Father Timothy Rawle, Church of the Holy Angels Dr. Lewis H. V. May, President of the Arcadia Board of Education PRESENT: ABSENT: Councilmen Gilb, Parry, Pellegrino, Sealid, Margett None ,On MOTION by Councilman Parry, seconded by Councilman Gilb and carried unanimously the minutes of the regular meeting of July 17, 1979 were APPROVED. Councilman Sae1id abstained from voting as he was absent at that time. The 1978-79 Employees' Safety Contest between the Public Works Department, Police Department and Fire Department, concluded June 30, 1979. The results indicate a general overall improvement in safety and the elimination of accidents in all three departments. The winner this year is the Police Department with reduced accidents by 29.8% over last year. Mayor Margett and Chairman of the Personnel Board Bernard Silver, presented the award to Captain Billy Oliver who ~ccepted it on oehaii of the Police Department. The City Clerk administered the Oath of Office to William Kuyper, Planning Commission, and to Ronald D. Street, Sister City Commission Councilman Pellegrino, Council Liaison to the Planning Commission, presented credentials and welcomed Mr. Kuyper. Councilman Parry, Council Liaison to the Recreation Commission, presented credentials and welcomed Mr. Street to the official City Family. Mayor Margett presented and read the title of ORDINANCE NO. 1685 - MODIFYING AND EXTENDING THE MORATORIUM ON COOPERATIVE MULTIPLE DWELLINGS AND EXPANDING THE MORATORIUM TO INCLUDE ALL MULTIPLE DWELLINGS IN AN R-3, ZONE, AND AMONG OTHER REQUIREMENTS, REQUIRING A CONDITIONAL USE PERMIT THEREFOR DURING THE INTERIM PENDING THE STUDY OF ZONING PROPOSALS, REGULATING THE SAME AND TERMINATING MAY 15, 1980. I Staff advised that the Planning Department had been instructed to conduct a city-wide study of the adequacy of existing land use regulations and zoning to control the land use impacts and impact on the avai1a~i1ity of multiple dwelling rental units from the construction of, or the conversion of existing multiple dwellings into cooperative multiple dwellings. An urgency ordinance was adopted requiring a Conditional Use Permit for cooperative Multiple dwellings. On May 15 the Planning Commission recommended an extension to prohibit the conversions during the interim pending the .study of zoning proposals regulating the same and extending the 8-7-79 - 1 - I ! ORDINANCE NO. 1685 ADOPTED HEARING STREET CLOSING (CALIFORNIA) F' r~'7r 23:9838 termination date of the moratorium to September 15, 1979. Now in order for the department to have adequate time to complete the study it was recommended that the moratorium be extended to May 15, 1980. Mayor Margett declared the hearing open and no one desiring to be heard the hearing was CLOSED on MOTION by Councilman Saelid, seconded by Councilman Parry and carried unanimously. It was further MOVED by Councilman Saelid, seconded by Councilman Parry and carried on roll call vote as follows that the reading of the full body of Ord"nance No. 1685, making findings of fact, be waived; that the Negative Declaration be approved and filed and that same be and it is hereby ADOPTED. AYES: NOES: ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid, Margett None None 1 Request of the Arcadia Unified School District for temporary closure of a portion of California Street between Santa Anita and First Avenue. The request has since been modified and they now ask for a 200 foot long closure rather than the 300 feet originally specified. Staff advised that a Negative Declaration had been prepared and it was found that there will be no significant effect on the environment from the project. Notices of this public hearing had been mailed, published and posted. Mayor Margett declared the hearing open and the resident of 17 E. California Street, was advised that the actual blockage location would be about 260' east of the east curb of Santa Anita - or at the easterly property line of the District's rental property and there will be no blockage. Robert Marshall, 17-A California Street, asked Council to consider eliminating parking on the south side and said in part that the parking problem, expecially on week ends, is a real problem. Mr. Marshall was assured by the City Council that it does not want to create more problems and will do everything possible to improve the parking situation. Roy Sertic, 229 S. First Avenue, spoke to his problem of parking for his customers and submitted that the turnaround should be much larger. He favored the school expansion but asked for serious consideration of the businessman's plight in the area. Ed Schreiner, 57 California Street, spoke of the parking problems of his customers and expressed concern for the time when school opens, especially as to where the teachers will park. John Hillhouse, 45 California Street, felt that if the street becomes dead-end, it would depreciate property values; also he was concerned about the buses loading and unloading. Dr. Herbert Herscher, 224 S. Santa Anita Avenue, asked for limited parking between 9 a.m. and 6 p.m. Monday through Friday - perhaps for 8-7-79 - 2 - RESOLUTION NO. 4851 ADOPTED WITH MODIFICATION 1 r I ?/I ~ ~ :,-'. :" ~ ' . 23:9839 2 hour periods... he said people park there for an entire day. He also asked that California become a cul-de-sac at the east end in order for people to have adequate turn-around space. No one else desiring to be heard it was MOVED by Councilman Gilb, seconded by Councilman Saelid and carried unanimously that the hearing be closed. Councilman Gilb then presenteq and read the title of RESOLUTION NO. 4851 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA MAKING FINDINGS OF FACT, ADOPTING A NEGATIVE DECLARATION AND AUTHORIZING A ONE-YEAR CLOSURE OF 200 FEET OF CALIFORNIA STREET BETWEEN FIRST AND SANTA ANITA AVENUES AT THE REQUEST OF THE ARCADIA UNIFIED SCHOOL DISTRICT TO FACILITATE RECONSTRUCTION OF FIRST AVENUE JUNIOR HIGH SCHOOL." Considerable discussion ensued and modifications were submitted for staff to study for feasibility and report back at the next regular meeting (August 21)--to include some type of limited parking at the west end of California Street and improved turnaround area. It was then MOVED by Councilman Gilb, seconded by Councilman Saelid and carried on roll call vote as follows that Council make findings of fact, approve. and file the Negative Declaration for the project and that the reading of the full body of RESOLUTION NO. 4851 be waived and that same be ADOPTED with the added provision that the curb at the east end be painted green for the benefit of the customers of the adjacent businesses. AYES: NOES: ABSENT: Councilmen Gilb, Parry, pellegrino, Saelid, Margett None None PERSONNEL (Class Specifications) Secretary The Personnel Board recommended the approval of revised class specifications for the position of Secretary. No changes are reflected in the requirements for the position and no change will be in the salary of $1027 to $1258 per month. The specification does reflect the inclusion of knowledge and abilities which brings the specification into conformance with the approved City format. 'It /. L (A/ ...Lt- ." AUDIENCE PARTICIPATION 1 ~>~ ,,( ~,~ Paul Wood, 265 N. Alta Vista, Monrovia, spoke to his concern about the problem the Alta-Dena Dairy, at 341 E. Foothill, is experiencing with ingress and egress to the Dairy by the customers and delivery trucks. He continued in part that the business on the corner of Fifth and Foothill, next to the Dairy, is actually in the City of Monrovia with the west portion in Arcadia - but that the owner indicates it as 351 E. Foothill, Arcadia, and should be 1001 Foothill in Monrovia... that a sign in his parking lot carries a "tow away" Code section and advises to call the Arcadia police department- in violations. He noted other infractions which are not pursuant to the original plan for development of that parcel and asked the City Council to try to rectify some of his concerns. Daniel D. Sheets, 505 Coyle Avenue, Arcadia, spoke to the same matter reiterating that there isn't a 351 E. Foothill in Arcadia. He noted problems of entering and leaving the Dairy and that the owner of the Dairy has a petition with about 500 signatures asking that the opening be reinstated. He referred to the wall recently constructed between the two properties and which blocks off an exit to a dedicated alley in Monrovia which has been used for years. I.. .' CONTRACT AWARD ,r;r II Iy:'/ If f: 11- /) ;;; ,- (>_ I PROGRESS REPORT (VALENCIA) HEARING AUGUST 21 fFUND TRANSFER 23:9840 Harold Coupland, 335 E. Floral, Arcadia, was advised that it is not necessary to obtain a permit to construct a wall under 6 ft in height. Mr. Coupland said in part that the alleyway has always been open to the public - that he has been acquainted with the property in question for about 50 years. He was also concerned with the possible increase in traffic accidents due to the change. He asked if there is any law governing the use of property which has been consistently used for a driveway - isn't a right-of-way automatically created. The City Attorney advised that it is possible to establish a private drive for egress and ingress over the portion which has been used for at least 14 years - this would have to be accomplished through a private attorney. The resident at 667 Canyon Crest, Sierra Madre, said he has been using the dedicated alley in Monrovia for over six years and felt the matter is open for litigation. 1 Mr. Miller, 505 N. Magnolia, Monrovia, was advised on the information submitted to the owner of the Dairy by the City Manager concerning various procedures the owner could take. Mary ~~xford, 1332 Highland Oaks Drive, told of the problem she has of entering and exiting when she goes to the Dairy and she could not understand how the owner of the corner property could construct a wall and block the dedicated alley to Monrovia making it almost impossible for the Dairy to conduct its business. CONSENT ITEMS APPROVED the tentative map of Tract No. 37952 proposing an 18 unit Condominium at 816-818 and 9834-9836 Naomi Avenue. Approved and filed the Negative Declaration and find that the project will not have a significant effect on the environment; that the tract is consistent with the General Plan and that the waste discharge from the tract will not result in a violation of the existing requirements set forth in the Water Code and the Director of Public Works was authorized to approve the Subdivision Agreement. APPROVED the request of the Signal Maintenance Company for a rate increase. This is pursuant to a provision of the agreement which provides that the contractor may request a price escalator adjustment in writing 60 days prior to the renewal date of the contract. APPROVED the tentative map of Tract No. 37958 proposing a 7 unit condominium at 825 W. Duarte Road. Approved and filed the Negative Declaration and find that the project will not have a significant effect on the environment; that the tract is consistent with the General Plan and that the waste discharge from the tract will not result in a violation of the existing requirements set forth in the Water Code; and the Director of Public Works was authorized to approve the Subdivision Agreement. 1ft.." ~ AWARDED the contract for the 1978-79 annual street maintenance program gutter construction to the low bidder, E. C. Construction, in the amount of $52,316.25 and authorized the appropriation of $57,000 from State Gas Tax Funds to cover the cost of the project as well as engineering, inspection and contingencies; that all other bids be rejected; any informalities or irregularities in the bid and bidding process were waived and the Mayor and City Clerk were authorized to execute a contract in form approved by the City Attorney. 1 RECEIVED and filed the report concerning traffic conditions on Valencia Way and Hillcrest. SCHEDULED a public hearing for August 21 on Planning Commission recommendation concerning a General Plan change at 535-554 Las Tunas Drive. AUTHORIZED transfer of funds in the amount of $95,000 from the General Revenue Sharing Fund to the Water System Fund FY 1979-80 Budget. 8-7-79 - 4 - NEWSPAPER PUBLISHINj 1 1D. . FRIENDSHIP / CLUB ( TRIP TO TRIPOLIS 23:9841 RECEIVED Planning Commission Minute Resolution clarifying Section 9263.1.28 of the Municipal Code relating to newspaper publishing. ALL OF THE CONSENT ITEMS WERE APPROVED ON MOTION BY COUNCILMAN GILB, SECONDED BY COUNCILMAN PELLEGRINO AND CARRIED ON ROLL CALL VOTE AS FOLLOWS: AYES: NOES: ABSENT: Councilmen Gil~, Parry, Pellegrino, Saelid, Margett None None It was MOVED by Councilman Gilb, seconded by Councilman Parry and carried on roll call vote as follows that Planning Commission Resolution No. 1104 granting a conditional use permit to the Church of the Good Shepherd and expanding the church parking lot at 400 w. Duarte Road be APPROVED. AYES: NOES: ABSTAIN: ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid None Mayor Margett, due to his business affiliation None Council received the staff report concerning the need for traffic signals at Duarte Road and Lovell Avenue. The study included traffic volumes, accident experience and progressive movement potential. Staff recommended that installation of traffic signals at this intersection be held in abeyance pending evaluation of the effectiveness of the recently installed left turn lanes and parking prohibition. Councilman Saelid would like to have a long range traffic control plan for the entire area, including plans for this particular signalization so that Council can know what the impact will be and it can then be ascertained whether or not to include or delete it. Council received the communication from the Arcadia Friendship Club advising that it is planning a tour to the Sister City, Tripolis, Greece, in May 1980. Some discussion held on the itinerary with Councilman Gilb submitting some of his experience in this regard. Mrs. Edith Casey, President of the Club, said they are still making changes. RESOLUTION Mayor Margett presented and read the title of RESOLUTION NO. 4848 NO. 4848 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA c ADOPTED IL": >MAKING FINDINGS OF FACT, ADOPTING A CATEGORICAL EXEMPTION AND t.,)J) U ORDERING THE INSTALLATION OF TEMPORARY TRAFF IC CONTROL DEVICES AT f: 5-:- VARIOUS INTERSECTIONS IN THE SANTA ANITA OAKS AREA." It was MOVED by Councilman Saelid, seconded by Councilman Pellegrino and carried on roll call vote as follows that the reading of the full body of Resolution No. 4848 be waived and that same be adopted. 1 r: CLAIM : REJECTED AYES: NOES: ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid, Margett None None On recommendation of the claims adjuster and the City Attorney the claim of LeRoy Keller for unspecified damages was REJECTED on MOTION by Councilman Parry, seconded by Councilman Pellegrino and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Gilb, Parry, Pellegrino, Saelid, Margett None None 8-7-79 - 5 - SAELID PARRY EXECUTIVE SESSION RECONVENE ADJOURNMENT 23:9842 Expressed concern at the property damage caused by fireworks on July 4 and felt some reasonable answer should be pursued. Was advised that the Superintendent of Parks and Recreation is handling details for the dedication of the new athletic p1ayfie1d adjacent to the Civic Center. No definite date as yet. At 9:50 p.m. Council entered an executive session on pending litigation and personnel matters. At 10:30 p.m. Council reconvened and ADJOURNED to 5 p.m. August 21, 1979 in memory of Bernard Gosper, former Alderman of Newcastle, Australia, Sister City to Arcadia. Councilman Gilb related how Newcastle came to be a Sister City and the tremendous part played in it by Mr. Gosper who actually initiated the program in Newcastle.
