REZONING APPROVED l /or!l .. .r{; f e r/fjIV , I 23:9627 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA REGUlAR MEETING SEPTEMBER 19, 1978 " The City Council of the City of Arcadia, California, met in regular session on Tuesday September 19, 1978 at 7:30 p.m. in the Council Chamber of the Arcadia City Hall. Berlien Present: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry On MOTION by Councilman Margett, seconded by Councilman Saelid and carried unanimously the Minutes of the Regular Meeting of September 5, 1978 were APPROVED. Planning Commission Resolution No. 1060 recommended approval of a zone change from R-l, R-2 and PR-l to C-O and D for properties at 671 Naomi Avenue to the northwest corner of Lovell and Naomi Avenues including l307.and 1315 Lovell Avenue. The resolution set forth restrictions made applicable to the properties, i.e. height of buildings to be limited to two stories not to exceed 30 feet in height; minimum setback of 55 feet from the center line of Naomi Avenue; no vehicle parking shall be located within the required front yard setback; seventy-five percent of the required front yard not to be used for driveway purposes, landscaping required; vehicular access to the properties shall be from one-way ingress drives off Naomi Avenue and a plot plan and elevations showing the proposed development shall be submitted to and approved by the Planning Commission prior to the issuance of any building permits. Mayor Parry declared the hearing open and Daniel Espinosa, 663 Naomi Avenue, speaking for himself and two other property owners, stated in part that they were in favor of the proposed zone change and felt it would mitigate problems. Bill Martin, 602 Naomi Avenue, spoke in opposition to the zone change and recalled a petition he had previ- ously filed with 120 signatures against the change. He felt it would have a detrimental impact on the environment and that some of the residents would leave, the neighborhood. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Gilb, seconded by Councilman Saelid and carried unanimously. The Councilmen then submitted individual observations in part as follows: Councilman Margett felt there are always those who oppose and favor a change such as is proposed, but the area in question has been in a stagnant state for so long and because the structures have not been remodeled or updated is evidence that no one wanted to invest in R-1. He noted the requirements for development as recommended by the Planning Commission which he felt would act as a buffer to those properties on the south side of Naomi Avenue. AYES: NOES: ABSENT: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry None None Planning Commission Resolution No. 1051 recommending an amendment to Chapter 17, Section 1704 of the Uniform Building Code 1973 Edition, relating to roof coverings. Staff advised that the Planning Commission's Ad Hoc Committee (Building Materials study) along with Planners, Building Official and the Fire Department had reviewed noncombustible materials and ordinances of other jurisdictions having special requirements for hillside areas. Properties in question include those in the existing R-M zone, those in Fire Zone 4 and all resi- dential lots north of Elkins Avenue. Those on the east side of Highland Oaks Avenue were eliminated because the Flood Control Channel property acts as a buffer. I Available water supply was also considered -- there are over 100 swimming pools in the area north of Elkins Drive, however, at the present time the Fire Department does not have sufficient pumping equipment. Roof types were also part of the oral report with the condition of the roofs explored. Cost of reroofing was also explored according to the material i.e., Cal-shake, heavy wood shake, tile, treated or untreated wood shakes.. there are many divergent processes but at this time they do not have laboratory reports. Mayor Parry declared the hearing open .and spokesmen for several segments of the roofing industry testified on roofing quality, types of roofing,., cost and structural changes that might be required if heavy roofing were installed by the homeowners. Those speaking to this were Mark Basich, R & R Roofing Company; S. M. Malloy, Western Regional Manager for the Asphalt Roofing Manufacturing Association, Morris Gold~erg;, representing the Red Cedar Shingle & Shake Bureau. - 2 - ., ,. 9-19-78 t c..,', ;",,-,-- '.', .-" 23:9629 G. L. Patterson, 2164 Canyon Road, spoke to the brush area in which he resides and noted that he is interested in obtaining the best fire protective material for a new roof which he will soon need. He is not certain whether or not the house could stand major changes in the wall structures. The Fire Chief and Cap~ain Clark spoke to Class A, Band C roofings which are required to be noncombustible and recog- nized as such by the National Fire Protection Association. They spoke to costs and other restrictions in addition to roofing material. I Al Green, President of the Highland Oaks Homeowners Association, said he and the Association's Architectural Review Board had approved fire retardant roofs. He said they did favor the recommendation of the Planning Commission and that at the present time they only approve tile or the wood shake shingle. In response to a question he said they had not polled the members. Residents speaking in opposition to the recommendation were Nadene Sanford, 2171 Highland Oaks Drive, Judy Helmuth, 320 Topaz Place, Lew Lawrence, 246 Angelo Place, Jean Wunberg, 122 White Oak Drive, Eloise Ward, 325 Topaz Place and Sidney Raikin, 2016 Wilson Avenue. In part they referred to the costs involved in replacing a roof, the fact that some buildings could not withstand the weight of some roofing materials and the fact that some of the materials could collapse under a person's weight when it was necessary to be on the roof. They agreed many homes were in need of new roofs but felt a change in regulations would be discriminatory against those homeowners and asked Council to retain the existing regulations. Mr. Raikin spoke as a structural engineer with particular reference to what happens to dwellings during an earthquake " particularly a house with a heavy roof because they are not required to have the structural blocking necessary in commercial buildings. Morris Hegg, Chairman of the Ad Hoc Committee, explained that the Committee was not endeavoring to propose the installation of a heavier roof to overstress a building - that they had inspected about 20 material samples and they had recommended a noncombustible roofing material but did not specify Cal-shake in particular but left that up to the Homeowners Association - they did not feel they should take a position on any specific type. He noted that the Building Code addresses itself to everything but a roof --- they did not want in any way to dictate what a homeowner should put on his roof. I In submitting personal observations Councilman Saelid said in part that actually there are two sides to the question 1) the possibility of changing the ground rules on existing residential areas and about the residential mountainous area where reasonable development rules may be established. He felt the present restrictions on. roofing has made the area so attractive. He was concerned on what restrictions might be placed in the mountainous area. He did not see the value of seeking a poll of the membership of the association and felt it would be wrong at this point to go into an area already developed and impose a change when homeowners may have already planned their future expenses. He would also like to see some staff studies in terms of what additional consideration should be undertaken for the new area as yet to be developed. Councilman Pellegrino felt that those living in the subject area would not replace a roof with anything but the best protective quality material they could afford for the protection of their family. He was against changing the developed residential area regulations. Councilman Gilb agreed and felt every homeowner maintains his residence in the best possible manner and a good roof is essential. He als9 felt there was no use in putting on a heavy roof when the walls would not maintain. He then referred to the value of being a member of the homeowners association.. that it is one way of pro- tecting an interes't... and there is value in numbers, Councilman Margett concurred with what has been submitted but he did i ~ , . 9-19~78 - 3 - HEARING (Variance Reques t) DENIED {.. He was in favor of continuing the hearing pending input from the association and staff. Mayor Parry agreed with the intent to promote safety in the hillside areas and would like additional time for further study especially for the regulations for the new mountainous area necessary for additional fire safety and improved structural engineering as far as earthquakes are concerned. It was the consensus of the City Council that it could not support any change in the regulations for the already developed residential areas and it was MOVED by Councilman Saelid, seconded by Councilman Gilb and carried on roll call vote as follows that the City Council exclude from further consideration roofing requirements in any zone other than the R-M zone I AYES: NOES: ABSENT: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry None None It was then MOVED by Councilman Gilb, seconded by Councilman Margett and carried on roll call vote as follows that the public hearing be CONTINUED to NOVEMBER 21, 1978. AYES: NOES: ABSENT: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry None None " Request for a variance from the Building Code relating to ramp requirements (percent of grade of the driveway) at 1125 Fairview Avenue. Staff advised that the Code currently requires the transition at the top of a driveway to be a minimum of 20 feet in length with a maximum slope of 2 percent. The applicant proposes an 8 foot transition area with a slope of 10 percent. The Planning and Public Works Departments recommend against the variance as it would not provide for adequate public safety... it would be too steep and too short to allow for adequate visibility over the front of a car. I Mayor Parry declared the hearing open and Lewis Rodwell, architect at 1041 E. Green Street, Pasadena, spoke as an interested party --- to ramps he has constructed in the area and felt the requirements are not reasonable and submitted instances when he has endeavored to have plans approved but has been denied. He felt a Committee should be formed to investigate the ramifications. No one else desiring to be heard the hearing was 'CLOSED on MOTION by Councilman Margett, seconded by Councilman Pellegrino and carried unanimously. The City Council expressed concern that the applicant was not present I as it would like to have discussed a possible space compromise and felt that the ramp ordinances should be re-evaluated. Whereupon it was MOVED by Councilman Gilb, seconded by Councilman Margett and carried on roll call vote as follows that the request for a variance be denied. Mayor Parry declared the hearing open and Ernest H. Lehman, 134 W. Sierra Madre Boulevard, said in part he was sorry to have to bring this to the legislative body but that the nuisance had gone on so long that it appeared he had no other recourse. He played a portion of a tape recording of the barking on a specific date which continued for five hours. He asked to be assured that he would not have to contend with the nuisance any longer. He said he would like a period of time to see whether or not it really did improve as it has recently. Leonard Altmeyer, owner of the dogs, said one of the dogs has been placed with a relative and is no longer at this address... that he is guilty of having the barking dogs as charged but that they are surrounded by dogs and it is possible that his dogs have not been the only ones to cause annoyance. Elliott Lief, 637 Fairview Avenue, said that if there are laws on the books in this regard they should be enforced and should be handled by the Police Department. The City Attorney explained the procedure and recited the pertinent sections of the Arcadia Municipal Code. No one else desiring to be heard the hearing was CLOSED by Councilman Margett, seconded by Councilman Saelid and carried unanimously. During the consideration it was the consensus of the City Council that a period of time should be determined in which to ascertain whether or not the situation has improved and that during the interim if it continues Mr. Lehman should contact the Police Department to have the disturbance verified; that the City Attorney could also draft the appropriate document finding that a nuisance does exist which could be available for Council consideration on the specific date. It was MOVED by Councilman Saelid, seconded by Councilman Pellegrino and carried on roll call vote as follows that the'hearing be continued to November 7, 1978; that the City Attorney prepare the appropriate document finding that a nuisance does exist which Council may consider at that time. AYES: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry NOES: None ABSENT:None Planning Commission recommendation concerning the tentative map of Tract No. 35726 (7 unit condominium at 1116 Arcadia Avenue.) It is consistent with the General Plan and the Zoning Ordinance. It was MOVED by Councilman ,Gilb, seconded by Councilman Saelid and carried on roll call vote as follows that the Negative Declaration be approved and filed and that Council finds the project will not have a significant effect on the environment; that it is consistent with , the General Plan and the waste discharge from the tract will not result in a violation of the existing requirements set forth in the Water Code; that the Director of Public Works be authorized to approve the subdivision agreement and that the tentative map be APPROVED. AYES: NOES: ABSENT: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry None None The Recreation and Parks Commission investigated the-many parking and loitering problems which have occurred at the City Parks after 10 p.m. It was submitted that the City has few regulations governing these problems and the Police Department has little or no leverage in keeping control. The City Council concurred in the recommendations and it was 110VED by Councilman Gilb, seconded by Councilman Margett 9-19-78 - 5 - RECESS and RECONVENE 23:9632 and carried on roll call vote as follows that the following rules be adopted for City Parks with the exception of Wilderness Park: Parks to be closed to all activity between 10 p.m. and 7 a.m. Vehicles parked on park property between those hours be subject to towaway. Elliott Lief, 637 Fairview Avenue, inquired ~hether or not the City Council is giving any consideration to a reduction or roll-back of rents similar to the action taken recently by the City of Los Angeles, i.e., roll back the rents to May 31 with a 6 month moratorium on rent increases. He was advised that the City'Council has not considered such a step and it was suggested that he contact the Howard Jarvis headquarters for the apartment house representative in the area. Adrian Asencio, 232 E. Laurel Avenue, asked about the status of lighting on Laurel Avenue and referred to a petition which was filed signed by a majority of the residents in the subject area. He was advised by staff that due to the passage of Proposition 13 some projects had been deleted; that if the residents were willing to bear the ongoing maintenance cost something might be worked out. It was noted that the installation costs are assessed to the property owner so there is no problem there. Mr. Asencio will confer further with the Public Works Director and during the interim the City Attorney will explore the legal aspect. CONSENT ITEMS Council scheduled a public hearing for October 3 on the Planning Commission recommendation concerning a conditional use permit for Maranatha High School at 501 N. Santa Anita Avenue. the APPROVED a zone variance to permit an addition to an existing dwelling on a nonconforming lot in an R-l zone at 1015 Jeffries Avenue (Planning Commission Resolution No. 1067). APPROVED the tentative map of Tract No. 33833 which will create a 30 unit condominium at 464-452 W. Huntington Drive. ' 1 WAIVED the business license fee for the Holy Angel's Church annual fiesta in connection with Bingo. Camino Real for removal of a parkway tree. The report indicated that the Director of Public Works can cite no justification compatible with City policy that would justify removal of the subject tree. It was noted also that there are many other trees in rear yards .in this area, one of which was given as one of the reasons for the request.. The report was ordered filed on MOTION by Councilman Gilb, seconded by Councilman Pellegrino and carried on roll call vote as fo llows: AYES: NOES: ABSENT: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry None None Staff submitted a comprehensive report concerning crossing Santa Anita Avenue at the Assistance League location (100 S. Santa Anita Avenue). Concern had been expressed for the safety primarily for groups using the League facilities. The existing. conditions, accident history and possible improvements were enumerated in the report. It was recommended that the improvements be limited to curb parking restrictions on the west side of Santa Anita north of Alta Street; installation of post mounted pedestrian signs in advance of the. crosswalk and some selective and bush trimming to improve visibility. It was MOVED by Councilman Saelid, seconded by Councilman Pellegrino and carried on roll call vote as follows the recommendations be ACCEPTED and that staff pursue the dedication by the Assistance League of the corner which would benefit those in wheel chairs. AYES: NOES: ABSENT: Councilmen Gilb, Margett, Pellegrino, Saelid, Parry None None Pursuant to the request of Council staff investigated the vacant lots which have been subject to frequent dumping of dirt, asphalt, tree stumps and other debris and submitted that the most equitable solution would be the installation of a physical barrier such as a fence to restrict the access for this illegal activity. The owners of lots which would be vacant for any period of time would secure their property by the installation of some type of restrictive barrier. On MOTION by Councilman Gilb, seconded by Councilman Saelid and carried on roll call vote as follows Mary Soldate, 276 Hacienda Drive, was appOinted to a four year term on the Planning Commission (ending June 30, 1982). (This will fill the vacancy created by the expiration of the term of Robert Huddy.) Staff will check into this and come back with a report. Suggested staff begin checking into zero-based budgeting for the 1979- 80 year. Staff to come back with a report. Some discussion held on the priorities for recreation facilities which the Commission will study and make recommendation. Brought up the possibility of an abatement period for steel buildings and it was the consensus of the City Council that it be referred to the Planning Commission. Cited the improved appearance of a new building on the southwest corner of Huntington Drive and Fourth Avenue. Was advised on the Library functioning now without a Children's Librarian which position was eriminated due to Proposition 13 effect on the budge t .
