CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETING
SEPTEMBER 4, 1979
The City Council of the City of Arcadia, California met in
regular session on Tuesday, September 4, 1979 at 7:30 p.m.
in the Council Chamber of the Arcadia City Hall.

On MOTION by Councilman Parry, seconded by Councilman Gilb and
carried unanimously Mayor Margett was excused.
Mayor Pro Tempore Pellegrino presented to retiring Police Sgt. Eric
A. Akerlind, Jr., a plaque in appreciation of his 23 years of
dedicated service to the City.
The City Clerk administered the oath of office to Claude C. Hoard,
new appointee to the Arcadia Beautiful Commission. Councilman Gilb
presented credentials to Mr. Hoard and welcomed him to the City
Family.
On MOTION by Councilman Parry, seconded by Councilman Gilb and
carried the minutes of the adjo~rned and regular meetings of
August 21, 1979 were APPROVED. Due to his absence from said meeting
Councilman Saelid abstained from voting.
Time and place scheduled for consideration of a grant application
for operating assistance funds under the Urban Mass Transportation
Act of 1964 as amended for fiscal year 1978-79. The Assistant City
Manager explained that the consultants, Wilbur Smith and Associates,
prepared an application for $40,000 for the dial-a-ride operation.
The project is in conformance with comprehensive land use and
transportation planning in the area and will take into consideration
the special needs of the elderly and handicapped.
Mayor Pro Tempore Pellegrino declared the hearing open and no one
desiring to be heard the hearing was CLOSED on MOTION by Councilman
Gilb, seconded by Councilman Parry and carried unanimously.
The City Attorney then presented, explained the content and read the
title of Resolution No, 4856, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA AUTHORIZING THE ASSISTANT CITY

MANAGER TO FILE WITH THE DEPARTMENT OF TRANSPORTATION, URBAN MASS
TRANSIT ADMINISTRATION, A GRANT APPLICATION FOR OPERATING ASSISTANCE
FUNDS UNDER THE URBAN MASS TRANSIT ACT OF 1964 AS AMENDED FOR
FY-1978-79."

CONSENT ITEMS
APPROVED the tentative map of Tract No. 34453, 9-unit residential
condominium at 1006 Arcadia Avenue, APPROVED and FILED the Negative
Declaration and found that the project will not have a significant
effect on the environment; that the tract is consistent with the
General Plan; that the waste discharge would not result in a
yiolation of the existing requirements set forth in the Water Code
and AUTHORIZED the Director of Public Works to approve the sub-
division agreement.

APPROVED the tentative map of Tract No. 35704, 18-unit residential
condominium at 924-928 Arcadia Avenue; APPROVED and FILED the
Negative Declaration and found that the project will not have a
significant effect on the environment; that it is consistent with the
General Plan; that the waste discharge will not result in a violation
of the existing requirements of the Water Code and AUTHORIZED the
Director of Public Works to approve the subdivision agreement.
APPROVED the tentative map of Tract No, 37965, 10-unit residential
condominium at 45-51 and 53 Alice Street; APPROVED and FILED the
Negative Declaration and found that the project will not have a
significant effect on the environment; that it is consistent with
the General Plan and the waste discharge will not result in a
violation of the existing requirements of the Water Code and
AUTHORIZED the Director of Public Works to approve the subdivision
agreemen t.
APPROVED the tentative map of Tract No. 37981, 15-unit residential
condominium at 735 Arcadia Avenue; APPROVED and FILED the Negative
Declaration and found that the project will not have a significant
effect on the environment; that it is consistent with the General
Plan; that the waste discharge ,will not result in a violation of the
existing requirements of the Water Code and AUTHORIZED the Director
of Public Works to approve the subdivision agreement.
APPROVED the granting of a conditional use permit by the Planning
Commission to construct classrooms at the Barnhart School at 226 W.
Colorado Boulevard (Res, No. 1107).
APPROVED the granting of a zone variance by the Planning Commission
for the construction of a single family dwelling on a site with an
existing dwelling at 1109 S. First Avenue, Upon completion of the
new dwelling the existing dwelling will be converted to a guest
house (Res, No. 1108).

GRANTED modification for tentative Parcel Map 7834 allowing a lot
width of 65 feet in lieu of the 75 feet required at 306 N. Fourth
and 305 N. Fifth Avenue; accepted the dedications and AUTHORIZED
the Director of Public Works to approve the subdivision agreement.
AUTHORIZED the adoption of a resolution approving amendment No. 2
to the County Solid Waste Management Plan (See Page 5).
APPROVED plans and specifications and authorized the call for bids
in connection with the modification of traffic signals at Baldwin
Avenue and Duarte Road. This project, upon completion, will provide
four-way left turn phasing and is designed to fit into the com-
puterized progressive system when Baldwin Avenue signals are
interfaced with the Multisonics Computer.

bids fOr a 12-inch fire protection waterline for the Civic Center
area.
APPROVED the purchase of one 4-wheel lawn mower for the Department
of Public Works from C. R. Jaeschke, Inc, in the amount of $6,444.80.
Funds are in the Capital Projects Fund 79-80.
APPROVED the purchase of communication equipment ($2,800) and office
files ($1,000) for the Police Department pursuant to report dated
August 29. Federal Revenue Sharing Funds 79-80.
APPROVED the purchase of two each 40 watt UHF Radio Repe\ters for
the Police Department from Aerotron, Inc" at a total cost of
$4,969.04. Federal Revenue Sharing Funds 79-80.
APPROVED the purchase of roadway chip seal material from Industrial
Asphalt Company in the amount of $11,700 plus tax for emulsified
asphalt and from Owl Rock Products in the amount of $2,435 for gravel;
that any informalities or irregularities in the bids or bidding
process be waived and that purchase orders be so issued; APPROPRIATED
$18,000 from Capital Improvement Funds to pay the cost plus any
unforeseen contingencies.

SECONDED BY COUNCILMAN SAELID AND CARRIED ON ROLL CALL VOTE AS

Pursuant to a request of the City Council staff prepared and submitted
a report concerning on-street parking on Fairview Avenue and other
streets in the West Arcadia area. The report indicated the number
of vehicles parked on the various streets between 8 a.m. and 10 a.m.
on August 28 and 29 - also between 5 a.m. and 6 a.m. on August 31.
Staff recommended that observations be continued to determine any
changes in parking space occupancy and react to specific needs if
and when they occur rather than to attempt an area wide program of
painting parking stalls at this time inasmuch as it would be time
consuming as well as expensive and unjustified in view of the parking
volumes indicated.
Councilman Gilb MOVED to accept the report and FILE same.

Staff recommended an appropriation to provide traffic control during
the forthcoming Oak Tree racing meet .' the amount to include Workers
Compensation costs. A $2000 emergency reserve has also been included
to cover any additional staffing necessitated by special promotions
by Oak Tree during the meet. It was MOVED by Councilman Saelid,
seconded by Councilman Gilb and carried on roll call vote as follows
that $32,408 be APPROPRIATED to provide this control.

The owner-operator of the Alta-Dena Dairy, Suresh Patel, submitted
a communication to the City requesting a cost, estimate for the
construction of a ramp on his property at 341 E. Foothill Boulevard.

This would be to provide vehicular access to an alley which runs
west from his property to Valencia Way. Staff report indicated it
would cost approximately $2,100 which would also include the
construction of an 8-inch curb on the south side of the alley which
would separate the alley from an adjacent private parking lot,
Conditions of such construction'were set forth in the report dated
September 4. Staff also recommended that inasmuch as the alley is
only 15 feet wide that one-way traffic operation westbound from the
Dairy property to Valencia Way be authorized,
Although Mr Patel had requested this matter be placed on the agenda
for this meeting he was not present, Mayor Pellegrino asked if
anyone in the audience desired to speak to the subject and Art
Zygielbaum, 1138 Valencia Way, said in part he recognized that
Mr, Patel has a problem but he was opposed to the proposed solution
and felt it would only increase traffic on Valencia which has
reduced since the installation of traffic signs, He suggested
leaving the alley which existed prior to the construction of a wall
which closed off that passageway from the Dairy.

Fran Scholtz, 1211 Valencia Way, expressed concern that a child will
be injured or killed on Valencia Way if the exit to Valencia Way is
approved.
Daniel Arredondo, 1110 Valencia Way, felt the proposed solution
would endanger the lives of those living in the immediate area and
because he is adjacent to the subject property he felt his property
value would be effected.
It was the consensus of the City Council that further discussion be
held on this matter and that the owner-operator be present for the
discussions, It was then MOVED by Councilman Gilb, seconded by
Councilman Parry and carried on roll call vote as follows that this
matter be placed on the September 18 agenda; that adjacent property
owners be notified along with those indicated on the communication
from Mr. Patel who will be notified by registered return receipt
mail.

In order to provide more flexibility in the selection of the Senior
Citizen Commissioners it was MOVED by Councilman Saelid, seconded
by Councilman Parry and carried on roll call vote as follows that
the By-Laws be amended to reflect the following:
One member shall be selected from the Arcadia Assistance League as
they recommend,
One member shall be selected from each of the following Arcadia
Senior Citizen organizations: Golden Age Club and Senior Friendship
Club.

Four members at large who mayor may not be members of the above
organizations.

Councilman Gilb MOVED to adjourn the me~ting in memory of
Mrs. Esther L, Butterworth who passed away August 30, stating
'~S. BUTTERWORTH received greetings from President and Mrs. Carter
on the occasion of her 99th birthday on July 27. She is the
mother of Edward L. Butterworth of Arcadia, former Mayor and
Counci lman.

She was born in Fort Scott, Kansas on July 27, 1880 which was just
four years after the first Centennial of the United States and she
lived to see the second Centennial pass by, Her life has covered
one-half of this public span,
Mrs. Butterworth lived at the Royal Oaks Manor in Duarte, a
Presbyterian retirement home. Because of the delicate condition
of her health at the time of her 99th birthday there was only a
quiet family celebration,

Rutherford B. Hayes was President of the United States when she
was born, Bismark ~as Chancellor of Germany and Queen Victoria
still had almost a quarter of a century to reign as Queen of England
and Empress of India.
She was born Esther Livingston in Fort Scott, Kansas. She still
recalled as a girl crawling u~derneath the bed with her mother when
the cowboys on the cattle trail would come into town and shoot
everything in sight, She moved to Whittier in 1900 and was
organizer and first President of the South Whittier Woman's Club.
The funeral was held last Saturday. She is survived by her daughter
Cecilia Ross of Beverly Hills, her son Edward and seven grandchildren."
