MAY 20, 1980
The City Council of the City of Arcadia, California met in a regular
session on May 20, 1980 at 7:30 p.m. in the Arcadia City Hall Council
Chaml>er.

On MOTION by Councilman Gilb, seconded by Councilman Saelid and carried
unanimously the minutes of the regular meeting of May 6, 1980 were
APPROVED.
Application of Six Star Cablevision, Inc., for a non-exclusive cable tele-
vision franchise. The need for additional study was evinced and it was
MOVED by Councilman Gilb, seconded by Councilman Saelid and carried unan-
imously that this be CONTINUED to MAY 29 at 6:30 p.m. in the Conference
Room.
Request by International Society for Krishna Consciousness for a Certifi-
cate of Registration for Religious Solicitation. Mayor Pellegrino de-
clared the hearing open for those who desired to be heard on the matter.
Peter F. Geisler, 43 W. Forest Avenue, said in part that he had reviewed
the application and had observed certain delinquencies which he would like
to bring to Council's attention. In response to one of the questions in
the application as to whether or not the organization had ever been denied
a license or permit by any California City the organization had replied in
the negative. Mr. Geisler said according to his records the organization
had been denied an application to solicit in Arcadia during June 1979. The
question concerning whether or not solicitors receive compensation .. the
financial report that was submitted indicates that $303,000 or 19 percent
of its total income was received by the devotees of the organization; that
in analyzing the financial statements which have been provided it is indi-
cated that approximately 3 percent of the money they collected in Arcadia
actually was acknowledged as a donation. There is no indication as to
where this money went or who provided it or what they are attempting to do
with it. Mr. Geisler felt a corrected financial statement should be re-
quired and that the citizens cannot receive any benefit from the activities
of the organization.
Councilman Saelid referred to a communication from the organization dated
May 16, 1980 in which, in addition to threatening litigation, the attorney
for the organization, Allen Zutnik, said that to his knowledge ISKCON has
never been refused such a permit. Also for the record it was noted that
the applicant was notified by mail that this public hearing had been con-
tinued from May 6 to this date.
Inasmuch as additional information is needed it

Request for a waiver of the fire retardant roof and stucco siding require-
ments for an existing structure at 663 Naomi Avenue. The applicant, Ana-
stasios Pappas, desired to convert the existing single family dwelling into
a temporary engineering office for 18 months. It is proposed to demolish
the structure, as well as structures to the east and west, for development
into an office complex. Conditions to be imposed if the request were approv-
ed as outlined in staff report dated May 20, 1980.
Mayor Pellegrino declared the hearing open and Mrs. Pappas, 67 West Longden
Avenue, responded to questions and stated that they are hoping to move as I
quickly as possible and that they would not hesitate to execute a covenant
that the use of the building for commercial purposes will be discontinued
in 18 months from the date of approval. Councilman Dring referred to the
condition requiring the construction of a driveway which would eventually
have to be torn up. He felt this condition should be waived.
No one else desiring to be heard the hearing was CLOSED on MOTION by Council-
man Gilb, seconded by Councilman Dring and carried unanimously.
It was further MOVED by Councilman Gilb, seconded by Councilman Haltom and
carried on roll call vote as follows that the request be granted subject to
the following conditions:
1. Existing garage to be removed.
2. Access shall be provided to the interior of the building
for inspection purposes and the applicant shall comply with
all the requirements set forth by the Building Division and
Fire Department at that time.
3. All parking shall be located north of the building.
4. Revised plot plan shall be submitted to the Planning Depart-
ment for review and approval prior to issuance of the Build-
ing permits.
5. The front yard, with the exception of the driveway, shall be
landscaped and maintained in a neat and orderly manner.
6. The applicant shall execute in form and content approved by
the City Attorney a covenant ensuring that the use of the
building for commercial purposes will be discontinued in
18 months from the date of approval.

Appeal of the Planning Commission's denial of a modification request for
a 10'6" rear yard in lieu of 35'0" required for a two story addition and
a 10' 6" rear yard in lieu of 25 '0" required for a covered patio attached
to the main dwelling at 1935 S. Eighth Avenue. The Commission felt that
the modification was an extreme deviation from the newly adopted R-l set-
back regulations and that the addition was excessive for the site.
Mayor Pellegrino declared the hearing open and the applicant, Gary Stevens, I
said in part that the requested improvement would be proper and would not
compromise the neighborhood ... that he had discussed this with his neigh-
bors and there was no opposition .. that they had signed a memorandum to
,this effect. He noted his efforts in ensuring his neighbors privacy...
there are cypress trees directly behind the proposed addition; garages from
a neighbor's yard are against his rear property line. He continued in part
that he would be willing to provide additional landscaping if it would help.
No one else desiring to be heard the hearing was CLOSED on MOTION by Council-
man Gilb, seconded by Councilman Saelid and carried unanimously.
Councilman Gilb said in part that he had attended the Commission meeting

when this matter was considered and that this application was denied on a
6 to 0 vote and although the Council has the power to overturn the Com-
mission's decision he would support the decision unless something new or
different were submitted. He also referred to the new setback regulations
which are now in effect.
Councilman Saelid referred to the zoning codes and requirements which are
to maintain the quality of a neighborhood and said the Commission reviewed
the situation and felt the density of the development exceeded what was
right for the neighborhood. He would have to support t~e Commission.
Councilman Dring said in part that it appears inconsistent to him that a
business type development is given a great deal of leeway whereas in the
subject instance the homeowner is endeavoring to enlarge living quarters
for his family. He noted that people are familiar with two story houses
and that the neighbors had signed in favor; that today money is not avail-
able and interest rates are so high that he believes Council should extend
itself to help the residents improve their homes and that he would favor
waiving the restriction and allowing Mr. Stevens to proceed.
Councilman Dring MOVED to grant the appeal and approve the requested modi-
fication. Motion seconded by Councilman Haltom and did not carryon the
following roll call vote:

MODIFICATION REQUEST

The Senior Citizens' Commission had directed staff to study the feasibili-
ty of developing a Senior Citizen Center which could be adapted for senior
citizen programs and other community activities. It was noted that a re-
port is not available at this time but is in the process. This is just to
make the project a matter of public record.
With reference to items like the modification for 1935 S. Eighth Avenue,
Councilman Dring asked if it would be possible for Council to provide a
direction to the Planning Commission that 'in instances where a man's home
stands some chance of being improved ... if it needs some modification .,.
that Council would like more leeway given especially when neighbors have
given their consent.
Councilman Saelid explained the appeals procedure whereby any individual
who feels he has a unique case can bring it before the Planning Commission
and if he doesn't gain relief there he has the option of bringing it to the
Council and if the Council sees things differently it has the right to re-
verse the Commission ..' that if Council feels the requirements in the
zoning code are inappropriate or too constraining that it can easily enter-
tain a text amendment to change the requirements which are the guidelines
by which the Planning Commission operates.
Councilman Haltom agreed with Councilman Dring; he has no problem with the
laws, restrictions and zoning ordinances but it seems inconsistent that a
variance can be granted to commercial and not to homeowners ... like a
double standard.
It was the consensus that this is something to discuss with the Planning
Commission and a joint meeting will be arranged.
The City Council adjourned in order to act as the Redevelopment Agency.

COUNCIL RECONVENED uuu_ AUDIENCE PARTICIPATION
Herb Fletcher, 175 W. Lemon Avenue, spoke in opposition to lighting the
athletic field adjacent to City Hall. He asked Council to ascertain if
there is a true need for the lighting and to make sure all the daylight
hours are utilized before proceeding.

Mrs. Johanna Hofer, 875 Monte Verde Drive, referred to the decline in
school enrollment and felt the children playing soccer would be under a
thousand. That the $100,000 for lighting could be used for a future Senior
Citizen combined auditorium ... she also referred to an agenda item con-
cerning the forthcoming fireworks sale by the American Legion. She felt
the City should have a report on profits made from the sale and also a re-
port from the police and fire as to how many additional personnel is needed
at this time of year .. and then make a determination as to whether or not
to waive the license fee. She would also like to see a fine le~ed against
anyone who handles pornographic literature and makes it available for any-
one under 18. This is also an agenda item.
Gary Mallard, 101 S. Ninth Avenue, President of the Arcadia Youth Soccer.
He noted that they have 2258 registrations for soccer at this time ... the
waiting list is growing. The field has not been used much because they
want the turf to be in good shape. In response to a question he said in
part they are willing to participate and contribute to the cost of light-
ing used during games.
John Patterson, 134 E. Las Flores Avenue, spoke in favor of the lighting
of the field. He is a soccer player.
Gordon Maddock, 20 W. Orange Grove Avenue, asked Council to continue its
participation in the youth sports programs and to support the lighting of
the field -- that instead of worrying about the direct cost thought should
be given to the benefits it would produce ... that the parents have always
supported the maintenance of the field and equipment.
Ed Rembecky, 41 W. Foothill Boulevard, said in part that the subject field
is the only one of regulation size for boys and girls 14 years and up.
That heretofore they have had to go to other cities to play on a regulation
field; that by having the lights there will be additional playing time.
Brooke Dosier, 1311 N. Santa Anita Avenue, told how his team also has to
travel to other cities in order to play... that the subject field should
be the best and he hopes they will be able to play on it.

Councilman Dring stated in part that he supports soccer, having two chil-
dren in the soccer organization; that this is not the issue before Council
at this time '" he felt the funds could be used for additional police or
for a senior citizen center for instance .. that priorities could be shift-
ed to provide more benefit to the community as a whole.
Cheryl Collins, 504 Gloria Road, suggested if lights are approved that
Council consider placing a time limit so the children are not out so late
at night.
William Billing, 17 W. Camino Real, said in part that what the young people
have been saying makes sense to him; that there would be double usage of the

field with lights; that as a taxpayer money would be wasted if the field
could not be used at night .. land usage is important ., and as a former
police officer he felt some of the problems might be lessened if more in-
vestment were made in the youth.
Sherry Passmore, 1109 Columbia Road, was informed that the Water Fund IS
still maintained as a separate fund and that a portion of revenue sharing
funds which has been allocated for Capital Budget has been used for a
capital project in the Water Department, i, e., the water main in Hunting-
ton Drive.
Mrs. Johanna Hofer, 875 Monte Verde Drive, suggested delaying a decision
on the lights and put the issue to a vote via the Newsletter.

Sue Wallace, 1523 Lovell Avenue, referred to an ordinance (No. 1701) per-
taining to home occupations and said in part she hoped Council would
approve it.
Joe Sar~is, 1611 Highland Oaks Drive, urged the Council to approve the
lighting .. and to continue the community commitment to its youth ....
that the City can ultimately afford a senior citizen center. He also felt
a Councilman does not have the right to attack a citizen of the community
and in his opinion an apology is 'in order.
Herb Fletcher, 175 W. Lemon Avenue, said in part that football is not as
field damaging as soccer and suggested checking with the high school and
because some of the youths speaking at this meeting were wearing Sierra
Madre jackets he wondered if Sierra Madre would be willing to assist the
City financially on this project.
Joe Earll, 79 W. Magna Vista, supported the lighting of the soccer field
and felt the night lighting would make it possible for the younger chil-
dren to use it more in the daylight hours.
At this point in the discussion about the lighting the Parks and Recrea-
tion Supervisor said that once the field is in full operation playing
could go from 5 p.m. to 9 p.m. He also explored the types of ball games
which can be played on the field and that every effort will be made to
maintain the field in the best playing condition possible.
Wayne Cassriel, 1114 La Rosa, submitted that although the field is multi-
purpose its dimensions are for soccer rather than for anything else. But,
by installing lights it would benefit all other teams especially in the
winter when it gets dark at five.
Sherry Passmore, 1109 Columbia Road, suggested exploring with the School
District whether ornat it would be willing to share in the maintenance
cost of the field and expand the recreational program especially if the
School District does not have a regulation field.

H. R. Stoke, 1040 Hampton Road, expressed appreciation to Council for
reconsidering the matter of lights and commented that as a general rule
construction costs are increasing at the rate of 2 percent per month ..
and going out to bid at this time would be following prudent business
practices.
Joyce Smith, 854 Murietta Drive, said in part that the Council would be
derelict in its responsibility if it spent $125,000 for the lighting. In
response to her question as to the actual cost the Director of Public Works
said the field was constructed at a total cost of $218,734; of which some
$19B,000 was a State Grant. Mrs. Smith continued in part that how can the
expenditure be justified in light of the importance of energy conservation.
She suggested the funds go into a larger fund for a desperately needed
senior citizen center.

Recreation Commission, stating in part that the Commission studied this
matter quite thoroughly and the Commission endeavors to reflect the input
it receives from residents. He asked for approval of the lighting recall-
ing that the cost of operations would be passed onto those who use the
field.
In response to a statement by Councilman Dring that he thought Mr. Stoke
had put enough pressure on the Mayor that the issue is closed, Mayor Pelle-
grino stated for che record that with reference to his previous negative
vote on the lighting he was swayed in that vote because of Councilman Hal-
tom's statement about the removal of lights by the El Monte School District;
that he assumed Mr. Haltom was correct and he had not taken the time to
look into the matter until later when he discovered the light standards
were wood and badly warped being over 35 years old. Mr. Haltom was correct I
in the high cost of maintenance. He continued that he does not know Mr.
Stoke personally, having seen him at public affairs; that he does not take
pressure from Councilmen Gilb or Saelid and that he never would take that
of any Councilman to sway his vote.

Plans and specifications for lighting the Civic Center Athletic Field were
presented to Council on April 15, 1980. They were not approved at that
time and staff was requested to prepare and submit estimated operating
costs. The Director of Public Works reported that based on current rates
annual operating costs would be $4,500 or $9.00 per hour of operation for
500 hours annual usage. It was noted however that anticipated increases
in power charges by Southern California Edison Company would probably re-
sult in an increase to $10.50 per hour of operation by July 1, 1981.

Staff advised on the result of bids and made recommendation for the award
of contract for the Orange Grove "G" and "H" Booster Pumps and installation
of 30" valves on Orange Grove transmission main. It was MOVED by Council-
man Gilb, seconded by Councilman Saelid and carried on roll call vote as
follows that the contract be awarded to the low bidder, Tennyson Pipeline
Company in the amount of $201,605; that all other bids be rejected; that
any irregularities or informalities in the bids or bidding process be waiv-
ed and that the Mayor and City Clerk be authorized to execute the contract
in form approved by the City Attorney. Additional costs will be incurred
amounting to $38,000 (see report dated May 20). $239,605 was APPROPRIATED
from the Water Fund for this project.

Request of the local American Legion Post No. 247 for a waiver of the
business license fee for the annual sale of fireworks on July 1 - 4, 19BO.
Speaking on behalf of the Legion, Park Webster stated in part that he be-
lieved last year $4500 in sales tax was turned in which he thought would
take care of the police and fire personnel sufficiently. That everyone
who works the fireworks display are licensed by the State; that insurance
is carried On all eight stands for the sales. He also noted that this has
been an annual event for the last 37 years.
It was MOVED by Councilman Gilb, seconded by Councilman Haltom and carried

Council received the report and recommendation for the renewal of General
Liability, Public Official Liability and Excess Workers' Compensation In-

Public hearing scheduled for June 3 on the tentative map of Tract No.
40374 for an 18 unit commercial condominium at 40 - 44 W. Live Oak Avenue
(southeast corner of WeIland and Live Oak).
On November 8, 1979 Council approved a request from the City of Monrovia
to deannex certain property located north of Hillcrest Boulevard in Arca-
dia. All City departments were in favor and the following resolution was
then presented. The Planning Director read the title of Resolution No.
4904 entitled: "A RESOLUTION OF TIlE CITY COUNCIL OF TIlE CITY OF ARCADIA
CONSENTING TO MUNICIPAL REORGANIZATION 80-2 OF CERTAIN PROPERTY LOCATED
NORTH OF HILLCREST BOULEVARD IN THE CITY OF ARCADIA."

Communication from the Arcadia Presbyterian Church regarding such litera-
ture being distributed within the City. Gary Richman, 1126 El Sur, Youth
Director of the Church, spoke at length regarding the presence of hard
core pornography in the city. He submitted the various locations where
the material is sold from vender machines. He felt it is of such magni-
tude and so offensive that it should be brought to the attention of the
Council to see what legally could be done.
Fay Angus, 403 Canon Drive, Sierra Madre, spoke to this and circulated a
magazine she had found in a vending machine in front of a local restaurant.
She noted the availability of this type of pornographic material to the
youth of the City.. it is against the law to sell this type of material
to juveniles; that the adult community must take the responsibility of rid-
ding the community of this and asked Council to adopt a prohibitive ordi-
nance for which it would have the unanimous support of the community.
Ernest Fox, 731 Fairview Avenue, supported the former speakers and sub-
mitted locations in West Arcadia where the material is sold. Some discus-'
sion held on the newspaper racks being on public right-of-way and Mr. Fox
felt the City is condoning the machines with this material which minors can
purchase; that it is a moral responsibility of the City, State and Federal
Government.
Cheryl Collins, 504 W. Duarte Road, expressed appreciation that the Council
is pursuing this matter.
Sherry Passmore, 1109 Columbia Road, expressed appreciation also and said
in part that the material should be removed and placed back into the stores
where it can be supervised and not sold to youth under 18 years of age.

The City Attorney presented, explained the content and read the title of

The City Attorney advised that it could be legal for Messrs. Dring and
Haltom to vote on this resolution despite the fact that they were not
Councilmen at the time the hearings were held, however, he advised them
to abstain from voting on this resolution.
