AUGUST 2, 1977
The City Council of the City of Arcadia, met in regular session on
Tuesday, August 2, 1977 at 7:30 p.m. in the Council Chamber of the
Arcadia City Hall.

On MOTION by Councilman Gilb, seconded by Councilman Margett and
carried unanimously Council Members Lauber and Parry were excused.
On MOTION by Council Member Margett, seconded by Council Member Gilb
and carried unanimously the minutes of the regular meeting of July 19,
1977 were APPROVED.
The application of the Foothill Jewish Center Men's Club for a permit
to conduct bingo games was continued to August 16 to permit the time
necessary for the applicant to obtain the necessary documents from the
Franchise Tax Board. Mayor Saelid declared the hearing open and
Mrs. Johanna Hofer, 875 Monte Verde Drive, Arcadia, stated in part
that she was neither for nor against Bingo but.... she would like to
see if the residents want Bingo in the City and suggested placing the
matter on the ballot at the next General Municipal election in 1978.
She also would like to see the City keep an accounting of what it
costs the City to administer and control the games. She also referred
to the considerations being given this matter by the City of Los
Angeles. Mayor Saelid commented in part that the City has adopted an
enabling ordinance consistent with the earlier State legislation,
however, the State has recently passed emergency legislation expanding
Bingo and Council will be looking into that very soon.
Time and place scheduled to hear objections to charges for the 1976-77
weed abatement program. Council received the list of locations and
Mayor Saelid declared the hearing open and Jim Dyer, representative
of the Los Angeles County Agricultural Commissioner, answered questions
along with Fire Chief Gardner. One location referred to by Council
Member Gilb will be checked out by the Fire Chief. Mrs. Johanna Hofer,
875 Monte Verde Drive, explored the very dry situation in parts of
California and other States and suggested that Council adopt some
measure whereby the weeds could be removed at once instead of having
to go through the lengthy procedures; that the water is too precious
to have to use it on unnecessary fires. No one else desiring to be
heard the hearing was CLOSED on MOTION by Councilman Gilb, seconded
by Councilman Margett and carried unanimously.
Councilman Gilb then MOVED to CONFIRM the list of charges and that the
Los Angeles County Auditor be instructed to enter the amounts of the

The City Council was advised that all legal requirements have been
complied with in connection with submitting Urban Mass Transportation
Administration applications for capital and operating assistance. This
included the notice of this public hearing with affidavits of such
publication on file in the office of the City Clerk. The proposed I
applications have been in said office for public inspection and no
objections have been received. The assistance applied for is for
capital assistance in the purchase of a transit van equipped with a
wheel chair lift and for operating assistance in the Dial-a-ride
program for 1976-77.
Mayor Saelid declared the hearing open and Mrs. Johanna Hofer, 875
Monte Verde Drive, questioned how much the wheel chair would be used.
Councilman Gilb commented that if it were used only once it would be
worth it. Mrs. Hofer continued in part that what is needed in her
opinion is a mini-bus-type service which could be used by everyone
and would not cost as much as the present Dial-a-ride system and
that the matter before Council is mass transportation and neither of
the proposed applications are that. She was not in favor of the
Dial-a-ride program and felt it was only a subsidy for the taxi company.
Mayor Saelid stated in part that all alternatives had been considered
by Council prior to going to the Dial-a-ride system which they found
to be the most reasonable alternative - the fixed route systems did
not prove out in the neighboring communities where they were tried.
The subsidy would probably work out to be much greater and the service
much less.
Mrs. Hofer then referred to a representative from County Supervisor
Ward's office who on July 19 spoke to Council concerning mass trans-
portation needs. She felt Council could have afforded him more time
to discuss the subject. Mayor Saelid said in part that unfortunately
the gentleman had chosen a meeting with a very lengthy agenda and
that Mrs. Hofer should feel free to discuss mass transportation with
that party and he agreed with the objective of finding out the need
before a project is embarked upon.
No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Margett, seconded by Councilman Gilb and carried unanimously.
The City Attorney then presented, explained the content and read the
title of Resolution No. 4636, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AUTHORIZING THE CITY MANAGER
TO FILE AN APPLICATION WITH THE DEPARTMENT OF TRANSPORTATION, UNITED I
STATES OF AMERICA, FOR A GRANT UNDER THE URBAN MASS TRANSPORTATION ACT
OF 1964, AS AMENDED FOR REIMBURSEMENT TO THE CITY OF ARCADIA OF UP TO
50% OF THE ELIGIBLE DIAL-A-RIDE SERVICES OPERATING COSTS INCURRED DURING
FISCAL YEAR 1976-1977 AND FOR AN 80% SUBSIDY FOR PURCHASE OF A TRANSIT
VAN EQUIPPED WITH A WHEEL CHAIR LIFT."

Planning Commission Resolution No. 994 recommending a zone change
from PR-3, C-2 D and PR-2 to PR-3, and from PR-2 to C-2 for 200 sq. ft.
located in the northwest corner of the property adjacent to Baldwin
Avenue, for 850 S. Baldwin and 653 W. Fairview. The Commission
determined that this proposed change would provide uniform zoning
within the subject area and the public convenience, necessity and
general welfare justify same. The Department prepared an initial
environmental quality act study which did not disclose any substantial
or potentially substantial adverse change in any of the physical
conditions within the affected area.
Mayor Saelid declared the hearing open and no one desiring to be heard
the hearing was CLOSED on MOTION by Councilman Margett, seconded by
Councilman Gilb and carried unanimously. Whereupon it was MOVED by
Councilman Gilb, seconded by Councilman Margett and carried on roll
call vote as follows that Council approve and file the Negative
Declaration; find that the project will not have a significant effect
on the environment; that the City Council hereby approves the zone
change and the City Attorney be directed to prepare the appropriate
ordinance.

The Santa Anita Church requested a variance from the Building Code to
allow a 20' x 521 modular structure to be used as classrooms at its
church location, 226 W. Colorado Boulevard. This would be for a
period of three years. Plans, calculations and tie-down information
has been supplied as requested by the Building and Safety Department
and the Department of Public Works. Staff recommended a variance be
granted subject to conditions set forth in its report dated July 26.
Mayor Saelid declared the hearing open. Frank Brent, representing
the Church, stated he understood and had no objections to any of the
specified conditions. No one else desiring to be heard the hearing
was CLOSED on MOTION by Councilman Gilb, seconded by Councilman
Margett and carried unanimously. It was further MOVED by -Councilman
Gilb, seconded by Councilman Margett and carried on roll call vote as
follows that the variance be granted subject to compliance with all
conditions.

Prior to proceeding with this public hearing Mayor Saelid read a
motion which Council had passed at a study session on July 27 -
"It was MOVED by Council Member Lauber, seconded by Council Member

ordinance be TABLED and that Council's policy be one of more rigid

c. - In_;t~O/Joseph O'Cello, 1015 S. Alta Vista, Arcadia, referred to a recent rock
j~----'--- party on his street which was broken up very quickly by the police
department when it was reported that an admission was being charged.
He noted other parties with the noise, parking problems, etc., which
are connected with such events. He was encouraged that steps are being
taken to help the situation and agreed there are existing laws to take
care of most of the problems.

disappointed that her remarks concerning this matter a few meetings
past were not included in the official minutes. She hoped by studying

the matter for a few months the matter could be worked out. She
suggested a fine procedure which would have a great impact on the
parents as well as the juveniles.
T~rrence Bennett, 30 N. Raymond, Pasadena, speaking as a private
attorney and a volunteer for the American Civil Liberties Union,
stated in part that he felt the decision to table the ordinance was
a good one and that the existing ordinances are sufficient combined
with police enforcement.
No one else desiring to be heard the hearing was CLOSED on MOTION
by Councilman Gilb, seconded by Councilman Margett and carried unani-
mously. The approach adopted by Council will be pursued for the
time being.

A public hearing was scheduled for August 16 on the appeal filed by
Dt. Ben Mirman from the decision of the Planning Commission in its
approval of a conditional use permit to allow a skateboard facility
at 131-137 E. Live Oak Avenue.
Planning Commission recommendation for approval of the tentative map
of Tract No. 33724 and a variance which would create a 7 lot subdivision
at 1212-1218 S. First Avenue. An initial study on the environment
d~termined the project would not have any substantial or potential
adverse change in any of the physical conditions within the subject
area hence a Negative Declaration had been prepared. It was MOVED by
Councilman Gilb, seconded by Councilman Margett and carried unani-
mously that Council approve and file the Negative Declaration, find
that the project will not have a significant effect on the environment;
that the tentative tract map be approved which is consistent with the
G~neral Plan, and that the waste discharge from the tract would not
result in a violation of the existing requirements set forth in the
Water Code and further that the Director of Public Works be authorized
to execute the Subdivision Agreement.
Thomas Ma'thews, 1021-25 S. 6th Av., spoke to a problem he has encountered
Wnen enoeavoring to apply to the Planning Department for a lot split
due to the fact that the lots would be substandard. He drew attention
to the size of the lots contained in the tract just approved by Council
Some of which would be substandard. Council advised that everyone has
the right to apply and to have the Planning Commission consider and
act upon the application which decision may be appealed to the City
Council if the applicant so desires.

Irene Burkner, President of the local League of Women Voters, recommended
that the City Council endeavor to achieve a balance on the City B~ards
and/or Commission with respect to sex, age, race and geographical "area
and referred to State law which obliges such appointments. Mrs. Burknerl
was advised on the number of women serving on the local boards and/or
commissions and she said she was primarily referring to the Planning
and Recreation Commissions on which there will be vacancies this year.
Mayor Saelid said he personally is more concerned in securing persons
with the necessary qualifications than basing such appointments on
the sex, age, etc. of a person.
Mrs. Edi Barker, North Hollywood, spoke to a claim she had filed with
the City for damages incurred when her recreational vehicle was
damaged by a limb from a tree. She had not received any communication
advising her of the status of her claim other than what the City's
insurance carrier had told her - that the claim was recommended for
rejection. She was advised by the City Attorney that as yet her claim
had not been rejected by the City and that it will appear on the agenda
for Council action on August 16.

Mrs. Johanna Hofer, 875 Monte Verde, spoke to the many fires throughout
the State and suggested the City not accept an offer to purchase the '
City's ladder truck (which was touched upon briefly in the adjourned
regular meeting earlier this evening). She felt the City should keep
all of its equipment as it may be needed. She also suggested that a
change be made in the architectural restrictions so that shake
composition roofs could be used..these are more fire resistant. Mayor
Saelid advised that the City would not be disposing of the ladder truck
until there was a replacement.
Herb Fletcher, 175 W. Lemon Avenue suggested that Council look into
the possibility of some of the sales tax from the sale of automobiles
which are sold outside of the city coming to the City of the buyer
and not the City of the dealer. He felt this could be sizable. He
also suggested Council reconsider the zoning of high-rise for property
east of Santa Anita between Huntington Dr. and Ouarte Road and noted
the lack of development in that area.
Council received the report on the bids received for the construction
of Newcastle Park (143 W. Cclorado Blvd.). The Director of Public Works
explained an error in the low bid submitted by E. C. Constru~tion
Company. This was set forth in detail in the report dated August 2.
This project will be from capital improvement funds which will be
reimbursed by State - 90% upon completion of the project and the final
10% to be paid after the State audit of the project accounts. Staff
recommended the bid for Schedule I be accepted in the amount of
$266,240, $299,000 to be appropriated from Capital Improvement Program.
However, because only two Council members will be eligible to vote,as
Councilman Margett will abstain due to his business affiliation with
the proposed awardee, the matter will be carried over to August 16.
During the interim staff will look at the type of lighting of the
tennis courts at Arroyo Park adjacent to the Pasadena Freeway.
Council received the result of bids received and recommendation for
award of contract for the street lighting program of San Luis Rey
Road and other lighting improvements. It was noted that modification
of the First Avenue system will be financed from Gas Tax Funds and
safety lighting at various locations from Capital Improvement Project
Funds. Lighting on San Luis Rey Road will be financed partly by
property owner contributions after completion of the work and the
balance from City funds.
It was MOVED by Councilman Margett, seconded by Councilman Gilb and
carried on roll call vote as follows that the low bid of Paul Gardner
in the amount of $50,478 be accepted; that all other bids b~ rejected;
that any informalities or irregularities in the bids or bidding process
be waived and that the Mayor and City Clerk be authorized to execute
the contract in form approved by the City Attorney.

Bids on the replacement of a 12 inch water main in Huntington Drive
from Second to Fifth were received. However, on recommendation of the
City Manager it was MOVED by Councilman Gilb, seconded by Councilman
Margett and carried on roll call vote as follows that all bids be
rejected. It was explained that the bids appear high and inasmuch as
the subject area will probably be relinquished by State within a year
it may be possible to receive bids more in keeping with the projected

the southwest corner of Foothill Boulevard and Baldwin Avenue as a
temporary construction yard site subject to conditions set forth in
staff report dated August 2 be approved. (This is in connection with
the Foothill Boulevard Improvement Project.)
The Economic Coordinator advised that an initial study had been prepared
for the downtown parking improvement finding that the improvement project
would not have a significant adverse effect on the environment. Based
on this finding a Negative Declaration had been prepared - all in
conformance with the requirements of the State Environmental Quality
Act. As required a notice of this preparation had been published and
copies were posted in City Hall and recorded. Whereupon it was MOVED
by Councilman Gilb, seconded by Councilman Margett and carried unani-
mously that the Negative Declaration be approved and that Council finds
the project will not have a significant adverse effect on the environ-
ment.

On recommendation of the City Manager it was MOVED by Councilman Gilb,
seconded by Councilman Margett and carried on roll call vote as follows
that the maintenance equipment for the City Garage which is included
in the 1977-78 Capital Improvement Budget be purchased - included are
two propane conversion kits to convert two Street Division vehicles
to propane. Amount to be appropriated from the Capital Outlay Fund
is $8,245; and that additional furniture, drapery and shelving necessary
for the refurbishing of the new Recreation Department in the amount of
$2,850 be appropriated from Capital Outlay Fund.

The City Attorney advised on new State legislation expanding Bingo.
Staff will review the new legislation and make recommendations for
those organizations to be included in the local ordinance.

any amount over $50 (license fee) to the Knights of Columbus in
connection with its Bingo license.

The City Attorney will prepare a resolution supporting Los Angeles
in its endeavor to secure the Olympic Games for 1984 in that City.
No action taken at this time pending decision of the Chamber of
Commerce.
The Director of Public Works advised on the progress of the improvement
of Baldwin Avenue. Also the Foothill Boulevard improvement.
At 10 p.m. Council entered an executive-session.
