REGULAR MEETING
'APRIL 5, 1977
The City Council of the City of Arcadia, met in'regular session on
Tuesday, April 5, 1977 at 7:30 p.m. in the Council Chamber of the
Arcadia City Hall.

On MOTION by Councilman Margett, seconded by Councilman Gilb,and
carried unanimously the minutes of the regular meeting of March 1 and
15 and the adjourned regular meeting of March 9 were APPROVED. On
MOTION by Co~ncilman Margett, seconded by Councilman Saelid and carried
unanimously the minutes of the adjourned regular meeting of March 21
were APPROVED. Mayor Lauber abstained as she was absent from this
meeting.
Mrs. Barbara Regan, Historian, Bicentennial Commission, presented to
the City Council an album containing memorabilia of all events during
the Bicentennial Year (1976). This will be in the City Library. Mayor
Lauber accepted the album with deep appreciation for the time and
effort put into compiling this historical record and presented Mrs,
Regan with a Certificate of Condemnation on behalf of the City Council.
On behalf of the City Council Mayor Lauber presented Paul Gayno.r
(age 18) with a Certificate of Commendation for his successful efforts
in saving the life of Mrs. Fred White when food became lodged in her
throat.
The Planning Commission granted a conditional use permit to Carl's Jr.,
for the addition of a drive-thru window to its existing eating
establishment at 165 E. Duarte Road (Resolution No. 981). Conditions
of approval were set forth in the resolution. It was MOVED by Councilman
Saelid, seconded by Councilman Parry and carried on roll call vote as
follows that the conditional use permit be approved subject to all
specified conditions.

Planning Commission Resolution No. 982 recommending certain amendments
to the Open 'Space and Conservation Element, Public Safety Element,
Land Use Designations on the General Plan map and Implementation Section
of the General Plan relating to Hillside Development. Council
scheduled a public hearing for APRIL 19.
On recommendation of staff it was MOVED by Councilman Gilb, seconded
by Councilman Parry and carried unanimously that the final map of
Tract No. 32076 (condominium at 630-60 Naomi Avenue) be APPROVED.

Walter Goins, 2329 S. Third Avenue, spoke concerning his many efforts
in,endeavoring to obtain permission for his 13 year old daughter to
play Pinto Pony League baseball. He submitted this is sex discrimination
and that girls are permitted to play elsewhere. During the deliberations
it was submitted by Council that this is basically not a Council matter
however it may be necessary in the future to provide additional facili-
ties for this activity inasmuch as so many of the youth desire to
participate. It was the consensus of Council that any discrimination
of this nature should be called to the attention of the League
of ficials.
Council received a petition from a majority of the 65 property owners I
in the North Gardens area (Santa Rosa Road, Santa Cruz Road and San
Luis Rey Road, north of Colorado Blvd.) requesting increased water
pressure. The petition stated they have had problems for a long period
of time. Staff had submitted two alternate plans for Council consider-
ation. Under Alternate A the City would make the necessary water
system changes which would increase the pressure to about 95 psi. Each
resident would be required to install a pressure reducing and pressure
relief valve on his internal plumbing. Costs therefor were also
indicated. Alternate B would call for the City to install the central
stations to serve the entire Gardens area (295 residences), The
residents would not be required to install any valves, but the water
pressure would only be raised by 20 psi so the pressure in the south area
of the Gardens'would not exceed 80 psi. Costs therefor'were also set
forth in the staff report dated March 17,

During the deliberations the City Manager spoke to the financing and the
Water Manager responded to, questions concerning the alternates and the
telemetry system to which modifications would have to be made if
Alternate B were decided upon. Council agreed the situation is intoler-
able and favored Alternate B if funds were available. Staff will
prepare and submit at the April 19 meeting a report with alternate
sources of funds and priority list of projects utilizing water funds
and capital, improvement funds.
In connection with the improvement of Baldwin Avenue between Camino
Real and Las Tunas the Flood Control District proposes to construct a
storm drain on that roadway between Naomi Avenue and Palm Drive. The
District has now awarded the contract to K.E.C. Company. This company
has requested permission to establish a temporary construction yard
site on vacant property southerly of the southwest co~ner of Camino
Real and Baldwin Avenue. It was MOVED by Councilman Saelid, seconded
by Councilman Gilb'and carried on'roll call vote as follows that the
request be granted subject to conditions stipulated in the staff report
of April 1 and that the site be returned to its initial condition prior
to vacating the premises.

Council received a Program of Federal Aid Urban System Projects -
Agreement 35 - Supplement No. 3 - in connection with the reconstruction
and median landscaping of Las Tqnas between Baldwin and Live Oak,and
the reconstruction of Baldwin Avenue between Camino Real and Las Tunas
Drive. In'connection therewith the following resolution was adopted.
The City Attorney presented, explained the content and read the title
of Resolution No. 4619, entitled: "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA APPROVING SUPPLEMENT NO. 3 TO AGREEMENT NO. 35
(BALDWIN AVENUE RECONSTRUCTION, JOB NO. 455), PROGRAM OF LOCAL,AGENCY
FEDERAL,AID URBAN SYSTEM PROJECTS, AND AUTHORIZING THE MAYOR AND CITY
CLERK TO SIGN SUCH SUPPLEMENT."

Because no specific appropriation had been made by Council in connection
with the preparation of a topographical survey which was required in the
development of preliminary engineering plans for a parking plan in the
downtown area it was MOVED by Councilman Parry, seconded by Councilman
Gilb'and carried on roll call vote as follows that $750 be appropriated
from Parking Fund 32-321 for payment to Wilsey & Ham consulting
engineers for this project,

The request of Robert and Phyllis Walker for three year extensions of their
loans on property at 113-115 E, Wheeler Avenue was received by Council.
Staff reported on the balances due (Lot 4 - $14,840 due April 18, 1977
and Lots 5, 6, 7 - $17,225.97 due June 15, 1977) and recommended a one
year extension which would give the property owners additional time to
seek a user for the site and would not bind the City to a substantial
commitment. If,after a period of one year, the owner requires
additional time Council can'evaluate another request. It was also
recommended that the interest rate be adjusted from 7% to 8% per annum
on the unpaid principal balance. A condition was added for Council
consideration - that the owners agree to the use of their property and
vacated Indiana Street as a temporary downtown parking lot during the
construction of the parking facilities in the area. It,was MOVED by
Councilman Gilb, seconded by Councilman Saelid and carried on roll call
vote as follows that an extension of one year be granted at 8% per
annum,on the unpaid principal; that the land, if still vacant, be utilized
for parking during the period of construction of the new parking
facilities for the downtown area and that a covenant therefor, in form
approved by the City Attorney, be executed.

On MOTION by Councilman Gilb, seconded by Councilman Parry and carried
unanimously a dance permit was approved for the Turf Club, 1037 S.
Baldwin Avenue, subject to all regulations applicable for any dance
permit. These permits are reviewed annually.
The agenda item concerning communication equipment for the police
department was withdrawn.

In order to comply with the prov1s10ns of the Alquist-Priolo Geologic
Hazards Zone Act the City must retain the services of a State registered
geologist to review and make recommendations on geologic studies sub-
mitted by applicants. The Planning Department has completed its
selection process and recommends the firm of Converse, Davis, Dixon and
Associates. The Planning Director explained the Special Studies Zone
Act and Helen Hauser, local realtor, said in part that it will be the
responsibility of a property owner to apprise the buyer of his property
of the existence of an earthquake fault. It was MOVED by Councilman
Parry, seconded by Councilman Margett and carried on roll call, vote as
follows that the City Manager be authorized to execute the Agreement
with said firm except that the last four conditions in the schedule of
fees and conditions be deleted, (This latter on recommendation of the
City Attorney.)

On recommendation of staff it was MOVED by Councilman Saelid, seconded
by Councilman Parry and carried on roll call vote as follows that Section
6429,3.2 of the Arcadia Municipal Code be amended to provide for a
license fee of $5.00 for each driver's permit and that the City be
reimbursed by the applicant for the current charge made by the State
Department of Justice for the processing of fingerprints. The staff
report indicated that the present $2.00 license fee does not cover the
administrative costs in handling the application by the License Office
and the Police Department. Also the current fee charged by the State
Department of Justice to process the fingerprints is $5.75 per person.

On advice from staff that Allbrite Electric, Inc., has substantially
completed the Huntington Drive Street Lighting System Job No. 448 it
was MOVED by Councilman Margett, seconded by Councilman Saelid and

final payment be authorized pursuant to the terms of the contract.

Staff advised that as of the first of the year the prov1s10ns of the
Healt~ and Safety Code of the State was amended which enforces the
existing requirement that City and County governments make an express
finding for local modifications to the uniform housing standards and
be filed with the State Department of Housing and Community Development. I
Whereupon the following ordinances were introduced setting a public
hearing for May 3, 1977.

Dr. William Stark, 17 Perkins Drive, requested permission to remove a
Eucylptus tree located in the parkway in front of his residence, He
stated in part that the tree is a detriment to the scheme of his
planned landscaping and is damaging his driveway. He felt that although
City policy forbids such removal he felt it infringes on his rights as
a homeowner to beautify his residence and to upgrade its value. He also
said he would assume the cost of removal of the tree and stump which
has been estimated to be about $400.
Staff had submitted a report indicating the scope of City policy and
submitted conditions should Council grant the request, It was the
consensus of Council that this case is different from most requests
where a property owner just wants a tree removed..that Mr. Stark is
desirous of improving his property and will replace the tree with
another which would have a narrower root system and deep tap root and
would not interfere with any growth or masonry work.
It was MOVED by Councilman Gilb, seconded by Councilman Saelid and
carried on roll call vote as follows that Mr. Stark be permitted to
have the tree removed subject to the following conditions as outlined
by the City Manager:
1. Total cost and liability of the tree removal to be at the
expense of the owner.
2.
A tree or trees of the variety in the Master Street Plan be
planted in the cleared area on the basis of at least one per
40 feet depending upon the variety and the location of
driveways and utilities; the exact number to be determined by
the Public Works Department.

The City Manager advised that the supply of water conservation kits was
about depleted and that the response to the communication concerning

Asked about the time for 'lights off' at the Tierra Verde Park tennis
courts and whether or not they could be angled so as not to shine in
adjacent residences. Staff will check this. It was the consensus of
Council that 9 p.m. be set for lights out which'would still provide
half an hour for the participants to finish their games and gather up
their gear. It was MOVED by Councilman Gilb that 9 p.m. be set for
lights out at this particular park. Motion seconded by Councilman
Parry and carried unanimously. (Staff to report back.)
Submitted for Council consideration revisions to the procedure for
appointing Board and Commission members and also the number of members
on the various boards and/or commissions.
Noted the times he has encountered drivers going the wrong way on
Huntington Drive. Staff submitted that it is hoped with the recon-
struction of the enter and exit driveways at the Hospital this will be
lessened.
Referred to new State Legislation concerning bingo being extended to
accommodate Senior Citizens and other Organizations. The City Attorney
responded to this and added that Mobile Homes will also be included.
Reminded Council and staff of the forthcoming Prayer Breakfast to be held
Good Friday at 7 a.m.
Reported on the recent Sister City Trip to Mexico and the hospitality
rendered the visiting contingent.
Council entered an executive session at 10:30 p.m.
Council reconvened at 11:30 p.m. and adjourned immediately thereafter
to April 19, 1977 at 7 p.m. in the Conference Room.
