Bishop William Van Dusen, Church of Jesus Christ of Latter-Day Saints , Dave Wright, Administrative Assistant, PRESENT: ABSENT: Councilmen Parry, Pellegrino, Saelid, Margett Councilman Gilb On MOTION by Councilman Parry, seconded by Councilman Pellegrino and carried unanimously Councilman Gilb was excused. On MOTION by Councilman Pellegrino, seconded by Councilman Saelid and carried unanimously the minutes of the regular meeting of May 1 were APPROVED, On behalf of the City Council Mayor Margett presented John F, Sinclair, Principal of Hugo Reid Primary School, with a plaque in appreciation and g~atitude for his recent action in saving the life of a young student, Andy Wilson, CONTINUED - Complaints of barking dogs at 1323 S, Santa Anita Avenue, Council received a staff report indicating that the situation has not improved and continues to be a serious problem. Mrs, Hoagland, mother of Mrs, Sheldon Howard, stated in part that she is on the subject premises every day between approximately 10 a,m, and 2 p,m. and efforts are being made to control the barking, She recited reasons for the barking and also submitted the noise from the remodeling of an adjacent house which has been going on for at least two years. She said efforts have been made to find other homes for the dogs - to no avail - up to the present time... that the dogs are placed in the garage during the evening and one dog is kept in the house. She noted there are other dogs in the neighborhood that bark. Mrs, Sheldon Howard, 1323 S. Santa Anita Avenue, said in part she gets home at 3 p,m, daily and will be home, during the summer months.. that she is making every effort to quiet the dogs and reiterated the information submitted by Mrs, Hoagland, She has also given thought to having the dogs debarked but then their protection value would be lost. Sheldon Howard, 1323 S, Santa Anita Avenue, said in p~rt that he felt his statements at the previous meeting were not heard - that although one of the complainants said the situation had been going on since 1974 -- he did not buy the house at 1323 S, Santa Anita until 1975 - at which time they had only one dog - that they have had the three about two years, He noted that there is a large German shepherd and other dogs in the neighborhood, Councilman Saelid read a communication from a resident in the subject 5-15-79 - I - RESOLUTION NO, 4~~0/ ADOPTEj HEARING continued to JUNE 5 v HEARING (Multiple dwelling conversions moratorium ) SEPT, 15, 1979 ~I (See Ord. adopted 8-7-79) ORDINANCE NO. 1680 " 23:9780 neighborhood stating in part that due to the constant barking they have not had a good night's sleep since moving into their home in 1974. Councilman Saelid also referred to the staff report indicating the problem still exists, No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Parry, seconded by Councilman Saelid and carried unani- mously. It was MOVED by Councilman Saelid, seconded by Councilman Pellegrino and carried on roll call vote as follows that the reading of the full body of Resolution No. 4820 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA FINDING THAT THE KEEPING OR MAINTAINING OF A DOG OR DOGS AT 1323 SOUTH SANTA ANITA AVENUE, ARCADIA, CONSTITUTING A PUBLIC NUISANCE TO THE SURROUNDING NEIGHBORS AND SPECIFYING THE MANNER OF ABATEMENT OF SAID PUBLIC NUISANCE" be waived and that the same be ADOPTED, 1 AYES: NOES: ABSENT: Councilmen Parry, Pellegrino, Saelid, Margett None Councilman Gilb General Revenue Sharing Program - proposed use of funds for the fiscal year 1979-80, The City Manager submitted that it is anticipated the City will have estimated funds of $210,000 and explained the proposed uses, Mayor Margett declared the hearing open. No one desired to speak at this time and inasmuch as the regulations suggest that public hearings on the revenue sharing uses be held at the same time the other budgets are being considered, it was MOVED by Councilman Parry, seconded by Councilman Pellegrino and carried unanimously that the hearing be CONTINUED to JUNE 5, 1979, Council considered the establishment of a moratorium on the conversion of multiple dwellings into cooperative multiple dwellings and extending the termination date of the moratorium to September 15, 1979. 'The ordinance would continue the existing moratorium requirement under Ordinance No. 1670 -- that all cooperative multiple dwellings proposed to be constructed first receive a Conditional Use Permit unless an approved tentative or tentative parcel has been obtained; it also prohibits the conversion of existing multiple dwellings into cooperative multiple dwellings, The provision would terminate September 15, 1979 -- and may be extended an additional eight months after a public hearing is held. 1685 Mayor Margett declared the hearing open. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Saelid, seconded by Councilman Pellegrino and carried unanimously, Councilman Saelid MOVED that Council find the project will not have a significant effect on the environment and that staff be instructed to prepare the Negative Declaration with appropriate filings. Councilman Pellegrino seconded the motion which was carried on the following roll call vote: 1 AYES: NOES: ABSENT: Councilmen Parry, Pellegrino, Saelid, Margett None Councilman Gilb The reading of Urgency Ordinance No. 1680 was read in full by members of the City Council and the City Attorney, entitled: "AN URGENCY ZONING ORDINANCE OF THE CITY OF ARCADIA EXTENDING AND EXPANDING THE MORATORIUM TO PROHIBIT THE CONVERSION OF MULTIPLE DWELLINGS INTO CO- OPERATIVE MULTIPLE DWELLINGS DURING THE INTERIM PENDING THE STUDY OF ZONING PROPOSALS REGULATING THE SAME, EXTENDING THE TERMINATION DATE THEREOF TO SEPTEMBER 15, 1979, AND DECLARING THIS ORDINANCE TO BE IMMEDIATELY EFFECTIVE." AYES: NOES: ABSENT: Councilmen Parry, Pellegrino, Saelid, Margett None Councilmen Gilb Staff recommended that in order to obtain a qualified Building Inspector it is necessary to have the authority to make an appointment at the E-Step within the Building Inspector's salary range. The Personnel Rules and Regulations limit an appointment higher than the C-Step - which is 10% below the E-Step, Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 4827 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AUTHORIZING THE CITY MANAGER TO APPROVE THE APPOINTMENT OF TWO BUILDING INSPECTORS UP TO THE E STEP FOR SAID POSITIONS AND DECLARING THE IMMEDIATE NEED FOR SUCH AUTHORIZATION FOR THE PROTECTION OF THE HEALTH, SAFETY AND WELFARE OF THE COMMUNITY," It was MOVED by Councilman Saelid, seconded by Councilman Parry and carried on roll call vote as follows that the further reading of the' full text be waived and that the same be ADOPTED, AYES: NOES: ABSENT: Councilmen Parry, Pellegrino, Saelid, Margett None Councilman Gilb Communication from the Santa Anita Oaks Homeowners Association requesting the rescheduling of the June 23 meeting to discuss the traffic situation in the subject area. Perry Cope, 1231 San Carlos Road, speaking on behalf of the Association, said in part that they would like to commend the Director of Public Works on his communication to the residents setting forth three choices for solution" that the Board favored the City's recommendations to see what it could do for traffic alleviation in the area, He asked that the meeting for June 23 be rescheduled to a later date and that they be provided with the residents' names who did not respond to the communication.. that they would like to contact those persons" after which they would have a majority response to the issue. Mrs. Floretta Lauber, 1225 Oaklawn Road, said those who were present at the Council meeting of March 20 left with the understanding that the meeting would be held on June 23 - that at the March 20 meeting the situation wasn't as desperate as it is now with the gas shortage. 5-15-79 - 3 - 23:9782 That she does her residence in her area. vote because she felt the not want to be closed off fromc,ingress or egress at however she would abide by the desires of the people She was opposed to the Association taking a straw they would be partisan.. the same as she would be... vote should be taken by a neutral'party - the City, Dr, M. Stehsel, 1049 Rancho Road, felt two months should be sufficient to evaluate the situation; that he is directly effected - on the south side of Foothill Boulevard.. that the entire city should take part in the evaluation and that it should be a ballot issue. Discussion ensued and it was the consensus that a future date should be scheduled for this matter ---- and it was MOVED by Councilman Saelid, seconded by Councilman Parry and carried on roll call vote as follows that the matter be rescheduled for JUNE 27 at 7:30 p.m. and that the Association be furnished with the names of those residents who have not responded to the Director of Public Works' connnunica tion. 1 AUDIENCE PARTICIPATION Jack Hibbard, 409 W. Live Oak Avenue, expressed opposition to the proposed construction of sidewalks on the north side of Live Oak between Baldwin and EI Monte Avenues. Dr. Mark G. Strom, 34 W. Sycamore Avenue, recited numerous incidents in connection with the gas lines which form on Sycamore Avenue in drivers' endeavor to reach the service station. He read a petition from residents requesting a temporary barricade at Santa Anita and Sycamore.. they are concerned with the safety of the children as there are no sidewalks - also for the general security of their homes. William Connor, 21 W. and felt Sycamore has park there overnight. all-night parking. Sycamore Avenue, also spoke to the gas situation turned into a 24 hour parking lot as cars do He referred to the city ordinance prohibiting Mrs. Bernice Strom, 34 W. Sycamore Avenue, also submitted concerns about the situation - that Sycamore is like a commercial street now:.. also with the absence of sidewalks the children are not safe. She could not see why the cars could not be diverted north on Santa Anita. Bob Slaby, 283 W. Live Oak Avenue, spoke against sidewalks on Live Oak Avenue. The Director of Public Works explained that the design of the project is under the jurisdiction of Temple City - but felt the sidewalks on Live Oak which are to be paid for by Arcadia could be deleted if the Arcadia City Council so directed. Mrs. Richard Pedranti, 1140 Rodeo Road, spoke to the traffic problem on Sycamore and asked that the traffic go up Santa Anita; that it is a desperate situation, Felt a temporary barricade would help. Harvey Biggs, 2822 Caroline Way, opposed the Sidewalks on Live Oak - that they do not need or want the sidewalks, 1 SIDEWALK HEARING JUNES) Councilman Saelid spoke to the sidewalk project that the entire sidewalk program in the City was originated for the protection of the school children - that the School had requested the sidewalks on the north side of Live Oak -- that he would like to have the time to visit the area and MOVED to place this matter on the agenda for June 5... as a public hearing. HEARING SCHEDULED JUNE 5 TRACT NO. 36480 Final Map 23:9783 ~ Mayor Margett then addressed the situation on Sycamore Avenue and asked the Chief of Police' to respond. He stated in part that as yet they have not had trouble as outlined by the residents on Sycamore in any other part of the City - that of the intensive use of their property by those waiting in line for gas" that the tension is beginning to build, '. and asked that he be permitted to ~ontinue his present mode of ' operation - that he did not want to start confrontations at this time - that he will do everything he can to alleviate the situation on Sycamore, The City Council agreed the situation is desperate and it was the consensus that a resolution be prepared and submitted posthaste to legislators in an endeavor to focus attention on the local situation, This resolution will be acted upon at an adjourned meeting (May 16), Council received the staff report concerning the expiration of the existing contract with Los Angeles County for animal control services, It will terminate June 30, The report indicated the quality of service being rendered and recommended its renewal for the fiscal year 1979-80, It was MOVED by Councilman Pellegrino, seconded by Councilman Saelid and carried on roll call vote as follows that the City contract with Los Angeles County for animal control services for 1979-80 and that the Mayor and City Clerk be AUTHORIZED to execute the contract in form approved by the City Attorney, AYES: NOES: ABSENT: Councilmen Parry, Pellegrino, Saelid, Margett None Councilman Gilb CONSENT ITEMS Tentative map of Tract No, 37258 proposing a ten unit residential condominium at 825 S, Golden West Avenue, Council approved and filed the negative declaration and found that the project will not have a significant effect on the environment; that the tract is consistent with the General Plan and that the waste discharge would not result in a violation of the existing requirements set forth in the Water Code; that the Director of Public Works be authorized to approve the subdivision agreement, Tentative Tract Map APPROVED, Tentative map of Tract No, 37278 proposing a nine unit condominium at 855 Arcadia Avenue, Council approved and filed the negative declaration and found that the project will not have a significant effect on the environment; that the tract is consistent with the General Plan and that the waste discharge would not result in a violation of the existing requirements set forth in the Water Code; that the Director of Public Works be authorized to approve the subdivision agreement, Tentative Tract Map APPROVED, SCHEDULED a public hearing for JUNE 5 on Planning Commission Resolution No, 1100 recommending approval of zone change from R-2 to R-3 for 807-809 W.
