ADJOURNED REGULAR MEETING
,JULY 12, 1978
The City Council of the City of Arcadia, California, met in
an adjourned regular session on Wednesday, July 12, 1978 at
6 p.m. in the Conference Room.

At 6:05 p.m. the City Council entered an executive session and
reconvened at 6:15 p.m.
Proposed Assessment District - Baldwin and Fairview Avenues. This
public hearing was called to receive input from the interested property
owners in the proposed parking district and staff explained what has
transpired thus far - that on June 20 Council authorized employment
of consultants for the preparation of data and documentation necessary
to form the district for a parking lot, however, no consultant
agreements to date have been executed. Written protests represent
Parcels 11 and 16.
The City Attorney advised that the law requires the City to either go
ahead and condemn the lot at 653 Fairview, which would be used for the
parking district, or terminate all condemnation proceedings by July 17.
That it is the intent of this hearcng to determine from the property
owners who would be paying for the improvement, whether or not they want
the City to proceed in the acquisition of the parking lot.
The Director of Public Works explained the sequence of events, referred
to the map of the district, and the two methods of spreading the
possible assessments and current cost data.
Mayor Parry declared the hearing open and Murray Seidner (along with
Paul Friedman) owners of Parcels 1 and 10, formally protested being
included in the district. The attorney for the owners of Parcels 11
and 16 submitted formal protests. Gordon Maddock, owner of ParcelS
was in favor of the district and offered to pay more than what either
methods 1 and 2 require; that there is a great need for parking space
in that location and felt it should move ahead as land is becoming
more valuable. Mrs. Susan Poulsen, owner of Parcels 8, 9, 12, 14 and
speaking for the owner of Parcels 6 and 7, stated in part that the
need is great and referred to the situation during the race season
when the curbs are painted red and the possibility that the day will
come when the curbs will be permanently red on Baldwin Avenue,
No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Gilb, seconded by Councilman Margett and carried unani-
mous ly.
The Director of Public Works explained that Section 2930 of the
Majority Protest Act of 1931 states basically that if written protests
from more than one half of the area of the properties to be assessed
for acquisition or improvement are received, then the proposed
proceedings shall be forthwith abandoned and the legislative body
shall not for one year from the filing of the written protests commence
or carryon any proceedings for the same improvement or acquisition...
hence it is mandatory to drop the proceedings at that point and all
costs accrued up to that time would be a liability to the City. He
submitted that there has been a majority protest.

Whereupon the City Attorney presented, explained the content and read
the title of Resolution No. 4762, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA REPEALING RESOLUTION NO. 4713 WHICH
APPROVED A NEGATIVE DECLARATION FOR, DECLARING AN INTENT TO FORM
SPECIAL ASSESSMENT DISTRICT 78-1 FOR, AND FOUND THAT THE PUBLIC INTEREST
AND NECESSITY REQUIRED INSLALLATION OF A PUBLIC PARKING LOT AT 653
FAIRVIEW AVENUE IN THE CITY OF ARCADIA AND ACQUISITION OF PROPERTY
THEREFORE."
It was MOVED by Councilman Gilb, seconded by Councilman Saelid and
carried on roll call vote as follows that the further reading of the
full text be waived and that the same be ADOPTED.

Due to the recent demise of Ralph A. Thorsen, owner and Manager of the
Best Disposal Company, it was MOVED by Councilman Gilb, seconded by
Councilman Saelid and carried on roll call vote as follows that the
new Board of Directors be and it is hereby APPROVED.

Council was advised that the Planning Commission was unable to come
to a decision on a conditional use application filed by the Boy's
Christian League and pursuant to the provisions of the Municipal Code
it was MOVED by Councilman Saelid, seconded by Councilman Gilb and
carried on roll call vote as follows that the City Council hereby
appeals the action of the Planning Commission and that a public
hearing be scheduled for August 15.
