Dr. Margaret Stevens, Santa Anita Church Finance Director Charles Reiman PRESENT: ABSENT: Councilmen Gilb, Pellegrino, Parry Councilmen Hargett, Saelid On MOTION by Councilman Gilb, "seconded by Counci~man Pellegrino and carried unanimously Councilmen Hargett and Saelid were excused. On MOTION by Councilman Gilb, seconded by Councilman Pellegrino and carried unanimously the Minutes of the Adjourned and Regular meetings of July 18, 1978 were APPROVED. Pursuant to a requirement by the Urban Mass Transportation Adminis- tration of the Federal Department of Transportation this public hearing was 8cheduled'in order to receive testimony concerning the City's proposal to request UMtA Grant Funds for the Dial-A-Ride Program for the fiscal years 1975-76 and 1977-78: The hearing must be held prior to submitting the application. The"appropriate legal notice was presented'to the City Council. It was noted that no action is required at this time other than to take testimony from the public. Mayor Parry declared the hearing open and no one desiring to speak in favor or against the request for Grant Funds for the Dial-A-Ride Program the hearing was closed on MOTION by Councilman Gilb, seconded by Councilman Pellegrino and carried unanimously.' The application will now be completed and submitted to Urban Mass Transportation Administration (Federal Department of Transportation). The Dial-A-Ride budget prepared by the consultants, Wilbur Smith & Associates for the fiscal year 1977-78 lists the local share from General Funds in the amount of $26,100 plus $3,000 from Federal Revenue Sharing - a total of $29,100 requested for reimbursement from the Urban Mass Transportation Administration. Th~s hearing is a requirement of the Federal Revenue Sharing ProglF~~ so that the program may be modified to reflect the expenditure from the General Fund. It was noted in the staff report dated July 27 that the total expenditures for the past year were made from General Revenue Sharing Funds "in the amount of $54,657.04 net cost. It was further MOVED by Councilman Gilb, seconded by Councilman Pellegrino and carried on roll call vote as follows that staff b~ authorized to transfer $26,100 (Dial-A-Ride expenditures made during 1977-78) from General Revenue Shadng Funds to the General Fun4~ AYES: NOES: ABSENT: Councilmen Gilb, Pellegrino, Parry None Councilmen Margett, Saelid 8-1-78 - 1 - HEARING Maranatha School Classrooms 1ft; I~:; t ,P " 23:9602 The Planning Commission adopted Resolution No. 1055 granting a conditional use permit for Maranatha School to use four classrooms at the Arcadia Christian Center at 21 Morlan Place. The City Council subsequently scheduled this public hearing. The Planning Director advised that the requested use at said location is a proper one for which the conditional USe permit is authorized; the site is adequate in size and shape to accommodate the USe including all yards, parking, loading, landscaping and other required features. The site does abut streets and highways adequate to carry the kind of traffic generated by the proposed USe and the project would not have a substantial adverse Unpact on the environment. The conditions were set forth in the resolution. A communication was received from Mrs. Wanda Lee Cummings, owner of 5, 7, 9 MOrlan Place and 101, 103, 105, 107, 109, 111 N. Santa Anita, in opposition to the request primarily because of night classes. It I was pointed out by staff that night classes will not be held at the Church, and that the use is only temporary - that Maranatha is endeavoring to locate elsewhere. Some discussion held on the transporting of the students. Mayor Party declared the hearing open and Jim Snyder, 22 W. Newman Avenue, e~pressed opposition to any further bus activity and said there is too much traffic now - what with the buses going to and from the facility. Barry Swayne, 33 E. Huntington Drive, attorney, spoke briefly concerning the need for the additional classrooms. Bill McKinley, P~incipal of Maranatha High School, explained the need and the endeavor being made to relocate. The students using the four classrooms will be freshmen and sophOlDOres and they will not be driving as they are under the age for driving. He also submitted that they do not have adequate facili- ties for physical education classes and are currently taking the students to the Sierra Madre Park and also to the Monrovia Y.M.C.A. There are 310 students with an expectation of 330 for the fall semester.. they have 2 buses for 44 students, 1 bus for 24 students and an 11 passenger van. They hope to rent an additional lot for parking purposes and about half the students will park off campus. They will not have night classes but will have night activities at its high school - not at the Christian Center. Mr'. McKinley recognizes the problem submitted by Mr. Snyder and will endeavor to resolve them. In response, to a question he said he understood the conditions imposed by the Planning Commission and can comply with them. During this consideration Doug Delahooke, 269 Rancho Road, Sierra Madre, also spoke to the need of the classrooms and their endeavor to locate elsewhere. The Planning Director advised that Maranatha High School has filed a new application for a Conditional Use Permit. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Gilb, seconded by Councilman Pellegrino and carried unani- mously. Councilman Gilb observed in part that he feels the school will work I with Mr. Snyder and his problem and that he feels the Christian Center has done an admirable job of the subject location and that Maranatha is a credit to the community. Councilman Pellegrino submitted that he ,too feels Maranatha is an added advantage to the City and he would like to see the High School remain in the City. It was MOVED by Councilman Gilb, seconded by Councilman Pellegrino and carried on roll call vote as follows that the City Council approve and file the Negative Declaration and find that the project will not have a significant effect on the environment. AYES: NOES:' ABSENT: Councilmen Gilb, Pellegrino, P~rry None Councilmen Margett, Saelid The California Vehicle Code requires this hearing in order to make the handicapped parking restrictions of the City applicable to any off- street parking facility. This hearing is being held specifically for that of Fashion Park. Once the ordinance is adopted it will provide that the owner of a designated facility may post' the blue and white wheelchair handicap parking signs adjacent to parking spaces which have been reserved for handicapped persons who have the distinquishing license plates or the placards which are issued by the Department of Motor Vehicles. The City police department would have the only authority to issue citations if someone parks in the space and does not have the appropriate,license plate or placard. Mayor Parry declared the hearing open and James Snyder, 22 W. Newman ' Avenue, referred to Assembly Bill 4140 which he said has been in effect 'since January 1977 and that all handicapped persons are desirous of seeing the law put into practice. He offered assistance in any way as he is very commensurate with the law and suggested contacting Glendale 'about its ordinance. The City Attorney expl~ined that once the ordinance is adopted resolutions may be adopted for other off-street. parking facilities. ,However each new designated facility must have a public hearing pursuant to, the law.. As of now only Fashion Park has requested this designation. , He also noted that the Ci,ty Council,'could adopt resolutions for other facilities without their consent, but if they do not post the signs, etc., there wouldn't be much the City could do about it. Roland Hart, 3519 Pal Mal, Temple City, expressed concern about the lack of marked parking spaces at the various restaurants,' public places and the like and felt little is being done about designated parking places for the'handicapped. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Gilb" seconded by Councilman Pellegrino and carried unani- mously. It was the consensus of the City Council that the proposed ordinance and resolution designating Fashion Park should be considered at this meeting and additional information may be obtained by the City Attorney for further review. It was noted that during an adjourned regular meeting this date the Chairman of the Diamond Jubilee Celebration, James R. Helms, Jr., had outlined a special event which has been planned by the Committee-- I that of a "Symphony under the Stars" by the San Gabriel Valley Symphony Orchestra at the Arboretum. Following considerations the City Council had accepted the event. Lemon Avenue, was advised that the budget for the fiscal year 1978-79 will be availab~e for public perusal by August 15. The delay has been due to changes brought about by Proposition 13. Milan Zirovich, 2066 Elkins Place, spoke at length concerning the disapproval of his working drawings and specifications by the Architectural Committee of the Highland Homeowners Association and to the length of tilDe it took for any action by the Committee. He spoke of his inability to obtain responses to his telephone calls for the decision. He finally received a notice of disapproval by two members of the Committee who had never visited the house. This took three months and Mr. Zirovich felt this was too long for a resident to have to wait. Councilman Gilb submitted that a communication should be directed to the Association advising it of this situation and asking that steps be taken to reduce the tUne it is currently taking to act on an application and to inform the applicant of its decision. Be it noted that Mr. Zirovich has appealed this decision for denial and the matter will be before the Planning Commission. CONSENT ITEMS I August 15 - Appeal from Planning Commission denial of a request for modification of required parking spaces for a condominium unit. September 5 - Planning Commission Resolution No. 1056 through 1059 amending filing 'fees. APPROVED final map of Tract No. 20969 - 17 unit condominium at 511 E. Live Oak Avenue' and found that the tract is consistent with the General Plan and that the waste discharge from the tract would not result in a violation of the existing requirements set forth in the Water Code. The Director of Public Works was authorized to approve and execute the Subdivision agreement for this tract. Valencia Way extends northerly from Foothill Boulevard for 1,100 feet to Hillcrest and is situated 150 feet from the Monrovia boundary line which lies midway between Valencia and Fifth Avenue. The report indicated traffic counts and vehicle accidents. The Police Chief and the Fire Chief did not anticipate 'any problems if the street were closed. During this consideration Art Zygielbaum, 1138 Valencia Way, submitted the hazards in connection with Valencia,Way traffic which travels downhill at a tremendous speed. Don Luff, 1122 Valencia Way, and Stewart Reeves, 405 Hillcrest Boulevard, spoke for the closure and discussed the traffic congestion which occurs from time to time. It was MOVED by Councilman Gilb, seconded by Councilman Pellegrino that Valencia Way be closed and that staff determine the method with report therefor to Council. Mayor Parry commented that he would support the motion unless a real problem develops which has not been ascertained at this time, in which event the action may be rescinded. This was agreeable to both Councilmen Gilb and Pellegrino. Roll call was then taken on the motion. Jenkins, in the amount of $27,436.16; that all other bids be rejected; that any informalities or irregularities in the bids or bidding process be waived and that the Mayor and City Clerk be authorized to execute a contract in form approved by the City Attorney. $30,000 was authorized for appropriation from State Gas Tax Funds for this purpose. Councilman Gilb spoke briefly concerning the reception he has been receiving of late from cable television and noted that persons having similar problems may not know they can report it to the City Hall.
