REGULAR MEETING
MARCH 15, 1977
The City Council of the City of Arcadia, met in regular session on
Tuesday, March 15, 1977 at 7:30 p.m. in the Council Chamber of the
Arcadia City Hall.

The City Clerk administered the Oath of Office to Mrs. Shirley K.
Butterworth who has been appointed to the Library Board. This will
fill the vacancy created by the resignation of Rev. James W.
Hagelganz whose term would have expired June 30, 1977.
Mrs. Claire Arth, on behalf of the Arcadia Freindship Club and the
Sister City Commission presented Council with a check for $340.39.
This represents the unused portion of funds received to cover expenses
incurred during the recent visit to the City of a contingent from
Newcastle, South Wales, Austr:alia (Arcadia',s Sister City). Mrs. Arth
advised that with the assistance of the citizens the visit was a
tremendous success.
Pursuant to the City Charter the City Manager submitted a proposed
Five-Year Capital Improvement Program. The required Notice of Public
Hearing had been published along with a Summary. Mayor Lauber
announced that Council had held extensive deliberations and it was now
time to receive input from the public. The Hearing was declared open.
Dennis Loieski, Chairman of the Parking Place Commission, spoke to the
parking situation in the downtown area and to meetings with the area
businessmen relating thereto. Reference was made to an amount of
$75,000 in the Capital Improvement Program for Community Development
Land Assembly in 1977-78 and Mr. Lojeske asked Council to consider
allocating the full $75,000 or a portion thereof to improve the
parking situation.
Herb Fletcher, 175 W. Lemon Avenue, expressed objection to some of the
items and referred in particular to an item in the 1980-81 program for
a fire main and also to replacement of fire hydrants...he felt Council
could have gotten the funds under a Federal program and submitted he
would like to know in advance of items proposed for the future. He
referred to the Arcadia Unified School District tax which he said is
third highest out of 42 County school districts.
No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Margett, seconded by Councilman Gilb and carried unanimously.
Captain Jack Molden, completed his e~lanation of Police Department items.

long range plan for full utilization of the park facilities for all

Planning Commission Resolution No. 978 recommending an extension of
Urgency Ordinance No. l582 (Hillside Development Moratorium) to December
21, 1977. Mayor Lauber declared the hearing open and Charles Lester,
1223 Oakglen, spoke in favor of the recommendation which would provide
adequate time for full consideration of a comprehensive set of hillside
planning and land use regulations. No one else desiring to be heard
the hearing was CLOSED on MOTION by Councilman Parry, seconded by
Councilman Saelid and carried unanimously.
Whereupon the City Attorney presented, explained the content and read
the title of Ordinance No. 1587, entitled: "AN ORDINANCE OF THE CITY
OF ARCADIA EXTENDING THE MORATORIUM ON DEVELOPMENT OF HILLSIDE AREAS,
ADOPTING ZONING REGULATIONS FOR HILl.SIDE AREAS REQUIRING A LAND USE

Appeal filed by J. W. Lorenzini from the decision of the Planning
Commission in granting a conditional use permit to operate a general
auto repair garage and towing service at 149-153 LaPorte Street.
Mr. Lorenzini set forth his reasons for filing this appeal in com-
munications on file in the office, of the City Clerk. The Planning
Director explained in part that two lots are to be consolidated and
one lot will be improved for parking. ,this to be accomplished by
December 21, 1977,

Mayor Lauber declared the hearing open and Orlando DePietro stated in
part that he has endeavored to meet all requirements and that as soon
as possible 153 La Porte will be demolished and he will proceed with
the parking lot improvements...that as far as room for storage is
concerned he is now negotiating with the City to lease 230 N, Second
Avenue for storage. If this property should not be available after a
period of, for instance, three months, he would then store the vehicles
at 315 E. Huntington Drive. As far as the trucks being on the street
he said he has been parking them on the street for very short periods
of time - 1/2 hour at the most - then they are gone five or six hours.
He said he has not received any complaints from the neighbors as to
parking on the street.
Dr. Rudolph Liska, 148 La Porte Street, said in part that in his
opinion it is an inappropriate place for a towing service but he would
not oppose it. He submitted a noise problem emanating from a shop on
LaPorte that races motorcycles up and down the street after closing
hours. He felt the subject business will only add to the present
confusion and disarray on La~orte. Dr. Liska suggested granting a
temporary permit until the operation can be evaluated.
Geraldine Campbell, 142 La Porte, said she is there 24 hours each day
and did not feel the noise to be a nuisance..that if cars are parked on
La Porte they are cited. She did not think the subject business would
be a problem.
John Lorenzini, owner of 200 E. Colorado, reiterated reasons for
appealing the decision of the Commission and submitted parkirg situations
which he has seen on specific dates and questioned what it would be like
with the proposed operation. The plight of Mr. DePietro was explained
to Mr. Lorenzini. The efforts of the City to alleviate the parking
problems were submitted by Council. The uses permitted under M-l zoning
were explained and the subject use is permissible. The possibility of
constructing some type of wall at the rear of Mr. Lorenzini's property I
was explored.. this would preclude the visual impact of the cars parked
on the towing property. It was noted that if the operator of the
business does not abide by the conditions the use permit can be revoked.
No one else desiring to be heard the, hearing was CLOSED on MOTION by
Councilman Gilb, seconded by Councilman Parry and carried unanimously.
It was then MOVED by Councilman Gilb, seconded by Councilman Margett
and carried on roll call vote as follows that the appeal be denied and
that a conditional use permit be issued to Mr. DePietro subject to all
conditions set forth in Resolution No. 977 with an added condition
requiring the construction of some type of landscaping or some other
type of screening at the rear of the property subject to the approval
of the Planning Department.

It was then MOVED by Councilman Gilb, seconded by Councilman Margett
and carried on roll call vote that the city property at 230 N. Second
Avenue be leased to Orlando DePietro and Becherer Buick for a period
of three months at $200 per month and that the Mayor and City Clerk be
authorized to execute the Lease Agreement in form approved by the City
Attorney; that any further use of the property after the three month
period must be approved by the City Council.

A public hearing was scheduled for April 19 on the Appeal filed by
William Cracknell from the decision of the Planning Commission in the
denial of a lot split, a variance and modification at 1220 Highland
Oaks Drive.
The Planning Commission by Resolution No, 979 granted a conditional use
permit for a Kentucky Fried Chicken drive-through eating establishment
at 841 S. Baldwin Avenue. It was MOVED by Councilman Gilb, seconded
by Councilman Parry and carried unanimously that the conditional use
permit be approved subject to all conditions set forth in said
resolution.
The Planning Commission recommended approval of the tentative map of
Tract No. 33429 (14 unit condominium at 1002 W, Huntington Drive). It
was MOVED by Councilman Saelid, seconded by Councilman Parry and
carried unanimously that the Negative Declaration be approved and
filed; that Council finds the project will not have a significant
effect on the environment and that the tentative map be APPROVED
subject to all specified conditions.
The Planning Commission recolmnended approval of the tentative map of
Tract No. 33430 (6 unit condominium at 503 W. Duarte Road). It was
MOVED by Councilman Margett, seconded by Councilman Gilb and carried
unanimously that the Negative Declaration be approved and filed; that
Council finds the project will not have a significant effect on the
environment and that the tentative map be APPROVED subject to all
specified conditions.

AUDIENCE 7TIClPATION
Mrs. Johanna Hofer, 875 Monte Verde Drive, was advised on items which
were deleted from the proposed Five-Year Capital Improvement Program.
She referred to a recent High School event where the need for an
auditorium was most apparent. She hoped Council was thinking in terms
of revamping the race track tax, also the license fees for parking at
the track.

On MOTION by Councilman Gilb, seconded by Councilman Margett and
carried unanimously the report on traffic signals at Foothill Boulevard
at Dexter and Old Ranch Road was received and TABLED.
Council received the information that the Acapulco Restaurant, 226 N.
First Avenue, has merged with and into Acapulco y Los Arcos
Restaurantes. Inasmuch as the merger involves a portion of city-owned
land across the street from the restaurant and used for parking by the
restaurant, it was MOVED by Councilman Saelid, seconded by Councilman
Parry and carried on roll call vote as follows that an Assignment of
Lease and Assumption of Obligations, in form approved by the City
Attorney, be executed by the Mayor and City Clerk.

Staff will look into problems created by so-called teenager parties in
the community at which sometimes as many as 400 persons attend.
Councilman Margett recited one recent occurrence.
In order to give Council a tool with which to work in the event a
proposal presents itself it was MOVED by Councilman Saelid, seconded
by Councilman Gilb and carried on roll call vote as follows that
staff prepare an amendment to the zoning ordinance which would
establish an R-O (22,000 sq. ft.) zone.

Referred to a communication from the Health Systems Agency which
indicates the need for citizen participation through registration as
members of a sub-area Council of Los Angeles County. Anyone desiring
to become a member must apply in person before March 31 at one of the
area meetings or at headquarters. The City Manager advised that the
names of the Council members had already been submitted but he would
secure additional information.
Referred to a recent article in the Government Executive Magazine
concerning zero-based budgeting and suggested it be reviewed by
Council and staff.

Agreed with the Planning Director in his recommendation concerning
agenda and minute distribution of the Planning Commission.
Referred to the condition of the restrooms at the Tierra Verde Park
(Second and Camino Real). Vandalism has taken its toll and it was
suggested that the building be boarded up for the time being. Some
discussion held on whether or not to construct restrooms in the parks
under construction. Other types of restrooms will be explored by
staff with a report back. It was MOVED by Councilman Gilb, seconded
by Councilman Saelid and carried unanimously that the Tierra Verde Park
restrooms be boarded up until some remedy can be implemented,
Brought up the many vacant store buildings on Baldwin Avenue and felt
the City should be endeavoring to bring business into that area as well 1
as the downtown redevelopment area. The Economic Coordinator stated in
part that it is a matter of time and priorities and advised on what
has been done and what he is hoping to accomplish in the West Arcadia
area.. he will continue to assist in securing tenants for Baldwin Avenue.
Was advised by the City Manager that there will be sufficient parking
available after the construction of the proposed soccer field on the
parking lot north of City Hall.
Reminded Council members of the breakfast meeting with the Library
Board on March 22. Also the invitation from the National Guard to
Visit Fort Irwin April 16 to observe exercises. The trip will be made
Ln a new jet propelled helicopter.
At 11:15 p.m. Council entered an executive session. Reconvened at
11:30 p.m, and adjourned to March 21 at 4:30 p.m.
