CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETING
OCTOBER 3, 1978
The City Council of the City of Arcadia, California, met in regular
session on Tuesday, October 3, 1978 at 7:30 p.m. in the Council
Chamber of the Arcadia City Hall.

On MOTION by Councilman Margett, seconded by Councilman Pellegrino and
carried unanimously the minutes of the regular meeting of September 19
were APPROVED.
Annually the City Council recognizes the department making the most
improvements in accident reduction and prevention. Mayor Parry
presented the Employee's Safety Award to the Fire Department. Fire
Chief Gardner accepted the award.
The City Clerk administered the Oath of Office to Richard A. Gaspari
and to Mrs. Mary Soldate, new appointees to the Senior Citizens
Commission and the Planning Commission respectively. Councilman
Saelid, Council Liaison to the Senior Citizens Commission, welcomed
Mr. Gaspari and Councilman Margett, Council Liaison to the Planning
Commission welcomed Mrs. Soldate.
Planning Commission Resolution No. 1065 granted a conditional use
permit for the continuation of the Maranatha High School at 501 N.
Santa Anita Avenue. Staff reported in detail on the conditions set
forth in the resolution and considerable discussion ensued on these
conditions. In addition to the pro and con communications included
in material submitted to Council the City Clerk advised that she had
petitions with 549 signatures and 89 letters favoring the conditional
use permit. Most of the letters in opposition were from adjacent
residents who complained about the noise and traffic problems generated
by the students.
Prior to opening the public hearing the Council members agreed with
observations made by Councilman Saelid that contrary to a misconception
the Council is not considering closing the school. Their concern is
to protect the residents adjacent to the school. Mayor Parry declared
the hearing open and Dr. Fordyce Johnson, 1131 Rodeo Road, spoke in
favor of the school, its principles and endeavors to control the
student body. He questioned whether or not there is as much disruption
in the community as some people seem to think and asked Council to
act favorably on the conditional use permit.
William McKinley, Principal of the school for almost five years,
presented additional letters and petitions in favor of the school some
of which were from residents in the immediate area. His particular
concern was Condition 5 in the resolution which restricts the use of
Cornell Drive, Windsor Road and Newman Avenue to buses and staff
vehicles and would require all other traffic to exit at the front of
the campus at the intersection of Santa Anita and Colorado. It would

also necessitate the construction of an additional driveway on the
north side of the school building. He asked Council to set aside
this restriction as unnecessary, hazardous and detrimental to the
environment. A drawing of the traffic flow was reviewed.
Mr. McKinley continued in part that due to the concern of the neighbors
the school has taken action to reduce traffic on the three streets
concerned, all student parking has been removed from campus, students
have also been restricted from going off campus at lunch time, all of
which reduces the traffic on the subject streets. He also commented
in part that discussions with the Police Department indicated no
particular problem with traffic and/or emergency vehicles. He asked
that students be allowed to park on campus when there are evening
activities.
Police Captain Molden responded to questions and said theylare not
aware of any problems of traffic, speeding and the like an could
recall only two complaints in the last four or five years. In
response to questions the Director of Public Works said in part that
his recommendations were in the interest of safety, i. e., all
driveways on Colorado and Santa Anita should be clearly marked as
entrances only and traffic required to exit via Cornell, Windsor and
Newman. He would not like to have buses stopping on the Santa Anita
or Colorado frontage.

Margaret Goeppinger, 1823 Anita Crest Drive, asked that the conditional
use permit be issued; that she is extremely impressed with the school
and submitted that there are irritants in her neighborhood --- school
buses several times a day, a~~lified rock music and the like.
P. G. Powers, 601 N. Santa Anita, corner of Newman, submitted that
many of her neighbors are in favor of the school and asked her to
express their position.... they are accustomed to heavy traffic on
Santa Anita and do not find it hazardous or inconvenient.
Mrs. Ralph Thomas, 1850 Louise Avenue, said her home is adjacent to
an elementary school where the campus is used daily for ball games and
evening dancing, also another resident whose street is used for band
practice. She felt residents close to Maranatha have little to complain
about in comparison to other locations, and that her rights are being
thwarted because she can't pick up her child on the school grounds
because the neighbors do not want it.
Joe Secony, 398 Highland Place, spoke in favor of the continuation of
Maranatha primarily because of its high standards.
Jim Brainard, 40 Lowell Avenue, Sierra Madre, spoke of other areas
with parking problems and felt the City should be assisting Maranatha
to relocate so it can expand - that a lot would be lost if the school
had to leave the community.
Don Stiver, 110 E. Longden Avenue, spoke of the value of the education I
received at Maranatha and felt that the public streets are for the use
of the public both for ingress and egress and for parking also... he
felt the restriction on the exit from the rear of the school parking
lot is unfair, inconvenient and discriminatory. He asked Council to
respond favorably to the school's cooperation with the neighbors by
continuing the conditional use permit with a traffic flow east or
west through the property as originally authorized.
David Andreas, 890 Hillcrest Place, Pasadena, speaking as the Student
Body President, spoke of the many compromises made by the school in
order to cooperate with the neighbors and noted that students attend
Maranatha by choice and follow the rules and regulations and are more
than willing to make necessary difficult adjustments for a peaceful
neighborhood.
Jim Moyer, 125 N. Bushnell, Alhambra, spoke to the quality of education
at Maranatha and asked for its continuation.

Robert Welch, 379 W. Norman, said in part that the school bas and is
endeavoring to be a good neighbor; that he is also inconvenienced by,
for instance, the traffic from the race track - that everyone has to
tolerate some inconvenience. He felt the problems would diminish if
each side would relax a little.
Dr. Ronald Hudson, 270 W. Lemon Avenue, said those in opposition
should consider that the students must subject themselves to strict
dress and conduct code; failure to so do results in suspension. He
asked for support of the school as it is one of the finest faculties
and administrations of the private school sector.

Jim Villescas, 411 San Luis Rey Road, asked Council to support the
School because of its high standards which was the reason he and his
family moved'into the City.
OPPOSITION
Edna Barker, 526 Cornell Drive, spoke to the increase in the student
body since 1970 - from 125 to 275 - and asked where does it stop. She
felt the school should relocate and that a time limit should be
imposed.... the traffic was a problem before the school came and it
has only increased.
Ruth E. Schmidt, owner of 515 Windsor Road, said she is receiving many
complaints about the noise and traffic from her tenants. She spoke
of the lack of parking spaces for visitors and felt the location is
not proper for the school.
Jim Schnieder, 22 E. Newman Avenue, also spoke of the increase in
student body since 1970; that he is not opposed to the school but felt
there is no possibility it can survive at its present location.. it
was originally a church and never intended to be a school. He spoke
of other complaints and suggested a contact be made with the post
office to find out about some of the student activities. He asked
for protection of the area and said the school should really be
elsewhere.
Patricia Riley, 522 Cornell Drive, asked for consideration of those
who live in the cuI de sac and referred to the traffic situation when
the parents pick up their children. She felt it is hazardous to those
residing there and spoke of the impossibility to find a parking place
in front of one's own home. In response to a question she said that
since September of this year she has had no difficulty in finding a
place to park on her street.
No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Gilb, seconded by Councilman Pellegrino and carried unani-
mously.

Considerable discussion ensued and it was the consensus of the City
Council that the usage must be considered and the residents on the
dead-end streets are entitled to ability for ingress and egress; that
the students should not be permitted to return to the old pattern of
parking on those streets. Reference was made to the possibility of
permitting the students to return to campus for parking when they had
to attend after school activities. Council did not like the idea of
the students having to walk from their parking places on Foothill
Boulevard after dark. Mr. McKinley advised there are actually 54
parking spaces with 50 available for automobiles, and the others for
buses.
Discussion continued on changing the last sentence of Condition 5
to permit egress only from the school site to the three subject
streets; also an additional condition to provide for student parking
on campus after 2:50 p.m. This would permit students to bring their
cars from the off site location at that time in order to participate
in after school activities.

APPROVED and FILED; that the last sentence of Condition 5 of
Resolution No. 1065 be amended to read "that e~ress be from Cornell
Drive, Windsor Road and Newman Avenue and that a Condition 7 be added
to read 'On campus student parking shall be prohibited during school
days until 2: 50 p.m. '" and as thus amended the conditional use permit
be approved pursuant thereto.

Planning Commission Resolution No. 1063 recommending a text amendment
to the Arcadia Municipal Code to effect the following:
I
1. Exempt certain nonconforming structures in the R-O and R-l
zones from requirements which prohibit any new construction
on lots where such structures exist.
2. Eliminate duplication in the Code.
3. Define "single-family dwelling".
4. Clarify the intended use in the R-l zone.
Staff advised that these steps would tend to clarify the Code and
would eliminate unnecessary red tape for homeowners.
Hayor Parry declared the hearing open and no one desiring to be
heard the hearing was CLOSED on MOTION by Councilman Saelid, seconded
by Councilman"Hargett and carried unanimously.
It was MOVED by Councilman Saelid, seconded by Councilman Hargett
and carried on roll call vote as follows that Council approve and
file the Negative Declaration and find it will not have a significant
effect on the environment and instruct the City Attorney to prepare
the necessary ordinance.

The Planning Commission considered and recommended the vacation of a
portion of Indiana Street which would facilitate the development of
an office structure at 115 Wheeler Street. It was MOVED by Councilman
Hargett, seconded by Councilman Gilb and carried on roll call vote as
follows that the Negative Declaration be approved and filed and find
that the project will not have a significant effect on the environment
and that the City Attorney prepare the necessary Resolution of
Intention to vacate said portion. Public hearing will be held
thereafter.

Staff advised that the improvement of Baldwin Avenue Phase II Job
No. 469 was approved by the City Council on April 18, 1978 but the
work had to be postponed due to the shortage of cement. The project
was approved for use of Federal Aid Funds and matching funds by the
City. The State budget for 1978-79 provided for $10,000,000 from the
State Highway Account for use by local agencies to match approved
Federal Aid Funds which were made available to cities and counties on
a first come first served basis rather than by the formulated
allocation. Application for funds was made and approval has been
received in the amount of $41,786 which leaves a local matching
requirement of $1,785.

approving the project and that the mayor and City Clerk be AUTHORIZED

the Director of Public Works to file an annexation report consisting
of plans and specifications, estimate of cost, diagram of the District
indicating the lands including all zOnes thereof to be benefited by
the proposed improvement and to be assessed to pay the expenses
thereof. This report will be filed with the City Clerk prior to the
Council meeting of November 7, 1978. It was MOVED by Councilman

In response to requests of residents on Valencia Way the City Council
on August 1, 1978 took action to barricade the street but that staff
contact the City of Monrovia to seek its cooperation in the location
of the barricade. Monrovia advised it would prefer to install stop
signs at the intersections of Hillcrest, Madison and Fifth Avenue.'
and would like Arcadia to do the same at Valencia Way and Hillcrest.
Monrovia felt that in this way motorists would be encouraged to use
other streets to get to Foothill Boulevard and not concentrate
traffic on anyone street.

The Arcadia Director of Public Works submitted in a staff report that
in his opinion multi-way stop signs control at the three intersections
would be less severe than a permanent barricade and would also permit
free access to all affected properties as well as to emergency
vehicles. He felt the stop sign approach would be less dangerous due
to the visibility problem if a barricade were installed. He
recommended a trial basis of the stop signs over a six month period.
Speaking in favor of the barricade were Art Zygielbaum, 1138 Valencia
Way, Gerald O'Neil, 1212 Valencia Way, Mrs. Bissell, 1130 Valencia
Way, Don Luff, 1122 Valencia Way and Gloria Penton, 1110 Valencia
Way. All expressed concern for the safety of those living on that
street and asked Council to abide by its previous determination.
Mr. Zygielbaum circulated photographs.
Discussion ensued and it was the opinion of the City Council that it
would like the City of Monrovia to cooperate, however it also felt
that the residents should have protection and it was MOVED by
Councilman Saelid, seconded by Councilman Pellegrino and carried on
roll call vote as follows that the City Council reaffirm its
intention to install a barricade on Hillcrest Boulevard at the City
boundary line; that the Director of Public Works prepare engineering
drawings and submit to Council; that during the interim staff contact
the City of Monrovia again to see if it would be agreeable to placing
the barricade at the corner of Fifth Avenue and Hillcrest, if not,
that the barricade be placed at the City boundary line. In answer
to a question the Police Chief said the department will do what it
can to patrol Valencia Way.

Brought up the Commission Handbook and suggested some changes. _
Briefly discussed the dues to the National League of Cities.
Spoke in favor of the use of ' Campus Drive for School Band practices.
Staff advised on the delay in connection with the traffic signal
modification work being performed by Steiny Company.

Brought up the fact that Boards and/or Commissions often take work to
the Print Shop and felt it placed an undue burden on the personnel
in that Department especially if it were already bogged ,down with
city business. Because the Finance Director is responsible for its
operation he will henceforth determine priorities.'
Announced that he had resigned as Vice President of the National
League of Cities and noted that the amount budgeted for'his attendance
at a Conference could be deleted as he would not be going.
Commented on the Diamond Jubilee Celebration and stated all in
all it was a successful event.
