HomeMy WebLinkAboutJANUARY 16,1973 CITY COUNCIL PROCEEDINGS ARE TAPE RECORDED AND ON FILE IN THE OFFICE OF THE CITY CLERK 1 'm~noo PLEDGE OF ALLEGIANCE ROLL CALL STUDENTS 'WELCOMED HEARING (RUBBISH REMOVAL) APPROVED 20:8207 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING JANUARY 16, 1973 The City Council of the City of Arcadia, California, met in regular session on Tuesday, January 16, 1973 at 7:30 p,m, in the Council Chamber of the Arcadia City Hall, Rabbi Irwin Cutler, Foothill Jewish Temple Mayor Don W, Hage PRESENT: Councilmen Arth, Butterworth, Helms, Hage ABSENT: Councilman Scott (officially excused) Mayor Hage welcomed students from various Civics classes, Council had notified the owner of property at 1112 N, Santa Anita Avenue and 1, 7 and 9 East Foothill Boulevard of the City's intention to abate rubbish and refuse which had accumulated on said property to such an extent as to constitute a public nuisance. A hearing was scheduled for December 19 at which time no one responded, Council , , expressed concern that perhaps the owner had not received notification ~'~Xr.,~~and continued the matter to this date to provide sufficient time for , staff to make this determination, The City Manager advised that the ~--(;..',AJ\., owner was willing for the City to proceed with the abatement, Mayor Hage declared the hearing open and no one desiring to be heard the hearing was CLOSED on MOTION by, Councilman Arth, seconded by Councilman Helms and carried unanimously, Councilman Butterworth then MOVED that consistent with the staff report of January 12 the lowest responsible bid be obtained for the clearing of the property at the owner's 1 HEARING (Scenic Highway Element) -+ LI go , )c,r{"f~ I < I .ft- l~~; ./1.---A"V (. ./J. 7JtfL;'/Ptf./.; expense. In response to an inquiry by Councilman Butterworth staff advised that property in a similar condition at the southeast corner of Foothill Boulevard and Michillinda Avenue will soon be cleared by the owners, Planning Commission recommendations for a Scenic Highway Element for the General Plan (Res, No, 800), Be it noted that Section 65302 of the Government Code of the State of California establishes the Scenic Highway Element as a required General Plan Element and it provides for the development, establishment, and protection of scenic highways pursuant to the provisions of the Streets and Highways Code, - The routes presently included in the system are listed in said Code however none of the routes so listed are within the jurisdiction of the City of Arcadia, Should the State designate any state highway within the jurisdiction of Arcadia as a State Scenic Highway the City should protect the scenic appearance of the scenic corridor in accordance with the responsibilities set forth in the report prepared and approved by the Planning Commission dated November 1972, -Mayor Hage declared the hearing open and no one desiring to be heard the hearing was CLOSED on MOTION by Councilman Arth, seconded by Councilman Butterworth and carried unanimously, It was further MOVED by Councilman Arth, seconded by Councilman Butterworth and carried unanimously that the recommendation of the Planning Commission be APPROVED and that the Scenic Highway Element dated November 1972 be ADOPTED as part of the General Plan, 1-16-73 - 1 - '... HEARING (Open Space Element) APPROVED WITH AMENDMENTS 10 &; 7: ZONING (Modi ficat ion requests) HEARING SCHEDULED 20:8208 Planning Commission recommendations for an Open Space and Conservation Element for the General Plan (Res, No, 801), This Element like the previously adopted Element is designed to guide future development in the City in a desirable and efficient manner and provide a basis for public decisions regarding the development of community resources, the expenditure of public funds and the allocation of land for various purposes, Basically it is a statement of public policy, The State Government Code sets forth the required General Plan Elements which are detailed in the Planning Commission report dated June 1972 with revisions submitted at a later date, The Planning Director explored in detail objectives and goals and noted the local open space land areas on an explanatory map. Mayor Hage declared the hearing open and no one desiring to be heard 1 the hearing was CLOSED on MOTION by Councilman Arth, seconded by Councilman Helms and carried unanimously, It was MOVED by Councilman Helms, seconded by Councilman Arth and carried unanimously that the recommendation of the Planning Commission dated June 1972 be APPROVED together with the amendments contained in the report dated January l6, 1973 and become a part of the General Plan, Planning Commission recommendations relating to modification appli- cations had been continued until this date as Council desired to study the changes more thoroughly and to allow time for staff to develop additional regulations which would provide for Council review of the Modification Committee actions. This was set forth in a new report dated January l6, 1973, Following discussion and determination on amendments it was MOVED by Councilman Helms, seconded by Councilman Butterworth and carried on roll call vote as follows that the City Attorney make provisions for the following additional and amended regu- lations some of which are set forth in the staff report of January 16 and in Resolution No, 795: Deletion of the requirement for "height of commercial buildings provided that the number of stories shall not be increased'.' The paragraph concerning R-3 building height to read "The R-3 building height regulations provided that such building as modified shall not exceed 35 feet in height nor more than two living levels or more than two living levels over one parking level," Reporting of Actions shall be revised as follows: "A copy of the Modification Committee's agenda noting the action taken by the Committee shall be sent to the members of the City Council and Planning Commission on the day following the Modification Committee's action and that such notation shall contain as a minimum sufficient information that the readers may form an intelligent understanding of the action taken," Provide for the appeal section to read "The City Council or Planning Commission or any member thereof, may at their own discretion and without the filing of any fee, appeal any decision of the Modification Committee not later than the next City Council meeting but in any case not less than 10 working days after the date of said decision," 1 AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Helms, Hage None Councilman Scott Council scheduled a public hearing for MARCH 6 on a proposed resi- dential subdivision development tax and land dedication ordinance, (Planning Commission Res, No, 799), 1-16-73 - 2 - TRACT NO, 24890 Tentative 'Map Approved 1--/30'1 PARADE ;/ (continued) 1 WORK ACCEPTANCE AND ADDITIONAL WORK AUTHORIZED (Library) 3.'Lf1rJ <' M , , ',." ., i' " ",'. 20:8209 Planning Commission recommended approval of the tentative map of Tract No, 24890 at 826 La Cadena Avenue for the conversion of an existing ten unit apartment to a condominium, It was noted that the applicant and the City Building Department have worked together on this matter and it appears that the existing building can meet regulations', It was MOVED by Councilman Arth, seconded by Councilman Helms and carried unanimously that the tentative map be APPROVED subject to all conditions, The request of the Arcadia Civitan Club for permission to conduct a parade for the winter olympics on March 10 was continued until February 6, Staff reported that the improvement of the west parking lot at the City Library has virtually been completed, however, seal coating is now necessary due to the condition of the pavement to cover up and patch work resulting from the project, This extra work is estimated to cost about $1,500, The City Librarian has also recommended improvements as follows: 1. Extend the concrete sidewalk that lies on the south side hedge bordering the south side of the north parking lot, improve accessibility to patrons on crutches or in wheel of the This will chairs. 2, Remove and replace two brick panels in the main entrance sidewalk, This will eliminate any'hazard due to loose bricks which could be used in vandalism, These two items would cost about $1,500 and it was MOVED by Councilman Helms, seconded by Councilman Arth and carried on roll call vote as follows that $3000 be appropriated from Unappropriated Capital Improvement Project Funds to pay the cost of all three items and that Council accept the work as completed by'Duke's Landscaping Service and authorize final payment to him in conformance with the contract, It was noted that the City will contract for the seal coating and the other work will be done by city forces, AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Helms, Hage None Councilman Scott. GRANT OF Staff reported that in 1970 the City granted an easement on city- EASEMENT owned land to permit the installation of a'County Sanitation District APPROVED ,sewer line on the west side of the Santa Anita Wash, ,This trunk line P" Iti (;i,U"IJ..-,was installed to relieve the existing county trunk line located on .~"' Live Oak that flows westerly to Second Avenue thence southerly out of ~ the city, At the time of this installation the District indicated ~, ! ," C'1 11-<' that in the future the relief line would be extended easterly along ~cthe south side of Live Oak to provide further relief to the Live Oak VI'LL f~-".A!'>I., Trunk, The District now proposes to proceed with this second phase and must obtain a second easement from the city, 1 It was MOVED by Councilman Helms, seconded by Councilman Arth and carried unanimously that the Mayor and City Clerk of the City of Arcadia be and they are hereby AUTHORIZED to execute easement docu- ments granting to the Los Angeles County Sanitation District No, 2 of Los Angeles County a perpetual easement and right-of-way for sewer purposes and the right to construct, maintain, reconstruct, use and operate sewers and appurtenances on, under, over, through and across that certain real property situated in the City of Arcadia, County of Los Angeles, State of California described in said sewer easement pursuant to specified conditions.1I 1-16-73 - 3 - / ADVERTISE FOR BIDS (Bonita Park Lighting) 0INANCIAL STATEMENT 20:8210 On recommendation of staff it was MOVED by Councilman Helms, seconded by, Councilman Butterworth and carried unanimously that the plans and specifications for sports lighting modification at Bonita Park (Job 406) be APPROVED and that the City Clerk be and she is hereby authorized to advertise for bids to be returned February 16, Funds available in the 1972-73 Capital Improvement Project Account, Council received the December financial statement, GASOLINE Staff responded to Council's inquiry about the cost of gasoline at COSTS ~ ' different delivery points in a report dated January ll, 1973, The Y' /1(<.~-{,!(,L,..; report indicated costs for deliveries to the City Garage, t he Police . ~ Department and the Fire Department, It was the City Manager's sug- Q , J.;.r"A..L- gestion that additional data be obtained, Whereupon it was MOVED by \ l~l.C Councilman Helms, seconded by Councilman Butterworth and carried unani- mously that the suggestion be followed and that the Finance Director be so directed, CONSULTAtlT RETAINED Reservoir No, 1 g )00 I-- PROCEDURAL ORDINANCE WAIVED LOWER AZUSA ROAD IMPROVE- MENT p: S1Ju~ 12 RESOLUTION . /NO, 4313 V ADOPTED ORDINANCE NO, 1471 INTRODUCED 1 , Upon recommendation and explanation by the Water Manager as to the urgency for the design and construction of drainage facilities which serve Santa Anita Reservoir No, 1 it was MOVED by Councilman Helms, seconded by Councilman Arth and carried on roll call vote as follows that Lampman and Associates be retained for the repair design work at a cost not to exceed $3000, AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Helms, Hage None Councilman Scott In order to consider the following items the provisions of the pro- cedural Ordinance were waived on MOTION by Councilman Helms, seconded by Councilman Arth and carried on roll call vote as follows: AYES: NOES: ,ABSENT: Councilmen Arth, Butterworth, Helms, Rage None Councilman Scott It was explained that the County Road Department is preparing to apply to the State for an allocation of 1974-75 Federal-Aid Secondary Urban Extension Funds to assist in financing the improvement of Lower Azusa Road, a portion of which lies within Arcadia, A resolution in this regard must be submitted to State by February 1, ,Whereupon the City Attorney presented, explained the content and read the title of Resolution No, 4313, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, JOINING THE COUNTY OF LOS ANGELES AND CITY OF ,IRWINDALE IN REQUESTING A STATE ALLOCATION OF FEDERAL-AID SECONDARY URBAN EXTENSION FUNDS FOR THE IMPROVEMENT OF LOWER AZUSA ROAD BETWEEN DURFEE AVENUE AND'SAN GABRIEL RIVER FREEWAY," 1 It was MOVED by Councilman Helms, seconded by Councilman Arth and carried on roll call vote as follows that the reading of the full body of the resolution be WAIVED and that the same be ADOPTED, AYES: NOES: . ABSENT: Councilmen Arth, Butterworth, Helms, Hage None Councilman Scott The City Attorney presented for the first time, explained the content and read the title of Ordinance No, 147l entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING, ADDING AND REPEALING 1-16-73 - 4 - 1 PROPERTY DAMAGE CLAIM , ZONING V EXECUTIVE SESSION RECONVENED and ADJOURNMENT TO DATE CERTAIN 1 20:8211 CERTAIN SECTIONS OF THE ZONING ORDINANCE RELATING TO, AUTOMOBILE SERVICE STATIONS AND CAR WASHES," It was MOVED by Councilman Helms, seconded by Councilman Butterworth and carried on roll call vote as follows that the reading of the full body of Ordinance No, 1471 be WAIVED and that the same be 'INTRODUCED, AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Helms, Hage None Councilman Scott The City Attorney advised of a claim which has been filed ar1s1ng out of an incident involving a police officer directing traffic and the insurance company requests that Council formally reject the claim, Prior to so doing Council expressed a desire for a detailed report which the City Attorney will submit to each of the Councilmen, In response to an inquiry by Councilman Arth the Planning Director said the matter concerning property on Naomi Avenue east of Baldwin Avenue will probably be before Council sometime in March, At 9 p.m., Council entered an executive session in the Conference Room.
