REGULAR MEETING
AUGUST 17, 1976
The City Council of the City of Arcadia, met in regular session on
Tuesday, August 17, 1976 at 7:30 p.m. in the Council Chamber of the
Arcadia City Hall.

On MOTION by Councilman Gilb, seconded by Councilman Margett and
carried unanimously Councilman Saelid was excused.
On MOTION by Councilman Margett, seconded by Councilman Gilb and
carried unanimously the Minutes of the Regular Meeting of August 3
were APPROVED.
Mayor Lauber presented City Attorney J. William Phillips with a Plaque
in appreciation of his efforts and accomplishments during his tenure
with the City. Mr. Phillip 'is returning to Kentucky to take up
private practice.
In order to consider Agenda Item 4a the prov1s10ns of the Procedural
Ordinance were WAIVED on MOTION by Councilman Gilb, seconded by
Councilman Margett and carried unanimously.
Pursuant to the request of Council staff reviewed the possibility of
reducing the property tax rate and submitted a report covering the
property tax rates for the Street Lighting District's five zones and
recommended a reduction in that area. The General City tax rate
position was set forth in a comprehensive report dated August 11. The
City Manager noted that the largest increases in the current budget
(1976-77) are for salaries, Worker's Compensation and Public Employee's
Retirement System; that 3 1/2 positions have been eliminated as has
Social Security coverage effective in the next fiscal year. He
calculates an approximate $251,000 surplus. This takes into con-
sideration the revenue from the increased assessed valuations. Staff
recommended a 6<:: reduction in the tax rate.
Mayor Lauber advised that the meeting would open up for public input
and the following residents spoke to the ever increasing tax burden on
the property owner and all asked Council to make every effort to
reduce the tax rate more than has been recommended and that perhaps
some of the expenditures could be reduced or eliminated in order to
accomplish a reduction in taxes.

All members of Council concurred with the expressed concerns and
invited all who could to attend the next County Board of Supervisor's
meeting in order to urge that body to reconsider its budget and to
reduce its tax rate.
Individual positions were submitted by the Council members and it was
the consensus that it would like to reduce the tax rate as much as
possible and this had also been the position of Councilman Saelid as
set forth .in his connnunication to Council. Reference was made to the
provisions of the City Charter, Section.1209- Tax Limits, which the
City Attorney explained in detail.
It was then MOVED by Councilman Gilb, seconded by Councilman Parry
and carried on roll call vote as follows that an ll~ reduction in the
City tax rate be fixed - this would reduce the tax rate to 83~ per
$100 assessed valuation.

Whereupon the City Attorney presented, explained the content and read
the title of Ordinance No. 1573, entitled: "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ARCADIA FIXING THE RATES OF TAXES AND LEVYING
TAXES FOR THE FISCAL YEAR 1976-1977."
It was MOVED by Councilman Gilb, seconded by Councilman Parry and
carried on roll call vote as follows that the reading of the full text
be waived and that the same be ADOPTED.

The City Attorney then presented, explained the content and read the
title of Resolution No. 4572 entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, STRONGLY URGING THE LOS
ANGELES COUNTY BOARD OF SUPERVISORS TO REDUCE THE RATES OF TAXES
OVER WHICH IT HAS CONTROL."
It was MOVED by Councilman Gilb, seconded by Councilman Parry and
carried on roll call vote as follows that the reading of the full text
be waived and that the same be ADOPTED.

Th~ Resolution requests the Board of Supervisors to effect an innnediate
and substantial reduction in the tax rate of all County Taxing Districts
and of the General Fund of the County. Council will also ask the Board 1
of Supervisors to place or continue a freeze on labor for at least two
years. It is the intention of Council to personally deliver these
requests to the Board on a date to be determined.
In order for Council to go on record in support of individual legis-
lation the following motion was adopted and will be directed to State
Legislators.

carried on roll call vote as follows that the State Constitution be
amended to permit separate assessment of residential and business
properties; to increase the homeowner's exemption' from property taxes;
to" increase' the Senior' Citizen's Tax Assistance Program and extend it
to rentals and low income citizens ' and that a study be made in connection

with the possible removal of education and welfare from property taxes.
Further, that State authorize additional sources of revenue for cities
such as tippler's tax, a percent of the state income tax in the form of
general revenue sharing or others so local governments may reduce the
burden on property taxpayers.

At the conclusion of the discussion and action on the reduction of the
tax rate, Councilman Gilb stated for the benefit of those in the
audience that the City is really blessed with its calibre of employees
and their dedication to help the citizens. He was joined in this
commendation by all members of Council.
The Political Reform Act of 1974 requires that all jurisdictions adopt
and promulgate a Conflict of Interest Code. The deadline for submitting
the proposed Code to the Fair Political Practices Commission is September
10, 1976. This matter requires a public hearing. Mayor Lauber declared
the hearing open and no one desiring to be heard the hearing was CLOSED
on MOTION by Councilman Gilb, seconded by Councilman Parry and carried
unanimously.
The City Attorney then presented, explained the content and read the
title of Resolution No. 4566, entitled: "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA ADOPTING A CONFLICT OF INTEREST CODE
APPLICABLE TO THE MEMBERS OF THE CITY COUNCIL PURSUANT TO THE
POLITICAL REFORM ACT OF 1974."

carried on roll call vote as follows that the reading of the full text
be waived and that the same be ADOPTED.

The Planning Commission recommended the granting of a conditional use
permit for a church day care center and related church facilities at
121 Alice Street (Arcadia Presbyterian Church). Conditions were set
forth in the staff report and Resolution No. 945. It was noted that
the Church seeks relief from one of the conditions concerning the con-
struction of sidewalks on Alice Street including a handicap ramp as
there are no plans for the northwest corner of First and Alice at this
time and it is not part of the new parking area. Councilman Gilb,
Council Liaison to the Commission, felt there would be no problem in
this request and that the only concern from residents in the area was
the parking lot which he felt the Church would endeavor to control
when it is not in use for church purposes.
It was then MOVED by Councilman Gilb, seconded by Councilman Parry and
carried on roll call vote as follows that the Conditional Use Permit
be approved and that Item 15 in Section 3 of Resolution No. 945 be
deleted.

for an eating establishment at 400 S. Baldwin Avenue (Fashion Park)
subject to conditions set forth in its Resolution No. 946. 'The Pizza
Parlor will have booths for 12 and will provide take-out business also.

The Planning Commission recommended the approval of a conditional use
permit to continue the operation of the riding stables and a residence
at 11723 Clark Street. Conditions set forth in Resolution No. 947 were
reviewed and particular attention was given to Condition 2 of Section 3
concerning the payment of the cost of water main installation which has 1
been outstanding for some time and is in the amount of $2,692.95. The
present condition of the building and grounds was also a matter of some
concern and it was agreed that the situation should be corrected within
three months or the conditional use permit would expire. The payment
of the delinquent charge to be made within six months.
It was MOVED by Councilman Gilb, seconded by Councilman Parry and
carried on roll call vote as follows that the conditional use permit be
granted subject to full compliance with all conditions specified in
Resolution No. 947 and that if 'same are not complied with"in 90 cays
this conditional use permit shall automatically expire. NOTE: Payment
of the delinquent charge shall be made within six months from this date.

The Planning Department shall inform the parties involved of this
Council action.
The public hearing on Planning Commission recommendation concerning a
text amendment relating to parking standards for the commercial and
industrial zones (Resolution No. 948) was scheduled for SEPTEMBER 7,
1976.
Council received the recommendation of the Planning Commission for denial
of a Text Amendment which would permit expansion of certain nDnconforming
uses in the R-3 zone as set forth in its Resolution No. 949. This was
brought about by the request of Charles Chila for a text amendment
which would allow him to make structural improvements to a single family
dwelling located in an R-3 zone and on a lot containing more than two
other units. The Commission felt such an amendment would encourage
investment in nonconforming uses and structures which would only prolong
substandard conditions in the R-3 zone. It was noted that any type of
maintenance is allowed, such as painting, refurbishing, reroofing, but
no structural additions.
The Planning Director'explained that it was suggested that this type of
request be made through the conditional use permit process so that at
the time an application is made the situation could be evaluated from
every aspect.

Councilman Parry expressed empathy for the applicant and felt there
should be some way of encouraging the upkeep of properties in these
situations while at the same time encouraging proper development in an
R-3 zone... he could not see why, because a person owns more than one
unit in an R-3 zone, he would be more likely to allow one of the two
units to deteriorate any more than the person "owning just one unit.

Irvin Livingston, 1927 Highland Oaks Drive, referred to a communication
from the Highlands Homeowners' Association concerning a situation at
Wilderness Park. He asked Council to examine the operating policy of
the Park.. that it was originally established as a wilderness area but
is being used now for other events for which there are other Parks within
the City which are more suitable. It was the consensus of Council that
a complete study and report be made and submitted to Council for tne'^--'
September 21 regular meeting. . ".......-
Frank Van Dongen, 25 LeRoy, owner and operator of the Fresh Fish Market
at Santa Anita and Live Oak and Las Tunas, and President of the South
Arcadia Businessmens' Association spoke of the confusion encountere~ by
customers in locating the business area due to the converging of Las
Tunas with Live Oak. He asked for some assistance. The Director of
Public Works will confer with Mr. Van Dongen to ascertain what may be
done to the directional sign to more accurately indicate his location.
Tom Simmers, President of the local Chamber of Commerce, commended
Council on the action it took concerning the tax rate.
On MOTION by Councilman Gilb, seconded by Councilman Margett and carried
unanimously Council received and ordered FILED the staff report on
emergency call boxes on Freeways. This was at the request of Councilman
Gilb who expressed appreciation for the report.
On MOTION by Councilman Parry, seconded by Councilman Margett and
carried on roll call vote as follows $1,785.71 was AUTHORIZED for
inclusion in the current budget and appropriated from the General
Contingency Account for the City's share of the local hard match for
the West San Gabriel Juvenile Diversion Project:

Counc~lman Margett commended the Department of Public Works and in
particular the person who performed the work in the refacing of the
various entrance monuments.

In response to an inquiry the Director of Public Works explained the
frontage road separations are treated like normal rights-of-way where
the property owners landscape and maintain them. This had reference
in particular to Colorado Boulevard near Harvard Drive.
The Director of Public Works reported on the progress being made on the
identification sign for the Police Building. Also on the signs calling
'/ attention to drivers on Huntington Drive where the street is one-way.
It is hoped these can be improved.
Some discussion held on the Code Section concerning fencing of
swimming pools.

4 p.m. in the Council Chamber for the purpose of taking up the
Metropolitan Water District Resolution whereby the City elects to pay
50 percent of the 1976-77 taxes levied upon property with the City
by MWD.
