Margaret Stevens, Santa Anita Church Tony Walker, Director of Juvenile Diversion PRESENT: ABSENT ' Councilmen Gilb, Parry. Pellegrino, Saelid, Margett None On MOTION by Councllman Parry, seconded by Councilman Saelid and carried unanimously the minutes of the Adjourned and Regular meetings of December 18, 1979, January 2, 1980 and the Adjourned Regular meeting of December 21, 1979 were APPROVED Appeal of the Planning CommisslOn' s denial of a zone change from R-3 to c-2 at 610-618 N, Santa Anita Avenue, The subject site was original~y purchased by the City from Caltrans as excess freeway property Recently a participation agreement was executed between Bowden Construction, Inc. and the Arcadia Redevelopment Agency for development of the site, The Commission denied the zone change on the basis that commercial zoning would allow uses too intense for the site and felt the proper- ty should remain residential, The City Council appealed the decision The area is approximately 30,000 sq, ft., with 155 feet of frontage along Santa Anita Avenue. The General Plan designates the area as mixed commercial multiple family land use and the zone change to C-2 would be consistent with the General Plan. The Planning Department had recommended approval of the zone change and after discussing the matter with Mr, Bowden it was discovered tm t there would be some retail sales business During the consideration Councilman Gilb stated in part for the record that during the time the Agency was considering applications for development of the subject site it was estimated that the development would bring in about $4800 annual city sales tax. Mayor Margett declared the hearing open and William Carnahan, 2, 4, 6 and 8 Newman Avenue, spoke in opposition to the zone change stating in part that at one time the area was zoned M-l, then it was zoned R-I and R-3, He spoke of the new homes 'on Newman and what owners have done through the years to upgrade the area. He could not see the property being used for the proposed electrical business with its trucks and storage yard and asked Council to dwell on this. C, J, Hubley; 30 E. Newman Avenue, said he was not 100 percent against the proposed use, but he would not like to see C-2 under any circumstances; that it could be the beginning of an encroachment of commercial on Newman Avenue. Newman Avenue is no longer blighted and Mr, Hubley referred to the new homes. He would like Newman to remain R-l. W. J. Snyder, 40 E, Newman Avenue, said he was under the impression two years ago that the area would remain residential. He felt the proposed development could result in traffic problems among others. -1- 1-15-80 HEARING (con' t. ) A R A ROLL CALL ADJOURNED January 24 5 p,m, RECONVENE ModificatiOn! Medical Building 24 :9938 Fred Bowden, 300 Elwood Drive, Monrovia, owner of the subject property, noted the irregular shape of the property and the present heavy traffic on Santa Anita " the freeway ramp also makes it less desirable for an R-3 situation " none of the property has any attachment to Newman Av, He said he will not have truck storage on the site - they have a storage yard elsewhere, Al Dixson, 1752 N, Wilson, Arcadia, spoke in favor of the commercial zoning and also spoke in favor of residential remaining on Newman Av, He noted in particular that all ingress and egress will be from Santa Ani ta Avenue. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Saelid, seconded by Councilman Pellegrino and carried unani- mously. I Councilman Saelid said he could support the commercial zoning and recalled what has transpired since the acquisition of the excess free- way land from Caltrans, ,tha tat one time it was be ing cons idered tha t the entire area might more properly be commercial, however, due to the expressed concerns of the residents on Newman Avenue the City Council rezoned Newman Avenue to R-l, He also noted that Santa Anita frontage is mixed commercial and residential. Councilman Gilb referred to the traffic problems at the subject corner and felt R-3 would certainly be unrealistic, He would support the commercial zoning. Councilman Pellegrino also referred to the traffic congestion and felt C-l would be the best zone classification and would support that, Councilman Parry felt the recommended zoning would be the best use and would support the commerical designation. Mayor Margett also felt C-l would be the most appropriate zoning and submitted that Mr. Bowden is aware of the concerns of the residents on Newman Avenue; also those of the City Council, It was then MOVED by Councilman Saelid, seconded by Councilman Parry and carried on roll call vote as follows that the Negative Declaration be APPROVED and FILED and that Council find that the project will not have a negative effect on the environment; and that the subject area be rezoned to C-l, AYES NOES ABSENT: Councilmen Giib, Parry, Pellegrino, Saelid, Margett None None The Council adjourned in order to act as the Arcadia Redevelopment Agency. Tenta- tive Map was approved by City Council on January 16, 1979 and will expire January 16, 1980. APPROVED plans and specifications for Baldwin Avenue Improvement - Phase III between Las Tunas Drive and Live Oak Avenue, and authorized the City Clerk to call for bids, Federal Aid Urban Funds are avail- able to finance 86,09% costs of the project with the remainder coming from gas tax funds, APPROVED low bid submitted by J, W, Tiedeman Company in the amount of $12,944,90 for the construction of a bus stop lane at Huntington Drive and Civic Center The Los Angeles Turf Club will contribute $6,000 toward the project with the balance from State Gas Tax Funds. AUTHORIZED the purchase of four light trucks for the Water Department, two for the Street Department and one for the Fire Department. Funds for the acquisition of the trucks are in the Equipment Replacement Fund, FY 1979-80, Budget total amount $55,000, ALL TIlE ABOVE CONSENT ITEMS WERE APPROVED ON MOTION BY COUNCILMAN GILB, SECONDED BY COUNCILMAN PARRY AND CARRIED ON ROLL CALL VOTE AS FOLLOWS: AYES NOES ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid, Margett None None At the request of Councilman Saelid the Planning Director ex?lained the revised lot lines of Tract 36895 by B & W Development, Inc with the view graph. Council then APPROVED the determination of "substan- tial conformity" for the minor modifications on MOTION by Councilman Saelid, seconded by Councilman Pellegrino and carried on roll call vote as follows: AYES NOES ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid, Margett None None Charles Bluth, President of B & W Development, Inc. said he was one day late putting in the streets because of the rains but the nature of the dirt on the slopes absorbs water that resulted in good compac- tion which hastened the germination of the hydroseeding. He spoke of the damage to the slopes by children climbing up and sliding down and that if it continues the damage will be tremendous, Councilman Gilb speculated from the insurance standpoint and directed the Superintendent of Parks and Recreation to advise the Soccer League not to trespass on the slopes, Councilman Gilb MOVED to ACCEPT the recommendation for award of a three-year contract to White's Landscape Service, Inc. for maintenance of landscaped areas and City Park properties pursuant to staff report. Councilman Saelid then introduced Tony Walker, Director of Arcadia's Juvenile Project, Mr, Walker gave a brief summary of the functions of the Diversion Project in the West San Gabriel Valley which presently contracts with six cities in a Joint Powers Agreement. They provide counseling pro- grams, recreation programs, reading clinics and an alcohol information program. He asked that City Council approve the following Resolution No, 4881 regarding the West San Gabriel Valley Juvenile Diversion Project, I The City Attorney presented, explained the content and read the title of Resolution No 4881 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA SUPPORTING THE WEST SAN GABRIEL VALLEY JU\~NILE DIVERSION PROJECT SEARCH FOR FUNDING UNDER THE UNIFORM COUNTY JUSTICE SYSTEM SUBVENTION PROGRAM" It was MOVED by Councilman Saelid, seconded by Councilman Gilb and carried on roll call vote as follows that the further reading of the full text be waived and ADOPTED, AYES NOES ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid, Margett None None The City Attorney presented for the firSt time, explained the content and read the title of Ordinance No, 1692 entitled: "AN ORDINANCE OF THE CITY OF ARCADIA AMENDING SECTION 9233,12 OF THE ARCADIA MUNICIPAL CODE TO REZONE PROPERTY FRONTING ON LOVELL AVENUE BEThlEEN DUARTE ROAD AND NAOMI AVENUE FROM PR-l TO C-O," It was MOVED by Councilman Parry, seconded by Councilman Pellegrino and carried on roll call vote as follows that the further reading of the full text be waived and INTRODUCED, AYES NOES ABSENT: Councilmen Gilb, Parry, Pellegrino, Saeiid, Margett None None Stated the League of California Cities has been promoting an advisory vote on the sales tax. the matter of returning one additional cent from the sales tax revenue to the cities, He felt this should be on the ballot so when the League approaches legislature and the cities, there would be support from the electorate, He stated this was on the ballot recently in San Diego and received overwhelming support from the corrnnunity, Discussion ensued and Councilman Gil~ MOVED, seconded by Councilman Parry and carried on roll call vote as follows to instruct the City Attorney to prepare a resolution for a ballot measure. I AYES NOES ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid, Margett None None Expressed concern that only two people have taken out nomination papers for Council vacancies and wished to encourage qualified persons in the community to do so, Noted that six or eight months ago he had requested information regard- ing dumps and the water wells and asked the Water Manager if that in- formation was still the same, Concurred with the Mayor and suggested that the newspaper publish the information in view of the fact that the Star News and Channel 7 NEWS -4- 1-15-80 24:9941 GILB con' t. had carried misinformation that wells in Arcadia had been closed, 5: I ~. ~\ If' , t. ~,l Explained that Arcadia wells are within the five parts per billion established limits and the State Health Department has taken samples but they do not have the results as of this date. They are concentrat- ing their efforts in the area where TCE was found, In the Water Mana- ger's report of the previous week it was stated that one well had 1.4 ppb, WATER MANAGER I In response as to what could be done about the contamination the Water Manager stated the most effective treatment is to aerate the water - that the substance is very volatile and aeration gets rid of it immedi- ate 1 y , He stated further that the State Water Resources Control Board issues permits for dumps and industrial waste; and that the City itself moni- tors Arcadia's wells and keeps track of water quality and has not found any deterioration in the quality, The water quality is good but the policing of dumps has to be done by the State, ADJOURNMENT to da te certa in At 9:15 p,m, the meeting adjourned to January 24, 1980 at 5:00 p,m, in the Conference Room.
