CITY COUNCIL OF THE CITY OF ARCADIA
REGUlAR MEETING
AUGUST 21, 1979
The City Council of the City of Arcadia, California met in
regular session on Tuesday, August 21, 1979 at 7:30 p.m.
in the Council Chamber of the Arcadia City Hall,

On MOTION by Councilman Parry, seconded by Councilman Gilb and
carried unanimously Councilman Saelid was excused.
On MOTION by Councilman Parry, seconded by Councilman Gilb and
carried unanimously the minutes of the adjourned and regular
meetings of August 7 were APPROVED.
APPEAL to the denial by the Planning Commission of an application
for a change in the General Plan from Single-Family Residential and
Commercial to Multiple-Family Residential at 536-554 W. Las Tunas
Drive. The appeal was filed by George Wiegand, dba Fairhaven
Development Corporation. The Cpmmission felt tha~ the change would
result in spot zoning for the site, the possible rezoning to R-2
or R-3 zone would be inconsistent with the surrounding land use and
zoning and also that a change would be detrimental to the public
health and welfare and injurious to the property or improvements
in the area, The application was denied on a 4-0 vote with two
Commissioners absent.
Mayor Margett, declared the hearing open and Jerry Wilson, 733 Kline
Street, La Jolla, owner of commercial property at the southeast corner
of Las Tunas and Baldwin, said in part that in his opinion the
Planning Commission denial was based on sound and proper study; such
a General Plan change is unnecessary and the present zoning is a far
more efficient use of the 'land. He asked the Council to consider the
impact the existing restaurant adjacent to the proposed site would
have On residents of a condominium at this location, what with its
normal parking of cars, patrons coming and going at night, etc. He
continued that neighborhood shopping is needed now with the cost
of gasoline. He urged denial of the appeal.
No one else desiring to be heard the hearing was CLOSED On MOTION by
Councilman Gilb, seconded by Councilman Pellegrino and carried
unanimously.
The City Council concurred with Councilman Gilb in his observation
that they have all been supplied with pertinent data and they are
well aware of what the Planning Commission considered and that all
its reaSOnS are a matter of record -- that the City Council has the
power to overrule the Commission but it does not have the right to
do that unless it is not proper and in this particular case he

Staff was directed to initiate proceedings for the rezoning of
536 W. Las Tunas Drive from R-3 & P to R-l with a Parking Overlay.
Request of Mr. and Mrs. James C. Poon for a variance to permit an
existing fence, which is lower than the requirement, to remain at
730 Katherine Lane. The code requires a fence surrounding a
swimming pool to be a minimum height of four feet (48 inches). The
existing fence is 44 inches in height. The violation occurred due
to the topography of the lot, The Public Works and Planning
Departments recommended approval and felt the variance would provide
for adequate public safety.

Mayor Margett declared the hearing open and no one desiring to be
heard the hearing was CLOSED on MOTION by Councilman Pellegrino,
seconded by Councilman Parry and carried unanimously. It was MOVED
by Councilman Gilb, seconded by Councilman Parry and carried on
roll call vote as follows that the request be APPROVED.

Beth Thomas, 506 S, 5th Avenue, MOnrovia, asked if the public works
equipment could take another route when going north from the city
yard. She said the noise and the additional traffic it brings is
disturbing to the neighborhood. The Director of Public Works
explained the need for his equipment to take this particular route.
Mrs. Thomas asked Council to see if anything could be done in this
regard.
CONSENT ITEMS
APPROVED the recommendation of the Personnel Board for class
specifications for a new position of Fire Crewmember. '
APPROVED the recommendations of the Recreation and Parks Commission
for the basic outfitting of the concession stand at the multi-purpose
playfield at a cost not to exceed $6000. Items would include hot
water heater, counter top, storage space, three stainless steel
sinks, garbage disposal, refrigerator and all necessary plumbing -
$6,000 was authorized for appropriation from the Parks and Recreation
Facilities Fund.

APPROVED a Conditional Use Permit for church expansion at 725 and 805
N. First Avenue, subject to conditions specified in Resolution
No. 1106 of the Planning Commission.
APPROVED the map and dedication of the right to prohibit the con-
struction of more than four residential units within Lot 1 at
53 California Street. This is necessary for the owner to file his
final parcel map.
RECEIVED the report concerning traffic signal master plan co-ordination
at Duarte-Lovell intersection. Priorities were set forth in the
report with the first to be signals on Baldwin between Camino Real
and Colorado, the second and third are tentative and could be

interchanged to accommodate unforeseen changes in traffic flow. The
modification for interfacing with the computer for Baldwin Avenue
signals is anticipated for 1980~81 fiscal year.
APPROVED the recommendation that Foothill Boulevard between Santa
Anita and Michi11inda be converted pursuant to the report dated
August 21 and AUTHORIZED an appropriation of $3000 from Capital
Improvement Project Account for street light improvements and
utility undergrounding. This will cover the cost of converting
the 15 City-owned lights on Foothill.
APPROVED the purchase of two Ford Courier trucks at $5,886.67 each
and one Ford Fairmont sedan at $5,294.70 from Huntington Ford,
Arcadia. Total of $17,068.04. Funds are in the Federal Revenue
Sharing Program Account for 1979-80. Also the purchase of two
Ford LTD sedans at $6,890 each from Fou1ger Ford Monrovia, and one
1979 LTD station wagon in the amount of $7,331,99 from Huntington
Ford, Arcadia - Total of $21,111,99. Funds are in the Equipment
Replacement Fund for 1979-80,

Council received the report on the California Street turn around
da led August 21 indicating that on the west end of the closure an
existing driveway permits a 900 turn as shown on one of the drawings
attached to the report.. if a driver backs up to the opposite curb
he could complete his turn without difficulty, Traffic at this
end will be relatively light since there are only two residences
and a doctor's office at the corner. At the east end an existing
65 foot wide driveway apron permits a V-turn as shown on another
drawing. This may be accomplished with cars parked at the north
curb. Staff recommended that any additional parking restrictions
be delayed until the departments can verify the need for such controls.
Some discussion held on the possibility of persons parking at the
west end for hours and the pu~lic works and police departments will
monitor that section in an effort to prohibit this.
It was MOVED by Councilman Gi1b, seconded by Councilman Parry and
carried on roll call vote as follows that staff recommendation set
forth in its August 21 report be APPROVED.

Staff advised that the contractor, Steiny and Company, has completed
the Huntington Drive traffic signal project; that the system is now
on-line, It was MOVED by Councilman Parry, seconded by Councilman
Pellegrino and carried on roll call vote as follows that the work
be ACCEPTED and that final payment be made pursuant to the terms
of the contract.

SELECT SYSTEM STREETS."

On MOTION by Councilman Gi1b, seconded by Councilman Pellegrino the
claim of David John Cavalieri in the amount of $574.22 be APPROVED
for payment. It was noted for the record by Councilman Gi1b that
the body shop estimate for the work to be done on the vehicle was
$722.91 which included extra work to the car and rental of a
vehicle. ,. the actual cost of the accident was $574.22.

Public Hearing scheduled for 5 p.m, October 2, 1979 on the
Republic Development Company and American Savings.
The Assistant to the City Manager will represent the City on the
Board of Realtors during discussions on HUD Affirmative Marketing
Agreement. Council will be apprised of the content of the meeting.
Some discussion held on the status of the barricades placed at a
strategic point in the Santa Anita Oaks area --- primarily as it
affects traffic on San Carlos Road. It was felt by the City Council
that the signs are confusing which Councilman Parry indicated was
his main reason for concetn.. During this consideration P rry Cope,
1231 San Carlos Road, recited some of the incidents the area has
experienced during the first week of the barricades and felt that
the residents have pursued this for almost three years., that now
there is a temporary solution and if it doesn't work he would hope
there will be another solution, In response to a question he said
he has noticed a slight reduction in the amount of traffic.

At 8:50 p.m, Council entered an executive session to discuss
pending litigation.
At 9:30 p.m. and on MOTION by Councilman Gilb the meeting ADJOURNED
to 7 p.m. September 4, 1979 in memory of Russell Gehring, Fire
Engineer for the City for 28 years, Mr. Gehring passed away August 18
and is survived by his wife Catherine, two sons, Steve and Todd and
one daughter, Debbie. Motion seconded Counc' n Parry and carried.
