CITY COUNCIL AND TIlE ARCADIA REDEVELOPMENT AGENCY
ADJOURNED REGULAR MEETING
DECEMBER 1, 1977
The City Council and the Arcadia Redevelopment Agency met in
an adjourned regular session on December 1, 1977 at 4 p.m. in
the City Hall Council Chamber.

CONTINUED - "Thi"s matter was contiD:ued from November, 23 and the
attorneys for both the claimant, Peter Wallin, and the Agency,
Eugene Jacobs, presented testimony (SEE TRANSCRIPT OF THIS ENTIRE
PROCEEDING).
For the record Mr. Jacobs asked that the Summons and Complaint
in the Unlawful Detainer and the Declaration relative to and
proof of service of the Notice to pay rent be made part of the
official record. Mr. Jacobs also submitted an Opinion as the
Special Counsel to the Agency and to the attorney for Richard
Vartanian, Peter Wallin. This was accepted by the Council and
Agency members.
In the Opinion it was stated in part that nothing whatsoever has been
found to support the Claimant's position relative to redevelopment
benefits and Mr. Vartanian has no right thereto. The Council and
Agency members felt 'the matter should be resolved at this meeting
if at all possible.. and Member Gilb submitted for consideration
that the claim for redevelopment benefits be denied and that the
City forego the $5200 back rent. This was' concurred in by the
other members.
Mr. Wallin and his client then discussed this privately and upon
their return to the Council Chamber Mr. Wallin asked for time until
Monday, December 5 to advise the City Attorney in this regard.
Discussio~ then held on just when Mr. Vartanian could move all of
his equipment from 215 'E. Huntington Dr. Council and the Agency
then went into an executive meeting to discuss the matter and
reconvened. Mr. Jacobs stated that the members would be agreeable
to a date certain and that they would take action on the two claims
at this meeting. Mr. Wallin said there is no objection.

Acting as the City Council it was MOVED by Council Member Gilb,
seconded by Council Member Parry and carried on roll call vote as
follows that the claim relating to 25 N. Fourth Avenue be and it is
hereby DENIED.

Acting as the Agency it was then MOVED by Member Gilb, seconded
by Member Parry and carried on roll call vote as follows that the
claim relating to 215 E. Huntington Drive be and it is hereby DENIED.

Mr. Wallin will submit to the City Attorney by 10 a.m. Monday,
December 5, 1977 his answer concerning whether or not his client
will vacate the premises at 215 E. Huntington Drive by February 17.
Council entered an executive session at 6:30 p.m. and reconvened
and adjourned immediately thereafter to 7 p.m. December 6 in the
Conference Room.
