service adjustments to the existing transit system. It was noted in the staff report that with the influx of Proposition A revenue, the City is in a position to make service improvements to the Dial-A-Ride system. At the City Council meeting of June 15 two changes were APPROVED (to increase the hours of service and decrease fares. ) Mayor Pellegrino declared the hearing open and no one desiring to be heard, the hearing was CLOSED on, MOTION by Councilman Lojeski, seconded by Councilman Hannah and carried. It was MOVED by Councilman Haltom, seconded by Councilman Lojeski and carried on roll call vote as follows, that the Dial-A-Ride service hours be from 7 a.m. to 9:30 p.m. weekdays, and 7 a.m. to 7 p.m. weekends, and that the fares be 50~ for regular passengers and 20~ for senior citizens and handi- capped persons. " AYES NOES ABSENT : Councilmen Haltom, Hannah, Lojeski, Pellegrino None Councilman Dring I Council recessed in order to act as the ARCADIA REDEVELOPMENT AGENCY Members Haltom, Hannah, Lojeski, Pellegrino Member Dring who was excused on MOTION by Member Haltom, seconded by Member Lojeski and carried unanimously. Staff advised that a request has been received from the Vice President of RPI, Inc., for the Agency to provide assistance for its project at 250 Colorado Boulevard, by tax exempt financing. A staff report reflected the history problems associated, with this particular site. PRESENT : ABSENT : -4- 7-6-82
