REGULAR MEETING
JANUARY 16, 1979
The City Council of the City of Arcadia, California, met in regular
session on Tuesday, January 16, 1979 at 7:30 p,m, in the Council
Chamber of the Arcadia City Hall,

On MOTION by Councilman Margett, seconded by Councilman Saelid and
carried unanimously Councilman Gilb was excused,
Mayor Parry read a communication from Mrs, Charles J, Funk on behalf
of the residents of the Huntington House Apartments, 895 W, Huntington
Drive, expressing appreciation for the response and efforts of the
Paramedics and also a donation of $100 to be used for the Fire
Department Paramedic in the purchase of any needed equipment, It was
MOVED by Councilman Margett, seconded by Councilman Pellegrino and
carried on roll call vote as follows that the donation be accepted
with appreciation to be expressed to Mrs, Funk,

On MOTION by Councilman Margett, seconded by Councilman Saelid and
carried unanimously the minutes of the adjourned regular and regular
meetings of December 19, 1978 were APPROVED,
Mayor Parry announced the scheduling of public hearings; appeal from
the denial by the Planning Commission on the request for consolidation
of three lots into one lot - FEBRUARY 6, 1979; and the recommendation
of the Planning Commission for a zone change on properties in the
downtown area for FEBRUARY 20, 1979.
Appeal from the Planning Commission's denial of modifications
requested for an existing addition constructed without a permit at
415 Cortez Road, It was noted that the residence and garage were
constructed in 1947 with reroofing and a bathroom alteration taking
place in 1967. It was concluded by staff that the addition was
constructed sometime prior to August 1967. The Commission was
concerned that approval of the modifications would set a precedent
with respect to zero side and rear yard setbacks for residential
dwellings, In reviewing the requirements staff recommended that if
approved a one hour wall with a parapet be constructed on the side
of the addition.
Mayor Parry declared the hearing open and Mrs, Arlon R, Brubaker
stated in part that they initiated the request as soon as they learned
there was a problem; they have made several substantial improvements
over the years and each time they took out the necessary building

permits. Although the Building Department shows only two permits
were taken out". their records indicate four were taken out. They
were not aware of the family room being built without a permit until
they were going to sell their home at which time they requested the
modifications. She continued in part that as far as a fire hazard to
the neighboring properties is concerned their family room is about
35 feet from any other neighboring buildings and the living room
which meets all setback regulations is about 20 feet from the neighbor's
garage, The existing wall of the family room probably exceeds the
1 hour fire wall standard since the wall and built-ins on the interior
are constructed of flagstone, It is a good solid wall and Mrs.
Brubaker felt it warrants approval for modification. In response to
a question Mrs, Brubaker said there would be no problem in constructing
a parapet as recommended,
Robert San Miguel, 412 Cortez Road, directly across from the subject
residence, said in part that it is a lovely well kept home and he was
in favor of the modifications, Mr. San Miguel filed a petition with
eleven signatures of residents on Cortez Road supporting the request,

Speaking also as a resident of the subject area Councilman Saelid
said in part he is wholly in favor of maintaining the requirements,
however, in this case there is an extenuating situation where the
property has changed hands many times since the improvement was first
made. He could not see where a precedent would be set for future
construction with a zero sideyard setback configuration, He then
MOVED to grant the appeal; that the modification request be granted
with the requirement that the property owner construct a parapet
pursuant to Planning Commission's recommendation; that a building
inspection be requested and paid for by the property owner and that
all violations which may be found be corrected to the satisfaction
of that department and that all required permits be obtained, Motion
seconded by Councilman Margett and carried on roll call vote as
follows:

Mayor Parry welcomed Boy Scouts of Troop No, 105, sponsored by the
Arcadia Kiwanis Club, and Bob Ross, Scout Master, introduced his
assistant Scout Masters, The Scouts were working toward their
communications merit badge and were in attendance to observe the City
Council in action.
Appeal from the Planning Commission denial of an application for the
creation of a five (5) lot subdivision (Tentative Map No, 36277) at
1140 and 1150 W, Foothill Boulevard (southeast corner of Michillinda 1
and Foothill), It was noted by staff that the majority of the
Commission expressed concerns with the amount of on-street parking on
the proposed cul de sac, the number of nonconforming lot characteristics
and the traffic circulation with regards to the median in Foothill
Boulevard. One Commissioner noted that the proposed subdivision
would comply with the required minimum lot areas and felt it would
provide for an adequate development under the given zoning of single
family residential", also that the characteristics are consistent
with other subdivisions on the south side of Foothill Boulevard and
that it would not have any significant impact on the traffic circu-
la tion,
The Planning Director submitted further that the General Plan
designation is single family residential 0 to 4 du/acre with a lot'
size requirement of 10,000 sq, ft, The site slopes from north to

south and soil compaction reports would be required prior to the
issuance of any building permits due to the 'dumping which has taken
place on the site through the years,

In discussing ingress and egress it was noted that the cu1 de sac
would only be accessible from the eastbound lane on Foothill Boulevard
and access to and from the westbound lane is blocked by the existing
median strip, however, an opening of a portion of the median strip
would shorten the westbound left-hand lane, The Department of
Public Works indicatesthat no median opening would be allowed at this
time although if the application is approved it is recommended that
the developer post a bond for the work involved in opening up the
median, The particular intersection is under the jurisdiction of
the State, An indication has been received that they would have no
objection to removing the U-turn prohibition for the westbound traffic
if the City so requested,
Projectura1s were reviewed by Council indicating the location of the
existing medians and the cu1 de sac street and it was submitted that
there would be sufficient room for the motorist leaving the cul de sac
to observe traffic on Foothill,
Mayor Parry declared the hearing open and Ralph Rittenhouse, Suburban
Land Development Company, recited the years of endeavors by developers
to construct on the site ----; that the proposals have been turned
down because the residents in the area did not want commercial or
condominiums; that the site has been used for dumping and is an
eyesore, They have spent many hours of planning and the subject
tract exceeds the zoning requirements, He recalled other subdivisions
he has developed on Foothill Boulevard and that the traffic circu-
lation is the same as is found everywhere a median has been constructed.
In response to an inquiry Mr, Rittenhouse said he understood all of
the requirements and felt they could all be used positively instead
of negatively" it would be a good sales approach from his standpoint".
and he is willing to accomplish them all. He did not feel the noise
from the freeway would be a factor and noted he has talked with the
neighbors who indicate there is no problem,
Ron Condell, 1622 S, Second Avenue, affiliated with Mr, Rittenhouse of
Suburban Land Development Company explained what they had done after
the Planning Commission's action for denial", Since there were no
objections lodged they contacted the residents on some of the adjacent
cuI de sac streets and in every instance the residents felt it would
be a great improvement ".' that the site is now a real problem, He
filed two letters from adjacent neighbors: Milton Berenbaum, 1049
Heritage Oaks; Lorne and Earline Block10ck, 1043 Heritage Oaks Drive,
Douglas Byrkit, 1036 Heritage Oaks, spoke in favor of the development
and said the noise is not a concern" the homes are so well insulated"
and felt the residents on Foothill Boulevard have learned how to
surmount the problems of the medians and do not find the situation
too much of a hazard.

Greg Avedesian, 1042 Whispering Oaks, said the noise and the way one
must drive on Foothill to reach home are not problems but that the dust
and the dumping on the site are, He favored the development,
Vivian Byrkit, 1036 Heritage Oaks, said she regretted not speaking
in favor of the development at the Commission hearings,.. but because
the Department had recommended approval she did not think it would be
necessary, She filed three letters in favor from residents on
Whispering Oaks Drive: Mrs, Enrique Castro, 1030; A. C, Super, Jr.,
1035; and Janet Jonker 1050. She felt the site as an entrance to
the City from the west is currently an eyesore and urged approval
of the appeal,
K. R, Schmidt, 534 Workman Avenue, asked if the property owners of the
site do not have to maintain their property, He was advised that
they do, however this site has been a dumping site for so long and

Councilman Pellegrino stated in part that the property has indeed
been an eyesore for so long and as long as the subdivider understands
and is willing to comply with all of the staff's requirements he
would favor the appeal,
Councilman Margett stated in part that his concerns have been
alleviated by staff's report and recommendations and also by Mr,
Rittenhouse who has gone on record as being willing to comply with 1
all requirements which are rather strict and because the property
lends itself to residential construction of the type proposed he
would be in favor of supporting the appeal.
Councilman Saelid commented that his only concerns are the traffic
circulations." how the traffic can be accommodated". he did not
think this would be unsolvable." he felt the dangerous situation at
present could be worked out and he would like to have staff make
such a study and if the subdivider would be willing to accept such
recommendations as a part of his development costs he would support
the appea 1.
Mayor Parry commented in part that he has given much thought to
other possibilities for ingress and egress, that it is unfortunate
that the property was not developed in conjunction with the existing
adjacent lot or lots but that did not materialize and in analyzing
the pros and cons he felt the subject project would be in the overall
best interest of the City., He felt it would be a quality development
and that the developer would do everything possible for safe ingress
and egress,
It was then MOVED by Councilman Margett, seconded by Councilman
Pellegrino and carried on roll call vote as follows that the tentative
map of Tract No, 36277 be APPROVED; that the Negative Declaration be
approved and filed and that Council find the project will not have a
significant effect on the environment; that the nonconforming
characteristics of the proposed lots will not prohibit adequate
building and yard areas for an appropriate development of the site
and that said nonconformities are hereby modified; that the tract
is consistent with the General Plan and that the waste discharge
would not result in a violation of the existing requirements set forth
in the Water Code; that the Director of Public Works be authorized
to approve the subdivision agreement and that a requirement also be
included that permission be obtained from State for a U-turn for
westbound traffic. It was noted that if this cannot be complied with,
staff will report back to Council with available alternatives,

The City Council received the recommendation of the Arcadia Beautiful
Commission and staff concerning a State Grant of $767 to be used in
enforcement activities to counter problems attendant with littering
within the City, The Commission felt the funds could be used for
decals to be placed on refuse containers, street sweepers and refuse
trucks,
It waS MOVED by Councilman Margett, seconded by Councilman Pellegrino
and carried on roll call vote as follows that the recommendation of
the Arcadia Beautiful Commission be APPROVED and, that the City
Manager be and he is hereby AUTHORIZED to exec~te a State Grant

supporting the City Council in the matter of the suit of the people's

Michael Genito, 153 W. Floral Avenue, made several suggestions for
the raising of revenue for the City, i,e" sales tax on cigarettes
and liquor, tax on speculator transactions, grant permission for a
lottery. He was not in favor of welfare rolls and urged the City
Council to request State for funds, Councilman Saelid responded in
part that what many persons do not realize is that out of the re-
maining property tax dollar the City receives 6.7% of that and 35%
of that goes to the County.. and one has to ask what services are
received from which agency.. that the answer is quite obvious, He
agreed that the City must work with the State Legislature to bring
about some tax reform; that he had recently discussed this with
Senator Richardson who was not too hopeful that the Legislature would
act to return any greater portion of the existing 6% sales tax to
Cities,. however, this is the direction in which the City Council has
to work.

Joan Coleman, Director of the San Gabriel Valley Humane Society,
requested the City Council to initiate a text amendment to permit an 1
animal pound facility in the Chicago Park area. William p, Mace,
attorney for the facility, advised that they are desirous of re-
locating the headquarters and the animal shelter to a parcel of land
in the Chicago Park industrial area of the City; that the City's M-l
zone does not provide specifically for this use. He asked the City
Council'to consider implementing its authority under the Code and
initiate hearings to allow an application for a conditional use
permit to be filed in an M-l zone for Animal Shelters including small
animal petting zoos and aviaries operated by a public agency or by a
Society for the prevention of cruelty to animals.
Considerable discussion ensued and it was the consensus of the City
Council that it should be understood that it is basically a matter
which should be considered first by the Planning Commission with
recommendation to the City Council. In response to an inquiry
Mr. Mace replied in part that the reason he brought this to the City
Council instead of going directly to the Commission is that they
would have to pay a fee which they would lose if the Commission
denied their request and that he felt it is more of a legislative
question at this point in terms of whether or not Council would want
this in the M-l zone at all. Should Council decide to pursue this
the first step would be to direct staff to initiate a change for the
consideration of a text amendment.
Nancy Piscitelli, 461 Sharon Road stated in part that she is in favor
of having an animal shelter in the City but would ~ot want the present
director of the San Gabriel Valley Humane Society to operate it. She
said she would address it further if the matter came up,
K. R. Schmidt, 534 W. Workman Avenue, questioned why Mr. Mace, a
resident of northern California, would commute to Southern California
to represent a non profit corporation. Mayor Parry submitted that
this type of questioning might be relevant later on if Council
determines to go through with the text amendment process.
Councilman Saelid stated in part that not until this matter was
presented had he given any thought to such a facility being located
within the City, but as he looks at the available areas in the San
Gabriel Valley the industrial park area seems probably the most
suitable. He would not want to prejudge it by sending a recommen-
dation to the Commission in essence saying Council thinks it is
necessary.,.. He could support action to see whether or not the
Commission thinks the facility would be an appropriate usage in the
area in question. He also referred to the fact that it might well be
a location for the consortium of cities to consider for a pound
facility. He had reference to a number of cities in the Valley which
have joined to study the possibility of providing animal control
services which would be equivalent or better than what they now
obtain from the County in order to obtain these services at the best
use of the taxpayer's dollar,

and for the benefit of those in attendance interested in this matter
he continued that in referring it to the Commission Council is neither
approving or disapproving it, That he would support the observation
made by Councilman Saelid, Councilman Pellegrino concurred and felt
the information he has received thus far is not sufficient for him to
make a valid decision.
Councilman Saelid then MOVED to direct staff to initiate text amendment
proceedings to have the matter presented to the Planning Commission
for its recommendation to Council. Councilman Margett seconded the
motion which was carried on the following roll call vote.

FIVE MINUTE RECESS
Staff noted that the Police Department has been directed by the
Santa Anita Municipal Court to update speed zoning data pursuant to
provisions of the State Vehicle Code, In compliance therefor the
department has made radar speed checks and the engineering division
has reviewed the accident history and existing physical conditions on
the arterial and collector roadways, Speed limits on various streets
were recommended as listed in the staff report dated January 16. It
was MOVED by Councilman Saelid, seconded by Councilman Margett and
carried on roll call vote as follows that the survey be approved and
that the City Attorney be directed to prepare an ordinance declaring
the prima facie speed limit as indicated,
On recommendation of staff Police Officer Antonio Martinez was
granted a six months extension on his leave of absence without pay
until July 26, 1979 or until the resolution of his Worker's
Compensation,
Whereupon the City Attorney presented, explained the content and

In response to a question the Economic Coordinator submitted the status
of the Johns and Kuhn development on Wheeler Street - they are about
ready to close escrow. He also responded to an inquiry concerning
the inclusion of the Chicago Park in the redevelopment project area
that at one time it was considered but was never consummated due to
problems with land titles,
The Director of Public Works advised that the fire hydrants on Baldwin
Avenue will be relocated during the time Baldwin Avenue is being
reconstructed, Mr, Saelid said he would notify Council when specific
dates for the meeting on cooperative efforts of the municipalities and
school districts would be submitted,
