HomeMy WebLinkAboutAPRIL 25,1974 CITY COUNCIL PROCEEDINGS ARE TAPE RECORDED AND ON FILE IN THE OFFICE OF THE CITY CLERK 1 RO", '^" HEARING Fireworks Approved f-- / 17 20:8532 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA ADJOURNED REGULAR MEETING APRIL 25, 1974 The City Council of the City of Arcadia, California, met in an adjourned regular session on Thursday, April 25, 1974 at 3 p.m. in the Council Chamber. PRESENT: Councilmen Gilb, Lauber, Saelid, Scott Councilman Helms arrived at 3:10 p.m. ABSENT: None Applicatlon of the American Legion Arcadia Post No. 247 for a Council Permit to conduct its annual fireworks sale on July 1, 2, 3 and 4, including the fireworks display at the County Park on July 4. Mayor Scott declared the hearing open and Mrs. Johanna Hofer, 875 Monte Verde Drive, expressed concern as to the danger of fires and injury to children because of the use of fireworks. She also questioned the age at which a child may purchase fireworks and felt these questions should be answered prior to Council making its determination. The City Attorney advised that pursuant to the Fire Code no one under 14 may set off fireworks without an adult to supervise and noted that the State and City has amended the Code to permit only safe fireworks to be sold and used within the City. He noted the existing ordinance which permits fireworks to be sold under specific circumstances and that subject applicant is permitted so to do; that if Council desires to ban fireworks the code would have to be thus amended. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Gilb, seconded by Councilwoman Lauber and carried unnani- mously. It was further MOVED by Councilman Gilb, seconded by Councilman Saelid and carried unanimously that the application be APPROVED. HEARING Application of the West Arcadia Business and Professional Association WAB&PA for a Council Permit to hold its 20th annual Mid-Valley Arts Festival Art Festival May 8 through 11. The locations will be on the east and west sides Approved of Baldwin between Duarte and Naomi. Specific parking conditions 1 were requested. Mayor Scott declared the hearing open and Mrs. Johanna ~ I Hofer, 875 Monte Verde Drive, spoke in favor of the event. . No one else ("\ ' desiring to be heard the hearing was CLOSED on MOTION by Councilwoman 1 Lauber, seconded by Councilman Saelid and carried unanimously. It was t? The Association will employ guards for protection. AGENDA ITEM Audience Part icipat ion Discussion was held on the appropriate place on the agenda for the item "Time reserved for those in the audience to address Council". The Council presented their individual viewpoints relating thereto and as this item had been previously scheduled for May 7 it will be before this body at that time. 4':25:-74 - 1 - LITIGATION ;(); tVl). /' f ,;' '0- '-- 0.',J 1\ 1\ \, ' EXECUTIVE SESSION RECONVENE AND ADJOURNMENT 20:8533 The City Attorney introduced Charles Ivie, special counsel retained by the City for the Arcadia Police Relief Association vs City of Arcadia litigation. Mr. Ivie explained the settlement of the suit and sub- mitted copies of the stipulation stating it complied with authority for negotiation given to him by the previous City Council. It was noted that the settlement was for $160,000 to be paid by the City to the Arcadia Police Relief Association for the benefit of the police personnel, $40,000 of which was to be paid in the fiscal year 1973-74 and the balance of $120,000 to be paid in 1974, In response to discussion the City Manager advised that the $40,000 had been budgeted for this fiscal year and that the balance would be budgeted for payment in 1974. It was MOVED by Councilman Helms, seconded by Councilman Gilb and carried on roll call vote as follows that the stipulation as submitted be APPROVED and Counsel authorized to execute it on behalf of the City. AYES: NOES: ABSENT: Councilmen Gilb, Helms, Lauber, Saelid, Scott None None The City Manager advised of the forthcoming Open House at the HOY headquarters and the Council Institute; also the scheduled tour of city facilities. Council entered an executive session at 3:55 p.m~ At 5:45 p.m. Council reconvened and adjourned immediately thereafter to 7 p.m. May 7 in [he Conference Room.
