I""'" BUSINESS LICENSE FEE (Apartment) (Staff report) 23: 9716 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA ADJOURNED REGULAR MEETING JANUARY 31, 1979 The City Council met in an adjourned regular seSSlon on January 31, 1979 at 5:30 p.m. in the Arcadia City Hall Conference Room. PRESENT: ABSENT: Councilmen Margett, Pellegrino, Saelid, Parry Councilman Gi 1 b On MOTION by Councilman Saelid, seconded by Councilman Margett and carried unanimously Councilman Gilb was excused. In its consideration of hillside roofing materials the City Council at its meetlng of September 19, 1978 directed staff to eliminate the existing developed residential areas from the proposed regulations for all properties in the R-M zone, Fire Zone 4 and all properties north of Elkins Avenue in Fire Zone 3. The hearing was then continued to this date to permit staff and Commissioners to examine and photograph recent fires which had devastated canyon areas. The photographs were reviewed by Council and staff explained how various types of material performed in those fires. Council also considered two types of treated wood products which can achieve a Class B or Class C rating depending on the application of the product. At the present time wood products in residential areas in Arcadia cannot achieve even a Class C rating and are referred to as unrated products. Staff was directed to schedule a public hearing for March 6 to consider Class A or B materials for the R-M zone. It also scheduled a public hearing for June 5 to conslder requiring noncombustible roofing materials (Class A, B or C) for all new residential construction regardless of location. During the interim staff will endeavor to explain the issue to homeowner associations, Chamber/Commerce and builders and bring back to Council the consensus of these groups. The Planning Commission on January 23 amended by resolution one of the conditions relating to the conditional use permit granted for the operation of a handball/racquetball club at 1001 S. First Avenue. This amendment will permit the sale of beer and wine on the premises - restricting the sale and consumption to the second floor snack bar lounge area. On MOTION by Councilman Pellegrino, seconded by Councilman Margett and carried on roll call vote as follows said action was RATIFIED. AYES: NOES: ABSENT: Councilmen Margett, Pellegrino, Saelid, Parry None Councilmen Gilb Request of Mrs. E. C. Sheahan that the City Council consider repealing the Arcadia Municipal Code provision regarding penalties for late filings of business license fees. Mrs. Sheahan also asked that the $17.50 fee for the period from July 1 through December 31, 1979 be cancelled. Correspondence revealed that Mrs. Sheahan acquired the property on July 24, 1978; the previous owner had paid the license fee for 1978. Staff submitted that a business license is not transferable and the business license so indicates. There is a $25 fee for late 1-31-79 - 1 - LANDLOCKED PROPERTY (Sta ff report) CHANGES IN LAND USE (Planning CommJ 5 s ion) BOARD COMMISSION RECOGNITION ADJOURNMENT 23:9717 filing and along with the 1979 business license fee of $35 there is a total due the City at this time of $77.50. The City Council requested additional information with a recommendation from staff. The City Council received a request from four residents on Doolittle Avenue that the parcel map fees of $400 be waived in connection with the strip of property at the rear of 2501, 2509, 2515 and 2519 Doolittle Avenue which it was felt by the residents was unreasonable considering the fact that they only paid $750 for the entire strip. It was the concensus of Council that staff determine an equitable solution in order to grant relief to the property owners. Staff discussed at length its inability to enforce Code Section 9269.3 - Changes in Use - primarily in fue area of required parking for each use It was noted that business licenses and building permits are being held up due to the lack of clarification. One case in point is 300 N. Santa Anita Avenue... the new owners want to operate a retail sales office of spa accessories. The former use was nonconforming for the location and there is no on-site parking. It was the consensus of Council that the entire matter should be and it is hereby referred to the Planning Commission for study and recommendation. I Mayor Parry announced that a date has been set (March 26) for the annual recognition of the various boards and/or commissions.
