NOVEMBER 1, 1977
The City Council of the City of Arcadia, met in regular session on
Tuesday, November 1, 1977 at 7:30 p.m. in the Council Chamber of the
Arcadia City Hall.

On behalf of the City Council, Council Member Lauber, Liaison to the
Recreation Commission, presented to Gary Ezzo a plaque of appreciation
for his efforts and accomplishments during his tenure as a member and
Chairman of the Recreation Commission.
On behalf of the City Council, Council Member Gilb, Liaison to the
Sister City Commission, presented Myree Gudus a plaque of appreciation
for her many efforts and accomplishments while a member of the Sister
City Commission.
The City Clerk administered the Oath of Office to newly appointed
Sister City Commission Member Mary Fran Anderegg and Parking Place
Commissioner D. Kirby Lesh. These terms will expire June 30, 1981.
On behalf of the City Council, Council Member Lauber presented to
members of the Foothill Hollywood Bowl Volunteer Committee (Bernice
Harris, Frances Going, Phyllis Thompson and Marguerite Towsley)
Certificates of Commendation for their dedication to the community
in serving on this Committee which for many years has made the events
so successful.
The following is a joint hearing with the Arcadia Redevelopment Agency
and roll call of the Agency Members was made part of the record.

Planning Commission Resolution 995 approving a land use permit t9
develop industrial buildings at 124 N. Second Avenue. The Planning
Director explained that this hearing has been continued several times
since August 16 and at the October 4 Council pre-regular meeting the
communication from Howard Bong asking the City Council to consider
the land use permit on the basis of a plan submitted in March 1977
even though the possible extension of Third Avenue had not been
determined, was not received until 7 p.m. A telegram was received
this date (November 1) from Mr. Bong asking that Council act in
accordance with his letter of October 4.
It was noted in detail that the applicant is applying for the land use
permit pursuant to the provisions of ordinances which imposed a
building moratorium on the area in ~hich the property is located.
This process allows for development providing specific general conditions
exist. The Commission in its recommendation for approval, specified
conditions of approval and these were outlined in Resolution No. 995

and read by the Planning Director. Reference Was made to the
provisions of a suggested land trade to which Mr. Bong has not
responded as of this date. It WaS the consensus of Council that the
telegram would indicate a rejection of this land trade offer.
Mayor Saelid declared the hearing open and no one desiring to be heard
the hearing waS CLOSED on MOTION by Council Member Lauber, seconded
by Council Member Gilb and carried unanimously. It was MOVED by
Council Member Gilb, seconded by Council Member Parry and carried
unanimously that Council reserve its action until the regular meeting
of November 15.
Appeal filed by the appellants from the decision of the Planning
Commission for denial of a request for R-3 at 645 Naomi Avenue and I
for PR-3 at 645-671 Naomi Avenue (north side of the street). The
Planning Director gave a chronological history of the zoning of this
area and noted that the CommisJioners who voted to deny the request
felt there were commercial and' parking uses to the north, eas't
and west of the subject properties; that there WaS a shortage of parking
for the existing commercial uses; that the subject area would not be
appropriate for development consistent with R-3 zoning classification
andthat there were substantial areas within the City already zoned
for R-3 uses. Those Commissioners voting to approve the request felt
that ample time has passed for the adjacent commercial and office
development to acquire the property for parking and felt it unfair to
the owners of the property involved to hold their property for some
future use. However, the Commission by its Resolution No. 1008,
denied the request which was subsequently appealed by the applicants.
It was noted that the existing inconsistencies between zoning and the
General Plan should be corrected by amending the General Plan and it
was recommended that this matter be continued for several months in
order for these procedures to be carried out. Council indicated its
concurrence with this.
Mayor Saelid declared the hearing open and Leland C. Dolley, Law Firm
of Burke, Williams and Sorensen, representing the property owners!
appellants in this matter, stated in part that the suggestion meets
with favor and urged Council in this regard. The opportunity to meet
with the Planning Department would be appreciated.
Dave Paradis, Manager of the local Chamber of Commerce, advised that
at the last Chamber of Commerce Board of Directors' meeting, this
matter was discussed and it was the consensus that the business
sections of the City do suffer from a lack of parking space. A vote
was taken for denial of this zone change request. However, with the
Council decision to continue the matter until after a study has been
made of the area met with approval and he submitted that the chamber
would like to have input in the study.
Oscar Kraft, 1145 Sano Court, explained his endeavor to purchase all
of the properties in question - two are in escrow at this time - and
he could understand and agree with the action to study the area but
to extend it until March would impose a hardship and hoped the matter I
could be considered at an earlier date.
It was MOVED by Council Member Lauber, seconded by Council Member Marge aD
carried on roll call vote as follows that the public hearing be
CONTINUED and that staff be directed to initiate a study of this area
with report back by March 7 or earlier if possible. (THIS HEARING
REMAINS OPEN).

The Economic Development Coordinator submitted an outline for the
procedure to be followed in this public hearing, however, he advised
that only one bid had been received for the construction of the

one bid be rejected and that authorization be given to readvertise for
bids, Mayor Saelid advised that Council has agreed to consider this
in a study session in order to review the physical configuration of
the project; that perhaps no changes will be made and the project may
go to another bid. Council Member Gilb submitted that something must
be done to enlarge the parking area, but the amount of money seems
great for the number of parking spaces and felt that more could be
accomplished at a Study Session...that the formula for assessment should
be fair to everyone. Whereupon he MOVED that the matter be considered
in a Study Session on November 4 at 3:30 p.m. in the Council Chamber.
Motion seconded by Council Member Parry and carried unanimously.
Mayor Saelid then declared the hearing open and Andrew Krappman,
representing one of the'property owners within the District, stated
in part that he would appreciate information with respect to the
various component aspects used in determining the assessment. This
would be helpful not only to the individual property owners but to the
City Council as well. He referred to the Wilsey Ham Report made some
time ago and suggested a similar report be made available. The
Economic Coordinator will make the formula available prior to November 4.

Dennis Lojeski, Chairman of the Parking Place Commission, submitted
that the Commission has spent about seven years in study on this matter
and Mayor Saelid invited the Commission to attend the study session
and make input.
THIS HEARING REMAINS OPEN.
Council received the report on the request for a one-way alley between
Huntington Drive and Wheeler Avenue east of First Avenue. The Parking
Place Commission and the Arcadia Business Association support the one-
way operation. Council reviewed a map indicating location of the
alley and the number of properties served by the alley as well as the
public parking lots therein. Staff recoIIllIlended approval of this
change.
Mayor Saelid declared the hearing open and Bill Connelly, stated in
part that in response to a suggestion in a communication from the
Director of Public Works that he had contacted those involved and in
the main they were all in favor, however, since that contact it has
been submitted that a potential problem may be encountered by trucks
making deliveries.. also that some say they exit on Wheeler but
experience delay as they approach First Avenue which situation may be
alleviated when the post office has different locations for mail drop.
Helen Schrader, Arcadia Tribune, said she encounters great difficulty
when exiting at Wheeler and First Avenue and felt some type of signal
would be necessary at that intersection and that with respect to the
parking lot unless it is redesigned, which would necessarily remove
some of the parking spaces, there will be problems as the Spaces are
so narrow. She p,efers to exit through the alley to First Avenue
rather than by Wheeler.
The Director of Public Works will report on the parking situation.as
a whole in the subject area inasmuch as both projects are inter-
related.
Council Member Margett MOVED that the public hearing be CONTINUED to
NOVEMBER 4 at 3:30 p.m. in the Council Chamber. Motion seconded by
Council Member Gilb and carried unanimously. . (HEARING REMAINS OPEN)
Planning Commission recommendation for a text amendment concerning
noticing procedures for modification applications. This would only
change Section 9292.1.13 of the Arcadia Municipal Code relating to
the requirement to post notices. It WaS submitted that the posting
procedure does not achieve any purpose - that notices which are
posted often disappear overnight. Inclement weather can Cause the signs

make the postings waS submitted as a reason for the change recommended
by Resolution No. 1011.
Mayor Saelid declared the hearing open and no one desiring to be
heard the hearing was CLOSED on MOTION by Council Member Margett,
seconded by Council Member Gilb and carried unanimously. It was then
MOVED by Council Member Gilb, seconded by Council Member Parry and
carried on roll call vote as follows that Council approve and file
the Negative Declaration and find the project will not have a
significant effect on the environment and th~t the City Attorney
prepare the appropriate ordinance.

Planning Commission recommendation for approval of the tentative map
of Tract No. 33763 which would create a 12 lot subdivision at 624-644
W. Foothill Boulevard subject to conditions outlined in the staff
report of November 1, 1977. It was MOVED by Council Member Margett,
seconded by Council Member Parry and carried on roll call vote as
follows that the Negative Declaration be approved and filed and that
Council finds the project will not have a negative effect on the
environment; that the tract is consistent with the General Plan and
that the waste discharge would not result in a violation of the
existing requirements set forth in the Water Code and that the
Director of Public Works be authorized to approve the subdivision
agreement. TENTATIVE MAP APPROVED.

Planning Commission recommendation for approval of the tentative map
of tract No. 33924, which would create a 12 unit condominium at
1141 W. Duarte Road subject to all conditions set forth in the staff
report of November 1. It was MOVED by Council Member Margett,
seconded by Council Member Parry and carried unanimously that Council
approve and file the Negative Declaration and find that the project
will not have a significant effect on the environment; that the tract
is consistent with the General Plan and that the waste discharge
would not result in a violation of the existing requirements set
forth in the Water Code and that the Director of Public Works be
authorized to approve the subdivision agreement. TENTATIVE MAP
APPROVED.
Council received the recommendations of the Personnel Board for
revised job specifications in the Water Department. The positions
covered are: Water System Inspector, Pump Mechanic, Water Service
Representative, Water Foreman, Equipment Operator, Pumping Plant
Operator and Maintenance Worker. It was MOVED by Council Member
Gilb, seconded by Council Member Lauber and carried unanimously
that the recommendations be and they are hereby APPROVED.

The Council Audit Committee (Council Members Lauber and Parry)
recommended that Council retain the firm of Lance, Soll and Lunghard,
Public Accountants, for auditing services for the fiscal year
1977-78 at $9000, payable on a quarterly basis upon presentation of
each report and in addition the firm will prepare separate audits for
the Federal Revenue Sharing Program and the Arcadia Redevelopment
Agency at rates set forth in its submitted proposal. It was so

On recommendation of staff it was MOVED by Council Member Lauber,
seconded by Council Member Parry and carried on roll call vote as
follows that permission be granted the following to erect tents for
Christmas Tree storage between November 25 and December 25 - all
subject to conditions specified in the staff report dated October 26;
and further that the requirement for a business license fee be
WAIVED for all non-profit organizations.

Discussion ensued on operations which are conducted without first
obtaining a business license and it was MOVED by Council Member Gilb,
seconded by Council Member Parry and carried unanimously that staff
prepare a recommendation for a penalty to be imposed on those operating
without a business license.
On recommendation of staff it waS MOVED by Council Member Gilb,
seconded by Council Member Lauber and carried unanimously that the
recommendation of the Planning Commission concerning an eating
establishment at 1423 S. Baldwin Avenue be APPROVED subject to all
conditions specified in Resolution No. 1013.
An agenda item relating to Tract No. 33430 will not be considered at
this time.
Public Hearings for NOVEMBER 15 were scheduled for:
Planning Commission recommendation concerning a General Plan change
,~for Santa Clara east of Santa Anita as a Collector Street and Third
Avenue as extended north to Santa Clara. (Resolution No. 1014)
~ranning Cammission recommendation concerning a text amendment to
~establish requirements for exterior lighting in residential zones.

The City Clerk read in full the communication from Mrs. Mabel Hein,
944 Arcadia Avenue, requesting Council to consider ways of assisting
the local senior citizens with their housing needs. Mrs. Hein
submitted in part that there are many living on small fixed incomes
who cannot afford the rent for apartments within the City but they do
not want to go elsewhere. She submitted two petitions with a total
of 166 signatures in this regard. She suggested that Council look
into construction of government assisted buildings and noted other
cities which have taken this step.
George Jones, Director of Project Development for Forest City Dillon,
Inc., builders of mid and hi-rise apartments for the elderly explained
in detail methods used to provide housing with the Department of
Housing and Urban Development insuring the financing and providing
rent assistance. One plan would be to work with the Redevelopment
Agency to find locations .. Churches, Fraternal organizations and
the like could sponsor the buildings. A tenant would pay up to 25
percent of his income with HUD paying the balance of the rent. A high

percent of the applicants are usually from the same City however
anyone meeting the criteria may apply.

During the discussion Mayor Saelid observed that he personally would
not look with favor on using HUD funds and would prefer checking into
private money or the California Housing Finance Agency money. It was
the consensus of the City Council that it is in complete sympathy with
the plight of the senior citizens and can understand their desire to
live in their own neighborhoods. Council asked staff to review the
studies which have already been made on this subject, update same
and check with all other avenues and report back.
During this consideration Herb Fletcher, 175 W. Lemon Avenue, I
submitted that Council could consider financial assistance for the
elderly and referred to the new Chamber construction cost.

In response to Council Member Lauber's concern about the weeds in the
parkways on Foothill Boulevard, the Planning Director advised that
communications in this regard were directed to all the property
owners and that this falls under the City's property maintenance program.
Referred to the danger of entering the May Company street level
driveway off Michillinda Avenue where the driveway is also used by
those exiting. She noted the existence of an exit at the southern
end of the Parking Lot. Staff will investigate.
Referred to the importance of acquainting the residents with
preparation material for disasters such as earthquakes for instance.
Suggested an appropriate display at the Library and that some type of
instruction sheet be prepared for distribution through the Schools, etc.

Council concurred in the draft of a communication in resp~nse to a
complaint about traffic on Baldwin Avenue. Mayor saelfa will sign same.
At 10:35 p.m. Council entered an executive session.
Council reconvened at 11:15 p.m.
The City Attorney presented, explained the content and read the title
of Resolution No. 4676 entitled: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO
OBTAIN PROPOSALS FROM APPRAISERS, LEGAL CONSULTANTS, AND ENGINEERING
CONSULTANTS TO PREPARE DATA AND DOCUMENTATION NECESSARY TO FORM A
SPECIAL ASSESSMENT DISTRICT FOR PARKING PURPOSES IN THE BALDWIN AND
FAIRVIEW AREA AND TO THEREAFTER CONSIDER THE USE OF 653 FAIRVIEW AVENUE
FOR PARKING LOT PURPOSES."
It was MOVED by Council Member Parry, seconded by Council Member
Lauber and carried on roll call vote as follows that the reading of

the condition that she deliver to the Finance Director a complete
and general rele~se of all claims against the City of Arcadia
executed by her and her spouse, fully notarized, within ten (10)
working days after receipt of notice by claimant from the City
Attorney's office of Council's action, in form and content approved
by the City Attorney, or else the claim is denied.

In connection with the proposed parking district in the vicinity of
Baldwin and Fairview Avenues, it was MOVED by Council Member Lauber,
seconded by Council Member Gilb and carried on roll call vote as
follows that the Director of Public Works be AUTHORIZED to draw up
an agreement for the purchase of 653 Fairview Avenue at $112,000.
