ADJOURNED ,REGULAR MEETING
JUNE. 27, 1973
The City Council met in an adjourned regular session en Wednesday, June
27, 1973 at, 7 ,30 'p.m: in the 'Council Chamber of the Arcadia City Hall.

On MOTION by Councilman Helms, seconded by Ceuncilman Hage and carried,
the minutes of the regular meeting ef June 5 and the adjeurned
regular meeting ef June 14 were APPROVED. Due to. his absence
Councilman Butterwerth abstained from voting. Councilman Helms then
MOVED to amend the Minutes of the adjeurned regular meeting of June 21
to reflect the adjournment of said meeting from "sine die" to
"adjournment" to 7 p.m. in the Conference Room. Motion seconded by
Councilman Hage and carried. Due to. his absence frem this meeting
Councilman Butterworth abstained frem voting en these minutes.
Planning Cemmission Resolution No. 813 granting a conditional use
permit to. censtruct Su~ay School reems at an existing church at 23 W.
Feethill Boulevard. The Planning Director exhibited prejecturals ef
the proposed additien, its surrounding zening and appearance which
indicated it weuld cerrespend to. the architecture in the subject area.
He noted that parking and circulation patterns are adequate fer the
site and fer the size ef the congregatien and that the continued use
of this property for said purpese is consistent with the General Plan
and the zening under the conditional use permit.
Mayor Arth declared the hearing epen and the Pastor ef the Church,
Paul Cheney, explained that there are 44 adult members at the present
time. The Sunday Scheel reems would be used by the children they new
have and they weuld net bus children from any ether area.
Charres Orr, member ef the Church Beard, stated in part that altheugh
the condition was.removed by the Planning Cemmission the Beard felt it
wise to include restrooms; that the Santa Anita Oaks Homeowners
Association accepted the plans on cenditions --- that 'the exterior
materials and celer be the same as the Church - which has been done.
He noted the parking arrangements for special days, such as Easter,
etc. He then exhibited films of other church structures in the City
and neted that the subject plan will blend in with the surroundings.
He said if parking becemes a problem the Church will assume the
respensibility for correcting it. In respense to a question he said
there are not plans fer a nursery schoel er a day schoel nor would
there be in the future.
No one else desiring to be heard the hearing was CLOSED en MOTION by
Councilman Butterworth, secended by Ceuncilman Helms and carried unani-
mously. It was then MOVED by Councilman Helms, seconded by Councilman

Butterworth and carried unanimously that the recemmendation of the
Planning Commission be SUSTAINED and that the cenditional use permit be
granted subject to. conditibns '~et ferth in Reselution No. 813.
Proposed constructien ef sidewalks under the 1911 Assessment District
Act fer apartment and commercial zenes. One pretest was received.
Mayor Arth declared the hearing open and no. ene desiring to be heard
the hearing was CLOSED on MOTION by Ceuncilman Hage, secended by
Councilman Scott and carried unanimously. It was further MOVED by
Councilman Hage, secended by Ceuncilman Butterworth and carried unani-
meusly that the protest be overruled and that the Director ef Public
Werks be AUTHORIZED to proceed with the preject.
Continuation of the discussion of the R-3 Plan Review Process and
additional building code requirements. Council had indicated a desire
to hear from the public relevant to. the proposed revisions. Mike
Vallone, 630 W. Huntington Drive, spoke to. the difference between
hollew deers and solid core deors. He said there isn't any advantage
to. having solid core doors in the i~terier apartment or condeminium
units - they are usually open and only used fer privacy within the
particular unit.

Planning Commission Reselution No. 814 granting a conditional use
permit to. censtruct a restaurant at 101 W. Huntington Drive. The
Planning Director explained that the property is currently deve1eped
with a metel and is zoned C-2. Property to the north is zoned R-l
and developed with single family hemes, preperty to. the south is C-2
and developed with a bar, property to the east is zened C-2 & D and
is developed with an auto. sales facility, property to the west is zoned
C-2 and develeped with an office building and a auto body shep. The
existing buildings wo~lq be demelished. Ceunci1 reviewed seme photo-
graphs of the proposal for the restaurant. It was neted in the repert
that the only driveway to serve the facility would be off Santa Clara.
There are adequate parking stalls in the plan. The resolutien sets
forth conditions to. be complied with if appreved.
Discussion held en the exit from Santa Clara onto Huntington Drive
where there is a 'no left-hand turn' sign; there ceuld be accidents
if persons are not familiar with this regulation. Discussien also.
held en the 2 a.m. closing hour due to the residential area to the
nerth of the facility.
Mike Kay, Designer ef the Restaurant, explained plans fer the restaurant
and lecatiens ef the various inside accommedatiens, dining room,
cocktail lounge, etc. Ceuncil had expressed cencern because ef the
pessibility of neise emanating from the facility and Mr. Kay explained 1
that the exterior ef the building would be two-inch redwoed with the
inside basically the same. During his presentation he stated his
company would be willing to. accept any conditions imposed by the City. ,
In its deliberations Council submitted the desire for the Police
Department to. investigate what if any preblems might be related to the
Santa Clara and Huntingten traffic situatien. Councilman Butterworth
stated in part that from all appearances and from what has been
presented the facility would be a credit to. the City and weuld be an
assist to the cemmercial area in which it is to be lecated, however,
due to its proximity to the residential area some thought should be
given to. any effect en those residents. Whereupen it was MOVED by
Councilman Butterworth, seconded by Ceuncilman Scott and carried unani-
mously that the recemmendation of the Planning Commission be SUSTAINED

subject to. all conditions imposed by the Cemmission and the Department
ef Public Werks and subject to the further conditien that Council
reserves the right at any time and from time to time to. review the
matter ef the 2 a,m. closing in the event that substantial evidence'
proves it to be a preblem to the residential area and that this matter
be directed immediately to the Police Chief (er assistant) with
instructiens that he report to Council no later than the next regular
meeting, If he dees not register a complai~the matter may be deemed
approved. The traffic situation to. be studied also..
On June 5 Council directed staff to. cenduct an infermal postcard poll
of registered voters to ascertain their attitude toward Sunday racing
at Santa Anita. Council desired this information by June 14 at which
time the matter was to. be heard in Committee on the State level and
members ef Council and the City staff were to attend this meeting. A
daily tabulatien was kept en the cards and Mayor Arth announced the
returns as of this date (June 27):

It was noted that at the June 14 Special Meeting Council had indicated
that if the trend continued the erdinance (No. 1485) relating to.
Sunday racing weuld be rescinded. However, residents were present
who. desired to speak to the matter.
Herbert Fletcher, 175 W. Lemon Avenue, expressed surprise at the
results and felt residents did net favor Sunday racing but did fear
their taxes weuld increase if the track should leave the City. He
referred to a cemmunicatien concerning that possibility frem Santa
Anita. He asked Ceuncil not to. rescind the erdinance and to autherize
a study of the total Santa Anita area as compared to. anether area to
ascertain just hew much tax each contributes so the public would
know if the racetrack ceases to. operate just what it would do to. the
tax paying public. He felt Ceuncil has a far greater control over
Sunday racing even if State passes the'legislation making it pessible....
this threugh the contrel of traffic within the City.
Jack Hardwick, 280 Arbelada, stated in part that in his opinion the
card survey is misleading, that it did not go to every veter while
seme received mere than ene card. He stated that as a member of PLAN,
residents were contacted by telephene and related that eut ef the
survey 22 voted no., 7 Yes and 9 did net receive a card. He referred
to the advertisement published by Santa Anita which he felt influenced
the vote. He also. felt the results should have not been released
before the full ceunt was in. He said AB 1324 is not eut ef Cemmittee
and'probably will not be censidered by the State Senate in this
Sessien and asked Council to. declare the results ef the card survey
inconclusive and to postpone any action at this time; and that an
examination of the cards be made by an independent agency.
Nick Pokrajac, 231 Carolweed, stated in part that the survey in his
opinion is in,conclusive and noted that at the time the cards were
received residents also received the letter frem Santa Anita and that the
opposition had net had the oppertunity to express their views,
Mayer Arth observed that Ceuncil was as amazed as anyone at the results
and Councilman Butterwerth stated in part that there seems to be no
question that Santa Anita had instantaneous knewledge of Ceuncil's
decision to. take the informal pell; and that due to the time element
a legal referendum could not have been undertaken. So Council did
what it thought was a practical solutien and that was to get out a
pestcard vote, informal but nenetheless it seemed to have some va-
lidity,

M. Eberly, member of the Board ef the Santa Anita Church, opposed the
prospect of Sunday racing primarily due to. the parking problem it
would generate at the Church parking let. He also stated in part that
a litter situation is also. attached to the track visitors; that
although the track does send men over the next day to. clean up it still
is not a geed sight. He felt Sundays are for churches, parks,
Arboretum and the like.
Mrs. Margaret Stevens, Paster ef the Santa Anita Church, confirmed what
was said by Mr. Eberly, and also submitted that the track creates a
hazard for the scheol children attending Church School each day; that
track visitors pay no. attention to barricades. The congregation has
been polled and a unanimeus decision was made in eppositien. She felt 1
the Sunday racing would destroy cemmunity life. She also felt the
results of the card survey were incenclusive and spoke again ef the
parking preblems encountered thus far.
Ed Passmore, 1109 Columbia Road, told of rece~v~ng the cards which
they did net send in because Ceuncil had already been in an emergency
session and had erdered a redraft ef the erdinance. He felt the results
of the survey were invalid, He referred to. the letter and publicatien
ef Santa Anita. He felt without a fact sheet the survey could net be
considered valid. He submitted figures fer believing the acreage of
Santa Anita would generate mere taxes to. the City if it were develeped
into residential use... And with the admissien tax received by the
City geing right back into police and fire for traffic contrel during
racing seasons - all that means is a tremendous increase in noise,
smog and congestion pollution by the thousands of cars en Sundays. He
felt the City is supporting the track, net the other way areund.
Ceuncilman Butterworth stated in part that with, for instance, a vete
of 80% against Sunday racing the Council weuld still be faced with
what appears to him to be an insurmountable legal problem - that
there seems to be almest no possibility of stepping this State legis-
lation to permit Sunday racing which is net far from passage.
Ceuncilman Helms felt some of the facts breught eut by Mr. Passmere
were relevant; things that he had breught up abeut 4 years ago --- as
far as the inequality in the assessment ef the Santa Anita property..
that nothing in the meantime has changed his epinien and felt that if
Santa Anita would leave the City residents would net net ice it on
their tax bills for years to come.
David Powell, President Elect ef the Santa Anita Village Association,
lodged eppesitien en behalf ef the asseciatien. He felt the decisien
sheuld have been up to. the preperty owners surreunding the race track..
those who. would be most affected by Sunday racing. He did not think
the vete is binding upon Ceuncil.
Den Ehr, representing PLAN, INC. stated in part that Council has the
prime responsibility to. pretect the health, safety and welfare of the
citizens of the cemmunity and it weuld be a violatien of pledges if 1
all the available facters are net weighed. He felt Councilmen should
be activists in representing the residents and sheuld net hesitate to
retain the ban on Sunday racing. He felt that Council in its rush to
take a pell ef the residents failed to consider problems resulting
from an uncentrolled mailing. He felt the results should net be
censidered in any decisien making in view ef mailing discrepancies
and the advertising in favor ef the questien by Santa Anita.... that
if Council desires a vote decisien it should be an electien with
preper contrels.
In respense to. a questien by Councilman Helms, Mr. Ehr stated in part
that if the City decided it would be best that Hinshaw's not open on
Sundays it would not be epened, He noted the problems which seme of
the dhurches, Holy Angels for instance, would experience. He felt
Council sheuld- fight pre-emption by the State and submitted that the
two local Legislators in Sacramento. are advecates ef local control.

Mrs. Hudsen Reysher, 1784 S. Santa Anita, oppesed Sunday racing and
stated in part that other businesses do net generate the traffic that
Santa Anita does. She felt that only one side was presented at the
time the pestcard survey was taken due to the publicity mailed out by
Santa Anita; that both sides of the issue should be submitted and then
a more objective decision couldbe made.
Mr. Fletcher speke once mere asking if the complexien ef Sa~ta Anita
could be changed under the Cemmunity Redevelopment Program.
Ceuncilman Hage stated in part that it is easy to look back and see
what sheuld have been done. The Council voted 5 to 0 to. appropriate
the meney to fight the Sunday Racing Bill. Something had to. be done
immediately. He noted this was because the California Horse Racing
Board was meeting within a matter ef days and Councilman Scott and the
City Manager went to Sacramento to try to influence the Committee to
secure a delay if nothing else.. Council's dilemma right now is what
to. de about it. As far as he was persenally concerned he was still
eppesed to Sunday racing, but a pell has ceme in that has indicated
some attitude. ... a majority of the card filers were in favor re-
gardless ef hew they arrived at that decision... He concluded by
stating in part that he ceuld not see hew he could vete to spend mere
money on lobbying as was suggested.
Marcella Whitmore, 512 Santa Maria Read, asked Council to. delay the
decision until the State Legislature acts,.. it'is unknewn at this
time as to how it will vete en the matter. She noted the oppositien
lodged at this meeting.

Ceuncilman Butterworth agreed in part with Councilman Hage except he
felt there are mitigating circumstances - the enormous amount of
prepaganda for instance which was not anticipated. And with the
indicatien that net all ef the residents received cards.. he felt the
matter sheuld be tabled for a given period of time until some con-
clusiens have been reached. That weuld not be breaking faith with
anyone to take time to consider,
Councilman Scott stated in part that if the card poll had been as
cenclusive as Ceuncil had expected it would have been used in Sacramento
when testifying befere the Cemmittee, but they did net ceme in the way
it was expected and he recalled,at ,the meeting it was decided to have
the poll, and it was agreed that Council weuld be beund by the poll -
that is Council weuld have received a direction. Then at the June 14
meeting it was indicated that if there were no. change Council would be
governed by the returns. He could not see how the elected representa-
tives ef the City ceuld in good censcience de anything but sustain the
results of the poll irrespective of the inadequacies... Council did the
best it could and in his opinion there b no other alternative but to
take actien tenight.
Mayer Arth stated in part that the action taken en June 14 was with
the preliminary results, which were a surprise. He expressed concern
with the results which he felt were influenced by the letter which
went out frem Santa Anita. He said further that regardless what he
dees as a Councilman he would still oppose this in every way he ceuld
and supported continuing the matter to a later date.
Councilman Scett stated in part that he felt Council has the will of
the people at this time and that altheugh it may net agree with those
attending this meeting, and although he too feels keenly about Sunday
racing, that the action taken en June 14 that Council would be
persuaded by the results of the pell as of this date (June 27) he
ceuld see no other course for Council than to adopt the rescinding
ordinance.
Councilman Helms suggested Council give thought to placing this matter

en the ballot for November 6 at which time a tax initiative measure will
be before the electorate. At this time both sides of the issue could
be presented to. the peeple. Mayor Arth concurred that this is worthy
of consideratien.
Ceuncilman Helms then MOVED to. table any further consideratien ef a
repeal of the existing erdinance until the meeting of August 7,
Councilman Butterworth secended the motion. Councilman Scett questioned
the need for this length of time. Ceuncilman Butterworth commented
that he persena11y wanted time to. censider the arguments which have
been made. During the interim the cards will continue to. be tabulated.
Rell call was then taken en the motien to continue the matter until
August 7.

Planning Commission recemmendation concerning a propesed subdivisien
at 255-277 Oakhurst Lane for a seven let tract subject to conditions.
A request had been received for a public hearing. Whereupon it was
MOVED by Councilman Hage, secended by Councilman Butterwerth and
~ \ iW!>carried unanimously that a public hearing be scheduled for JULY 17
and that the apprepriate netices be mailed. The ewner of the property
submitted an urgency in the matter.
Planning Commission recemmendation fer approval ef the final map of
Tract No.. 30057 (12 unit condominium at 1025-31 Holly Avenue).
Council was advised that all cenditions have been complied with.
Whereupon it was MOVED by Councilman Scott, seconded by Councilman
Hage and carried unanimously that the final map be APPROVED.

Lois Andersen was advised to check with the City Engineer concerning
sidewalk censtructien.
Ceuncil received a cemmunication frem the Arcadia Cemmunity Theatre
Greup explaining its present financial situatien. The follewing
persens told of the efferts and accemplishments ef the group and asked
Ceuncil to consider some manner ef financial assistance, referring
specifically to the waiving of a fee which is now paid to. the City
Library for the use of the Art and Lecture Reem for its perfermances.

OF THE CITY OF ARCADIA ESTABLISHING COMPENSATION FOR VARIOUS POSITIONS
IN THE CITY EMPLOY FOR THE FISCAL YEAR 1973-74."

Staff reported that the Department ef Public Werks received a
memerandum frem the State Department of Rehabilitation clarifying
requirements fer construction ramps for the physically handicapped,
The ramps must be censtructed as part of the current Sidewalk Preject
(Phase VII) Hewever as a result ef the deletien ef Sixth Avenue and
subsequent deletion ef sidewalks on Lengley Way no additional
appropriation is necessary.

Council received staff report dated June 22 concerning modernizing
existing signal at Huntington Drive and Santa Anita, Huntington Drive
and First Avenue, Baldwin Avenue and Duarte Road and Feothill Boulevard
and Second Avenue. The intersectiens as well as the propesed im-
prevements have met all requirements for financing under the Federal
TOPICS Program at an estimated cost of $44,000. It was noted that
prier to approving the plans and specifications the Federal Highway
Administratien Reviewing Officials approved a Negative Declaration as

The City Attorney presented fer the second time, explained the centent
and read the title of Ordinance No. 1481, ent it led: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA RECLASSIFYING PROPERTY AT
610-670 NAOMI AVENUE FROM R-l AND R-2 TO R-3."
